Abstract

This thesis examines the incompleteness of the mediator competency standards set in the Minister of Trade Regulation No. 72 of 2020 as a requirement for members of the Consumer Dispute Resolution Agency (BPSK). The regulation does not explicitly stipulate mandatory training or certification of mediators for BPSK members, thus opening up the possibility of mediation being carried out by parties without a legal background or mediation skills. This has an impact on the low quality of dispute resolution, injustice for the parties, and decreased public trust in BPSK as a dispute resolution institution. This study uses a normative juridical method with a statutory, conceptual, and comparative approach. Based on the analysis, the absence of mediator competency regulations causes legal uncertainty (Gustav Radbruch's Theory of Legal Certainty) and violations of the principle of distributive justice (Aristotle). As a solution, this thesis recommends the reconstruction of Minister of Trade Regulation No. 72 of 2020 by adopting the German legal system model, namely requiring mediator certification and the imposition of administrative sanctions for violations. This proposal is in line with the civil law system and Philipus M. Hadjon's theory of authority, which emphasizes the importance of proportionality and professionalism in the implementation of public authority.

Abstract

Advertising strategies through social media are increasingly being chosen by business actors to market their goods and/or services. The existence of advertising strategies through social media has given birth to a new term known as endorsers. The rapid development in the world of advertising is not balanced by the development of laws in the legislation in Indonesia which is specifically regulated through Law Number 8 of 1999 concerning Consumer Protection. The purpose of this study is to find out the ideal regulation of endorser liability for consumer losses due to promotional actions carried out by endorsers. The research method used in this study is normative legal research with a conceptual approach, a statutory approach, and a comparative approach with the Code of Federal Regulations (CFR) Part 255 on Guides Concerning the Use of Endorsements and Testimonials in Advertising. The results of this study are the urgency for legislation in Indonesia to regulate endorsers in detail and explicitly so that endorsers can be held accountable for promotional actions carried out by them.

Abstract

In the Indonesian civil law system, the role of judges is crucial in adjudicating cases involving contractual legal relationships, particularly in banking default cases. Injustice often arises from the abuse of circumstances, where debtors who are in a weak position are often victims of adverse bank policies. Additionally, high interest rates and oppressive contractual clauses pose significant challenges for judges. This research shows that disparities exist in court decisions on abuse of circumstances, creating legal uncertainty. Using a normative juridical approach, this research examines the need for clear legal guidelines from the Supreme Court to establish uniformity in the handling of default cases. Stronger regulations are expected to ensure that judges make more judicious decisions and uphold justice for all parties. This research emphasises the importance of applying the principle of fairness in contracts, so that freedom of contract does not neglect the rights of weaker parties.

Abstract

Abstrak Perkawinan “Pada Gelahang” merupakan bentuk perkawinan alternatif dalam masyarakat adat Bali yang dipilih ketika pasangan tidak dapat melaksanakan perkawinan biasa atau nyentana. Dalam praktiknya, baik suami maupun istri tetap berstatus purusa di rumah masing-masing dengan segala hak (swadikara) dan kewajiban (swadharma) yang melekat. Kondisi ini menimbulkan persoalan dalam hukum kewarisan karena sistem adat Bali memprioritaskan laki-laki sebagai penerus tanggung jawab keluarga dan pengelola warisan, sedangkan perempuan hanya berperan sebagai penerima manfaat. Penelitian ini bertujuan untuk menganalisis implikasi pelaksanaan hak waris anak dalam sistem perkawinan Pada Gelahang di Kabupaten Buleleng dan Kota Denpasar. Metode penelitian yang digunakan adalah Socio Legal Research dengan pendekatan yuridis sosiologis. Hasil penelitian menunjukkan bahwa kedudukan hak waris anak dalam perkawinan Pada Gelahang tidak memperoleh kepastian hukum yang jelas. Posisi anak sebagai ahli waris menjadi ambigu karena tidak terdapat perjanjian formal yang mengatur status mereka dalam struktur keluarga ganda. Hal ini menimbulkan ketidakpastian dalam distribusi harta warisan, sehingga diperlukan regulasi atau kesepakatan adat yang lebih tegas untuk memberikan kepastian hukum. Kata Kunci: Perkawinan Pada Gelahang, Purusa, Hukum Waris, Masyarakat Adat Bali, Kepastian Hukum Abstract Pada Gelahang marriage is an alternative form of marriage in Balinese customary law, chosen when couples are unable to perform either the common marriage system or the nyentana system. In this practice, both husband and wife retain their status as purusa in their respective families, along with the attached rights (swadikara) and obligations (swadharma). This situation creates challenges in inheritance law since Balinese customary law prioritizes males as family successors and estate managers, while females are regarded merely as beneficiaries. This study aims to analyze the implications of children’s inheritance rights in the Pada Gelahang marriage system in Buleleng Regency and Denpasar City. The research employs Socio Legal Research with a sociological juridical approach. The findings reveal that the inheritance rights of children born from Pada Gelahang marriages lack legal certainty. Their position as heirs remains ambiguous due to the absence of a formal agreement regulating their status within the dual family structure. This ambiguity creates uncertainty in the distribution of inheritance, indicating the need for clearer customary agreements or regulations to ensure legal certainty. Abstract

