Abstract

This study aims to determine the local government policy of Kutai Kartanegara Regency in arranging participatory local regulations to accommodate the local wisdom of Kutai Kartanegara society in the era of regional autonomy. It also analyzes the implementation of local wisdom regulation to ensure the existence of society. The methodology used is empirical juridical, where researchers use data collection techniques through interviews with the Legal Section of the Regional Government of Kutai Kartanegara Province. The method of data analysis is qualitative and deductive inference, that is, drawing conclusions from a general form to a specific form. The formation of participatory local regulations based on local wisdom becomes urgent when the implementation of regional autonomy is faced with global demands where people must follow technological developments. This can change the cultural values that have been developed in local communities, and the government is obliged to provide legal protection in the form of the formation of local regulations that contain local wisdom values and guarantee their sustainability.

Abstract

Struktur pemerintahan di Indonesia terbagi menjadi provinsi, kabupaten, dan kota, diatur oleh UUD 1945. Pilkada diselenggarakan untuk memilih kepala daerah. Mulai 2024, Pilkada akan serentak demi efisiensi dan untuk mencegah konflik. Namun, kepala daerah yang habis masa jabatan menjelang Pilkada 2024 tidak dapat dipilih kembali hingga November 2024. Pasal 201 ayat (10) dan (11) UU Pilkada mengatur pengangkatan Penjabat Kepala Daerah saat kekosongan jabatan terjadi. Namun, mekanisme pengangkatan dianggap tidak demokratis dan mengundang kontroversi. Pentingnya memperbaiki mekanisme ini untuk lebih melibatkan partisipasi masyarakat dalam proses pemilihan kepala daerah. Peneliti dalam penelitian ini menerapkan metode pendekatan doctrinal atau doctrinal research yaitu pengarahan pada kumpulan norma guna menyasar penelitian melalui analisis norma yang dalam pelaksanaannya secara kualitatif dan berdasar pada studi kepustakaan. Objek penelitian dikaji berdasarkan asas dalam ilmu hukum. Hasil penelitian ialah Pentingnya pengisian jabatan negara dalam pemerintahan daerah untuk menjaga pelaksanaan organisasi negara, administrasi pemerintahan, dan ruang sosial masyarakat. Penunjukan penjabat kepala daerah dapat mengakibatkan sentralisasi kekuasaan, tergerusnya partisipasi masyarakat, dan kemunduran kedaulatan rakyat. Diperlukan prinsip demokrasi yang transparan dan partisipatif dalam penunjukan pejabat negara. Sehingga dari alur penelitian diatas peneliti dapat mengambil kesimpulan bahwa tidak terwujudnya demokrasi dalam penunjukan penjabat (Pj) kepala daerah yang dilakukan oleh pemerintah pusat hal ini dapat dilihat dari mekanismenya yang tidak terdapatnya proses musyawarah-mufakat maupun konsep perwakilan sebagai unsure demokrasi di Indonesia serta berbagai permasalahan-permasalahan di daerah terhadap penunjukan penjabat (Pj) kepala daerah oleh pemerintah pusat.

Abstract

The Head Election is one of the democratic parties of the Indonesian people. Pilkada is a form of leader regeneration in order to create new ideas and thoughts in an area. Through regional elections, it is hoped that qualified regional leaders will be elected who are in accordance with the will of the people. The practice of holding regional elections in Indonesia has reaped problems which have resulted in the violation of democratic principles. The problem that continues to occur is the practice of money politics which aims to influence the hearts of voters when conducting elections. This problem is caused by various sectors, one of which is regulation. The regulation of money politics, which each tries to divide the provisions of its legal subject, and the existence of structured, systematic and massive (TSM) elements in the administration of administrative sanctions are things that hinder the handling of money politics in Indonesia. Thus, this research will examine the reformulation needed to be able to deal with money politics. The research method used is a normative method. The research results show that there is an urgency to change the regional election law, especially regarding the subject of money politics and the requirements for the TSM element in granting administrative sanctions

