Abstract

The research on Aceh in various fields has been conducted by many scholars so far. What is felt less of concern in academic studies is on current period of post-conflict Aceh after peace process between Free Aceh Movement and Indonesian Army since 2005. This article would like to discuss about contemporary situation, especially in the post-conflict Aceh, on what has been shifted dealing with socio-cultural in Acehnese society. However, it has been a big change and shifting within society in Aceh, particularly after sharia religious law stipulated as the main legal formal that is objected as social engineering. Why sharia is important to be studied here could be not separated from Aceh’s long history and its deep role of Islamization process to South East Asia. Beside it is used as an identity, sharia currently in Aceh has also chosen as the new culture system and as the way out of prolonged armed conflict in Aceh that has taken place for more than three decades (1976-2005). By using theory religion as a culture system, this article would like to discuss and analyze about how does sharia now in Aceh become a new culture system of identity that broadly changed Aceh and its society, not only in socio-cultural, but also any other dimensions of life in contemporary time. The findings show that sharia religious law which has been institutionalized and stipulated as the main legal formal is more being objected as social engineering projects for future oriented social transformation and being a new culture system of identity.

Abstract

The Islamic perspective on the veil is bound and limited by the concept of aurat. Some scholars view the face as not part of the aurat, therefore the face does not have to be covered with a veil. Others see and conclude that the face is a woman's private parts, so it is mandatory for women to cover their faces with a veil. Cultural, social and political perspectives also follow the veil trend in society. This research aims to look at the motivation for using the veil as practiced by students at the Faculty of Sharia and Law (FSH) UIN Ar-Raniry. Next, these motivations are analyzed with a review of Islamic law and culture. The determination of locus is because FSH students are well-known (familiar) with legal matters, so the use of the veil should at least be considered based on a scientific approach. Apart from that, we want to get a detailed and detailed picture of the laws of the veil and the various responses to its use in society. There were ten female students who wore the niqab who were interviewed for several different reasons. The results obtained are related to the motivation to use the veil among students because (1) they follow along with seniors without knowing the reasons and urgency in more depth; (2) often take part in studies, because wearing the veil is understood as sunnah and is inspired by other people.

Abstract

Perkawinan Anak atau juga sering disebut sebagai Pernikahan Dini, sering dikaitkan dengan mencegah terjadinya zina. Pernikahan dini sering terjadi di dalam konteks yang tidak baik, dan sering terjadi karna faktor ekonomi, faktor pendidikan dan yang paling banyak karna faktor diri sendiri, yang beralasan saling mencintai sehingga menimbulkan kejadian-kejadian yang tidak baik, contohnya seperti hamil pranikah yang mana dengan adanya kejadian tersebut pernikahan dini harus segera dilaksanakan dengan bantuan dispensasi kawin pada peradilan agama. penulisan ini hadir untuk memberikan gambaran tentang pemahaman perkawinan anak dan kaitannya terhadap pencegahan terjadinya zina, Adapun metode penelitian yang digunakan adalah metode kualitatif. Di mana peniliti melakukan pengamatan, mencatat, mencari tahu, menggali sumber yang berkaitan dengan peristiwa yang sedang terjadi, Menikah tidak bisa dijadikan alasan untuk menghindari perzinahan, melainkan kesadaran individu lah yang harus di tanamkan. Meskipun menikah muda mempunyai manfaat, namun Agama Islam mengajarkan jika lebih banyak mudarat nya maka manfaat nya akan hilang dan sebaiknya pernikahan dini ini tidak dilakukan.

