Abstract

Abstrak Tujuan penulisan ini mengkaji implementasi asas terjangkau dalam proses pendaftaran tanah di Kabupaten Sukoharjo guna mempercepat pensertifikatan tanah. Penelitian hukum ini menggunakan metode normatif yang bersifat perspektif dengan pendekatan perundang-undangan. Bahan hukum yang digunakan yaitu bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data yang dilakukan dengan cara studi pustaka. Penulisan hukum ini menggunakan penalaran deduksi. Berdasarkan hasil penelitian dihasilkan simpulan implementasi dari asas terjangkau dalam proses pendaftaran tanah yang terjadi di Pemerintahan Kabupaten Sukoharjo belum memenuhi asas terjangkau. Hal ini dikarenakan tingginya nilai NJOP yang lolos dalam tahap validasi, honorarium PPAT yang diatas satu persen dari harga transaksi dan adanya biaya lain-lain. Hal ini mengakibatkan sulitnya terwujud asas terjangkau pendaftaran tanah.Kata kunci : Pendaftaran Tanah, Kabupaten Sukoharjo, Asas Terjangkau

Abstract

AbstractThis paper aimed to study theasset recovery effort from corruption cases conducted by Sukoharjo State Prosecutor Office with public policy law study and law effectiveness study.Regarding itstype, this paper was a problem solution research, as it seeks to find solutions that relate to the problems being studied, so that the type of paper is sociological with non-doctrinal / empirical approach. In this study using primary data sources, and secondary and tertiary as supporting data. Data collection techniques, researchers use interview techniques and library research (library research). Data analysis is by model of flow analysis (interactive model of analysis) andinteractive analysis (interactive model of analysis).The results of paper and discussion although in returning the asset recovery from corruption cases in practice there are several inhibiting factors related to the legal effectiveness resulting in the return of the stolen state asset become not maximized, but the State Prosecutor Sukoharjo already implemented several policies related to the stolen state asset.Keywords: Prosecutor Office; Asset Recovery; Corruption.AbstrakArtikel ini mengkaji upaya pengembalian kerugian negara dari perkara tindak pidana korupsi  yang dilakukan oleh Kejaksaan Negeri Sukoharjo dengan kajian hukum kebijakan publik dan  studi keefektivitasan hukum.Berdasarkan jenisnya artikel ini merupakanproblem solution, karena berusaha untuk menemukan solusi yang berhubungan dengan permasalahan yang diteli, sehingga jenis artikel ini adalah artikel sosiologis dengan metode pendekatan non-doktrinal/empiris.Dalam artikel ini menggunakan sumber data primer, dan sekunder serta tersier sebagai data pendukungnya. Teknik pengumpulan data, menggunakan teknik wawancara dan studi kepustakaan (library research). Analisis data yaitu dengan model analisis mengalir (interactive model of analysis) maupun analisis interaktif (interactive model of analysis).Berdasarkan hasil artikel dan pembahasan meskipun dalam mengembalikan kerugian negara dari perkara tindak pidana korupsi dalam praktiknya terdapat beberapa faktor penghambat terkait dengan keefektivitasan hukum sehingga menyebabkan pengembalian kerugian negara tersebut menjadi tidak maksimal namun, Kejaksaan Negeri Sukoharjo sudah menerapkan beberapa kebijakan terkait pegembaliankerugian Negara.Kata Kunci: Kejaksaan; Pengembalian Kerugian Negara; Korupsi.

Abstract

The purpose of this research is to explain and examine the expansion of the absolute competence of the Administrative Court (hereinafter referred to as PTUN) after the Government Administration Law is promulgated and the implications of the application of the Administrative Law on legal certainty to eradicate and enforce corruption in Indonesia. This research uses a normative juridical research method and uses a statutory approach (statute approach). The results showed "that there are several forms of expansion of PTUN competencies, such as the authority that acts factually, the authority, administrative authorization, decide on positive fictitious decisions, and discretionary trials". Meanwhile, the implications of the Government Administration Law on corruption are known as corruption crimes, which are true. So, in this context, there are at least two problems, namely: “1. If the authorized court case is carried out by the state government which is submitted to the court simultaneously, to the State Administrative Court and to the District Court in a corruption case? 2. If at any time a PTUN decision has been issued stating that it is not authorized, but there is also a party who submits the case to the District Court on charges of corruption. What is the attitude of the District Court, whether to accept the PTUN decision on the case or choose to override the PTUN decision”. So the author is of the view that in this case there is concern that it will complicate the prosecution or eradication of criminal acts of corruption in the case of abuse of authority committed by government officials.

