Abstract

Klinik kecantikan berkembang pesat, namun penyelenggaraannya harus disertai nilai keadilan sosial bagi stakeholder yaitu pasien pemerintah dan klinik kecantikan.  Artikel ini mengkaji keadilan sosial dalam penyelenggaraan klinik  kecantikan estetika. Kajian dilakukan dengan metode yang digunakan Socio Legal Studies yang dianalisis secara kualitatif, Analisis data pada penulisan hukum lazimnya dilakukan melalui pendekatan kualitatif.  Hasil penelitian menunjukkan bahwa keadilan sosial ini meliputi pemenuhan hak dan kewajiban stakeholder yang terkait dalam penyelenggaraan klinik kecantikan estetika, yaitu pasien, pemerintah dan klinik kecantikan estetika itu sendiri. Keadilan sosial dalam penyelenggaraan klinik kecantikan estetika di Indonesia dalam hal pemenuhan hak atas kondisi sehat, pelayanan kesehatan, jaminan perlindungan hukum, kepastian hukum, hak dan kewajiban pasien pemerintah dan klinik kecantikan

Abstract

Technological developments in the era of globalization have crept into the financial world. The high demand for people in financial matters makes financial technology grow rapidly. Community problems in meeting financing needs are increasingly needed so funding sources are needed. In practice, there are insufficient funding sources to help the community, the process is complicated and requires a long time to make peer to peer lending begin to be looked at by Indonesians who are looking for sources of funding. Legal norms in positive law and by type of library research. The conclusion of this research is that users must protect more in carrying out all activities that require financial technology, borrowing money, and in conducting peer to peer lending practices in order to guarantee legal certainty in accordance with the laws and regulations in force in Indonesia

Abstract

Medical aesthetic tourismberkembang pesat beberapa tahun terakhir. Kajian terhadap perlindungan hukumnya perlu diperdalam agar tren ini dapat memberikan rasa aman bagi pelakunya. Tujuan artikel ini untuk mengkaji dan menganalisis Perlindungan Hukum medical aesthetic tourism. Jenis penelitian ini termasuk penelitian doktrinal yang mengacu pada sumber data primer, sekunder dan tersier, dengan teknis analisis data interaktif. Hasil kajian menunjukkan perlindungan hukum medical aesthetic tourism terkait pada standarisasi pelayanan medik, standar keamanan produk, asuransi, litigasi risiko medik selama tindakan dan perawatan.  Perlindungan hukum ini dikaji dengan perspektif Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, serta hukum internasional yang terkait.Ulasan literatur naratif ini berfokus pada masalah perlindungan hukum wisatawan yang mendapatkan perawatan medical aesthetic tourism di luar negeriKata Kunci : Perlindungan Hukum, Medical Aesthetic, TourismABSTRACTMedical Aesthetic Tourism shows significant growth in recent years. A study on its law protection should be conducted more in-depth to enable this trend to give the feeling of secure to its actors. This article aimed to study and to analyze Law Protection of Medical Aesthetic Tourism. This study was a doctrinal research referring to primary, secondary and tertiary data sources, with interactive technique of analyzing data.  The result showed the Law Protection of Medical Aesthetic Tourism related to medical service standardization, product security standard, insurance, medical risk litigation during action and treatment. This law protection is studied from the perspective of Pancasila and Republic of Indonesia’s 1945 Constitution, and related international law. This narrative literature review focused on the problem of law protection for the tourists getting Medical Aesthetic Tourism treatment abroad.

Abstract

The protection of aesthetic beauty clinic patients is important because of the increasing number and development of beauty clinic businesses, and the emergence of many problems and cases related to its implementation, as a result of implementing actions that are not in accordance with the relevant laws and regulations. This raises the need for protection against health risks arising from losses for services in beauty clinics that are not in accordance with statutory regulations in the field of health law and consumer protection law. The state is obliged to provide protection related to the implementation of constitutional rights to legal protection and the right to health, so that beauty clinic business actors obey all applicable regulations related to its implementation, increasing the responsibility as a business actor towards its consumers. In reality, the phenomenon of this beauty clinic case is like an iceberg, large but not visible on the surface, because the majority of patients from the middle to upper economic class feel ashamed and do not want to bother reporting it, ideally organizing aesthetic beauty clinics is based on applicable laws and regulations. The state must be able to provide legal certainty and protection to aesthetic beauty clinic patients with good regulatory and institutional and risk litigation. Abstract

Beauty Clinic is an outpatient health care facility that provides medical services(consultation, examination, treatment, and medical action) to overcome variousconditions / diseases which relate to person's beauty (aesthetic appearance) that is performed by medical personnel (doctors, dentists, medical specialist, and dentalspecialist) based on their expertise and authority.  However, behind the rapid growth of beauty clinics, there are several negative sides and one of them is when the consumer has already paid costly for beauty products services and beauty services,  the consumer experiences complications in its use which actually worsens the condition of consumer's skin. Moreover, it needs efforts from authorized stakeholders in order to protect legal rights for aesthetic beauty clinic patients. Various methods and motives of violations which are committed lead to mere profit. Furthermore, the research method that was used in this research was legalsocial (non-doctrinal) research method by an interactional (micro) approach with qualitative analysis or qualitative methods.