Abstract

Domestic violence (KDRT) has been understood by the community as only the same physical violence, but can also include sexual, psychological, or family neglect. Domestic violence has social implications for divorce in society, because domestic violence can be the cause of divorce. This paper aims to review the legal aspects of domestic violence from the perspective of Islamic Law and Positive Law in Indonesia on the high divorce rate. This article uses a qualitative research method with a case approach. Data was obtained through interviews with related parties. The location of this study was carried out in Aceh using interpretation analysis. Based on research, it was found that domestic violence is motivated by a person's low mental health, low religious values in the family, low education, lack of support from the family, and low values of aqidah and morals, so that from these factors the potential of a person to file for divorce is very high.   Keywords:  Impact, Domestic Violence, and Divorce.

Abstract

When there is a marriage contract, husband and wife are legally bound and bear each other's rights and obligations. Not infrequently in household life, there are often debts carried out by both husband and wife in meeting family needs. In theory, the settlement of joint debt cases seems easy to do. But in fact, there are often protracted and often unresolved problems. The purpose of this study is to find out the concept of joint debt settlement according to Islamic Law and Indonesian Positive Law and to find out how to combine these two concepts in the lives of Indonesian people. This research is library research. The method used in this research is a qualitative method using a juridical-normative approach to understand the laws and regulations; ta'lili reasoning to understand the 'illat of all the provisions of the texts revealed by Allah as well as a comparative approach to compare Islamic Law and Indonesian positive law and find common ground.The results of the study indicate that according to Islamic law, the husband is obliged to pay the debt during the marriage because the husband is the one who is obliged. While according to Positive Indonesian Law, the husband and wife are jointly obliged to pay the family debt based on the union of property during the marriage. These differences can be integrated in the lives of Indonesian people by understanding mutual debt as 'urf which does not conflict with Islamic law and of course to achieve the common good of husband and wife (mashlahah mursalah).

Abstract

Abstrak Peraturan Menteri Dalam Negeri Nomor 108 Tahun 2019 Tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil. Aturan tersebut menyatakan kebolehan pembuatan Kartu Keluarga atas perkawinan siri dengan status “Perkawinan belum tercatat”. Penelitian ini dilakukan di Kabupaten Bireuen dengan tujuan untuk menganalisis proses pelaksanaan permendagri Nomor 108 Tahun 2019 Tentang Kebolehan Pencatatan Anak Perkawinan Belum Tercatat. Dan mengkaji konsekuensi berlakunya Permendagri Nomor 108 Tahun 2019 Terhadap Perlindungan Anak. Metode penelitian yang digunakan adalah field research (penelitian lapangan) dalam mengambil kesimpulan menggunakan jenis penelitian deskriptif analisis yaitu memaparkan secara detail fakta-fakta yang ditemukan di lapangan atau masyarakat, kemudian di analisis kembali untuk memperoleh kesimpulan terhadap permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa Proses Pelaksanaan Permendagri Nomor 108 Tahun 2019 Tentang Kebolehan Pencatatan Anak Perkawinan Belum Tercatat. Dengan pencantuman status “Kawin Belum Tercatat” dalam kartu keluarga telah legal sesuai dengan substansi dari peraturan tersebut untuk membedakan penduduk sudah atau belum memiliki surat nikah yang dikeluarkan Kantor Urusan Agama (KUA) dikeluarkan melalui Dinas Kependudukan dan Pencatatan Sipil dengan melampirkan surat pernyataan tanggung jawab mutlak (SPTJM) sebagai upaya perlindungan terhadap hak warga negara khususnya anak. Konsekuensi Berlakunya Permendagri Nomor 108 Tahun 2019 Terhadap Perlindungan Anak. Dapat dilihat dari dua sisi postif dan juga negatif. Positif memberikan hak anak dalam hal administrasi, memberikan manfaat konkrit yang dirasakan oleh masyarakat antara lain memberikan kepastian mengenai status perkawinan dan hubungan dalam keluarga pada kartu keluarga. Memberikan kepastian mengenai asal usul anak (siapa ayah dan ibunya). Dapat mulai membuka informasi tentang perkawinan siri dan perkawinan adat yang kemudian didorong dan dilanjutkan dengan isbat nikah. Negatifnya, melemahkan otoritas lembaga pencatat perkawinan Kantor Urusan Agama dan Kantor, mempersempit kewenangan lembaga peradilan dalam hal penetapan (istbat) suatu perkawinan yang tidak tercatat. Bertentangan dengan Undang-Undang Nomor 16 Tahun 2019 dalam hal pencatatan perkawinan. Kata Kunci: Permendagri, Anak, Perkawinan, Perlindungan