Abstract

This research is a formulation model of profit sharing principle in land lease agreement in the framework of giving Building Rights Titles / Right to Use Titles which aims to resolve land conflicts as a result of the imbalance of agrarian structure in Indonesia and to balance the rights and obligations in land lease the provision of Building Right Titles (HGB), as well as formulating the principle of profit sharing principle in the land lease agreement in the framework of awarding Building Right Titles (HGB) / Right to Use Titles above Freehold Titles. This research used qualitative research method with symbolic interaction as research strategy, that is, reconstruct adjustment of action from three subject of legal relation that is holder of HGB / Freehold Titles, holder of Freehold Titles (HM) and National Land Agency.The conclusion of this research suggests that the HM holder agreement with the HGB winner as a tenant is required to interfere with government policy, which is to harmonize and protect the interests of holders of Freehold Titles and tenants in the form of profit sharing principles in the provision of HGB / Right to Use Titles on Freehold Titles. begins with a land lease agreement, with the profit sharing principle having to consider the dominant factors affecting the amount of land rent that is just and sustainable, such as the location of the land, the selling value of the tax object, the market price of the land, the operational cost, and the existing building.

Abstract

AbstractThis article examines the model of Local Regulation related to investment-friendly and environmentally-friendly licensing in Surakarta City. This study includes the type of normative legal research using conceptual approach and statue approach. The authors used the primary legal material and secondary legal material obtained by the collection technique were analyzed using the deduction method. The conclusion of this research is that there are some Regional Regulations in Surakarta that impede investment and not environmentally friendly, namely: Local Regulation No. 9 of 2003 on Industrial Business License, Trading Business License and Warehouse Registration Letters (not investment friendly and not environmentally sound) And Regional Regulation No. 5 of 2012 on the Implementation of Advertising. Therefore, the authors offer the construction of an investment-friendly and environmentally-friendly Regional model with the following four indicators: openness for access and testing, local regulations related to regional development planning priorities, able to encourage economic activity, using integrative approach and have long-term perspective. Keywords: Local Regulation, Licensing, Investment, Environment AbstrakArtikel ini mengkaji tentang model Peraturan Daerah terkait perizinan yang ramah investasi dan berwawasan lingkungan di Kota Surakarta. Penelitian ini termasuk jenis penelitian hukum normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Penulis menggunakan bahan hukum primer dan bahan hukum sekunder yang diperoleh dengan teknik pengumpulan dianalisis menggunakan metode deduksi. Kesimpulan yang diperoleh dari penelitian ini bahwa dari ada beberapa Peraturan Daerah di Surakarta yang menghambat investasi dan tidak berwawasan lingkungan, yaitu: Peraturan Daerah Nomor 9 Tahun 2003 tentang Izin Usaha Industri, Izin Usaha Perdagangan dan Tanda Daftar Gudang (tidak ramah investasi dan tidak berwawasan lingkungan) dan Peraturan Daerah Nomor 5 Tahun 2012 tentang Penyelenggaraan Reklame. Oleh karena itu, penulis menawarkan konstruksi model Peraturan Daerah yang ramah investasi dan berwawasan lingkungan dengan 4 indikator sebagai berikut: keterbukaan untuk akses dan pengujian, Peraturan Daerah terkait dengan prioritas perencanaan pembangunan daerah, mampu mendorong aktifitas ekonomi, menggunakan pendekatan integratif dan memiliki perspektif jangka panjang.Kata kunci: Peraturan Daerah, Perizinan, Investasi, Lingkungan