Abstract

The background of this study examines the overlapping authority in determining forest areas and its implications for the legal protection of ownership of Land Ownership Certificates (SHM). This study found that overlapping authority occurred due to the absence of confirmation of forest area boundaries and systematic spatial planning, thus triggering conflict between communities that own SHM and forestry policies. The state has an obligation to protect community rights, including land rights as evidenced by SHM. The purpose of the study is to answer two things, first, to find out clarity about the factors that cause overlapping in determining forest areas in the Forestry Law, by analyzing the problems that arise from existing provisions. Second, the study looks at the form of legal protection provided by the state to the community in dealing with the problem of overlapping determination of forest areas in Kutai Kartanegara Regency. The type of this research is sociological legal research or Sociolegal studies. The research was conducted in the East Kalimantan Province, (East Kalimantan Province Environmental and Forestry Service, and the East Kalimantan Province Agrarian Spatial Planning Office/National Land Agency). The focus of this research was conducted in Sepati Village, Anggana District, Kutai Kartanegara Regency. This research will use selected respondents (purposive sampling) within the Kutai Kartanegara Regency in the area around the forestry cultivation area, namely Village Heads and Community Leaders. Specifically for respondents, researchers will conduct an interview process (deep-interview) including the use of snow-ball techniques with respondents who have a structured information network. The results of this study conclude that resolving overlapping authorities requires a comprehensive approach involving all related parties. The steps taken are comprehensive spatial planning, land dispute resolution, confirmation of forest area boundaries, strict law enforcement, strengthening institutions and non-litigation resolution.

Abstract

This study aims to analyze the effectiveness of the authority of the Judicial Commission (KY) in the enforcement of the ethics of judges in Indonesia and propose an ideal construction to strengthen the authority of this institution. The KY, which is regulated by the 1945 Constitution and related laws, has an important role in maintaining the integrity of judges through supervision and recommendation of sanctions, but is constrained by limited authority that is limited to recommendations to the Supreme Court (MA), which is often not followed up. Through a doctrinal approach and qualitative analysis of primary, secondary, and tertiary data, this study examines the challenges faced by the KY in carrying out its duties, and offers a solution in the form of granting greater authority in imposing direct sanctions on judges who violate the code of ethics. This research is expected to make a theoretical and practical contribution in strengthening a clean and transparent judicial system in Indonesia

Abstract

The application of restorative justice in the Indonesian criminal justice system cannot be immediately implemented in all cases, particularly for assault crimes. This is due to limitations in implementation and inhibiting factors that arise in the field. Facts show that some law enforcement officers are still less than optimal in expediting the restorative justice process. This condition creates legal uncertainty and anxiety, especially for prosecutors handling cases. This situation also impacts the prosecutor's position, which could be questioned by superiors and supervisory committees if case resolution does not proceed according to regulations. This study uses a socio-legal research approach to examine two main issues. First, the author analyzes the implementation of restorative justice in resolving assault cases in the jurisdiction of the Samarinda District Attorney's Office. Second, the author identifies obstacles faced in implementing restorative justice in that jurisdiction. Based on the results of the study, 14 cases of assault were handled. Of these, 11 cases were successfully resolved through restorative justice mechanisms, while 3 cases were declared failed. This failure is generally influenced by the failure to meet several important requirements, including: the perpetrator being a recidivist or having previously committed a crime, a sentence exceeding five years, the absence of a peace agreement between the perpetrator and the victim, and the perpetrator's failure to fulfill their obligation to provide compensation. Therefore, it can be concluded that although restorative justice plays a crucial role in achieving a more humane and equitable resolution of cases, its implementation still faces structural and technical obstacles. Consistent efforts by law enforcement and increased understanding of the concept of restorative justice are needed for this mechanism to operate effectively, provide legal certainty, and address the community's need for justice.

Abstract

This research was carried out in order to conduct an assessment of the Constitutional Court decision number 114/PUU-XX/2022 regarding the existence of an open proportional system as the identity of democracy in Indonesia. As is known, the decision rejected the review of several articles in the law relating to the open proportional system ( Law Number 7 of 2017 concerning General Elections) so the implication is that the open proportional system is still used as a mechanism for the general election system in Indonesia. As well as looking from another perspective regarding the advantages and disadvantages of the proportional system itself, the history of the application of open and closed proportional systems in Indonesia in the implementation of general elections, why the open proportional system was stated by constitutional judges as the ideal system to be implemented in Indonesia, and seeing how consistent the judges are constitution in deciding cases related to the open proportional system by comparing several constitutional court decisions related to the open proportional system. The author uses a doctrinal (normative juridical) approach. Research carries out analysis and research based on expert opinions and related theories in conducting discussions. Thus creating a correlation which thus sees the conclusion drawn by the constitutional judges that the open proportional system is the ideal system to be applied in general elections in Indonesia and that the existence of the open proportional system as a system in general elections in Indonesia is increasingly strengthened.

