Abstract

Proyek food estate merupakan bagian dari Proyek Strategis Nasional yang digagas oleh pemerintah untuk mewujudkan ketahanan dan swasembada pangan nasional dengan menggunakan pemanfaatan kawasan hutan sebagai lahan pertanian skala besar. Dalam pelaksanaannya proyek food estate menghadapi beberapa tantangan terutama dibidang lingkungan hidup seperti alih fungsi kawasan hutan, konflik lahan, deforestasi dan degradasi tanah, kegagalan produksi, mangkraknya lahan pertanian serta disharmoni peraturan perundang-undangan sebagai landasan hukum juga menjadi tantangan serius dalam penyelenggaran proyek food estate. Adapun penelitian ini bertujuan untuk mengetahui urgensi dan tantangan pelaksanaan proyek food estate, menganalisa asas tanggung jawab negara dalam pengelolaan sumber daya alam yang dilakukan oleh pemerintah serta tanggung jawaban pemerintah terkait kerusakan lingkungan oleh proyek food estate. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif, dengan pendekatan undang-undang dan pendekatan konseptual untuk mengkaji hubungan antara regulasi dan prinsip-prinsip hukum yang relevan. Diharapkan pada perkembangan selanjutnya penelitian ini dapat memberikan sumbangsih wawasan bagi pemerintah dalam menentukan kebijakan terkait pemanfaatan sumber daya alam agar sesuai dengan prinsip-prinsip pengelolaan dan pemeliharaan lingkungan hidup yang berkelanjutan serta mengedepankan keadilan ekologis sehingga dapat tercipta keseimbangan antara kebutuhan ketahanam dan swasembada pangan dengan kelestarian lingkungan hidup.

Abstract

Excise is state income that is not included in the tax bracket. Excise on tobacco products is part of excisable goods. Determination of excise rates for tobacco products is determined in Law No. 39 of 2007 in addition to further Minister Finance of Regulation 191/PMK.010/2022 governs this. When determining the excise rates tobacco on products, issues arise with respect to things like the steadily rising tax excise rates on tobacco products, the relationship between the vertical excise tax regulations on tobacco products and the effects of the steadily rising tobacco product excise rates on the emergence of illicit cigarettes. The purpose of this study is to investigate issues with tobacco product excise in order to reduce the spread of illicit cigarettes, which cause losses for the state. A conceptual, statutory, and normative legal approach are all combined in the study technique. The Ministry of Finance's examination of its fiscal strategy, which takes into account a number of criteria, is the basis for the causes driving up tax rates on tobacco goods. The legislation governing tobacco product excise tax rates and the guidelines set forth by the minister of finance are irreconcilable. There is no denying that the effects of tobacco product excise taxes contribute to the distribution of illicit cigarettes.

Abstract

General Background: Regional elections play a crucial role in democratic governance, ensuring public participation in leadership selection. However, fair electoral competition is often challenged by the undue advantage of incumbent candidates. Specific Background: Indonesia’s Law No. 10 of 2016 permits incumbent regional heads to take a leave of absence during elections rather than resigning, raising concerns about potential abuse of power. Knowledge Gap: While existing studies discuss election regulations, limited research has specifically examined the urgency of mandatory resignation for incumbents seeking re-election. Aims: This study evaluates the fairness of incumbent candidacy requirements and proposes legal reforms to prevent electoral manipulation. Results: The analysis reveals that the leave requirement is insufficient to prevent conflicts of interest, as incumbents retain influence over state resources, policies, and personnel. Comparative legal frameworks from other countries suggest that a resignation mandate can enhance electoral integrity. Novelty: This research uniquely emphasizes the necessity of reconstructing candidacy rules to include mandatory resignation, drawing on constitutional principles of fairness and equality. Implications: The findings advocate for legislative amendments to establish a resignation requirement for incumbents, thereby strengthening democratic processes and ensuring a more equitable electoral system. Highlights: Incumbent Advantage: Allowing leave instead of resignation enables unfair use of state resources. Legal Reform Needed: Mandatory resignation ensures equal competition in elections. Abstract

Emergency laws are often enacted by the President to address urgent situations and safeguard public welfare. Still, it risks fundamental rights and the rule of law without proper scrutiny.  This research is addressed to analyse the tendency of judicial independence of the Constitutional Court in conducting a review over a Government Regulation in Lieu of Law (Perppu), especially based on Court Decision Number 138/PUU-VII/2009. This article is important because it addresses the critical issue of judicial independence in the context of emergency laws, which can have significant implications for fundamental rights and the rule of law. This research is a doctrinal research  with focus on analyzing constitutional and statutory provisions, legal principles, case law and also comparative approach. Subsequently, data collection techniques were employed utilizing a document study, then analyze qualitatively. The findings of this research is that the enactment of emergency law turns into a double challenge for judges to decide the case, particularly when the judges are appointed by the President. Moreover, judicial review on emergency law shows the more tension between executive power and judicial oversight compared to  judicial review of legislation. This helps deepen the understanding of how courts balance constitutional principles during emergencies and provides valuable insights for other jurisdictions facing similar challenges.