Abstract

AbstractThis study examines the legal politics of immigration facilities for foreign workers with Indonesian labor law. The Politics of Immigration Law should be based on a Selective Policy that benefits the Indonesian economy. There is still a conflict of norm between immigration regulations and labor regulations. This research is a prescriptive legal research with the approach of law and conceptual approach. Technique of collecting legal material of literature study and technique of analysis of law material of deduction method. This study concludes that there is disharmonization between the rules of immigration law and the labor law regulation concerning the use of foreign workers in Indonesia where, which is more inclined to provide convenience for foreign workers. This study recommends that the government make changes to the regulations on the use of foreign workers so as to create harmonization between the rules of immigration law and labor law.Keywords: legal Politic,  immigration,  foreign worker and manpower AbstrakPenelitian ini mengkaji politik hukum fasilitas keimigrasian bagi tenaga kerja asing dengan hukum ketenagakerjaan Indonesia. Politik Hukum Keimigrasian harus berdasarkan kebijakan selektif (Selective Policy) yang memberikan manfaat bagi perekonomian Indonesia. Masih adanya conflict of norm antara peraturan keimigrasian dengan peraturan ketenagakerjaan.  Penelitian ini merupakan penelitian hukum yang bersifat preskiptif dengan pendekatan undang-undang dan pendekatan konseptual. Teknik pengumpulan bahan hukum studi pustaka dan teknik analisis bahan hukum metode deduksi. Penelitian ini menyimpulkan, adanya disharmonisasi antara peraturan hukum keimigrasian dengan peraturan hukum ketenagakerjaan mengenai penggunaan tenaga kerja asing di Indonesia dimana, yang lebih condong memberikan kemudahan bagi tenaga kerja asing. Penelitian ini  merekomendasikan agar pemerintah melakukan perubahan peraturan tentang penggunaan tenaga kerja asing sehingga tercipta harmonisasi antara peraturan hukum keimigrasian dengan hukum ketenagakerjaan.Kata Kunci : Politik Hukum,  Keimigrasian, tenaga kerja asing dan ketenagakerjaan.

Abstract

AbstractThe purpose of this article is to describe the Application of Laws According to Government Regulation Number Year 2010 concerning the Use of Forest Areas in Riau Province under the management of related technical agencies namely the Riau Provincial Environment and Forestry Agency in the context of the use of efficient forest areas, in particular associated with: The Use of Forest Areas, and the Constraints Factor in the Application of Laws concerning the Use of Forest Areas that occurred at the Riau Plantation Office on unhealthy plantation companies. This study uses a prescriptive normative approach, finding the law in concreto on the Law on Plantation Law in Riau Province. The type of data used is secondary data. Secondary data sources used include primary data, secondary data, and Non-Legal data. Data collection technique used is literature study. Some data then asked for explanation and confirmation from Plantation Office of Riau Province. Data analysis techniques used with the method of syllogism and interpretation by using deductive thinking patterns. Based on the results of research and discussion, the following conclusions are derived: First, the application of the law concerning the use of forest areas in Riau Province has not been in accordance with the provisions contained in Law No. 41 Year 1999, Government Regulation No. 24 of 2010. Second, Factor Constraints in Implementation of Laws According to Government Regulation No. 24 of 2010 on the Use of Forest Areas in Riau Province.among others, law enforcers, infrastructure facilities, communities that are not in accordance with the provisions contained in Law no. 41 of 1999 and Government Regulation No. 24 of 2010.Keywords:Application of Laws, Use of Forest Areas,Obstacle FactorAbstrakTujuan artikel ini adalah untuk mendeskripsikan Penerapan Hukum Menurut Peraturan Pemerintah Nomor Tahun 2010 tentang Penggunaan Kawasan Hutan di Provinsi Riau yang berada dibawah pengelolaan dinas teknis terkait yaitu Dinas Lingkungan Hidup dan Kehutanan Provinsi Riau dalam rangka penggunaan Kawasan hutan yang berdaya guna, khususnya dikaitkan dengan: Peraturan Penggunaan Kawasan Hutan, dan Faktor Kendala Dalam Penerapan Hukum Tentang Penggunaan Kawasan Hutan yang terjadi di Dinas Perkebunan Provinsi Riau terhadap perusahaan perkebunan yang tidak sehat.Penelitian ini menggunakan pendekatan normatif bersifat preskriptif, menemukan hukum in concreto mengenai Peraturan Perundang-undangan Perkebunan di Provinsi Riau.Jenis data yang digunakan yaitu data sekunder.Sumber data sekunder yang digunakan mencakup data primer, data sekunder, dan data Non Hukum.Teknik pengumpulan data yang digunakan yaitu studi kepustakaan.Beberapa data kemudian dimintakan penjelasan dan konfirmasi dari Dinas Perkebunan Provinsi Riau.Teknik analisis data yang digunakan dengan metode silogisme dan interpretasi dengan menggunakan pola berpikir deduktif.Berdasarkan hasil penelitian dan pembahasan dihasilkan simpulan sebagai berikut: Kesatu,Penerapan Hukum Tentang Penggunaan Kawasan Hutan di Provinsi Riau Belumlah sesuai dengan ketentuan yang terdapat dalam UU No. 41 Tahun 1999, Peraturan Pemerintah Nomor 24 Tahun 2010. Abstract

