Abstract

Masa jabatan hakim merupakan salah satu elemen penting dalam independensi kekuasaan kehakiman yang harus dijamin dalam undang-undang. Hakim ad hoc adalah hakim yang menjalankan fungsi kekuasaan kehakiman dan perlu dijamin masa jabatannya dalam undang-undang. Pada kenyataannya, pengaturan masa jabatan hakim ad hoc dalam sistem kekuasaan kehakiman di Indonesia diatur dalam berbagai peraturan perundang-undangan. Tidak hanya bentuk peraturannya yang beragam, model pengaturannya pun beragam, termasuk yang telah diputus melalui putusan Mahkamah Konstitusi Nomor 49/PUU-XIV/2016 dan Putusan Nomor 85/PUU-XVIII/2020. Penelitian tesis ini bertujuan untuk mengetahui bagaimana pengaturan masa jabatan hakim ad hoc dalam sistem kekuasaan kehakiman di Indonesia menurut peraturan perundang-undangan dan putusan Mahkamah Konstitusi. Metode penelitian yang digunakan adalah penelitian hukum normatif yang didasarkan pada sumber-sumber kepustakaan. Hasil dari penelitian ini adalah pengaturan masa jabatan hakim ad hoc, baik dari segi bentuk maupun materi muatan ketentuannya, belum cukup menjamin kepastian hukum dan kesamaan kedudukan di hadapan hukum serta independensi bagi hakim ad hoc, sebagaimana yang telah dikuatkan oleh putusan Mahkamah Konstitusi. Oleh karena itu, perlu adanya penataan kembali masa jabatan hakim ad hoc melalui perubahan atau pembentukan undang-undang yang komprehensif dalam sistem kekuasaan kehakiman yang berlandaskan pada prinsip-prinsip negara hukum, UUD 1945, dan Pancasila.

Abstract

Perlindungan hukum terhadap pemegang saham dalam perseroan terbatas merupakan aspek fundamental dalam menjamin kepastian hukum, keadilan, dan stabilitas ekonomi, terutama ketika direksi melakukan perbuatan melawan hukum yang merugikan kepentingan para pemegang saham. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum yang diberikan kepada pemegang saham terhadap tindakan melawan hukum oleh direksi serta pertimbangan hakim dalam memberikan perlindungan hukum berdasarkan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis deskriptif terhadap peraturan perundang-undangan, doktrin hukum, dan putusan pengadilan, khususnya Putusan Pengadilan Negeri Jakarta Selatan Nomor 80/Pdt.P/2014/PN.Jkt.Sel. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap pemegang saham dapat dilakukan secara preventif melalui pengaturan hukum dan mekanisme pengawasan internal, serta secara represif melalui pemeriksaan oleh pengadilan, gugatan perdata, maupun pelaporan pidana. Pertimbangan hakim dalam memutus perkara tersebut didasarkan pada asas keadilan, kemanfaatan, dan kepastian hukum yang seimbang.

Abstract

This study aims to analyze PKPU in implementing debt restructuring in Decision No. 718/K/ Pdt.Sus-Pailit/2019. jo. No. 4/ Pdt.Sus.Pembatalan Perdamaian/2019/PN.Niaga.Jkt.Pst. jo. No. 23/PKPU/2011/PN.Niaga.Jkt.Pst regarding the judge's consideration in terms of Law No. 37 of 2004 concerning Bankruptcy and PKPU. The research method used is a qualitative method using data collection techniques in the form of literature studies. This research is studied based on Law No. 37 of 2004 concerning Bankruptcy by combining the theory of justice as a Grand Theory. The results of this research are in the form of Judex Jurist considerations that grant the petition of the Applicant for the cancellation of the peace agreement that has been homologated based on Decision No. 23/PKPU/2011/PN.Niaga.Jkt.Pst because the peace agreement dated November 1, 2011, which was homologated by the court, is a decision that is final and legally binding, so it cannot be changed for any reason, let alone changes made outside the court. As well as the PKPU Applicant, PT. Arpeni Pratama Ocean Line, Tbk. has admitted everything argued by the Bankruptcy Applicant, PT. Bank CIMB Niaga, Tbk. especially regarding all substantial requirements of the PKPU Applicant.

