Abstract

This study aims to determine the effect of the work environment and stress at work on employees' work productivity in a company. Illustrate for the community in general and the company, and several factors can cause the increase and decrease in work productivity. This study uses quantitative research with exploratory, descriptive data presentation by taking a sample at a university in East Java. With multiple linear regression techniques can be seen the relationship that occurs to these problems. The results of this study indicate that the Work Environment (X1) and Stress at Work (X2) influence Work Productivity (Y). This research also includes suggestions for improvement to increase work productivity

Abstract

This article aims to establish a better institutional system for the national financial audit as part of the government's efforts to create a clean state free from financial abuse and corruption. Normatively, the Supreme Audit Agency (BPK) plays a crucial role based on Article 23 paragraph (5) of the 1945 Constitution. However, its singular existence changed after the formation of the Audit Board of the Republic of Indonesia (BPKP) through Presidential Regulation Number 192 of 2014, which became part of the Government Internal Supervisory Apparatus. From these normative issues arose a controversial case involving land procurement for a Palm Oil Plantation in Southwest Aceh, resulting in a dualistic determination of state losses between BPK and BPKP. The novelty of this article, compared to existing ones, lies in its reinforced analysis through comparisons with financial supervisory institutions in Japan (Board of Audit), the United States (GAO), and Australia (ANAO). The research employs a normative legal research method to examine principles and norms in positive law. It utilizes statutory, conceptual, and comparative approaches. In the context of financial oversight in Indonesia, both external and internal supervisory institutions, such as BPK and BPKP, play a vital role in ensuring efficiency, transparency, and accountability in financial management. Despite differences in regulatory foundations, appointment systems, and follow-up mechanisms among BPK, the Board of Audit, GAO, and ANAO, all of them have important roles in ensuring proper financial management. Additionally, the article proposes an alternative model for appointing members of the Republic of Indonesia Financial Audit Board (BPKRI) based on the experience of the U.S. GAO. This mechanism includes forming a commission comprising legislative, executive, and academic representatives to recommend BPK member candidates, aiming to enhance the independence of financial supervisory institutions in Indonesia

Abstract

Participation from the general public is an essential component that must be taken into account during the legislative process. It is essential to the operation of laws in a country and includes the participation of society in the legislative process. This is particularly important in terms of the rule of law, the hierarchy of legal norms, and the operation of the law in its entirety. The purpose of this research is to evaluate the significance of public participation in the legislative process in Indonesia as well as the potential repercussions of excluding this procedure from the legislative process. For the purpose of carrying out this research, normative legal research that takes both a statutory and conceptual strategy was utilized. According to the findings, public participation offers a variety of possibilities for involvement, in accordance with the requirements of Article 96 of Law Number 11 of 2012 on the Formation of Regulations (UU P3). Due to this, the importance of public participation cannot be overstated, despite the restricted channels through which members of the public can communicate their thoughts and goals.

Abstract

Abstract Habermas’s theory of communicative action is highly relevant as a philosophical foundation for upholding human rights, emphasizing the intrinsic value of each individual, which must not be eliminated by any power. This is supported by Article 6 paragraph (1) of the International Covenant on Civil and Political Rights, ratified as Law Number 12 of 2005. Critical theory, a school of philosophy, focuses on liberating human knowledge from transcendental and empirical oppression, critiquing ideologies that perpetuate social oppression. Human rights have become a dynamic issue in Indonesia, especially during the Presidential Election, with widespread discussions at national and international levels. Countries, organizations, and individuals are increasingly voicing concerns about human rights issues. These problems are complex, particularly in resolving and sanctioning perpetrators, leading some to view human rights as “merely theoretical.” Applying critical theory is crucial in this context, as perfected by Jürgen Habermas. This research employs normative methods, including statutory, conceptual, and case approaches. It concludes that Jürgen Habermas’s theory of communicative action and John Locke’s natural law are similar, emphasizing the inherent meaning of external rights. This grounding makes Habermas’s theory important for upholding law and human rights internationally, although its implementation remains ambiguous. Abstrak Teori kritis tindakan komunikatif Habermas sangat relevan sebagai fondasi filosofis penegakan HAM yang menekankan nilai intrinsik setiap individu, yang tidak boleh dihilangkan oleh kekuasaan mana pun, sesuai dengan Pasal 6 ayat (1) International Covenant on Civil and Political Rights yang diratifikasi menjadi Undang-Undang Nomor 12 Tahun 2005. Teori kritis adalah aliran filsafat tentang pembebasan pengetahuan manusia dari segala bentuk penindasan transendental dan empiris. Ide teori kritis adalah kritik terhadap ideologi yang bertujuanmenyadarkan manusia akan penindasan sosial dan mencoba membebaskannya. Isu HAM menjadi perbincangan dinamis di Indonesia, terutama pada saat pemilihan presiden, serta di dunia internasional. Berbagai negara, organisasi, dan individu menyuarakan sudut pandang HAM yang ada. Problematika HAM sulit diselesaikan dan penerapan sanksi bagi pelaku sering dianggap “teorik belaka.” Penerapan teori tindakan komunikatif ini penting terkait HAM karena disempurnakan oleh Jürgen Habermas. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan adanya kesamaan konsep antara teori kritis Jürgen Habermas dan aliran hukum kodrat John Locke, yang menekankan hak-hak lahiriah. Teori Jürgen Habermas menjadi penting untuk penegakan hukum dan HAM di dunia internasional, meskipun penerapannya masih ambigu.

