Abstract

Partners in this community service are Blumbungan village community, Larangan District, Pamekasan Regency, East Java. Socio-economic and cultural conditions of the community as well as the activities of the Blumbungan village community are heavily influenced by socio-religious activities, including the existence of youth organizations, mosque youth, “PKK”, recitation groups, farmer groups, and the development of small/home industries (cassava chips, making cigarettes, furniture, pillar making, tofu production). The existence of this small/household industry has positive impact on increasing the income of the Blumbungan community, although there are still obstacles in practice. The problems that have been inventoried, include: (1) Lack of understanding of legal aspects in business management, (2) Lack of knowledge about marketing methods and product packaging, (3) Lack of access to capital business for WUB (New Entrepreneurs), and (4) The direction and development of Village-Owned Enterprises has not yet been determined. The method of the activities includes preparation, counselling, mentoring, and evaluation. The results and conclusions of this community service activity are: (1) Increasing knowledge of the legal basis, function, and role of BUMDes for partners, as evidenced by the results of the distributed questionnaires. (2) Village regulations regarding BUMDes, AD-ART, and the Roadmap of BUMDES Blumbungan Sejahtera are important components in the development of BUMDes. So it must be completed as part of the output in this assistance. (3) In addition to regulations, product development to be managed by BUMDes is also important. In the next mentoring, it will be focused on developing packaging systems and promoting typical Village products both offline and online. (4) With the strengthening of BUMDes as legal entities as regulated in the Village Law after the Employment Creation Law and PP BUMDes, it is easier for BUMDes to gain access to capital.

Abstract

This study aims to determine the effect of the work environment and stress at work on employees' work productivity in a company. Illustrate for the community in general and the company, and several factors can cause the increase and decrease in work productivity. This study uses quantitative research with exploratory, descriptive data presentation by taking a sample at a university in East Java. With multiple linear regression techniques can be seen the relationship that occurs to these problems. The results of this study indicate that the Work Environment (X1) and Stress at Work (X2) influence Work Productivity (Y). This research also includes suggestions for improvement to increase work productivity

Abstract

This article aims to explain and analyze the implementation of tax monitoring system to local tax collection in Sidoarjo Regency. The electronic collection of local taxes is a strategy utilized by Sidoarjo Regency to enhance efficiency, effectiveness, and transparency in collecting local taxes, one of them is Tax Monitoring System. This writing reviews the benefits and impacts of the implementation adopted by the local government in implementing tax monitoring system, the advantages of it, and the resulting effects on the local tax revenue of Sidoarjo Regency. Highlights : Enhanced Efficiency: The Tax Monitoring System in Sidoarjo Regency streamlines tax collection processes, reducing manual efforts and expediting transactions. Increased Transparency: This system promotes accountability and transparency in local tax operations, building trust among taxpayers. Revenue Impact: The implementation of the Tax Monitoring System has positively influenced the local tax revenue, indicating improved compliance and collection rates. Abstract

The Constitutional Court of Indonesia has held the followers of the indigenous religion (the Penghayat) can have their own religious identity on their identity card (ID) in 2016. The 1945 Constitution of Indonesia mentions a non-discriminatory principle which has been applied by the Constitutional Court to this case. However, the implementation of the Constitutional Court decision will face challenges and opportunities on the field. The author has used of both normative and empirical methodology by providing related legal information and the result of the interview with the local leader of the indigenous religion as sources of analysing the issues. As the result of the research shows the following challenges for the implementation of the Constitutional Court decision ; a. unification of the laws, b. lack of affirmative action for the followers of the indigenous religions, c. Lack of the updated and integrated administrative data base of the citizens with the Constitutional Court decision, d. religiously and ethnically based politics effecting the decision of public officials to accommodate public services for the followers of the indigenous religions while the following opportunities of the implementation of the Constitution Court decision are the constitutional recognition and protection of the indigenous community, the existence of the National Ombudsman Commission, the rule law principle in the 1945 Constitution, final and legally binding status of the Constitutional Court decision.

Abstract

Law and morals are related as an ideal value in the formation of law, because morals are considered universal values "‹"‹that should ideally characterize every legal formation, with the hope that morality in the law can produce good behavior for legal subjects and objects. These morals and laws are in our administrative law, in this case the executive. The problem that is difficult to solve is the problem of corruption, where the act is legally and morally not good or wrong. Anti-corruption regulations are in place and the establishment of the Corruption Eradication Commission reveals that the problem of corruption in our country is not resolved and is even more systematic. Ideally, with the advancement of civilization and the strengthening of moral values "‹"‹as the basis for rules, corruption will decrease to its lowest point from year to year as a government develops. Then, if this law represents a moral value, then the court decision, which is the law, can also contain moral values. As an example also regarding court decisions by state administration officials that are not implemented voluntarily, this can be equated with blatant disobedience to the law making state administration officials arrogant.   Normative juridical analysis used in research includes legal and regulatory theory. Therefore, in order to achieve conformity regarding the morals and behavior of state officials in carrying out their duties, there is a close connection between the bad morals of state officials and behavior that violates the law. The good morals of state officials will make the behavior of state officials high and far from breaking the law.

