Abstract

The legal considerations in Decision Number 24/Pdt.G/2020/Ms.Bna do not contain Islamic legal considerations, only referring to the regulations for granting the contents of the posita. This research aims to analyze Decision Number 24/Pdt.G/2020/Ms.Bna in terms of Islamic law which has a verstek decision which grants marriage annulment because the marriage carried out is considered invalid. The research method used is qualitative, namely decision research and literature research using a case approach. After analyzing the decision Number 24/Pdt.G/2020/Ms.Bna, it is relevant to Islamic law. If standard operational procedures at the KUA Baiturrahman District, Banda Aceh City are implemented properly, of course there will be no dispute in this case. The litigants and the community must also be honest and know their lineage well so that no marriage occurs unless it is a marriage approved by Allah Swt.

Abstract

This study aimed at explaining the shift in the legality of children in Indonesia in the decisions of the Religious Court and Syar’iyah Court regarding the determination of the origin of children. This normative legal research used a conceptual approach, legal regulations, and cases. The data were obtained from the decisions of the Religious Court and Syar’iyah Court as well as legal regulations in Indonesia. The data were collected through literature review. The research results showed that the judges’ considerations no longer strictly adhered to fiqh, but referred to Indonesian positive law and even ignored both by prioritizing justice and the benefit of children. The judges’ decisions that had accommodated the welfare of children were in line with maqāṣid al-sharī‘ah, which requires the maintenance of the five basic foundations for children such as religion, soul, reason, heredity, and property. This research confirmed that there has been a shift in the legality of children in Indonesia in judges’ decisions from fiqh to positive law which prioritizes the best interests of children.

Abstract

Article 1 of Law No. 8 of 1999 which regulates "Consumer protection law", in Article 1 states "Consumer protection as all efforts that ensure legal certainty to provide protection to consumers". The researcher applies empirical law in this study, which is legal research that examines the adoption or application of normative legal provisions in each unique legal event in society. Various data sources were used, including secondary data from a literature review as well as primary data from interviews with business owners. The research findings show that the E-2B Banda Aceh refillable drinking water depot business has taken steps to protect consumers by obtaining SLHS in accordance with Permenkes No. 492 of 2010. With the SLHS, the business has met good sanitation and hygiene standards in processing and distributing drinking water that is free from bacteria as required by the Ministry of Health based on Permenkes No. 492 of 2010. The principles of fairness, integrity, and accountability are the basis of consumer protection in Islamic law.

Abstract

Corruption in Aceh has become a serious issue, with its corruption rates over the past decade being above average compared to other provinces in Sumatra and nationally. Efforts to eradicate corruption do not solely rely on law enforcement agencies but also require the participation of various parties, including religious leaders. The study aimed to analyze the perspectives and participation of ulama (scholars) in Aceh in combating corruption. It employed an empirical legal research method with a sociological anthropological approach. The results of this study indicated that corruption in Aceh was a complex issue that requires a holistic approach and cross-sector collaboration. Ulama plays an important role in eradicating corruption through preaching and religious education that instills the values of amar ma’ruf nahi munkar (enjoining what is good and forbidding what is wrong). However, their involvement is limited to the general public without direct access to policymaking. Effective efforts require synergy between ulama, law enforcement, the government, and society to create a corruption-free culture.

Abstract

The legal perspective on interfaith marriage in Indonesia, particularly between Muslims and adherents of other religions, is predominantly influenced by Islamic legal norms. The legal regulations have been established in Articles 40 and 44 of the Compilation of Islamic Law. Fundamentally, these regulations prohibit marriage between Muslims and non-Muslim religious adherents. However, the legal construction in Indonesia tends to be non-binding, as opportunities for interfaith marriage practices persist. The Marriage Law Number 1 of 1974, which serves as the foundational legal framework for marriage in Indonesia, has not explicitly prescribed either permission or prohibition. This is substantiated by the prevalence of marriage practices between Muslim men or women and individuals from other religious backgrounds. The dichotomy between legal practices and legal norms consequently leads to a lack of legal certainty regarding its regulation in Indonesia. Therefore, this manuscript comprehensively elucidates interfaith marriage from Islamic legal perspectives, positive legal frameworks, and its practical legal implementation within the Indonesian context.