Abstract

General Election Contestation (Election) is one indicator of the implementation of the ideals of a democratic country. A democratic state certainly cannot be separated from the ideal of the rule of law, because in fact the state of law and democracy go together. This is because a state administration must be based on applicable law, and the law is implemented as much as possible for the community. In order to support the implementation of the rule of law in accordance with the wishes of the people, the concept of democracy is a concept that is no less important. In the context of statehood, it is appropriate for the voice of the people to be represented by representatives of the people in parliament, both central and regional. The people's representatives are elected through elections by stating the conditions that must be met. However, the conditions listed seem inconsistent and there are even aggrieved parties so that they do not show legal certainty. The purpose of this study is to see aspects of legal certainty regarding the requirements for ex-prisoner who want to run in election contestations, especially the selection of individual candidates for DPD members. The method used in this research is juridical-normative legal research or commonly called doctrinal legal research with statute approach and conceptual approach. The results showed that the requirements for ex-prisoner who wanted to run in the election contestation had changed several times as a result of material tests in the Constitutional Court. The change in requirements is the result of an inconsistent change in attitude by the Constitutional Court towards the existence of ex-prisoner requirements when they want to run in election contestations, including the selection of individual candidates for DPD members.

Abstract

Pembentukan peraturan daerah yang semakin hari semakin bertambah memerlukan kontrol dari pemerintah untuk menghindari terjadinya disharmoni peraturan perundang-undangan. Kontrol tersebut dilakukan dengan metode pengawasan preventif melalui pengharmonisasian rancangan peraturan daerah. Namun pelaksanaan pengharmonisasian mengalami dualisme kewenangan, yakni harmonisasi oleh Kemenkumham dan fasilitasi oleh Kemendagri. Penelitian ini menggunakan penelitian normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Hasil penelitian ini menunjukkan bahwa pergeseran kewenangan pengharmonisasian kepada Kemenkumham merupakan kebijakan yang sentralistik namun bertujuan untuk meningkatkan efektivitas penataan regulasi di daerah. Peran pembinaan dan pengawasan Kemendagri terhadap pemerintah tidak dapat diabaikan sepenuhnya sehingga perlu mengakomodir kepentingan pengawasan kemendagri terhadap pembentukan peraturan daerah. Untuk itu pemerintah harus mengatur pelaksanaan pengharmonisasian secara kolaboratif antara Kemenkumhan dan Kemendagri, sehingga pelaksanaan pengawasan preventif peraturan daerah dapat berjalan optimal dan tidak dilaksanakan dalam dua metode yang berbeda.

