Abstract

Technological advancements have significantly facilitated electronic transactions, making business interactions faster and more convenient. However, these developments also introduce risks, especially for consumers, as electronic transactions can lead to significant financial losses if not handled carefully. This study proposes effective legal protections for consumers to prevent such losses and ensure proper compensation in electronic business transactions. This research employs a normative legal methodology, utilizing both a statutory and conceptual approach. The statutory approach analyses laws and regulations governing electronic transactions, while the conceptual approach applies Richard Posner's Economic Analysis of Law theory to assess the efficiency of consumer protection mechanisms. Data was gathered through a literature review of primary and secondary legal sources, and conclusions were drawn using deductive reasoning. The Economic Analysis of Law theory was the major premise, with relevant laws and regulations forming the minor premise. The findings reveal two main conclusions. First, while existing laws such as the Consumer Protection Law, the ITE Law, PP PMSE, PP PSTE, and Regulation of the Minister of Trade Number 31 of 2023 provide basic consumer protection by sanctioning businesses that offer mismatched products, reclaiming consumer rights is not straightforward. Second, to mitigate potential losses in electronic transactions, a validation process for business actors is necessary before they offer products, and Electronic System Trading Providers (PPMSE) must establish an efficient mechanism for compensating consumer losses. This study highlights the need for a more robust and accessible framework to protect consumers in electronic business transactions, ensuring that legal recourse is both efficient and effective.

Abstract

This study critically examines the existing legal framework for personal data protection within Indonesia’s population administration system. Through a normative legal research approach, it identifies significant regulatory gaps that leave personal information vulnerable to misuse and breaches. The results show that the current legal policies remain insufficient, as numerous aspects of personal data protection have yet to be explicitly regulated in the Population Administration Law. Despite the enactment of a national personal data protection law, its effectiveness is undermined by the lack of comprehensive integration into the Population Administration Law. This research proposes reconstructing the legal framework to address essential aspects of data management—such as collection, utilization, safeguarding, exchange, and misuse prevention—while establishing clear access rights, prohibitions on unauthorized activities, and a structured system of proportional sanctions. By incorporating specialized legal provisions and aligning with international best practices, these reforms would strengthen Indonesia’s data protection framework, enhance public trust, and reinforce the government’s role in safeguarding citizens’ personal information.

Abstract

Pengaturan pengelolaan air minum adalah kebijakan yang ditetapkan untuk memastikan ketersediaan, kualitas, dan distribusi air minum yang aman dan layak bagi masyarakat, serta melibatkan perlindungan sumber daya alam untuk keberlanjutan sumber daya air. Namun, dalam pengelolaan air minum terdapat permasalahan mengenai aspek keberlanjutan. Hal tersebut dikarenakan pengaturan pengelolaan air minum belum sepenuhnya mengatur secara rinci pengelolaan air minum yang berbasis keberlanjutan. Penelitian ini ditujukan untuk mengetahui apakah pengaturan pengelolaan air minum di Kabupaten Karanganyar telah mencantumkan teori ecological justice. Untuk mencapai tujuan tersebut, analisa dilakukan dengan metode penelitian hukum normatif menggunakan pendekatan peraturan perundang-undangandan dan pendekatan konseptual yang bersumber dari bahan hukum primer dan bahan hukum sekunder. Diperoleh hasil penelitian bahwasanya Kabupaten Karanganyar belum sepenuhnya mencantumkan ecological justice dalam peraturan tentang pengelolaan air minum.

Abstract

The research aims to determine the government's role in interfaith marriage rights protection in Indonesia and Malaysia. This research belongs to normative research that examines the role of government in the religious difference in marriage in Indonesia and Malaysia. This research employed a case approach, namely the study of the role of government in interfaith marriage rights protection. The techniques of collecting law items were conducted using literature research, while the analysis techniques were performed using deductive syllogism and interpretative methods. The results indicated that interfaith marriages are not technically recognized in Indonesia since the marriage connection is regarded to be a contract between two persons of the same religion.  While this is going on, interesting cases frequently take place near the Malaysian and Indonesian borders, particularly in the Sambas region. The Indonesian government's role in intermarriage rights protection is manifested in the Indonesian judiciary. The courts have sanctioned multiple interfaith marriages. Religious conflicts that occur in Malaysia cannot be avoided. It may become a ticking time bomb or a flesh-piercing thorn

Abstract

"Land Information Letter" once played an important role in land registration, but their issuance often caused problems such as overlapping and lack of understanding by village heads regarding the legal basis for their issuance. The government continues to strive to improve the land registration system, one of which is by revising Government Regulation Number 24 of 1997 to Government Regulation Number 18 of 2021.This research is a Doctrinal/normative research that adopts a statutory approach to analyze Land Information Letter. The data used are secondary data in the form of primary legal materials, secondary legal materials, and non-legal materials. Based on an in-depth analysis of the position of the “Land Information Letter” as proof of land ownership in the context of land registration in Indonesia, it can be concluded that the “Land Information Letter” does not provide a strong guarantee of legal certainty regarding land ownership. Government Regulation Number 18 of 2021, which changes the function of the “Land Certificate” to merely instructions in the land registration process, is expected to encourage the public to immediately take care of land registration and obtain stronger land title certificates. However, the implementation of this regulation needs to be carried out carefully and pay attention to the rights of vulnerable communities, as well as ensuring that they get sufficient understanding and information regarding changes in land registration regulations.