Abstract

Menghadap kiblat ketika shalat di atas kendaraan merupakan suatu perbuatan yang telah dilaksanakan oleh Rasulullah shallallahu ‘alaihi wasallam . Kendaraan yang sering dikendarai yaitu seekor unta dan lainnya. Namun seiring perkembangan zaman sampai saat ini, berbagai jenis transportasi yang digunakan oleh masyarakat bagi perjalanan yang jauh semakin banyak seperti mobil, pesawat terbang, kapal laut dan lain-lain. Permasalahan dalam penelitian ini, yaitu pertama, apa hukum menghadap kiblat ketika shalat di atas kendaraan menurut empat mazhab?. Kedua, bagaimana dalil dan metode ijtihad yang digunakan oleh ulama empat mazhab tersebut?. Selanjutnya metode penelitian yang digunakan adalah metode kualitatif dengan jenis kepustakaan dan penelitian ini menggunakan pendekatan komparatif yaitu perbedaan pada hukum fikih dan mencari pendapat yang mana lebih kuat. Hasil penelitian ini menemukan bahwa menurut mazhab Hanafi, Syafi’i dan Maliki wajib menghadap kiblat ketika shalat fardhu di atas kendaraan, sedangkan menurut mazhab Hanbali kewajiban tersebut gugur apabila berlaku kondisi yang tidak memungkinkan dan tetap sah apabila tidak menghadap kiblat, sekiranya kiblat tersebut beralih arah. Dalil yang digunakan oleh mazhab Hanafi dan Hanbali, yaitu dari riwayat Abu Daud r.a. Adapun pendapat mazhab Syafi’i dan Maliki bahwa dalil tersebut tidak diterima oleh kedua mazhab, karena menurut pendapat kedua ini dalil hadis tersebut mengkhususkan hanya untuk shalat sunnah saja. Kesimpulan dari penelitian ini, penulis menyimpulkan bahwa pendapat mazhab Hanafi dan Hanbali lebih dominan karena mempunyai qiyas yang jelas pada dalil hadis yang digunakan dengan alasan sakit sebab orang yang sakit tidak bisa ruku dan sujud, maka gugur kewajiban melakukan ruku dan sujud (rukun shalat), secara tidak langsung gugurnya kewajiban dalam menghadap kiblat dalam kondisi-kondisi tertentu.

Abstract

The scholars agree that there is no maximum limit for the amount of dowry, but they differ on whether there is a minimum limit for the dowry. Then the reality is that in the culture of the people of Indrapuri District, it tends to set a burdensome dowry value. This type of research is categorized in the qualitative methods. The location of this research is in Indrapuri District, Aceh Besar District. Retrieval of data sources is done by feasibility (purposive sampling). Data analysis activities are carried out by analyzing data, organizing data, dividing it into manageable units, synthesizing to look for patterns, finding out what is meaningful and what is being researched and reporting systematically. The research results show that 1). The practice of the Community of Indrapuri Sub District, Aceh Besar District in the Determination of Dowry is to determine the amount of dowry determined by the community, the custom is always changing and varies according to changing times and the circumstances of prospective husbands and prospective wives. The practice of determining the dowry is carried out by the parents and themselves. Marriage, which begins with the determination of the dowry, is very important for the people of Indrapuri Subdistrict, Aceh Besar Regency, because it is one of the conditions for getting married. The dowry in the people of Indrapuri Subdistrict, Aceh Besar Regency is a symbol of the honor and prestige of the woman's family, the higher the dowry given by men will show the social status of women in the community, therefore everyone will compete to comply with the dowry obligations. 2). The analysis of Islamic law regarding the practice of determining dowry at Indrapuri susb district community of Aceh Besar district is that the practice of determining dowry that occurs is permissible in religion, because there is no specific law that forbids it. Plus, in Islam itself there are no absolute provisions regarding the amount of dowry, it's just that everything that is used as dowry is not excessive but must have value and benefits. Dowry does not have to be very large or very little. However, the point is that the dowry is prepared by the man as best he can and as well as possible.