Abstract

Abstract: Customary law is law formed from various Indonesian characters, most of which are not in the form of written rules. Meanwhile, State Law or National Law is a legal entity that was built to achieve the goals of the State which originates from the philosophy and constitution of the state, in both cases, it contains the goals, foundations, and ideals of the Indonesian state law. Purpose: The purpose of this research is to find out the existence of customary law in state law. Abstract

Background: Setiap pelaku usaha bisnis menempatkan kepentingan bisnis di prioritas utama. Masih ada beberapa aspek lain yang perlu difikir dan diikutsertakan diantaranya aspek hukum dan manajemen khususnya bagi pelaku usaha brem di wilayah Kabupaten Madiun. Tujuan kegiatan ini untuk mengadakan penyuluhan dan pendampingan terkait Pengelolaan Bisnis dan Aspek Legalitas Pada Kelompok UKM Produsen Brem Di Desa Bancong Metode: Pengabdian dilakukan dengan memberikan penyuluhan dan pendampingan berdasarkan yuridis-empiris. Hasil: Aspek hukum dan aspek manajemen sangat penting bagi penyelenggaraan kegiatan bisnis UKM. Aspek hukum pada UKM terkait bentuk badan usaha, perizinan, kekaryawanan atau SDM (sumber daya manusia), perjanjian/kontrak, pertanahan, jaminan kesehatan, permodalan dan kekayaan intelektual seperti merek. Aspek manajemen pada UKM terkait dengan keberadaan tata kelola perusahaan, struktur organisasi, bussiness plan, audit perusahaan, pemasaran, pembukuan, dan pertanggung jawaban/laporan. Abstract

This study aims to discuss a midwife as a health professional, professional ethics in midwifery practices, the management of pregnancy and childbirth complication, and legal rights for nursing mothers. This qualitative research utilizes interview as a main instrument. The data are collected from interviews conducted with: 1.) pregnant women who gave premature birth, 2.) nursing women and families supporting breastfeeding program, and 3.) Public Health Office staffs. The study reveals that legal ethics between midwives and patients is significantly crucial. There is a need for effective communication between midwives and patients. Patients have the right to obtain information as clearly as possible and midwives also have the right to get the trust of patients to perform medical procedures without any interventions. In addition to the aforementioned result, this study reports that there is pregnancy and premature childbirth complication. It is a maternal health issue occurred during pregnancy causing premature birth. This study also highlights a breach of guarantee to nursing mothers who breastfeed up to 2 years of age. The results of study conclude three points. First, it reports informed consent. It is a process for getting permission before conducting a healthcare intervention on a person, or on disclosing personal information. Second, legal practice regulating rights for nursing mothers and its legal sanctions for someone who prohibits breastfeeding for working women or health workers who provide formula milk to newborns without medical indication. Third, the authorized party will conduct an investigative audit of cases of complications of pregnancy and childbirth that cause infant mortality.

Abstract

Perkembangan teknologi berpengaruh pada banyak aspek kehidupan. Harapan dan tantangan generasi milenial ditentukan oleh keberhasilan pembangunan manusia secara struktural dan kultural. Literasi masyarakat menjadi salah satu kunci keberhasilan pencapaian bonus demografi pembangunan manusia. Masyarakat literat dituntut mampu beradaptasi dengan kemajuan teknologi. Kajian ini menggunakan metode deskriptif kualitatif tentang bagaimana format pemberdayaan masyarakat literat di momentum emas revolusi industri 4.0. Empat komponen utama literasi dan pemberdayaan masyarakat yang layak masuk revolusi industri 4.0, yaitu sistem fisik-siber terdesentralisasi untuk pengambilan keputusan, salinan virtual dunia fisik untuk transparansi informasi, kesanggupan dan kemampuan sistem untuk mendukung dan membimbing bantuan teknis, dan sistem komputer (software) yangInteroperability untuk mengubah dan memanfaatkan informasi supaya terkoneksi dan dapat berkomunikasi antara mesin, perangkat, sensor, dan orang.

Abstract

Kondisi kesehatan warga negara Indonesia telah dijamin oleh Konstitusi Negara Indonesia. Jaminan konstitusi tersebut memberikan amanat bahwa negara wajib memberikan layanan publik kepada warganya. Salah satu layanan publik kepada warga negara agar tetap memiliki kondisi kesehatan yang baik adalah melalui kewenangan pelayanan Kesehatan di Rumah Sakit. Upaya peningkatan penyelenggaraan dan kualitas pelayanan kesehatan di UOBK (Unit Organisasi Bersifat Khusus) RSUD (Rumah Sakit Umum Daerah) “Ngudi Waluyo” Wlingi Blitar terus dilakukan sebagai upaya untuk menjaga kesesuaian dengan standar pelayanan rumah sakit, berkaitan dengan ini maka diperlukan adanya produk hukum ataupun kebijakan-kebijakan tentang standar pelayanan  dan teknis penyelenggaraan rumah sakit sebagai landasan penyelenggaraan pelayanan. Tujuan pengabdian kepada masyarakat ini untuk memberikan pemahaman tentang pendampingan pelatihan penyusunan produk hukum dan strategi rumah sakit dan beretika bisnis pada UOBK RSUD “Ngudi Waluyo” Wlingi Blitar. Metode pelaksanaan menggunakan Rapid Rural Appraisal (RRA) untuk mengidentifikasi masalah dan pencarian solusi dengan melibatkan partisipasi aktif UOBK RSUD “Ngudi Waluyo” Wlingi Blitar. Pelaksanaan pengabdian meliputi pendahuluan, pelaksanaan pelatihan, FGD, partisipasi peserta untuk mengidentifikasi masalah dan solusi, hingga evaluasi kegiatan pengabdian beserta keberlanjutannya. Diharapkan selain pemahaman dalam penyusunan produk hukum untuk mewujudkan perlindungan hukum, keadilan, kepastian hukum dan ketertiban hukum serta produk hukum yang beretika bisnis di lingkungan UOBK RSUD “Ngudi Waluyo” Wlingi Blitar, ada kegiatan berkelanjutan berupa penelitian dan pendampingan berkelanjutan