Abstract

Ketentuan Islam terkait poligami telah disebutkan dalam al-Qur’an dan hadis. Ketentuan poligami ini juga mendapat legitimasi dalam Undang-Undang Nomor 1Tahun 1974 tentang Perkawinan. Di Aceh, regulasi hukumnya sedang dibahas dalam Rancangan Qanun Hukum Keluarga Tahun 2019. Akan tetapi ada penambahan persyaratan dalam berpoligami dalam raqan ini sehingga adanya perbedaan antara Raqan hukum keluarga dengan peraturan perundang-undangan yang lain. Untuk itu, permasalahan yang diajukan ialah bagaimana analisis rancangan qanun hukum keluarga tentang poligami dalam ketahanan keluarga di Aceh, dan bagaimana perspektif maqasid syari’ah terhadap peraturan poligami dalam ketahanan keluarga. Jenis penelitian ini termasuk penelitian yuridis normatif. Data penelitian diperoleh dari wawancara, dan studi dokumentasi. Metode analisis yang digunakan adalah deskriptif analisis. Temuan dalam penelitian ini bahwa syarat-syarat poligami dalam rancangan qanun hukum keluarga adanya penambahan syarat berpoligami yaitu harus ada surat keterangan kesehatan dari dokter ahli, hal itu diperlukan sebagai bukti jika istri terdapat penyakit atau cacat yang menjadi sebab suami berpoligami seperti dinyatakan mandul (tidak mempunyai keturunan), dan lainnya. Adanya surat keterangan kesehatan dari dokter ahli menghasilkan ke maslahatan bagi kedua belah pihak sehingga adanya surat keterangan tersebut menjadi bukti fisik sebagai syarat poligami.

Abstract

Pencatatan perkawinan merupakan proses yang sangat penting untuk kepastian hukum pada suatu pasangan yang melakukan perkawinan. Hal ini sesuai dengan Pasal 2 ayat 2 Undang-Undang Perkawinan No. 1 Tahun 1974 bahwa tiap-tiap perkawinan di catat menurut peraturan perundang-undangan yang berlaku. Hanya saja perbedaannya bahwa pencatatan perkawinan bagi umat Islam dilakukan di Kantor Urusan Agama Kecamatan dan bagi orang yang beragama nonIslam pencatatannya dilakukan di Kantor Catatan Sipil. Namun, terdapat permohonan pencatatan perkawinan beda agama antara Rizal Adikara dan Eka Debora Sidauruk yang telah dikabulkan penetapannya pada tanggal 26 April 2022 oleh Pengadilan Negeri Surabaya agar dapat di catat pada Disdukcapil kota Surabaya. Petimbangan hakim dalam mengabulkan permohonan Para pemohon salah satunya menggunakan Pasal 35 huruf a Undang-Undang No. 23 Tahun 2006 tentang Administrasi Kependudukan yang menghendaki adanya pencatatan perkawinan beda agama dengan penetapan pengadilan, kemudian hakim beralasan bahwa Pasal 2 ayat 1 Undang-undang No. 1 Tahun 1974 tidak dapat diterapkan atas perkawinan antara dua orang yang memeluk agama yang berbeda. Tujuan penelitian ini untuk meninjau keabsahan dari perkawinan beda agama yang dicatatkan pada Disdukcapil Kota Surabaya serta akibat-akibat hukum yang ditimbulkan dari pencatatan perkawinan beda agama tersebut. Metode penelitian yang digunakan adalah penelitian pustaka (library research). Hasil peneltian menunjukkan pencatatan perkawinan beda agama atas penetapan pengadilan berdasarkan Pasal 35 huruf a Undang-Undang Administrasi Kependudukan No. 23 Tahun 2006 berseberangan dengan Pasal 2 ayat 1 Undang-Undang Perkawinan No.1 Tahun 1974 yang mengatur keabsahan perkawinan berdasarkan masing-masing agama dan kepercayaannya, dengan adanya ketentuan Pasal 2 ayat 1 diatas perkawinan beda agama seharusnya tidak dapat dilakukan karena tidak ada agama yang membolehkan dan mengizinkan perkawinan beda agama bagi pemeluknya di Indonesia. Hadirnya Pasal 35 a Undang-Undang No. 23 Tahun 2006 tentang Administrasi Kependudukan menjadikan perkawinan beda agama mendapatkan tempat dalam hukum Indonesia, walaupun hanya sebatas pencatatan perkawinan. Namun hal tersebut sebagai tanda bahwa perkawinan beda agama telah diakui dan dilegalkan. Seperti dalam Putusan hakim Pengadilan Negeri Surabaya Nomor 916/Pdt.P/2022/PN.Sby terlihat hakim lebih mendukung untuk mengabulkan permohonan pencatatan perkawinan beda agama ini dengan mengesampingkan dan tidak memperhatikan peraturan-peraturan yang mengatur keabsahan perkawinan dan larangan perkawinan beda agama bagi umat Islam