This study examines the reconstruction of copyright law as marital property within the Indonesian legal framework, focusing on the economic rights of works created during marriage. The research background stems from the complexity of the relationship between intellectual property rights and family law, where copyright often becomes a source of conflict in asset division during divorce. Employing a normative method with legislative, comparative, and conceptual approaches, this study compares regulations in Indonesia and the People's Republic of China. The findings indicate that Indonesia lacks specific rules on the division of economic copyright rights as marital property, whereas China has explicitly integrated them into the Civil Code. Reconstruction is proposed through harmonization of the Copyright Law and Marriage Law, differentiation between moral and economic rights, and the establishment of technical regulations to ensure legal certainty, justice, and protection of creators' rights. These findings contribute to the development of a more responsive national law towards intangible assets in family contexts.

Abstract

Modern digital-based justice is the answer to the challenges of the development of the times. Although modern justice reflects an adaptive judicial body, it must still be equipped with established regulations. This study aims to examine the harmonization of personal data protection principles between the Supreme Court Regulation No. 7/2022 concerning electronic case administration and trials and Law No. 27/2022 concerning Personal Data Protection (PDP Law). In this case, the researcher uses a normative juridical method, with a statutory regulatory and comparative combined approach. This study highlights the norms gap in the Supreme Court Regulation No. 7/2022, particularly in the aspect of protecting the personal data of the parties input into the electronic justice administration system. The main findings exhibited are that the Supreme Court Regulation No. 7/2022 does not regulate the basic principles of data protection as mandated by the PDP Law, which has the potential to cause legal uncertainty and privacy right violations. The fact that the principle of personal data protection in the Supreme Court regulation has not been absorbed is due to the PDP Law, which only came into effect in 2024, even though both were enacted in the same year in 2022. This is seen as weakening the legitimacy of electronic justice in Indonesia. This study is expected to provide a positive contribution in the form of regulatory reform through the revision of the Supreme Court regulations, the establishment of data protection units in the judicial environment, and strengthening institutional coordination. The results of the comparative analysis of common law systems such as England show the importance of integrating data protection principles into the legal infrastructure and institutions of electronic justice to be aware of the protection of privacy rights that intersect with the guarantee of the human rights of justice seekers.

Abstract

Kris is an object of Indonesian culture which has beautiful artistic and high economic values. Kris making is still maintained in several areas, one of which is in Sumenep Regency. Since 2014, Sumenep Regency has been recognized by UNESCO as the area that has the most Mpu (makers of heirlooms) in the world and most of them are in Aeng Tong-Tong Village. The tradition of making kris in Sumenep has existed since the time of the Majapahit Kingdom and has continued to this day. The rapid development of the industry and the number of kris makers in Sumenep have made Sumenep the Indonesian Kris City. The aim of this research is to analyze the legal protection of the Aeng Tong-Tong Sumenep Kris based on national laws and international conventions using a statutory approach. The legal protection of the Aeng Tong-Tong Sumenep Kris in national law is contained in Law Number 28 of 2014 concerning Copyright and Law Number 5 of 2017 concerning the Promotion of Culture, while the legal protection of the Aeng Tong-Tong Sumenep Kris in International Conventions is contained in The Convention on the Protection and Promotion of the Diversity of Cultural Expressions 2005, The Convention for the Safeguarding of the Intangible Cultural Heritage 2003, and The Berne Convention for the Protection of Literary and Artistic Work. In realizing optimal legal protection for the Aeng Tong-Tong Sumenep Kris in national law and international conventions, a comprehensive legal protection must be provided including legal protection for Intellectual Property and Non-Intellectual Property. (Keris merupakan benda hasil budaya bangsa Indonesia yang memiliki nilai seni yang indah dan nilai ekonomi yang tinggi. Pembuatan keris tetap dipertahankan di beberapa daerah, salah satunya di Kabupaten Sumenep. Sejak Tahun 2014, Kabupaten Sumenep diakui oleh UNESCO sebagai daerah yang memiliki Mpu (pembuat benda pusaka) terbanyak di dunia dan sebagian besar ada di Desa Aeng Tong-Tong. Tradisi pembuatan keris di Sumenep sudah ada sejak zaman Kerajaan Majapahit dan masih terus bertahan hingga kini. Pesatnya perkembangan industri dan jumlah perajin keris di Sumenep menjadikan Sumenep sebagai Kota Keris Indonesia. Tujuan pada penelitian ini untuk menganalisis perlindungan hukum Keris Aeng Tong-Tong Sumenep berdasarkan hukum nasional dan konvensi internasional dengan menggunakan pendekatan perundangan. Perlindungan hukum Keris Aeng Tong-Tong Sumenep dalam hukum nasional terdapat dalam UU Nomor 28 Tahun 2014 tentang Hak Cipta dan UU Nomor 5 Tahun 2017 tentang Pemajuan Kebudayaan, sedangkan perlindungan hukum Keris Aeng Tong-Tong Sumenep dalam Konvensi Internasional terdapat dalam The Convention on the Protection and Promotion of the Diversity of Cultural Expression 2005, The Convention for the Safeguarding of the lntangible Cultural Heritage 2003, dan The Berne Convention for the Protection of Literary and Artistic Work. Dalam mewujudkan perlindungan hukum yang optimal terhadap Keris Aeng Tong-Tong Sumenep dalam hukum nasional dan konvensi internasional, maka harus dilakukan perlindungan hukum secara menyeluruh meliputi perlindungan hukum atas Kekayaan Intelektual dan Non Kekayaan Intelektual.)