Abstract

Penelitian ini menjelaskan mengenai permasalahan dalam pelaksanaan pengadaan tanah jalur kereta api Bandara Soekarno-Hatta yang berkeadilan berdasarkan prinsip keadilan kompensatoris dan keadilan distributif, dimana termasuk ke dalam penelitian hukum normatif dengan bersifat perspektif. Untuk itu digunakan cara pendekatan pada undang-undang dan kasus serta menggunakan data sekunder yaitu bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini mewujudkan bahwa pengaturan pengadaan tanah jalur kereta api Bandara Soekarno-Hatta secara hukum sudah memenuhi prinsip keadilan kompensatoris, walaupun dalam prosesnya masih terdapat kendala berupa bentuk penolakan dari warga di Kelurahan Tanah Tinggi. Proses pemberian kompensasi juga sudah sesuai dengan hasil penilaian dan beberapa langkah yang dilakukan oleh PT. KAI agar pemberian kompensasi tersebut tidak merugikan warga yang bidang tanahnya menjadi objek pengadaan tanah.Kata kunci: Pengadaan Tanah, Ganti Rugi, Keadilan Kompensatoris, Keadilan Distributif

Abstract

Vastenburg Fort is a cultural heritage area that has been designated by the Department of Culture and Tourism in 2010. In line with this designation, the City Government changed the spatial plan of Surakarta City by revising the Regional Regulation related to the regional spatial plan. In addition, the land status in the Vastenburg Fort area is divided into building use rights granted to the private sector. Even so, the City Government managed to obtain the former HGB land No. 383 which was designated as a Public Service Mall. The change in designation as a Public Service Mall is considered to reflect the need to adjust to the spatial plan in Surakarta City. However, the purpose of spatial planning in the Vastenburg Fort area should be designated for the preservation of cultural heritage. The purpose of this study is to find legal certainty arising from the conversion of former HGB land into a Public Service Mall by the Solo City Government. This study uses an empirical legal studies. The results of this study indicate that the conversion of former HGB land No. 383 in the Vastenburg Fort area by the Surakarta City Government is in accordance with the legislation. As for the City Government, the land is designated for the Public Service Mall in accordance with the spatial plan in Surakarta City in the Surakarta City RTRW Regional Regulation for the preservation of cultural heritage. However, the Surakarta City Government has not yet maximized the acquisition of HGB in the Vastenburg Fort area so that the use of land in the area is more optimal so that it benefits the entire community.

Abstract

This research discusses the settlement of Sultan Ground (SG) and Pakualaman Ground (PAG) land controlled by the community based on the principle of people's sovereignty. The special status of the Yogyakarta Special Region (DIY) grants the Sultanate and Pakualaman Duchy the authority to manage SG and PAG land. However, in practice, the inventory process of these lands has led to legal issues, particularly concerning ownership and the rights of communities that have long occupied the land. This study employs normative legal research methods with statutory and conceptual approaches. The sources of data include primary, secondary, and tertiary legal materials. The findings indicate a dualism in agrarian law between the Basic Agrarian Law (UUPA) and the Yogyakarta Special Region Law, which results in legal uncertainty for communities that have long inhabited SG and PAG land. The study concludes that the community's rights over SG and PAG land before the inventory process can be based on the magersari and anggaduh principles, which are recognized in customary law. However, the lack of legal recognition within the national legal system causes communities to lose rights over the land they have utilized for generations. Therefore, a legal solution that accommodates the principle of people's sovereignty is needed to resolve land disputes in Yogyakarta, ensuring legal certainty and justice for the community.

Abstract

This study aims to analyze the policy regarding the utilization of conservation forest areas in the Grand Forest Park (Tahura) K.G.P.A.A. Mangkunagoro I Karanganyar, particularly in the context of developing nature-based tourism grounded in the principles of benefit and sustainability. The background of this research lies in the urgency of managing conservation areas not only to preserve the environment but also to contribute to the sustainable social and economic development of surrounding communities. This research employs normative legal research methods with statutory and conceptual approaches. Data were obtained through literature study, document analysis, and direct field observation. The data analysis was conducted deductively by linking normative legal provisions with the principles of benefit and sustainability. The results indicate that the management policy of Tahura K.G.P.A.A. Mangkunagoro I has accommodated the fundamental principles of conservation as stipulated in the applicable legislation, particularly Regional Regulation of Central Java Province Number 3 of 2011. However, in practice, several potential inconsistencies remain. Therefore, it is necessary to improve the implementing regulations, technical governance, and supervision systems to ensure that the policy implementation genuinely reflects the substantive and equitable application of the principles of benefit and sustainability

Abstract

This research aims to describe an overview of the existence of ulayat land in the Minangkabau customary law community, the characteristics of ulayat land conflicts that occur in the Minangkabau customary law community, and alternative solutions to conflict resolution of ulayat land in the Minangkabau customary law community according to Islamic law. This research is a normative legal research conducted using the comparative legal study approach method. The legal material used comes from library materials or secondary data, then the data is analysed qualitatively juridically. Based on the results of the research, it can be explained that the existence of ulayat land in customary law communities has been recognised in various laws and regulations. However, horizontal and vertical conflicts still occur in the community. Litigation settlement, it turns out, has not been able to bring justice to customary law communities. This is because the resolution of conflicts over ulayat rights tends to prioritise the aspect of formal legality alone. Therefore, in resolving various customary land conflicts that occur, it is a necessity for Minangkabau customary law communities that make Islam the only religion adopted to consider ways of dispute resolution based on Islamic law, such as through ishlah or peace. Thus, in the midst of legal pluralism that applies in Indonesia, in addition to State law, the provisions in Islamic law and customary law should also be used as a reference in resolving any ulayat land conflicts in the community.