Abstract

This study analyzes the normative conflicts surrounding the regulation of land rights duration in Indonesia’s Capital City and the legal implications of the land rights cycle in its development. The research focuses on the implementation of Presidential Regulation Number 75 of 2024 and Government Regulation Number 29 of 2024, which amends Government Regulation Number 12 of 2023. Employing a normative method, the study reveals that inconsistencies arise between the general principles of the Basic Agrarian Law (UUPA) and the more specific provisions applicable to the Capital City. The newly introduced government regulation substantially extends the durations for the Right to Cultivate (HGU), Right to Build (HGB), and Right to Use, departing from UUPA’s more restrictive agrarian policies. This discrepancy creates legal uncertainty for investors and land users, underlining the urgent need for regulatory harmonization to maintain legal coherence and stability. Moreover, the policy allowing land control for up to two cycles may lead to monopolization and exacerbate social inequality due to the prolonged periods of HGU and HGB. The regulation also broadens foreign investor access to land in the Capital City, potentially clashing with UUPA’s principles of social justice and national sovereignty. To safeguard public interest, prevent legal ambiguity, and ensure equitable land governance, it is essential to align these new regulations with the foundational values of the UUPA. The government must provide a clear and accurate interpretation of these provisions and enforce limitations on land ownership by individuals and legal entities to prevent misuse and protect national interests.

Abstract

BUMDes menjadi salah satu lembaga yang dapat dikembangkan sebagai basis perekonomian desa dan berkontribusi dalam meningkatkan standar hidup masyarakatnya. BUMDes seyogyanya perlu mempertimbangkan kebutuhan dan dapat menemukan solusi terhadap tantangan pengelolaan serta pemanfaatan potensi lokal desa agar semakin optimal. Dalam konteks kegiatan PkM Prodi MSHP Sekolah Pascasarjana Universitas Airlangga yang bermitra dengan BUMDes Gampeng Kabupaten Nganjuk Provinsi Jawa Timur; kolaborasi ini ingin mengoptimalkan pemanfaatan potensi lokal dan merumuskan strategi dalam menghadapi tantangan pengelolaan BUMDes yang belum terakomodasi ketika kegiatan ini berlangsung. Dengan aktivitas wawancara, survei, dan observasi ingin menggali potensi lokal desa dan menemukenali masalah pengelolaan BUMDes; lalu dilakukan penyuluhan dan diskusi bersama pengurus, perangkat desa, dan stakeholder. Hasil kegiatan menunjukkan pentingnya BUMDes agar semakin berkontribusi pada pembangunan desa dan mensejahterakan warganya. Bentuk strategi optimalisasi pengelolaan BUMDes diantaranya: peningkatan peran lumbung desa yang tidak hanya sebagai penyedia pangan pokok desa tapi juga memberikan manfaat ekonomi bagi warga, perluasan kerjasama dengan pihak eksternal agar membuka potensi usaha lain seperti pembayaran layanan pajak, penguatan dan diversifikasi unit usaha, penambahan keterlibatan lembaga keuangan pemberi pinjaman bagi petani, pembangunan wisata religi yang lengkap, peningkatan nilai tambah produk desa (pisang, singkong, bawang merah, cabai, tempe berbungkus daun jati), dan promosi kuliner lokal (asem-asem kambing). Kedepan, kegiatan pengabdian masyarakat ini dapat menjadi bentuk kerjasama dan kolaborasi dengan Universitas untuk mengembangkan BUMDes.