Abstract

Workers sometimes encounter differences in calculation with employers regarding the amount of overtime wages they should receive. In such cases, workers tend to leave the resolution of overtime wage discrepancies to labor inspectors. Labor inspectors will examine the implementation of overtime wage payments and issue a determination of the overtime wage amount. Parties who object to this determination may pursue legal remedies in the administrative court. The court's decision on the determination may result in either an acceptance (kabul) decision or a dismissal decision. These differing decisions are intriguing to analyze, as they pertain to the same administrative object but may lead to two different outcomes. The objective of this study is to analyze how labor inspector determinations in disputes over unpaid overtime wages constitute administrative decisions and to examine the legal application in resolving such disputes to provide legal certainty for both employers and workers. This study employs a normative juridical research method analyzed qualitatively. The study concludes that labor inspectors' determinations meet the criteria for administrative decisions. The application of the law through acceptance decisions provides greater legal certainty as it aligns with the fulfillment of administrative dispute criteria under statutory regulations and ensures legal certainty for both employers and workers regarding the payment of unpaid overtime wages.

Abstract

Arsitektur merupakan perwujudan hasil penerapan ilmu pengetahuan, teknologi dan seni secara utuh dalam bentuk ruang dan lingkungan binaan sebagai bagian dari budaya dan peradaban manusia, pemenuhan fungsi, prinsip bangunan dan prinsip estetika serta memasukkan faktor keselamatan, kesehatan, kenyamanan dan kemudahan. Sebagai arsitek profesional yang merancang rencana arsitektur dan sebagai penulis, pencipta suatu karya memiliki hak atas karyanya. Untuk mendefinisikannya, pemilik hak cipta adalah pencipta sendiri sebagai pemilik hak cipta atau orang yang menerima hak pencipta, dan dapat disimpulkan bahwa pencipta karya desain secara otomatis adalah pemilik hak cipta setelah penciptaan dengan prinsip deklaratif. Faktanya adalah pelanggaran gambar online semakin meluas, namun pelaku pelanggaran gambar online selalu terbebas dari tuntutan hukum karena tidak ada aturan khusus tentang pelanggaran gambar online seperti di Indonesia.

Abstract

In 2019, President Joko Widodo announced the plan to relocate Indonesia's capital to East Kalimantan. This project aims to improve regional governance and reflect the nation's identity and unity. With a budget of Rp466 trillion, the project involves various funding schemes. The Nusantara Capital Authority (OIKN) was established to manage the preparation, construction, and relocation of the new capital, as well as to administer the special regional government. This study aims to analyze the legal status of OIKN and the legal implications of its regulations in managing the capital city. Using normative and descriptive legal methods, the study evaluates OIKN's special authority within Indonesia's state administration system and its legal implications. The research reveals that OIKN, established under Law No. 21 of 2023 and Presidential Decree No. 62 of 2022, functions as a special regional government institution under Article 18B of the 1945 Constitution. Although the head of the authority is appointed directly by the president and not elected by the Regional People's Representative Council (DPRD), OIKN has broad powers, including in investment licensing, spatial planning, and development. While this system is expected to expedite development and provide legal certainty, the potential conflicts with regional governments and criticism of relocating the capital from Jakarta to IKN highlight the challenges and complexities of implementing the project, including concerns about budget and legal certainty for investors.

