Abstract

Kemiskinan dan permukiman kumuh merupakan salah satu permasalahan utama di wilayah perkotaan. Reforma agraria, yang mencakup penataan aset dan penanganan akses, menjadi salah satu upaya untuk meningkatkan kesejahteraan masyarakat miskin perkotaan. Oleh karena itu, tulisan ini bertujuan untuk mengkaji dampak reforma agraria dari perspektif penanganan akses terhadap aset penghidupan masyarakat. Kajian ini difokuskan pada analisis aset penghidupan masyarakat di Kampung Kenteng, Kelurahan Mojo, Kota Surakarta, Provinsi Jawa Tengah. Untuk memperoleh data dalam penelitian ini, digunakan metode campuran yang menggabungkan metode kuantitatif dan kualitatif. Metode kuantitatif dilakukan melalui survei terhadap 75 responden dengan menggunakan kuesioner, yang kemudian dianalisis menggunakan pendekatan pentagon aset. Sementara itu, metode kualitatif dilakukan dengan wawancara terhadap delapan perwakilan dari pemangku kepentingan yang terlibat dalam penanganan akses. Hasil penelitian menunjukkan bahwa aset penghidupan masyarakat mengalami perubahan setelah dilakukannya penanganan akses. Dari lima jenis aset penghidupan, terdapat empat aset yang mengalami peningkatan dan satu aset yang tidak mengalami perubahan. Aset yang mengalami peningkatan meliputi aset finansial, aset fisik, sumber daya alam, dan aset sosial, sementara aset yang tidak mengalami perubahan adalah aset sumber daya manusia.

Abstract

This research aims to see how land title certificates are utilized by transmigrant communities who have participated in the PTSL program from 2021 and have businesses. It is hoped that the utilization carried out can increase economic growth for the community. The sample population used as respondents in this research was 30 people. This research uses mixed methods. The data collection method used was a survey method through distributing questionnaires and interviews with community leaders and village officials. The results of this research show that financial literacy in the community has a big impact on the development of businesses run by the community. The financial literacy of the community is quite high. The PTSL program has an impact on the business development of transmigrant communities in Sridadi Village. This can be seen from: 1) changes in the type and number of businesses, 2) changes in business capital, and 3) changes in business management. Business capital owned by the community increases by 50% - 100% of the previous capital. This change in capital is a positive impact of the use of certificates by the community.

Abstract

One of the problems in mixed marriages of different nationalities is joint property. Most mixed-married couples do not make property separation agreements because they are unaware that the Marriage Law governs them. The absence of a marriage agreement results in a mix of assets, which means that foreigners own half of the joint property. The provisions in the land law/ UUPA state that foreigners are prohibited from having land rights except for usufructuary rights and rental rights. This study applied the normative legal research method with a statutory and case-based approach. This study showed that if mixed marriage actors did not have a property separation agreement, Indonesian citizens' land rights ownership status was equal to that of the foreigners. Second, jurisprudence still required a separation of properties in mixed marriages. The agreement could be made before, during, or after the marriage. Third, marriage institutions could conduct legal smuggling to obtain land rights in Indonesia through borrowing names (nominees), usually carried out in an unregistered marriage.

Abstract

Abstract: This research aims to examine the transformation of narrow, elongated land in Triharjo Village into a more proportional shape through agricultural land consolidation activities. In the 1990s, the community self-organized, leading to a mismatch between the physical and legal conditions of the land. The government's initiative to accelerate systematic land registration through the Land Management and Policy Development Program in 2006-2007 also proved unable to accommodate this issue. The research method used is a qualitative approach with a case study. Data was collected through observation, document study, and in-depth interviews. Data analysis was conducted using the Miles and Huberman analysis method with 3 stages: data reduction, data presentation, and conclusion drawing. The research results show that the majority of agricultural land in Triharjo is less than 200 m² in size, with an unfavorable length-to-width ratio for cultivation. This condition stems from past inheritance processes that adhere to the principle of justice and the saying 'kabeh mangku dalan.' The implementation of the agricultural land consolidation program in 2019-2020 was able to achieve consistency between physical and legal conditions, provide proportional land parcel shapes for cultivation, and supply agricultural support infrastructure in the form of farm roads and irrigation channels. Abstract