Abstract

Dualisme pemerintahan desa, desa adat dan desa dinas di Bali menjadi salah satu keunikan tatanan pemerintahan desa di Indonesia. Perkembangan jaman dan teknologi mendatangkan keuntungan secara ekonomi baik untuk Desa Adat maupun desa dinas. Namun disatu sisi dapat mempengaruhi tatanan sosial dan budaya masyarakat di kedua desa tersebut. Kearifan lokal yang menjadi ciri khas Masyarakat adat menjadi kewajiban bagi desa dinas dan desa adat untuk melindungi, mengelola, dan menjaga kearifan lokal. Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Pasal 18B ayat (2) menjadi landasan melindungi kearifan lokal yang memiliki urgensi untuk menjaga dan mempertahankan nilai-nilai budaya serta tradisi yang hidup di Desa Taro, Gianyar, Bali. Perlindungan kearifan lokal terkait dengan aspek adaptasi, yang meliputi upaya pengembangan tradisi budaya dan adat istiadat untuk kegiatan yang lebih sesuai dengan kebutuhan masa kini dengan melakukan perubahan terbatas yang tidak akan mengakibatkan kemerosotan nilai pentingnya atau tanpa mengobarkan keasliannya. Maka dari itu perlu di bentuknya peraturan desa yang berkaitan dengan Nilai Lokal di Desa Taro. Artikel ini membahas perlunya sebuah peraturan mengenai perlindungan kearifan lokal di Desa Taro. Dalam membahas isu utama pada artikel ini digunakan pendekatan legal empiris yang melihat peraturan perundang-undangan mengenai perlindungan kearifan lokal dengan merelevansikan pada data-data empiris mengenai nilai-nilai budaya dan kearifan lokal yang hidup dan ada di desa Taro. Artikel ini berkesimpulan ada beberapa alasan urgensi perlunya pengaturan mengenai perlindungan kearifan lokal dalam bentuk peraturan desa di Desa Taro. Abstract The Urgency of Village Regulation on Local Wisdom Values in Taro Village, Tenggallang, Gianyar, BaliThe dualism of village governance; the customary villages and the official villages in Bali is one of the unique governance in Indonesia. The development of time and technology brings economic benefits to both the traditional and the official villages. But on the one hand, it can affect the social and cultural order of the people in both villages. Local wisdom that characterizes indigenous peoples is an obligation for official villages and customary villages to protect, manage, and maintain local wisdom. The 1945 Constitution of the Republic of Indonesia Article 18B paragraph (2) is the basis for protecting the local wisdom that has the urgency to maintain and protect cultural values and traditions that live in Taro Village, Gianyar, Bali. The protection of local wisdom is related to the aspect of adaptation, which includes efforts to develop cultural traditions and customs for traditional activities. Therefore, it is necessary to form a village regulation relating to Local Values in Taro Village. This article discusses the need for a regulation making regarding the protection of local wisdom in Taro Village. In discussing the main issue in this article, an empirical legal approach is used by looking at the legislation on the protection of local wisdom, thus, by revealing empirical data on cultural values and local wisdom that live and exist in Taro village. This article concludes that there are several reasons for an urgency of the need to regulate the protection of local wisdom in the form of village regulations in Taro Village.

Abstract

Cultural heritage is a fundamental asset in promoting cultural diversity and facilitating access to education, social values, science, technology, and tourism. Museums play a pivotal role in preserving cultural heritage and fulfilling constitutional obligations, as enshrined in the Indonesian Constitution. Protecting cultural heritage is essential for maintaining national identity and upholding citizens' constitutional rights, particularly in education and cultural participation. This study analyses the constitutional framework and government policies related to cultural heritage protection, with a specific focus on museums in Indonesia. Employing a statute-based and comparative approach, the research examines constitutional provisions such as Article 18B(1) of the Indonesian Constitution, which mandates the state’s responsibility to preserve cultural heritage and safeguard indigenous communities' rights. Despite this constitutional obligation, challenges such as limited financial resources, inadequate maintenance, and institutional constraints hinder the effective operation of museums. The findings emphasize that strengthening museums is not only necessary for heritage conservation but also for fostering national and local values that define Indonesia’s constitutional identity. The study argues that the government must implement more comprehensive policies and allocate sufficient resources to enhance museums’ role in cultural preservation, ensuring their sustained contribution to public welfare and national development.

Abstract

Excise is state income that is not included in the tax bracket. Excise on tobacco products is part of excisable goods. Determination of excise rates for tobacco products is determined in Law No. 39 of 2007 in addition to further Minister Finance of Regulation 191/PMK.010/2022 governs this. When determining the excise rates tobacco on products, issues arise with respect to things like the steadily rising tax excise rates on tobacco products, the relationship between the vertical excise tax regulations on tobacco products and the effects of the steadily rising tobacco product excise rates on the emergence of illicit cigarettes. The purpose of this study is to investigate issues with tobacco product excise in order to reduce the spread of illicit cigarettes, which cause losses for the state. A conceptual, statutory, and normative legal approach are all combined in the study technique. The Ministry of Finance's examination of its fiscal strategy, which takes into account a number of criteria, is the basis for the causes driving up tax rates on tobacco goods. The legislation governing tobacco product excise tax rates and the guidelines set forth by the minister of finance are irreconcilable. There is no denying that the effects of tobacco product excise taxes contribute to the distribution of illicit cigarettes.