Abstract

The position of illegitimate children who are legally recognized as Substitute Heirs (Plaatsvervulling) in Indonesia is still not fully regulated. The position of illegitimate children who are recognized as legal if they replace their parents still often causes conflict, especially the conflict that occurs between Article 872 of the Civil Code and the Constitutional Court Decision. Number 46/PUU-VIII/2010 which amends Article 43 paragraph (1) of the Marriage Law. The existence of this conflict will certainly give rise to legal uncertainty so this needs to be studied. This research will discuss legal certainty regarding the position of illegitimate children who are recognized as legal successors (Plaatsvervulling). This research is a normative juridical research method with the approach taken being a statutory approach. The results of the analysis of legal uncertainty regarding the position of illegitimate children who are recognized as legal substitute heirs (Plaatsvervulling) can be resolved using the principle of lex posterior derogat legi priori, so that the Marriage Law overrides the law of the Civil Code, so that illegitimate children have the right to become successor heirs to their parents without Look at the terms or conditions as stated in Article 873 of the Civil Code.

Abstract

The changes that occurred in the Constitutional Court Decision Number 69/PUU-XIII/2015 caused multiple interpretations, the change of the phrase "Making a written agreement" in Article 29 paragraph (1) of the Marriage Law to "submitting a written agreement" in the Constitutional Court Decision Number 69/PUU-XIII/2015 needs to be explained in more detail so that it creates legal certainty. The difference between the phrases "Making" and "Submitting" in the KBBI has a very different meaning, not explaining the meaning of this phrase will cause legal uncertainty, especially for Notaries. So it is necessary to study how the regulation of the ratification of marriage agreements carried out by notaries in Indonesian positive law after the Constitutional Court Decision Number 69/PUU-XIII/2015. The type of research used is the normative legal method, namely research conducted on legal sources such as laws or other literature that includes analysis of legal principles to identify and resolve legal issues that will be studied using the Theory of Legal Certainty. The results of the analysis explain that from the Constitutional Court Decision Number 69/PUU-XIII/2015, Notaries should have two new authorities.

Abstract

This research examines the legal protection of clients when the notary's wherea-bouts are unknown (lost contact).describe and analyze the certainty of legal protection for appearers who are harmed by a notary whose whereabouts are unknown (lost contact) and to analyze and formulate forms of legal protection that can guarantee legal certainty for ap-pearers who are harmed by a notary whose whereabouts are unknown (lost contact).This research is a normative juridical research through literature studyusing statutory approach (statute approach) and conceptual approach (conceptual approach). The main issues were analyzed using primary legal materials includingProvisions of Article 463 in conjunction with Article 467 of the Civil Code, provisions of Article 15, Article 16, Article 17, Article 62, Article 63 Article 67, Article 69 and Article 70 of Law Number 30 of 2004 concerning the Position of Notary Public juncto Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary, Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 15 of 2020 concerning Procedures for Examining the Supervisory Board of Notaries and Notary Code of Ethics. Legal materials were analyzed based on prescriptive analysis and grammatical and systematic interpretation techniques. Based on the research results it is known thatLegal protection for appearers who are harmed by a notary whose whereabouts are unknown (lost contact) based on the analysis of UUJN Amendment) is weak, because basically (“UUJN”) juncto (“UUJN”) Amendment has accommodated arrangements regarding the presence of a notary in the exercise of his office. No matter of how, there are incomplete norms in regulating the absence of a notary in Law Number 2 of 2014 concerning Notary office  (“UUJN”) juncto (“UUJN”) Amend-ment because it cannot accommodate the existence of a notary whose whereabouts are un-known (lost contact), including not being able to guarantee legal protection to appearers who are disadvantaged because the event of absence of a notary is not contained in the provisions in UUJN juncto UUJN Amendment which is used as a guideline results in legal uncertainty which causes legal protection for aggrieved appearers to be also not guaranteed
