Abstract

Penelitian ini berangkat dari adanya fenomena lavemder marriage, pernikahan heteroseksual yang dilakukan untuk menyembunyikan orientasi seksual, yang menimbulkan persoalan etis, sosial, dan hukum dalam masyarakat Muslim kontemporer. Dalam konteks fiqh, praktik ini memunculkan pertanyaan penting mengenai keabsahan akad, kejujuran niat, dan kesesuaiannya dengan tujuan pernikahan menurut syariat Islam. Dengan menggunakan metode penelitian kualitatif berbasis studi kepustakaan, penelitian ini menganalisis lavender marriage melalui pendekatan maqāṣid al-syarī‘ah, khususnya terkait lima tujuan utama syariat: menjaga agama, jiwa, akal, keturunan, dan kehormatan. Hasil kajian menunjukkan bahwa meskipun secara formal memenuhi rukun dan syarat nikah, lavender marriage mengandung unsur tadlis (penipuan) yang merusak prinsip kejujuran dan keterbukaan, serta berpotensi menimbulkan tekanan psikologis, ketidakstabilan keluarga, kerusakan garis keturunan, dan hilangnya martabat pasangan. Karena mafsadah yang ditimbulkan lebih besar daripada maslahah, praktik ini dinilai bertentangan dengan tujuan syariat dan tidak dapat dibenarkan secara moral maupun syar‘i. Penelitian ini menegaskan bahwa fiqh kontemporer perlu merespons fenomena sosial modern dengan tetap berpegang pada nilai-nilai fundamental maqāṣid al-syarī‘ah untuk menjaga integritas institusi pernikahan dalam masyarakat Muslim.

Abstract

The development of Artificial Intelligence (AI) technology has brought significant changes in various sectors of life, including in the education sector, especially in religious learning. So it is necessary to study Islamic law in the use of this technology. This study aims to explore and analyze Islamic law studies on the use of AI in religious learning. Using a qualitative approach with a literature review method, this study analyzes the concept of Islamic law related to AI in Islamic education, as well as reviews relevant literature and regulations. The results of the study show that the law on the use of AI in religious learning is contextual, depending on the intention, purpose, method of use, and its impact on Islamic values. However, in general the use of AI is permitted, this is based on the opinions of scholars both classical and contemporary. So AI can be used in religious learning, but still within the limits of sharia. Thus this study emphasizes the importance of understanding the implications of Islamic law on AI, in order to be wise and responsible in its use in religious learning.

Abstract

The development of modern food technology has given rise to innovation in the form of artificial meat (in vitro meat) produced through cell culture techniques in laboratories. This innovation was initiated as a solution to the increasing demand for animal protein and the limited supply of conventional meat. However, its existence has sparked debate regarding its halal status from a contemporary Islamic jurisprudence perspective. This study used a literature study method by analyzing Islamic jurisprudence literature, religious fatwas (fatwas), halal regulations, and scientific studies related to the production process of cultured meat. The results show that the law on consuming in vitro meat is a khilafiyah issue. Some Islamic scholars and international fatwa institutions, such as the International Islamic Fiqh Academy, the Islamic Religious Council of Singapore, and the Fatwa of the Mufti of the Kingdom of Malaysia, permit the consumption of in vitro meat provided that the cells come from halal animals slaughtered according to Islamic law and the production process is free from impure and harmful elements. In contrast, the Nahdlatul Ulama (NU) National Conference of Religious Scholars (Munas Alim Ulama) determined that cell-based meat is haram (forbidden) because the cells are taken from live animals without slaughter, thus creating carcasses. The culture process involves impure materials such as blood serum. In conclusion, the halal status of cultured meat depends heavily on the cell source, production procedures, and the cleanliness of the supporting materials, necessitating a more comprehensive Sharia standard to assess the halal status of this modern food technology. Abstract

The development of artificial intelligence (AI) has brought about major changes in the way society produces, processes, and disseminates photographs, so that images are no longer viewed as mere visual portraits, but as high-value biometric data that can be used for individual identification, behavioral analysis, and advanced digital manipulation. This article examines the law on taking photographs without permission from a contemporary Islamic jurisprudence perspective, while examining how advances in AI technology increase threats to the privacy and security of personal data stored in facial images. This research produces several important points, namely: photographs as sensitive data, the prohibition of taking photographs without permission, the risks of the AI ​​era, consent and restrictions on use, digital ethics and literacy, protective and preventive approaches. Furthermore, this article outlines the importance of implementing digital ethics as a preventative measure to prevent the misuse of photos in the increasingly complex cyberspace. Through a normative approach and literature review, this discussion demonstrates that Islamic sharia teachings, modern privacy principles, and digital ethics frameworks align in demanding caution, requiring explicit consent, and protecting human dignity and honor when photographs are produced, used, or distributed in the era of AI technology.   Keywords: Photos, AI, contemporary Islamic jurisprudence, digital privacy, digital ethics.