Abstract

Indonesia menganut sistem negara kesatuan yang memberikan kewenangan otonomi kepada pemerintah daerah, salah satunya membentuk peraturan daerah, dengan tetap menjaga keselarasan dengan aturan pada pemerintah pusat. Dalam pembentukan peraturan daerah provinsi, terdapat dua mekanisme pengawasan secara preventif yaitu mekanisme harmonisasi oleh Kementerian Hukum dan mekanisme fasilitasi oleh Kementerian Dalam Negeri. Namun dalam praktiknya, sering terjadi perbedaan hasil antara proses harmonisasi dan fasilitasi yang dilakukan oleh institusi yang berbeda dan pada waktu yang tidak bersamaan, sehingga berpotensi menciptakan ketidakpastian hukum. Penelitian ini bertujuan untuk menganalisis kedudukan dan implikasi hukum dari hasil harmonisasi yang dilakukan oleh Kementerian Hukum terhadap proses pembentukan peraturan daerah provinsi. Dengan menggunakan pendekatan perundang-undangan, konseptual, dan kasus, dalam penelitian ini ditemukan bahwa hasil dari harmonisasi Kementerian Hukum bersifat rekomendatif dan tidak mengikat, yang berdampak pada inefisiensi proses pembentukan peraturan daerah provinsi dan menghambat percepatan pembangunan di daerah.

Abstract

Pelanggaran terhadap Pedoman Kode Etik oleh Aparatur Sipil Negara (ASN) merupakan isu serius yang berpotensi merugikan negara dan masyarakat. ASN yang bertindak sebagai whistleblower memainkan peran penting dalam menjaga transparansi dan integritas birokrasi. Namun, ketakutan terhadap ancaman pembalasan, pemecatan, atau intimidasi sering kali menghambat keberanian ASN untuk melaporkan pelanggaran tersebut. Penelitian ini bertujuan menilai efektivitas perlindungan hukum bagi ASN yang melaporkan dugaan pelanggaran kode etik di lingkungan Pemerintah Provinsi Jawa Timur. Hasil penelitian menunjukkan bahwa sistem perlindungan hukum yang ada belum sepenuhnya memberikan rasa aman bagi ASN whistleblower. Hambatan utama meliputi lemahnya implementasi peraturan, minimnya sosialisasi, dan kurangnya dukungan institusional. Sebagai penutup, penelitian ini merekomendasikan penguatan mekanisme perlindungan hukum bagi ASN whistleblower, termasuk peningkatan peran lembaga pengawas dan penyediaan jaminan non-diskriminatif bagi pelapor, khususnya di tingkat Pemerintah Provinsi Jawa Timur.

Abstract

The Indonesian Constitutional Court is defined as a judicial body with specific competencies as stated in the 1945 Constitution. Given its significance and the heightened attention it receives from the public, the rulings of independent courts and impartial judges are vital for maintaining the reputation of the Indonesian judiciary and the public's confidence in its work. In addition to adjudicating cases, the Constitutional Court and its judges are involved in various non-judicial activities. This research article explores the reasons behind the Constitutional Court’s engagement in these activities, outlines the various types of non-judicial actions, and evaluates their effect on the court's reputation. The aim of this research is to establish a conceptual framework and assess the influence of non-judicial activities on judicial reputation by utilizing conceptual, statutory, and comparative frameworks, supported by empirical data from official documents.Top of Form The results show that the court participates in non-judicial activities to obtain benefits like increased popularity, public interest, visibility, preventing its decisions from being overturned by other judicial entities, and enhancing its reputation and influence. Often, these activities involve promoting the court's work to both local and international judicial communities to foster dialogue and connections with similar courts and stakeholders. Furthermore, non-judicial activities can influence public interest and engagement. While these initiatives benefit the institution, judges, and the public, they do not inherently improve the Constitutional Court's reputation, as its standing fundamentally relies on the quality of its decisions and its credible independence, impartiality, and integrity.

Abstract

Introduction: The stipulation of Decision Number 757/Pdt.G/2022/PN.Jkt.Pst raises many pros and cons, namely related to the decision to postpone the 2024 elections. Through the Decision, the Central Jakarta District Court decided and adjudicated the Unlawful Acts dispute filed by the Adil Makmur People's Party against the General Election Commission. The Central Jakarta District Court should not have the authority to adjudicate disputes filed by the Adil Makmur People's Party because it violates absolute competence. Purposes of the Research: The purpose of this study is to analyze the position of the Decision and its legal consequences on the people's sovereignty in the electoral system in Indonesia. Methods of the Research: The research methods used are normative legal research methods, with a conceptual approach, a statue approach and a case approach. Results Main Findings of the Research: The research found that (1) the General Election Commission was right to appeal, showing that the 2024 election must be in accordance with the constitution, and (2) the postponement of the election violates the sovereignty of the people, as the election system in Indonesia should be carried out every five (5) years, and does not recognize the term postponing the election.