Abstract

The city that contributes to investment in order to improve the national economy is South Tangerang due to the ease of licensing in the city of South Tangerang based on Regional Regulation Number 7 of 2013 concerning the Implementation of Advertisements. Problem: How can ease of advertising licensing increase regional investment in South Tangerang City? What are the obstacles to increasing regional investment through ease of licensing in South Tangerang City based on Regional Regulation Number 7 of 2013 concerning the Implementation of Advertisements? Normative legal research research methods. In conclusion, regional investment in the context of facilitating licensing in the city of South Tangerang based on Regional Regulation Number 7 of 2013 concerning the Implementation of Advertisements is one of the policy focuses for improving the investment climate in Indonesia. The development of One Stop Integrated Services (PTSP) has become the government's agenda for registration and establishment of business sectors. The licensing bureaucracy is one of the obstacles to the development of the world of business in Tangierang Sielatan City. Many of the licensing processes that are currently available have various aspects of process, problems, non-transparency, unplanned timing and high costs that must be paid.

Abstract

Medical negligence is a doctor's failure to provide a standard of care that results in harm to the patient. The difference in the concept of negligence in the Criminal Code and the lex specialist Law No.17 of 2023 is in the legal standing of the basis for proving medical negligence. Articles 359 and 360 of the Criminal Code do not involve PPK. In Article 280 paragraph (2) jo Article 291 paragraph (1) of Law No.17 of 2023, it is explained that to avoid impacts that can harm medical personnel and hospitals, services must be carried out as a form of best effort, which is by norms, service standards, professional standards, and patient needs. Proof of whether or not the doctor commits negligence must be present in the PPK and medical records. In many criminal and civil cases in court in terms of evidence, the judge has ruled out PPK as evidence of letters. The research method in this research uses juridical-normative research. The results of the research are the requirements for proving medical negligence according to Law No.17 of 2023, which must fulfill legal obligations, violations of obligations, injuries, and causality. Proof of medical negligence in hospitals can use PPK as evidence if it fulfills the formal and material legal requirements. The formal requirement is if the PPK is by the legislation. The material requirement is if the PPK is prepared according to science, namely the National Guidelines for Medical Services (PNPK).

Abstract

Seafarers are a crucial profession in the maritime sector with great responsibility for the crew, passengers, and cargo cargo. Crew members face high risks that require prevention to minimize danger. Especially for fishing boat crews, occupational risks are very high, so special attention is needed regarding job characteristics, safety and relevant competencies. Fisheries workers, as universally recognized owners of human rights, need special legal protection for their rights and decent working conditions. This research focuses on the legal relationship between fishery crew members and companies, as well as wage regulation in Indonesia. The research method used is normative juridical, which examines legal products such as laws. The implementation of wage regulations is subject to change, so it is important to obtain accurate information from official sources. The legal structure and quality of legal substance must be well organized, but the success of implementation depends on the involvement of all parties in the legal system and a supportive legal culture. Adopting these suggestions can create a more transparent, fair, and effective working environment for fisheries crews in Indonesia. ABSTRAKPelaut adalah profesi krusial dalam sektor maritim dengan tanggung jawab besar terhadap awak kapal, penumpang, dan muatan barang. Anak Buah Kapal (ABK) menghadapi risiko tinggi yang memerlukan pencegahan untuk meminimalisir bahaya. Terutama bagi awak kapal penangkap ikan, risiko pekerjaan sangat tinggi, sehingga perhatian khusus diperlukan terkait karakteristik pekerjaan, keselamatan, dan kompetensi yang relevan. Pekerja perikanan, sebagai pemilik hak asasi manusia yang diakui secara universal, memerlukan perlindungan hukum khusus untuk hak dan kondisi kerja yang layak. Penelitian ini berfokus pada hubungan hukum antara ABK perikanan dan perusahaan, serta pengaturan pengupahan di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif, yang mengkaji produk hukum seperti undang-undang. Implementasi peraturan pengupahan dapat mengalami perubahan, sehingga penting untuk mendapatkan informasi akurat dari sumber resmi. Struktur hukum dan kualitas substansi hukum harus ditata dengan baik, namun keberhasilan implementasi bergantung pada keterlibatan semua pihak dalam sistem hukum dan budaya hukum yang mendukung. Mengadopsi saran-saran ini dapat menciptakan lingkungan kerja yang lebih transparan, adil, dan efektif bagi ABK perikanan di Indonesia.