Abstract

Islam merupakan agama yang sangat menghormati dan menghargai perempuan dan laki-laki di hadapan Allah secara mutlak. Islam menghapus tradisi Jahiliyah yang begitu diskriminatif terhadap perempuan, dalam Islam laki-laki dan perempuan dianggap sebagai makhluk Allah yang setara, bebas ber-tasarruf, bahkan satu sama lain saling melengkapi dan membutuhkan. Islam sebagai rahmatan lil Alamin memposisikan perempuan pada tempat yang mulia. Tidak ada dikotomi dan diskriminasi peran antara laki-laki dan perempuan. Al-Qur’an mengajarkan kedudukan orang beriman baik laki-laki maupun perempuan itu sama di hadapan Allah, oleh karena itu mereka harus memperoleh status yang setara dimata Tuhan, dan keduanya telah dideklarasikan secara sama dengan mendapatkan rahmat Allah. kepergian perempuan untuk studi walau tanpa mahram dapat dibenarkan selama terjamin kehormatan dan keselamatannya serta tidak mengundang kemaksiatan. Perempuan mempunyai hak untuk bekerja selama ia membutuhkannya atau pekerjaan itu membutuhkannya dan selama norma-norma agama dan susila tetap terpelihara. Oleh karena itu tidak ada halangan bagi perempuan untuk bekerja di selama pekerjaan tersebut dilakukan dalam suasana terhormat, sopan, serta mereka dapat memelihara agamanya dan dapat pula menghindarkan dampak-dampak negatif terhadap diri dan lingkungannya. Mengabaikan perempuan dan tidak melibatkannya dalam kegiatan yang bermanfaat bagi masyarakat berarti menyia-siakan paling tidak setengah dari potensi masyarakat.

Abstract

Dalam sebagian masyarakat, isteri begitu patuh kepada suami bahkan ada yang berkonsultasi kepada penulis bahwa dia tidak berani menolak ajakan suami walaupun kondisinya sendiri kurang fit, belum suci dari menstruasi, atau harus menyiapkan makanan dan pakaian walaupun dia sendiri kurang sehat karena takut masuk dalam keriteria nusyuz sehingga surga menjadi haram baginya. Begitu juga dengan suami sering bersikap semena-mena terhadap isteri dan merasa wewenang yang dimilikinya bersifat absolut sehingga ia dapat menggunakan kapan saja tanpa mempertimbangkan kondisi apapun, jika isteri enggan mematuhinya maka sering disebut sebagai isteri “nusyuz” ataupun “durhaka”. Tulisan ini memaparkan tentang “Persepsi Masyarakat Terhadap Nusyuz (Studi Kasus di Aceh Tenggara)” yang memiliki adat istiadat yang unik dan berbeda dari daerah lain di Aceh, yang begitu menikah maka seorang isteri harus rela diboyong dan tinggal di rumah suami (mertua isteri) sehingga sebagian isteri merasa  harus patuh kepada suaminya secara mutlak. Hampir semua responden tidak tahu dan tidak familiar dengan istilah “nusyuz” sebagaimana istilah yang digunakan oleh Alquran. Istilah yang familiar di kalangan mereka adalah “durhaka”, namun secara umum mereka labelkan hanya kepada isteri sekiranya tidak patuh dan taat kepada suami. Kemudian secara umum, responden menganggap bahwa masalah nafkah sepenuhnya tanggung jawab suami, sedangkan terkait urusan domestik seperti mencuci, mengurus rumah dan anak mutlak dibebankan kepada isteri, dan isteri harus memberikan pelayanan sepenuhnya terhadap suami.

Abstract

The Islamic perspective on the veil is bound and limited by the concept of aurat. Some scholars view the face as not part of the aurat, therefore the face does not have to be covered with a veil. Others see and conclude that the face is a woman's private parts, so it is mandatory for women to cover their faces with a veil. Cultural, social and political perspectives also follow the veil trend in society. This research aims to look at the motivation for using the veil as practiced by students at the Faculty of Sharia and Law (FSH) UIN Ar-Raniry. Next, these motivations are analyzed with a review of Islamic law and culture. The determination of locus is because FSH students are well-known (familiar) with legal matters, so the use of the veil should at least be considered based on a scientific approach. Apart from that, we want to get a detailed and detailed picture of the laws of the veil and the various responses to its use in society. There were ten female students who wore the niqab who were interviewed for several different reasons. The results obtained are related to the motivation to use the veil among students because (1) they follow along with seniors without knowing the reasons and urgency in more depth; (2) often take part in studies, because wearing the veil is understood as sunnah and is inspired by other people.