Abstract

Keberlakuan UU No. 6 Tahun 2023 tentang Penetapan Perpu Cipta Kerja memberikan dampak yang signifikan terhadap eksistensi BUMDes. Pengaturan lebih lanjut tentang BUMDes diatur dalam PP No. 11 Tahun 2021 tentang Badan Usaha Milik Desa yang mewajibkan BUMDes melakukan beberapa penyesuaian. Untuk mengoptimalisasi fungsi BUMDes, Desa Taro telah memiliki BUMDes bernama Sarwada Amerta yang memiliki beberapa unit usaha dibawahnya. Pada perkembangannya, BUMDes ini telah melakukan beberapa upaya penyesuaian pasca keberlakuan beberapa peraturan terbaru, namun berdasarkan hasil dari kegiatan Pengabdian Masyarakat yang telah dilakukan masih terdapat beberapa kekurangan. Metode yang digunakan adalah yuridis dan empiris dengan pendekatan sosiolegal dan partisipatif. Hasil yang diperoleh adalah masih ditemukan beberapa hal yang belum optimal untuk dapat mengembangkan BUMDes lebih jauh seperti pemanfaatan perkembangan teknologi, kesesuaian pada sektor perijinan, kemudian pada aspek peraturan yang dibuat oleh Pemerintah Desa, serta pada sektor promosi yang belum masif. Dalam kegiatan Pengabdian Masyarakat yang telah dilakukan, ada beberapa rekomendasi untuk BUMDes Sarwada Amerta yang berpotensi dapat lebih meningkatkan kiprah BUMDes lebih jauh lagi seperti pemanfaatan teknologi dalam hal promosi, penjualan, serta penyesuaian rancangan kontrak dan regulasi baik untuk kesesuaian peraturan dan prinsip keseimbangan, serta kesesuaian pada aspek leglitas dan perijinan.

Abstract

Pasal 25A Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 pada penambahan afiks “yang berciri nusantara” memberikan derivasi terhadap konsep negara kepulauan sebagaimana diatur dalam United Nations Conventions on The Law of The Sea Tahun 1982, bahwa ada ciri khusus bagi Indonesia dalam memaknai konsep negara kepulauan. Untuk membahas hal tersebut, penelitian ini menggunakan metode penelitian hukum dengan pendekatan perundang-undangan, pendekatan konsep, dan pendekatan sejarah. Hasil penelitian ini menunjukkan bahwa ratio legis derivasi konsep negara kepulauan dalam konstitusi Indonesia pada amandemen kedua sebagai penguatan kedaulatan negara dalam pembangunan wilayahnya harus berciri nusantara. Founding constitution sejak awal perumusan, menyatakan bahwa wilayah Indonesia memiliki ciri khusus, hal tersebut juga menjadi dasar logis deklarasi Juanda bahwa Indonesia adalah negara kepulauan. Maka, akibat hukum pembangunan wilayah yang tidak didasarkan atas ketentuan konstitusi, khususnya politik hukum negara kepulauan yang berciri nusantara, memiliki potensi inkonstitusional. Kerangka hukum Negara Kesatuan Republik Indonesia adalah negara kepulauan yang berciri nusantara.

Abstract

This article aims to establish a better institutional system for the national financial audit as part of the government's efforts to create a clean state free from financial abuse and corruption. Normatively, the Supreme Audit Agency (BPK) plays a crucial role based on Article 23 paragraph (5) of the 1945 Constitution. However, its singular existence changed after the formation of the Audit Board of the Republic of Indonesia (BPKP) through Presidential Regulation Number 192 of 2014, which became part of the Government Internal Supervisory Apparatus. From these normative issues arose a controversial case involving land procurement for a Palm Oil Plantation in Southwest Aceh, resulting in a dualistic determination of state losses between BPK and BPKP. The novelty of this article, compared to existing ones, lies in its reinforced analysis through comparisons with financial supervisory institutions in Japan (Board of Audit), the United States (GAO), and Australia (ANAO). The research employs a normative legal research method to examine principles and norms in positive law. It utilizes statutory, conceptual, and comparative approaches. In the context of financial oversight in Indonesia, both external and internal supervisory institutions, such as BPK and BPKP, play a vital role in ensuring efficiency, transparency, and accountability in financial management. Despite differences in regulatory foundations, appointment systems, and follow-up mechanisms among BPK, the Board of Audit, GAO, and ANAO, all of them have important roles in ensuring proper financial management. Additionally, the article proposes an alternative model for appointing members of the Republic of Indonesia Financial Audit Board (BPKRI) based on the experience of the U.S. GAO. This mechanism includes forming a commission comprising legislative, executive, and academic representatives to recommend BPK member candidates, aiming to enhance the independence of financial supervisory institutions in Indonesia

Abstract

Participation from the general public is an essential component that must be taken into account during the legislative process. It is essential to the operation of laws in a country and includes the participation of society in the legislative process. This is particularly important in terms of the rule of law, the hierarchy of legal norms, and the operation of the law in its entirety. The purpose of this research is to evaluate the significance of public participation in the legislative process in Indonesia as well as the potential repercussions of excluding this procedure from the legislative process. For the purpose of carrying out this research, normative legal research that takes both a statutory and conceptual strategy was utilized. According to the findings, public participation offers a variety of possibilities for involvement, in accordance with the requirements of Article 96 of Law Number 11 of 2012 on the Formation of Regulations (UU P3). Due to this, the importance of public participation cannot be overstated, despite the restricted channels through which members of the public can communicate their thoughts and goals.