Abstract

This research aims to analyze the judge's consideration of public insults as a reason to reduce criminal sentences in cases of criminal acts of corruption based on Decision Number: 29/Pid.Sus-Tpk/2021/PN.Jkt.Pst. The research method used is normative juridical research with a case study approach. Primary data was obtained through court decision documents, while secondary data was collected from relevant legal literature, journals and other legal sources. The results of the research show that in the judge's consideration, public insults are often used as one of the reasons for mitigating criminal sentences. This is based on the view that social pressure and negative stigma from society can have a significant psychological effect on the defendant, which in some cases can be considered a form of additional punishment beyond the sentence imposed by the court. In the decision studied, the judge considered that the defendant had experienced severe social pressure due to insults and ridicule from society, which was then used as a reason to reduce the criminal sentence imposed. This research also found that the use of public insults as a reason to reduce criminal sentences still raises pros and cons among legal practitioners and academics. Some parties argue that this reason should not be used because it can reduce the deterrent effect of criminal punishment. On the other hand, other parties argue that these considerations need to be taken into account to provide more humane justice for the defendant. The conclusion of this research is that the judge's consideration of public insults as a reason to reduce criminal sentences has a strong basis in an effort to achieve a balance between legal justice and social justice. However, there needs to be clearer and more consistent guidelines in the application of these reasons to ensure objective and equitable justice.

Abstract

Penelitian ini menganalisis pelaksanaan hak inisiatif Dewan Perwakilan Rakyat Daerah (DPRD) Kabupaten Berau dalam proses pembentukan Peraturan Daerah (Perda) periode 2021-2023. Analisis dilakukan dengan menggunakan data Propemperda Kabupaten Berau dan wawancara dengan Sekretariat Daerah Kabupaten Berau Bidang Hukum dan Perundang-Undangan serta anggota DPRD. Penelitian ini bertujuan untuk menganalisis efektivitas proses pembentukan peraturan daerah di Kabupaten Berau dan pelaksanaan hak inisiatif DPRD dalam pembentukan peraturan daerah. Metode penelitian yang digunakan adalah empiris deskriptif kualitatif dengan data primer dan sekunder. Hasil penelitian menunjukkan bahwa proses pembentukan peraturan daerah di Kabupaten Berau telah mengikuti tahapan yang diatur dalam peraturan perundang-undangan. Namun, pelaksanaan hak inisiatif DPRD masih menghadapi kendala, baik internal maupun eksternal. Faktor internal meliputi keterbatasan sumber daya DPRD dan kurangnya kapasitas anggota DPRD dalam menyusun Raperda. Faktor eksternal meliputi kurangnya dukungan dari pemerintah daerah dan kurangnya partisipasi masyarakat. Penelitian ini memberikan beberapa saran untuk meningkatkan pelaksanaan hak inisiatif DPRD di Kabupaten Berau, seperti meningkatkan kualitas anggota DPRD, meningkatkan dukungan dari pemerintah daerah, dan meningkatkan partisipasi masyarakat dalam mengoptimalkan hak inisiatof DPRD dalam pembentukan peraturan Daerah.

Abstract

Political parties play a vital role in Indonesia’s constitutional system, particularly in fulfilling democratic functions such as political participation, leadership recruitment, and policy formulation and oversight. However, in the post-reform era, political parties continue to face persistent internal and external challenges that weaken their strategic role in sustaining democratic governance. This study employs a normative-juridical and comparative approach, drawing upon statutory analysis, scholarly literature, and institutional practices of political parties in Indonesia and selected democratic countries. The findings reveal that the stagnation of political party reform is primarily driven by the weakness of political education, the lack of internal democracy, and limited financial transparency. The study concludes that amending Law No. 2 of 2011 on Political Parties is essential to strengthen institutional integrity and public accountability. Its main scholarly contribution lies in proposing a conceptual model of “three pillars of party reform”—political education, internal democratization, and financial transparency—which can serve as a normative framework for designing a more adaptive, inclusive, and civilized party system within Indonesia’s democracy.Keywords: Democratization; Political Parties; Reform, Transparency
