Abstract

Penelitian ini menganalisis pelaksanaan hak inisiatif Dewan Perwakilan Rakyat Daerah (DPRD) Kabupaten Berau dalam proses pembentukan Peraturan Daerah (Perda) periode 2021-2023. Analisis dilakukan dengan menggunakan data Propemperda Kabupaten Berau dan wawancara dengan Sekretariat Daerah Kabupaten Berau Bidang Hukum dan Perundang-Undangan serta anggota DPRD. Penelitian ini bertujuan untuk menganalisis efektivitas proses pembentukan peraturan daerah di Kabupaten Berau dan pelaksanaan hak inisiatif DPRD dalam pembentukan peraturan daerah. Metode penelitian yang digunakan adalah empiris deskriptif kualitatif dengan data primer dan sekunder. Hasil penelitian menunjukkan bahwa proses pembentukan peraturan daerah di Kabupaten Berau telah mengikuti tahapan yang diatur dalam peraturan perundang-undangan. Namun, pelaksanaan hak inisiatif DPRD masih menghadapi kendala, baik internal maupun eksternal. Faktor internal meliputi keterbatasan sumber daya DPRD dan kurangnya kapasitas anggota DPRD dalam menyusun Raperda. Faktor eksternal meliputi kurangnya dukungan dari pemerintah daerah dan kurangnya partisipasi masyarakat. Penelitian ini memberikan beberapa saran untuk meningkatkan pelaksanaan hak inisiatif DPRD di Kabupaten Berau, seperti meningkatkan kualitas anggota DPRD, meningkatkan dukungan dari pemerintah daerah, dan meningkatkan partisipasi masyarakat dalam mengoptimalkan hak inisiatof DPRD dalam pembentukan peraturan Daerah.

Abstract

This article is to analyze the existence of other laws and regulations listed in Article 8 of Law Number 12 of 2011 concerning the Formation of Laws and Regulations; which is assumed to be regulation . The current condition is that the legal product in question is in its formation it is very easy and fast to handle state affairs. However, the scope and testing are not yet clear. and the amount is uncontrolled. The main problem of this research; First , in the form of the need to evaluate the characteristics of the legal product contained in Article 8 in the a quo provisions . Second , tracing position law or degree of other laws and regulations with regulation legislation is seen from the perspective of legal science. The method used is classified as normative legal research with a legal and doctrinal approach. Thus, the results of this study explain several important things, namely First , there were findings in the form of differences characteristics between statutory regulations (regeling) and legislative regulations other (policy regulations) or called as a Regulation Policy. The difference in legal status can be measured through several indicators such as the formation, scope or nature and its testing. Both sit down regulation legislation other as regulation implementer to synergize regulations and policies through separation of the position of other laws and regulations to be included in laws which are per se related to government administration with touchstone of General Principles of Good Governance through Administrative Justice

Abstract

Political parties play a vital role in Indonesia’s constitutional system, particularly in fulfilling democratic functions such as political participation, leadership recruitment, and policy formulation and oversight. However, in the post-reform era, political parties continue to face persistent internal and external challenges that weaken their strategic role in sustaining democratic governance. This study employs a normative-juridical and comparative approach, drawing upon statutory analysis, scholarly literature, and institutional practices of political parties in Indonesia and selected democratic countries. The findings reveal that the stagnation of political party reform is primarily driven by the weakness of political education, the lack of internal democracy, and limited financial transparency. The study concludes that amending Law No. 2 of 2011 on Political Parties is essential to strengthen institutional integrity and public accountability. Its main scholarly contribution lies in proposing a conceptual model of “three pillars of party reform”—political education, internal democratization, and financial transparency—which can serve as a normative framework for designing a more adaptive, inclusive, and civilized party system within Indonesia’s democracy.Keywords: Democratization; Political Parties; Reform, Transparency

Abstract

The problem of excessive regulation at the ministerial regulatory level in the presidential system arises because the Minister often exceeds his actual functions. This research aims to analyze the causes of overlapping regulations and authorities that cause legal uncertainty. The results show that excessive regulation is triggered by the unclear type and source of Ministers' authority, limits of authority in the formation of regulations, and the practice of direct delegation that is less controlled.