The implementation of the Agrarian Reform Access Arrangement (PARA) program often faces a variety of responses from the community, ranging from support to rejection. The success of this program depends on the readiness of the community as the main subject in the implementation of the program. The purpose of this research is to analyze the level of community readiness in the implementation of the PARA program in Krikilan Village, Kalijambe District, Sragen Regency. The method used is a mixed-methods approach with the Community Readiness Model, which measures community readiness through five dimensions: community knowledge, leadership, community attitudes, community understanding, and local resources. The results of the study indicate that the leadership dimension has the highest score of 4.2, which is classified as a high level of ownership. Meanwhile, the community knowledge dimension has a score of 3.4, which is classified as a low level of awareness and falls into the lowest score category. The role and support of leaders in implementing the PARA program play an important role in increasing community readiness. The factors hindering community readiness in Krikilan Village include the fact that the community has not fully participated in the series of activities organized. This indicates that the level of community readiness in Krikilan Village has not yet reached its full potential.   Implementasi program Penataan Akses Reforma Agraria seringkali dihadapkan pada beragamnya respons masyarakat, mulai dari dukungan hingga penolakan. Keberhasilan program ini bergantung pada kesiapan masyarakat sebagai subjek utama dalam pelaksanaan program. Tujuan penelitian ini untuk menganalisis tingkat kesiapan masyarakat dalam pelaksanaan program PARA di Desa Krikilan, Kecamatan Kalijambe, Kabupaten Sragen. Metode yang digunakan adalah metode campuran dengan pendekatan Community Readiness Model, yang mengukur kesiapan masyarakat melalui lima dimensi yaitu pengetahuan masyarakat, kepemimpinan, sikap masyarakat, pemahaman masyarakat dan sumber daya lokal. Hasil penelitian menunjukkan bahwa dimensi kepemimpinan memiliki skor tertinggi yaitu sebesar 4,2 yang termasuk pada tingkat rasa kepemilikan yang tinggi. Sementara dimensi pengetahuan masyarakat memiliki skor 3,4 yang termasuk pada tingkat tidak ada kesadaran dan termasuk dalam kategori skor terendah. Peran dan dukungan pemimpin dalam melaksanakan program PARA memiliki peran penting untuk meningkatkan kesiapan masyarakat. Adapun faktor yang menghambat kesiapan masyarakat Desa Krikilan yakni masyarakat belum sepenuhnya terlibat dalam rangkaian kegiatan yang diadakan. Hal ini menunjukkan bahwa tingkat kesiapan masyarakat Desa Krikilan belum maksimal.

Abstract

Complete Systematic Land Registration or PTSL is a program that aims to provide legal certainty and legal protection of land rights owned by the community so that it can improve the welfare and prosperity of the community. This paper aims to see the impact of PTSL through community livelihood assets. This article will answer the problem: What is the impact of the PTSL program on community asset management in Karangwangi Village? and What is the potential of the PTSL program in changing the poverty profile of the community in Karangwangi Village? This paper focuses on analyzing the livelihood assets of PTSL participating communities in Karangwangi Village, Depok District, Cirebon Regency. This research uses quantitative and qualitative methods to obtain data related to livelihood assets. The quantitative method was carried out through a survey of 94 respondents, using a questionnaire which was then analyzed using the livelihood asset pentagon. For the qualitative method, it was carried out through interviews with respondents. The results of the research show that there has been a change in the management of community assets from being productive to being both productive and consumptive. There was an increase in 3 (three) of the 5 (five) livelihood assets, namely natural assets, physical assets and financial assets. The PTSL program opens access to financial institutions. The poverty profile experiences change due to people's ability to not only meet minimum living needs (survival) but also social needs and accumulate capital. Pendaftaran Tanah Sistematis Lengkap atau PTSL merupakan program yang bertujuan untuk memberikan kepastian hukum dan perlindungan hukum hak atas tanah yang dimiliki oleh masyarakat sehingga dapat meningkatkan kesejahteraan dan kemakmuran masyarakat. Tulisan ini bertujuan untuk melihat dampak PTSL melalui aset penghidupan masyarakat. Tulisan ini akan menjawab permasalahan: Bagaimana dampak program PTSL pada perubahan pengelolaan aset masyarakat di Desa Karangwangi? serta Bagaimana potensi program PTSL dalam mengubah profil kemiskinan masyarakat di Desa Karangwangi?. Tulisan ini memfokuskan analisis aset penghidupan masyarakat peserta PTSL di Desa Karangwangi, Kecamatan Depok, Kabupaten Cirebon. Penelitian ini menggunakan metode kuantitatif dan kualitatif untuk mendapatkan data terkait aset penghidupan. Metode kuantitatif dilakukan melalui survei terhadap 94 responden, menggunakan kuesioner yang selanjutnya dilakukan analisis menggunakan pentagon aset penghidupan. Untuk metode kualitatif, dilakukan melalui wawancara terhadap responden. Hasil penelitian menunjukkan bahwa terdapat perubahan pengelolaan aset masyarakat dari yang semula produktif, menjadi produktif sekaligus konsumtif. Terdapat peningkatan pada 3 (tiga) dari 5 (lima) aset penghidupan yaitu aset alam, aset fisik dan aset finansial.  Program PTSL membuka akses terhadap lembaga keuangan. Profil kemiskinan mengalami perubahan dari kemampuan masyarakat yang tidak hanya mampu memenuhi kebutuhan hidup minimum (survival) tetapi juga kebutuhan sosial dan penumpukan modalnya.

