Abstract

Fenomena tindak kekerasan berupa bullying yang dilakukan oleh anak di bawah umur semakin marak terjadi, khususnya di lingkungan pendidikan. Kondisi ini menimbulkan persoalan serius karena tidak hanya merugikan korban, tetapi juga berimplikasi pada masa depan pelaku. Sistem peradilan pidana anak di Indonesia melalui Undang-Undang Nomor 11 Tahun 2012 telah mengedepankan konsep keadilan restoratif sebagai alternatif penyelesaian perkara, namun penerapannya dalam kasus bullying masih menghadapi berbagai kendala, baik dari sisi perlindungan korban maupun kepastian hukum bagi pelaku. Penelitian ini bertujuan untuk menganalisis pengaturan restorative justice terhadap tindak pidana bullying yang dilakukan oleh anak di bawah umur dalam perspektif hukum positif dan hukum pidana Islam. Dengan menggunakan metode penelitian yuridis normatif melalui pendekatan kualitatif, penelitian ini menelaah regulasi, doktrin, serta pandangan hukum Islam yang relevan. Hasil penelitian menunjukkan bahwa restorative justice secara normatif memberikan peluang penyelesaian yang lebih humanis, karena menekankan pada pemulihan, perdamaian, dan pemaafan. Namun, praktiknya sering kali menimbulkan ketidakadilan, seperti korban yang tertekan untuk memaafkan meskipun belum siap secara psikologis, atau sanksi yang bersifat subjektif bagi pelaku. Dalam perspektif hukum Islam, prinsip al-‘adl (keadilan) dan al-ishlah (perdamaian) memberikan landasan moral agar penyelesaian perkara melalui keadilan restoratif tidak menjadi sarana pemaksaan, melainkan benar-benar berorientasi pada pemulihan. Dengan demikian, penelitian ini menegaskan pentingnya penerapan restorative justice yang seimbang, baik dalam kerangka hukum positif maupun hukum pidana Islam, guna melindungi hak-hak korban sekaligus membina pelaku anak.

Abstract

This article examines the implementation of the principle of legal certainty or legality in the Qanun Jinayat, specifically Article 34, a regulation of Islamic criminal law in Aceh. This research is motivated by differing views regarding the application of the Qanun Jinayat, particularly regarding the principle of legality, a fundamental principle in modern criminal law. The principle of legality, which states that "there is no punishment without law," aims to protect individuals from arbitrary actions by those in power. However, in the context of the Qanun Jinayat, it is questionable whether this regulation fully accommodates these concerns. This research uses a normative legal research method with a conceptual and regulatory approach. Data were collected through literature review, legal document analysis, and interpretation of articles in the Qanun Jinayat. The results indicate that the Qanun Jinayat has attempted to adopt the principle of legality by clearly defining prohibited acts (jarimah).

Abstract

  Optimism regarding the integration of Islamic criminal law based on Aceh's success as a national legal laboratory shows optimism regarding the integration of Islamic criminal law in other provinces. Ideally, the Qanun Jinayah creates humanistic and constitutional justice, but in practice it still faces legal disharmony in the socio-political sphere. This study uses a qualitative method with a normative juridical approach through a statute approach and conceptual approach. Data was obtained through a literature study of primary sources such as Law No. 11 of 2006, Qanun Aceh No. 6 of 2014, and Aceh Governor Regulation No. 5 of 2018, as well as secondary data in the form of academic literature and scientific journals. The analysis was conducted descriptively and analytically through content analysis to identify the normative position of the Qanun Jinayah, potential legal disharmony, and opportunities for applying its legal values outside Aceh. This study presents a novelty by placing the Qanun Jinayah Aceh as a model for the integration of Sharia law into national law through analysis that is not only normative but also sociological and political. Thus, several recommendations from this study are the strengthening of national law integration, the reformulation of the approach to Islamic criminal law, and the critique of the challenges of enforcing Qanun in other regions to demonstrate the opportunities for applying the Qanun Jinayah Aceh in Indonesia.

Abstract

This research aims to analyze the legitimacy and position of the justice collaborator within the Indonesian criminal justice system and to assess its compatibility with the principles of Islamic criminal law. The method used in this research is a normative juridical approach with statutory and conceptual approaches. The research data were obtained through a literature study of primary legal materials in the form of legislation, the Supreme Court Circular Letter Number 4 of 2011, as well as Islamic legal sources such as the Qur’an, Hadith, and literature on fiqh jinayah. The results of the study indicate that the regulation of justice collaborators in Indonesian positive law provides legal protection and recognition in the form of sentence reductions for perpetrators who cooperate in revealing crimes. From the perspective of Islamic criminal law, this concept can, in principle, be accepted through the approach of tahfif al-‘uqubah (mitigation of punishment), taubat nasuha (sincere repentance), and considerations of public benefit (maslahah mursalah). This research finds a point of convergence between national law and Islamic law, particularly in efforts to realize substantive justice and the protection of public interests.