Abstract

The MSME sector is indeed a big challenge in ensuring the continuity of entrepreneurship. This entrepreneurial interest is still not accompanied by commensurate capacity in running a business. The purpose of this study is to examine and analyze the Micro, Small and Medium Enterprises (MSMEs) sector in the National Capital Region (IKN) and collaboration and local authorities for business activists. The research method used in this research is empirical juridical. The primary data source uses Law Number 80 of 2008 concerning Micro, Small and Medium Enterprises. The data collection used by researchers is by using certain research methods that are adapted, namely by way of question and answer, observation and documentation to collect as much data as possible. Data analysis technique; condensing data and drawing conclusions. The results of the study concluded that this sector is able to meet the needs of clothing and food. Regulators should accommodate the progress of MSME businesses. The existence of IKN has the potential to increase people's welfare. The weaknesses are the degradation of the area and the income of the community's economic value and local authorities.

Abstract

The background of this study examines the overlapping authority in determining forest areas and its implications for the legal protection of ownership of Land Ownership Certificates (SHM). This study found that overlapping authority occurred due to the absence of confirmation of forest area boundaries and systematic spatial planning, thus triggering conflict between communities that own SHM and forestry policies. The state has an obligation to protect community rights, including land rights as evidenced by SHM. The purpose of the study is to answer two things, first, to find out clarity about the factors that cause overlapping in determining forest areas in the Forestry Law, by analyzing the problems that arise from existing provisions. Second, the study looks at the form of legal protection provided by the state to the community in dealing with the problem of overlapping determination of forest areas in Kutai Kartanegara Regency. The type of this research is sociological legal research or Sociolegal studies. The research was conducted in the East Kalimantan Province, (East Kalimantan Province Environmental and Forestry Service, and the East Kalimantan Province Agrarian Spatial Planning Office/National Land Agency). The focus of this research was conducted in Sepati Village, Anggana District, Kutai Kartanegara Regency. This research will use selected respondents (purposive sampling) within the Kutai Kartanegara Regency in the area around the forestry cultivation area, namely Village Heads and Community Leaders. Specifically for respondents, researchers will conduct an interview process (deep-interview) including the use of snow-ball techniques with respondents who have a structured information network. The results of this study conclude that resolving overlapping authorities requires a comprehensive approach involving all related parties. The steps taken are comprehensive spatial planning, land dispute resolution, confirmation of forest area boundaries, strict law enforcement, strengthening institutions and non-litigation resolution.

Abstract

Secara ontologis, manusia merupakan makhluk sosial sekaligus subyek hukum yang selalu berinteraksi dengan hukum beserta akibat yang ditimbulkannya. Secara epistimologis, akibat hukum berpotensi menimbulkan konflik baik secara vertikal maupun horizontal. Hal tersebut menimbulkan berbagai perkara yang patut diselesaikan. Secara aksiologis,,diperlukannya kehadiran regulasi tarkait bantuan hukum. Faktanya, melalui keberadaan regulasi tersebut yang merupakan perwujudan prinsip persamaan didepan hukum memberikan perlindungan dan jaminan hukum belum dipahami secara utuh oleh masyarakat serta keterbatasan ekonomi. Seperti konflik antara masyarakat Kelurahan Lok Bahu, Kota Samarinda dengan Pemerintah Daerah Provinsi Kalimantan Timur terkait tidak jelasnya pergantian ganti rugi tanah yang dijadikan jalan Provinsi selama bertahun- tahun. Hal ini menjadi alasan perlunya dukungan dari wakil sekaligus legislator daerah yang memiliki kekuasaan untuk dipenuhi haknya melaui kegiatan Sosialisasi Peraturan Daerah Nomor 05 Tahun 2019 Tentang Penyelenggaraan Bantuan Hukum yang merupakan Langkah untuk meningkatan literati guna mengoptimalisasikan program bantuna hukum gratis bagi rakyat yang kurang mampu. Dari hasil sosialisasi tersebut, terjadi peningkatan pemahaman dari Masyarakat.