AbstractThis study talk about analysis law political recommendations ombudsman that is not legally binding. Where in in law on Indonesian Ombudsman, this institution given the authority to made a mediation, reconciliation, and adjudication in decide maladministration. In terms of dispute resolution public service through adjudication ombudsman, ruling issued only to recommendations. The problem is how the power of these recommendations, for ombudsman is not institutions a court or forum court like the arbitration. The research is research law that is prescriptive with the approach the act and approach conceptual. Technique collection material law through the literature study and techniques analysis material law by using the method deduction. The results of this writing concluded to a weakness and lack of harmony between rules.Keywords: Legal politic; non-legally binding; recommendation of Indonesia Ombudsma; public service.AbstrakTulisan ini membahas tentang analisis politik hukum rekomendasi Ombudsman Republik Indonesia yang bersifat tidak mengikat secara hukum (Non-Legally Binding). Di mana di dalam UU No. 37 Tahun 2008 tentang Ombudsman Republik Indonesia, institusi ini diberikan wewenang untuk melakukan mediasi, rekonsiliasi, dan ajudikasi dalam menyelesaikan perkara maladministrasi. Dalam hal penyelesaian sengketa pelayanan publik melalui ajudikasi Ombudsman, putusan yang dikeluarkan hanyalah sebatas rekomendasi. Persoalannya adalah bagaimanakah kekuatan rekomendasi ini, sebab Ombudsman bukanlah lembaga pengadilan atau forum pengadilan seperti halnya arbitrase.  Penelitian ini merupakan penelitian hukum yang bersifat preskriptif dengan pendekatan undang-undang dan pendekatan konseptual. Teknik pengumpulan bahan hukum melalui studi pustaka dan teknik analisis bahan hukum dengan menggunakan metode deduksi. Hasil tulisan ini menyimpulkan adanya kelemahan dan ketidakharmonisan antara peraturan perundang-undangan antara, UU Pelayanan Publik, UU Ombudsman Republik Indonesia, dan  Peraturan Ombudsman Republik Indonesia.Kata Kunci: politik hukum;non-legally binding;rekomendasi Ombudsman Republik Indonesia;pelayanan publik.

Abstract

AbstractThis article aimed at to see if the regional regulation of a Surakarta city number 3 year 2010 about waste management was adequate in realizing the concept of zero waste in Surakarta city. The thesis is a kind of an normative perspective analysis which describes the data found and presented by the writer during this study of the issue using the statue approach and conceptual statue. It uses the technique of writing by collecting law-based-data based on bibliographical studies and some interviews.The result of the research showed that there has been dysfunction of rwgulation of regional regulation of a Surakarta city number 3 year 2010 about waste managementbecause there has been no mayor rules about waste management. A ideal model of waste management in realizing the concept of zero waste now is sanitary landfill. Landfilling is the last option which is a choice that are no better off or even worse than incineration of. Penelitian ini merupakan penelitian normatif yang bersifat perspektif dengan pendekatan perundang-undangan dan pendekatan konseptual.Teknik pengumpulan bahan hukum dilakukan dengan dengan studi kepustakaan dan wawancara untuk mengumpulakn bahan hukum dengan jalan membaca peraturan perundang-undangan, dokumen-dokumen resmi maupun literature yang berhubungan dengan masalah yang diteliti.Hasil yang diperoleh dari penelitian ini menujukkan bahwa telah terjadi disfungsi pengaturan pada Peraturan Daerah Kota Surakarta Nomor 3 Tahun 2010 tentang Pengelolaan Sampah karena belum ada Peraturan Walikota tentang pengelolaan sampah sebagai petunjuk pelaksana . pengelolaan sampah dalam mewujudkan konsep zero waste di Kota Surakarta saat ini adalah SanitaryLandfill. Landfilling adalah pilihan terakhir yang merupakan pilihan yang tidak lebih baik atau bahkan lebih buruk dibandingkan insinerasi. Pemerintah pusat menunjuk Kota Surakarta sebagai salah satu pilot project dalam pengelolaan sampah menjadi sumber energi listrik.Kata kunci :Pengaturan; sampah; konsepzero waste