Abstract

Some society assumed that all person who perform marriages under the hands or unregistered marriages are marriages that are carried out secretly without the knowledge of official officers, namely mariages record officer. Unregistered marriages become a problem in the community that can’t stop it soon, more harm than good. Unregistered marriages can also have a big impact on the consequences of the marriages law there is especially an bad effect on women and children. Now a days much of all still many unregistered marriages processed, because there are still many unofficial marriages with decision of false judge, therefore need for applicate the sanctions for the two perpetrators of unregistered marriages, in this case teh MPU Aceh have the create Fatwa about this problem one, so they must state a regulation to protect this habitual can not occur again in our community. Therefore, the researcher is interested in reviewing the application of sanctions for unregistered marriages perpetrators in MPU Aceh Fatwa No. 1 of 2010 concerning Siri Marriages. The research methods used are field research and literature research. The result in this study state that MPU Aceh applied sanctions for perpetrators of this series of marriages against false judge with imprisonment, the presence of false judge this unregistered marriages is viral now, therefore there needs to be sanctions applied. In the study of Maqasid Syar’iyah the recording of marriages agreements falls into the category of primary benefits of Daruriyat that can protect and maintain the benefit of religion, soul, reason, offspring, and property. Related to offspring, because with the recording, for women children benefif from the wife gets an inheritance and the child gets.

Abstract

There is a discrepancy between Malaysia's positive law which stipulates that the right to hadhanah (custody) of a child must be given to Muslim parents, and the court ruling that gives non-Muslim mothers the authority to take care of the child. Therefore, there needs to be a deep understanding of how the decision contributes to the best interests of the child and the protection of the child. This article aims to analyze the implementation of hadhanah rights for parents of converts in Islamic family law in Malaysia. This study uses qualitative methods and normative legal approaches, focusing on the Federal Court decision No. 02-19-2007 (W) on the right of hadhanah for parents of converts in Malaysia. Data sources include laws, judges' decisions, and legal literature. Data were collected through literature studies and analyzed inductively. The results of the study show that the Federal Court's decision emphasizes the importance of mutual consent in decision-making related to custody, where the welfare of the child is the top priority. The decision underlines that child protection should include various aspects, such as collaborative custody, emotional well-being, appropriate religious education, and protection from negative influences. Thus, this research contributes to the development of Islamic family law and emphasizes the importance of child protection in the legal system.