Abstract

This article aims to explain the implementation of community service through the creation of the SI-BAPER application and the benefits that the community derives from this community service activity. The steps for creating the Blanko Information System and Application Flow are as follows: 1) identify service types by grouping land services frequently requested by the public, 2) compile and visualize the application flow for each service, 3) upload PDF or Word files, flow diagrams, and application forms to Google Drive, 4) generate QR codes, 5) design stickers containing the SI-BAPER QR code, 6) affix the QR code at service counters or on notice boards at the Sukoharjo District Land Office and Village Offices, 7) conduct QR code testing with applicants/the public and village officials, and 8) explain the benefits of SI-BAPER to applicants/the public and village officials. The research results show that the SI-BAPER application is a strategic medium for bringing services closer to the village level. The inclusion paradigm is one of the important foundations for creating this application. In its implementation, the community feels greatly assisted by the presence of the SI- BAPER application. The follow-up to the creation of this application is to ensure that it can reach a wider range of village locations. The SI-BAPER application can also be replicated in other land offices as a form of facilitating easy land services. The SI-BAPER application needs to be continued to be synchronised with other public service applications available in the village.

Abstract

This paper aims to examine the contribution of agrarian reform in addressing the gerontocracy of agriculture in rural areas. The research specifically focuses on examining how the post-agrarian reform program in Gunung Kukusan hamlet has shifted land ownership and control from the older to the younger generation, and how agrarian reform has influenced changes in land management control. The research was conducted using a qualitative approach. Data collection techniques included in-depth interviews, observation, and documentation. Data analysis was carried out qualitatively by categorizing and visualizing the data. The research results clearly demonstrate the issue of agricultural gerontocracy, particularly the tendency to view agricultural activities as a secondary profession. Agrarian reform through asset restructuring and access restructuring does not bring about changes in land control, ownership, and management. Land certification serves as a confirmation of ownership rather than a direct transfer of ownership. The practice of land grabbing shows that management control is entirely in the hands of landowners, most of whom belong to the older generation. The youth lack the authority to make changes to the generations-old coconut farming practices. This situation underscores the need for agrarian reform policies that accommodate the issue of youth landlessness.

