Abstract

This article examines the implementation of the principle of non-refoulement in Indonesia’s policy on foreign refugees from both international and national legal perspectives. As a non-signatory to the 1951 Refugee Convention and its 1967 Protocol, Indonesia is not bound by their formal obligations; however, the principle of non-refoulement remains relevant as part of customary international law. The study employs a normative legal research method, analyzing primary and secondary legal sources, including international instruments, national regulations, and policy practices. Findings indicate that while Indonesia has taken initial steps through Presidential Regulation No. 125 of 2016, the absence of a dedicated refugee law, inconsistent inter-agency coordination, limited administrative capacity, and negative public perceptions hinder effective implementation of non-refoulement. Furthermore, refugee detention conditions and ad hoc decision-making often fail to meet international human rights standards. The article concludes that harmonizing international norms with domestic law is essential for a more structured and humane refugee protection framework. Recommendations include enacting specific legislation on refugees, enhancing institutional coordination, improving detention facilities, and increasing public awareness. With stronger political will and commitment to humanitarian values, Indonesia can strengthen its role as a responsible transit country and contribute meaningfully to global refugee protection efforts.

Abstract

The rapid growth of Islamic banking in Indonesia has encouraged financial product innovation, particularly through the application of hybrid sharia contracts that combine two or more contracts within a single transaction structure. Although such contracts are normatively recognized in fiqh muamalah and explicitly permitted under fatwas issued by the National Sharia Council of the Indonesian Ulama Council (DSN-MUI), judicial practice reveals inconsistent assessments regarding their legal validity. This study aims to examine the legal validity of hybrid sharia contracts from the perspective of Religious Court decisions and to analyze the juridical implications of sharia non-compliance in hybrid contractual arrangements. Employing a normative juridical method with a descriptive-analytical approach, this research analyzes primary legal materials in the form of Religious Court judgments, alongside secondary legal sources including legislation, scholarly works, and DSN-MUI fatwas, using qualitative legal analysis. The findings indicate that hybrid sharia contracts are legally valid in principle, provided that they fulfill the essential elements and conditions of contracts, avoid prohibited elements such as riba, gharar, and maisir, and are implemented in strict accordance with DSN-MUI fatwas. However, Religious Court decisions demonstrate that ambiguity in the classification and sequencing of contracts, imbalanced risk allocation that departs from profit-and-loss sharing principles, and deviations from DSN-MUI fatwas result in hybrid contracts being deemed defective or invalid both sharia-wise and legally binding. These deficiencies not only undermine the juridical validity of contracts but also pose risks to public trust and confidence in Islamic banking institutions. Accordingly, DSN-MUI fatwas function as a crucial source of substantive law and serve as the primary benchmark for Religious Court judges in assessing the legality and sharia compliance of hybrid sharia contracts.

Abstract

This study discusses women's right to abortion without the husband's consent from the perspective of Islamic family law. The main focus of this study is to explore how Islam views women's reproductive rights in the context of abortion decision-making, especially when the decision is made without involving the husband. This study uses a normative approach by referring to primary sources such as the Qur'an, Hadith, and jurisprudence books, as well as secondary sources in the form of scholars' fatwas and contemporary literature. The analysis results indicate that Islam allows women to make decisions regarding their health, including abortion in cases of medical emergencies or pregnancy due to rape. However, the principle of joint responsibility in marriage also requires the involvement of the husband in such decision-making. Conflicts between women's reproductive rights and the rights of husbands often arise due to differences in views on the priorities of justice and maslahah (well-being). Abortion without the husband's consent can have a negative impact on household harmony, such as communication breakdowns, distrust, and moral conflicts. Therefore, the proposed solution is the application of the principle of consultation (musyawarah) as an effort to reach a fair and beneficial agreement for all parties.

Abstract

This study examines the legal dilemma in regulating abortion in Indonesia through the conflict between pro-life and pro-choice doctrines. The problem arises from the tension between protecting the right to life of the fetus and the right to bodily autonomy of women within the framework of national health and criminal law. This study aims to analyze how the latest regulations, particularly Law No. 17 of 2023 on Health and the new Criminal Code, seek to harmonize these two interests. The method used is normative legal research with a legislative approach and a conceptual approach through the study of regulations and legal literature. The results of the study show that Indonesian law is still oriented towards a pro-life approach through a general ban on abortion, but provides limited exceptions in cases of sexual violence and medical emergencies. This selective recognition gives rise to normative inconsistencies and double standards in the protection of women's bodily autonomy. This study concludes that existing policies are still partial compromises and recommends a more proportional and reproductive health-based legal approach.

Abstract

State-Owned Enterprises (SOEs) play a strategic role in Indonesia’s national economy by combining business objectives with public service mandates. This dual function places SOE directors in a difficult position when making business decisions involving risks, as any financial loss may lead to legal or even criminal liability. The Business Judgment Rule (BJR) serves as a legal principle that protects directors who make business decisions in good faith, with due care, and without conflicts of interest. In Indonesia, this principle is reflected in Article 97 paragraph (5) of the Company Law and the SOE Law, and further supported by Supreme Court Regulation No. 4 of 2023. This study employs a normative juridical method with a descriptive-analytical approach to statutory regulations and legal doctrines. The findings indicate that although BJR has a legal foundation, its practical application remains problematic due to overlapping regulations, differing perspectives between business actors and law enforcement authorities, and limited understanding of the requirements for BJR protection. Therefore, clearer legal standards and consistent law enforcement are necessary to ensure that BJR functions effectively as both a protective and accountability mechanism for SOE directors.