Abstract

The evolution of criminal law in Indonesia, marked by the enactment of Law Number 1 of 2023 concerning the Criminal Code (the New KUHP), has altered the regulation of aggravated theft; the provisions previously set forth in Article 363 of the old Criminal Code have been superseded by Article 477 of the New Criminal Code. A significant update in this article is the inclusion of protection for sanctified religious objects as an aggravating factor in the crime of theft. This provision warrants examination because the theft of sanctified religious objects causes not only material loss but also impacts spiritual values, social order, and religious dignity within society. This study aims to analyze the classification of sanctified religious objects as an aggravating factor for theft under Article 477 of the Criminal Code, examine the Islamic criminal law perspective regarding this aggravating factor, and analyze the objectives of sentencing perpetrators who steal sanctified religious objects from the viewpoints of both positive law and Islamic criminal law. The study employs a normative-juridical method utilizing statutory, conceptual, and comparative approaches. The research findings indicate that sanctified religious objects possess a special legal status due to the sacred, social, and religious values they embody. Consequently, the theft of such objects merits harsher sanctions than ordinary theft. From the perspective of Islamic criminal law, this provision aligns with the objectives of maqasid al-shariʿah specifically hifz al-din (protection of religion) and hifz al-mal (protection of property) and is best understood within the framework of taʿzir as a means to protect religion and maintain social order. The novelty of this research lies in the integrative analysis of Article 477 of the New Criminal Code and the concept of jarimah sariqah in Islamic criminal law specifically regarding the classification of sanctified religious objects as an aggravating factor in theft a topic that has received limited attention in previous studies.

Abstract

The implementation of caning punishment in the Aceh Qanun Jinayah is an implementation of Islamic law that obtains legal legitimacy through constitutional recognition of regional specificities. However, its existence and implementation practices still generate debate, particularly regarding its position within the national legal system and its conformity with human rights principles. This study aims to analyze the legal legitimacy of caning punishment within the framework of Indonesia's pluralistic national legal system and examine the dynamics of its implementation in response to human rights criticism. This study uses a normative legal method with a legislative and conceptual approach through a review of the 1945 Constitution, laws, the Qanun Jinayah, and legal literature. The results show that caning punishment has a valid and binding legal basis specifically in Aceh, and has undergone adjustments in its implementation, including through changes in the location of execution. The novelty of this study lies in the integrative analysis of the legal legitimacy and implementation practices of caning punishment. The contribution of this research is to enrich legal studies on the harmonization of Islamic law and human rights in the Indonesian rule of law.

Abstract

Graduates of the Islamic Criminal Law (HPI) Study Program at UIN Sunan Gunung Djati Bandung face challenges related to the suitability of their academic competencies with the demands of the world of work. This study aims to assess the distribution of alumni, the relevance of the curriculum, and the relationship between academic experience and career achievements. The methods used are purposive sampling with an online questionnaire and a sequential explanatory mixed method approach. The results show that the majority of HPI graduates have careers in education, public administration, and da'wah, while their involvement in the formal legal sector is limited; academic abilities support professionalism, but professional networks need to be strengthened. The novelty of this study lies in the integration of alumni distribution analysis with curriculum relevance evaluation, providing practical contributions to the development of learning strategies, internships, and alumni networks so that graduates are more adaptive and ready to face professional demands. Keywords : competence, islamic criminal law study program, opportunities

Abstract

Qanun Jinayat is an autonomous regional regulation that only applies in the province of Aceh as a manifestation of the special implementation of Islamic law in Indonesia's national legal system. This study aims to analyze the position and role of Qanun Jinayat as an instrument for crime prevention in the Aceh region. This study focuses on the normative and functional aspects of Qanun Jinayat in enforcing criminal law based on the principles of Islamic law, as well as assessing its contribution to social stability and public order. The research method used is a qualitative approach with a normative juridical method through a literature study, which includes an analysis of Islamic legal literature, Aceh Qanun Number 6 of 2014 concerning Jinayat Law, and relevant laws and regulations. The results of the study show that the Qanun Jinayat has a strong position as part of the regional legal system recognized within the framework of Aceh's special autonomy. Its implementation plays a significant role in reducing crime rates through the imposition of sanctions that have a deterrent effect and increase public legal awareness. The innovation offered by this study lies in its strengthened analysis of the position and role of the Jinayat qanun in reducing crime in Aceh. This study contributes to the development of Islamic legal studies in Indonesia, particularly in understanding how Sharia norms can be effectively integrated into the positive legal system through the instrument of the Jinayat Qanun.

Abstract

Pencurian data pribadi melalui metode phishing adalah salah satu bentuk kejahatan siber yang kian meningkat dan berdampak merugikan masyarakat. Kejahatan ini tidak hanya mengancam privasi individu, tetapi juga menimbulkan kerugian ekonomi dan sosial. Meskipun terdapat harapan akan perlindungan hukum yang maksimal terhadap data pribadi, kenyataannya tindak kejahatan ini masih sering terjadi akibat lemahnya pengawasan, rendahnya kesadaran hukum, dan keterbatasan penegakan hukum. Penelitian ini bertujuan untuk menganalisis penerapan sanksi pidana terhadap phishing sebagaimana diatur dalam Pasal 67 Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi, serta mengevaluasi kesesuaiannya dalam perspektif hukum pidana Islam. Metode yang digunakan adalah pendekatan yuridis normatif dengan teknik analisis deskriptif melalui studi kepustakaan. Hasil analisis menunjukkan bahwa tindakan phishing memenuhi unsur tindak pidana karena dilakukan tanpa hak dan bertujuan memperoleh keuntungan. Dari sudut pandang hukum Islam, perbuatan ini tergolong jarimah taʿzir, karena tidak diatur secara eksplisit dalam nash, namun merugikan masyarakat. Peneliti berpendapat bahwa sanksi pidana dalam Pasal 67 UU PDP tidak hanya sesuai secara yuridis, tetapi juga sejalan dengan prinsip-prinsip keadilan dan kemaslahatan dalam hukum pidana Islam.
