Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas sistem pengawasan yang dilakukan oleh Badan Pengawas Pemilu (Bawaslu) dalam menangani pelanggaran Pemilu di Indonesia, dengan fokus pada perubahan kewenangan Bawaslu yang diatur dalam Undang-Undang Nomor 7 Tahun 2017. Perubahan signifikan pada kewenangan ini meliputi penguatan tugas Bawaslu dalam menyelesaikan sengketa dan pelanggaran administratif yang sebelumnya menjadi tanggung jawab Komisi Pemilihan Umum (KPU). Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus untuk mengevaluasi pelaksanaan kewenangan Bawaslu, tantangan yang dihadapi dalam implementasi pengawasan, serta faktor-faktor yang mempengaruhi efektivitas pengawasan Pemilu. Hasil penelitian menunjukkan bahwa meskipun Bawaslu memiliki kewenangan yang lebih luas, tantangan dalam pelaksanaan pengawasan Pemilu tetap besar, terutama terkait dengan keterbatasan sumber daya manusia, anggaran, dan koordinasi antara lembaga pengawas Pemilu lainnya. Pengawasan yang dilakukan oleh Bawaslu masih menghadapi berbagai kendala, seperti politisasi lembaga pengawas, kesulitan dalam menerapkan kewenangan setengah peradilan, serta kurangnya implementasi regulasi yang mendukung pengawasan yang efektif. Penelitian ini menyarankan perlunya peningkatan kapasitas Bawaslu, pembaruan regulasi, serta perbaikan koordinasi antara KPU, Bawaslu, dan Dewan Kehormatan Penyelenggara Pemilu (DKPP) untuk memperkuat integritas Pemilu dan menjamin pelaksanaan Pemilu yang jujur, adil, dan transparan.

Abstract

This thesis examines legal issues related to village head elections, with a case study in Kota Bangun 2 Village, Kutai Kartanegara Regency. The background highlights the importance of village head elections in village democracy, but the lack of attention to the village head election regime is a weakness in itself. The results of the study show that violations in Pilkades can be caused by poor supervision, such as administrative disputes and election result disputes. The factors causing Pilkades disputes include internal factors (non-neutral committees, problematic voter lists, unhealthy campaign processes, fanaticism among supporters, and lack of social control) and external factors (local government intervention, regulatory weaknesses, political and power interests, and proximity to local authorities). The mechanism for resolving Pilkades disputes is regulated in Law No. 6 of 2014 concerning Villages, Government Regulation No. 47 of 2015, Minister of Home Affairs Regulation No. 112 of 2014 in conjunction with Minister of Home Affairs Regulation No. 72 of 2020, and Kutai Kartanegara Regency Regulation No. 3 of 2015 in conjunction with Kutai Kartanegara Regency Regulation No. 3 of 2018. However, in practice, the resolution of Pilkades disputes is often not in accordance with the proper mechanisms, as was the case in the Pilkades in Kota Bangun 2 Village.

Abstract

The right to life is a non-derogable human right and constitutes a fundamental obligation of the state in all public policies, including public security. However, in the practice of handling mass demonstrations, the protection of the right to life often conflicts with a security paradigm that prioritizes stability and public order. This study aims to analyze the failure of state security policies in protecting the right to life of civilians by using the death of Affan Kurniawan during a mass protest operation as an entry point for analysis. This research employs a normative juridical approach through the examination of legislation, police regulations, and human rights literature. The findings indicate a significant gap between legal norms that guarantee the protection of the right to life and their implementation in crowd control practices. Civilian deaths in this context cannot be understood merely as individual incidents, but rather as preventable deaths resulting from the state’s failure to manage the risks associated with the use of force. The study highlights the need for a shift in security policy from a state-centered security approach toward a human security paradigm that places the protection of human life and dignity at the core of public security governance.

Abstract

For the general public, Indonesia’s five-year electoral cycle is often perceived merely as a procedural voting event, overlooking the substance and quality of how voters select presidential or regional leaders. Following the 2024 General Election, the challenges of democracy have shifted from technical management to the prevention of polarization, money politics, digital disinformation, identity politics, and echo chambers. This article analyzes the urgency of implementing sustainable voter education during the inter-election period, using the General Election Commission (KPU) of Balikpapan City as a case study. The study focuses on KPU Balikpapan’s strategies to transform pragmatic voters, who are susceptible to manipulation, into informed participants, while also addressing the vulnerabilities of first-time voters ahead of the 2029 Election to increase participation rates. The analysis indicates that political education during the non-election period is a critical moment to build the cognitive foundation of voters without compromising their independent choice, making the role of KPU Balikpapan essential in maintaining democratic integrity in the city.

Abstract

The untimely formation of government regulations on the delegation of laws is still a serious problem in the practice of forming laws and regulations in Indonesia. It was recorded that from 2021 to 2023 there were 16 government regulations that were formed late, which shows that there are problems in the follow-up mechanism for legislation delegations. The author analyzes whether the government has a legal obligation in the timeliness of the formation of government regulations as implementing rules. In addition, this study also examines the juridical and practical implications of the law if a delegated government regulation is formed late. The data used are quantitative and supported by doctrinal research methods through the analysis of laws and regulations, expert opinions, and related legal literature. The results of the study show that the government has a legal obligation to form government regulations in a timely manner. The delay in the formation of government regulations has an impact on disrupting the effectiveness of the implementation of the law and causes some provisions to not be implemented optimally because the implementing instruments are not yet available according to the specified deadline. In addition, these delays have the potential to cause legal uncertainty for the public, law enforcement officials, and policy implementing agencies. The vacuum of implementing rules can also trigger differences in interpretation, hinder policy implementation, and increase the risk of legal disputes. Therefore, this study emphasizes the importance of stricter monitoring and evaluation mechanisms against the deadline for the formation of government regulations to ensure legal certainty and regulatory effectiveness.

Abstract

Pasal 33 ayat (3) UUD 1945 menyatakan bahwa bumi, air, dan kekayaan alam dikuasai oleh negara untuk kemakmuran rakyat. Berdasarkan prinsip ini, pemerintah bertanggung jawab mengelola tanah dan sumber daya alam, yang tercermin dalam pembentukan hukum agraria nasional. Salah satu bentuk implementasi kewenangan negara adalah Bank Tanah, yang bertujuan menyediakan tanah untuk kepentingan umum dan pembangunan nasional, serta mengatasi kendala penyediaan tanah di daerah terpencil. Melalui UU Cipta Kerja, pemerintah membentuk Badan Bank Tanah sebagai lembaga non-profit yang dikelola secara transparan dan akuntabel. Bank Tanah juga berperan dalam reforma agraria dan pemerataan ekonomi. Penelitian ini bertujuan mengeksplorasi peran Bank Tanah dalam pengelolaan tanah dan dampaknya terhadap sistem pertanahan serta kesejahteraan masyarakat. Hasilnya menunjukkan bahwa Bank Tanah memperkuat konsep Hak Menguasai Negara dalam pengelolaan sumber daya alam untuk kemakmuran rakyat.