Abstract

Since 2018, the Bantul Land Office has been actively working on reforms to raise the caliber of public services, one of which is the use of various public service innovations. The Bantul Land Office then took the initiative to create several land service innovations without using a technology base, namely LASTRI (Special Service without Queuing) and PANGKON (Consulting Corner) innovations as breakthroughs in convenience and fluency at service counters, including for those with special needs. This study will describe public service activities at the service counter of the Bantul Land Office, reviewing the application of LASTRI and PANGKON innovations, including the benefits and advantages offered both in terms of service providers and recipients, as well as the influence given to improving the quality of public services at the Bantul Land Office, using qualitative research methods with a descriptive approach. For the Bantul Land Office itself, the benefits obtained from the LASTRI and PANGKON innovations are that they can improve the quality of land services to the community and obtain community satisfaction through the Community Satisfaction Index (IKM) survey, as well as being more open and closer to the community. These innovations are also one of the indicators of achievement as a series of declarations for the development of the Integrity Zone, where the Bantul Land Office later received the title of Corruption Free Area (WBK) by the Ministry of Administrative and Bureaucratic Reform in December 2020.   Pembaruan demi pembaruan dalam rangka peningkatan kualitas pelayanan publik gencar dilakukan oleh Kantor Pertanahan Kabupaten Bantul sejak tahun 2018 lalu, salah satunya melalui pemanfaatan berbagai inovasi pelayanan publik. Kantor Pertanahan Kabupaten Bantul kemudian berinisiatif menciptakan beberapa inovasi pelayanan pertanahan tanpa menggunakan basis teknologi, yakni inovasi LASTRI (Layanan Spesial Tanpa Antri) dan PANGKON (Pojok Angkringan Konsultasi) sebagai terobosan kemudahan dan kelancaran di loket pelayanan, termasuk bagi mereka yang berkebutuhan khusus. Penelitian ini bertujuan untuk menganalisis penerapan inovasi LASTRI dan PANGKON serta pengaruh yang diberikan pada peningkatan kualitas pelayanan publik di Kantor Pertanahan. Penelitian dilakukan dengan menggunakan metode kualitatif. Hasil penelitian menunjukkan bahwa Inovasi LASTRI dan PANGKON dapat meningkatkan kualitas pelayanan pertanahan. Inovasi diterima oleh masyarakat yang ditunjukkan dari kepuasan masyarakat terhadap pelayanan yang diberikan kantor pertanahan. Pelayanan menjadi lebih terbuka dan dekat dengan masyarakat. Inovasi-inovasi ini juga merupakan salah satu indikator capaian prestasi sebagai rangkaian deklarasi pembangunan Zona Integritas dimana Kantor Pertanahan kemudian memperoleh predikat Wilayah Bebas dari Korupsi (WBK) oleh kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasi pada Desember 2020.

Abstract

ABSTRACT The Complete Systematic Land Registration Program (PTSL) is one of the initiatives of the Ministry of Agrarian and Spatial Planning/National Land Agency to register land ownership throughout Indonesia. In its execution, the PTSL program still gives rise to various issues, including cluster 3. The emergence of Cluster 3 poses a substantial challenge to the attainment of the PTSL program's objectives. This circumstance is plausible due to cluster 3 (referred to as "K3") being a product of the PTSL, with its implementation phase yet to culminate in the issuance of certificates. The implementation of the PTSL program could encounter impediments arising from the manifestation of the K3 cluster issue. This study aims to scrutinize the resolution strategies pertaining to the K3 clusters at the Semarang City Land Office. Employing a qualitative methodology under a case study framework, the research focuses on the identification of cluster 3 occurrences within the Gajahmungkur and Candisari Districts. Data collection techniques encompass observation, document analysis, and interviews. The findings of this study reveal that several initiatives have been undertaken to address K3 matters, notably K3.1 and K3.3 clusters. The resolution endeavors encompass both administrative and technical measures, entailing the augmentation of rights through compliance with the prerequisites specific to each cluster 3, alongside the deactivation of K3 parcel identity numbers (NIB K3) and the utilization of NIB K3. Keywords: land registration, PTSL, improvement of land data quality.   INTISARI Program Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan salah satu program Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional untuk mendaftarkan kepemilikan tanah di seluruh Indonesia. Dalam pelaksanaannya, PTSL masih meninggalkan berbagai permasalahan termasuk masalah klaster 3. Munculnya klaster 3 menjadi masalah serius dalam pencapaian program PTSL. Hal ini dimungkinkan karena K3 adalah produk PTSL yang tahap implementasinya belum mencapai penerbitan sertifikat. Implementasi PTSL akan terhambat oleh munculnya klaster K3. Penelitian ini bertujuan untuk mengkaji penyelesaian klaster K3 di Kantor Pertanahan Kota Semarang. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus. Studi kasus dilakukan pada temuan klaster 3 di Kecamatan Gajahmungkur dan Kecamatan Candisari. Teknik pengumpulan data dilakukan melalui observasi, studi dokumen, dan wawancara. Dari hasil penelitian ini diketahui bahwa telah dilakukan beberapa upaya untuk menyelesaikan lapangan K3, terutama K3.1 dan K3.3. Penyelesaian dilakukan secara administratif dan teknis, yaitu melalui peningkatan hak dengan memenuhi persyaratan masing-masing Klaster 3 dan menonaktifkan Nomor Identifikasi Bidang (NIB K3) serta memanfaatkan NIB K3. Kata Kunci: pendaftaran tanah, PTSL, peningkatan kualitas data pertanahan.