Abstract

Kegiatan ini mengkaji urgensi eksistensi Badan Usaha Milik Desa (BUMDes) dalam meningkatkan kesejahteraan masyarakat Desa Salo Palai, Desa Saliki, dan Desa Badak Baru, Kecamatan Muara Badak, Kabupaten Kutai Kartanegara, Kalimantan Timur. Desa-desa ini dikenal dengan potensi ekonomi yang berbasis sumber daya alam seperti pertanian dan perkebunan, perikanan, dan jasa. Tujuan dari kegiatan ini adalah untuk mengevaluasi peran BUMDes dalam pemberdayaan ekonomi lokal, mengidentifikasi tantangan yang dihadapi, serta merumuskan rekomendasi strategis yang dapat mendukung optimalisasi fungsi BUMDes dalam meningkatkan kesejahteraan masyarakat pedesaan. Melalui BUMDes, pemerintah daerah mendorong pemberdayaan ekonomi lokal dengan mengelola sumber daya secara berkelanjutan. Namun, terdapat beberapa isu yang perlu diatasi, seperti kurangnya sumber daya manusia, transparansi pengelolaan sumber daya alam, pembentukan regulasi BUMDes, serta aspek keadilan dan kemanfaatan bagi seluruh masyarakat desa. Kegiatan ini menggunakan pendekatan deskriptif untuk mengeksplorasi manfaat BUMDes dan tantangan yang dihadapi, dengan fokus pada asas transparansi, keadilan, dan kemanfaatan. Data diperoleh melalui studi literatur dan observasi terhadap praktik BUMDes di tiga desa. Hasil kegiatan menunjukkan bahwa BUMDes memiliki potensi besar dalam meningkatkan ekonomi dan kesejahteraan masyarakat desa, namun perlu dilakukan langkah-langkah strategis untuk mengatasi permasalahan BUMDes yang ada.

Abstract

The potential of natural caves spread across Sanggulan Village, Sebulu District, Kutai Kartanegara Regency, East Kalimantan Province, which is a buffer zone for the capital of the Indonesian archipelago, has great potential to be developed as a tourism and educational facility. Currently, ecotourism development is widespread in the IKN area to fulfill the smart city slogan which prioritizes aspects of nature conservation, social, cultural and economic empowerment of local communities as well as learning and educational facilities. These elements significantly influence traditions, socio-economic life of the community and the empowerment of local village products. The village's identity is summarized in a slogan that highlights the richness of natural resources, preservation of cultural heritage and IKN's ecotourism priorities. By using a policy model that is Meaningful Participation, Asset Based Community Development (ABCD) and SWOT analysis of Regional Government policies in regulating or making regulations regarding cave or karst ecotourism, the aim is to increase IKN tourism by integrating cultural, geotourism and legal aspects. This model promotes participatory legal regulation, empowerment of local communities and environmental conservation to encourage sustainable regional development.

Abstract

Our country is known as a nation that upholds human rights values. This is manifested in the recognition of the right to express opinions, which is specifically regulated in Law Number 9 of 1998 concerning Freedom of Expression in Public. Along with the increasing dynamics of political contestation and polarization in society, the frequency of demonstrations has also escalated. This condition places the professionalism and neutrality of the police force under increasing public scrutiny. The reduction in citizens' freedom to express their aspirations often creates a negative image of the police, particularly due to repressive actions and the use of discretion that is deemed disproportionate. Based on a normative juridical approach, this study aims to analyze the extent to which the state upholds access and protection of freedom of expression in public, as well as examine the application of human rights principles from both national and international legal perspectives in demonstrations
