Abstract

This study comprehensively analyzes the effectiveness of the Alternative Dispute Resolution Institution for the Financial Services Sector (LAPS SJK) through a juridical-empirical approach that integrates semi-structured interviews, observation, and document analysis of annual reports from 2022–2024. The findings reveal that the composition of disputes is consistently dominated by the banking sector and fintech lending, with mediation serving as the overwhelmingly dominant settlement mechanism. On the other hand, the institution faces significant challenges, including a high case-rejection rate, primarily due to non-compliance with the Internal Dispute Resolution (IDR) process and indications of fraud. In terms of timeliness, LAPS SJK has demonstrated remarkable efficiency by compressing its Service Level Agreement (SLA)driven by digital transformation and process optimization. The most substantive achievement is reflected in the increase in voluntary compliance with decisions, indicating strengthened legitimacy and trust in the institution. This research provides an original contribution through empirical evidence of the paradox between procedural justice in mediation and the role of arbitration in ensuring legal certainty, as well as a projective analysis of the integration of Artificial Intelligence (AI) in the development of ADR systems in Indonesia.

Abstract

The Semendo constitute an indigenous ethnic group in South Sumatra, Indonesia. This research aims to analyze the flexibility of the Semendo system in Rejang customary law and its conformity with the principles of Islamic law, particularly within the framework of maqāṣid al-syarī'ah. This study employs a normative-juridical method, utilizing a conceptual and comparative approach to analyze customary norms, Islamic legal principles, and national marriage law provisions. The findings indicate that the Semendo system, particularly the Semendo Rajo-Rajo model, demonstrates a significant accommodating character towards the values of justice, equality of rights, and the protection of property and lineage, which are integral parts of maqāṣid al-syarī'ah. Its flexibility allows it to function as a contextual and adaptive alternative model of marriage law. In conclusion, the integration of customary law values and Islamic law in the Semendo system provides a strong foundation for a more inclusive and culturally rooted reformulation of national marriage law in Indonesia. This study contributes to the scientific discourse by offering a methodological framework for harmonizing local wisdom with Islamic legal principles, which can be applied to the study of other customary law systems across the archipelago. Furthermore, it provides an academic foundation for the future development of a more pluralistic and context-sensitive national marriage law.

Abstract

The phenomenon of domestic violence (KDRT) in Indonesia remains a serious issue that impacts the psychological, social, and human rights aspects of victims. Through a restorative justice approach and normative analysis of positive law and Islamic law, this study aims to evaluate the effectiveness of restorative approaches in resolving domestic violence cases. The research employs a qualitative method with data collection techniques including literature review, legal document analysis, and interviews with relevant stakeholders. The findings indicate that the restorative justice approach holds strong relevance both from the perspective of positive law, as regulated in Law No. 23 of 2004 on the Elimination of Domestic Violence and Indonesian National Police Regulation No. 8 of 2021, and from the perspective of Islamic law, which emphasizes the principles of ishlah (reconciliation) and sulh (peaceful settlement). This approach aligns with efforts to restore victims (ḥifẓ al-nafs) and maintain family harmony (ḥifẓ al-usrah). However, its implementation faces challenges such as patriarchal cultural resistance, inadequate mediation infrastructure, and lack of coordination between law enforcement agencies and religious leaders. This study concludes that integrating restorative justice approaches based on positive law and Islamic legal principles can create a more holistic and equitable model for resolving domestic violence cases. Policy recommendations include strengthening mediator capacity, developing integrative guidelines, and enhancing collaboration between the government and religious communities.

Abstract

This article examines the status of Intellectual Property (IP) as collateral for financing within the framework of Islamic Economic Law. IP—covering trademarks, patents, copyrights, industrial designs, trade secrets, and communal intellectual property—embodies reputation and economic value, thereby raising the question of whether it may qualify as māl (property) and function as marhūn (pledged collateral). Employing a descriptive-analytical method and a juridical-empirical approach through library research, the study analyzes statutory regulations on IP-based security, relevant fatwas, and contemporary Islamic legal scholarship. The findings suggest that IP conceptually corresponds to ḥaqq al-ibtikār (creative/authorial right), which is increasingly recognized as a proprietary right containing both economic and moral dimensions. Its legitimacy is frequently grounded in ‘urf (recognized custom) and maṣlaḥah mursalah (public interest), supporting the permissibility of utilizing IP as collateral under the general maxim that commercial transactions are allowed unless proven otherwise. The article further proposes Sharia-compliant operational models—such as rahn combined with murābaḥah, ijārah, istiṣnā‘, and profit-sharing schemes (muḍārabah/mushārakah)—subject to strict avoidance of ribā, gharar, and maysir, and contingent upon reliable valuation standards, secondary-market readiness, and enforceable execution mechanisms. Divergent scholarly views are mapped, particularly regarding intangibility, valuation volatility, and moral-right constraints.

Abstract

Ideally, copyright, as part of intellectual property rights, should receive full protection from the state through firm and effective legal instruments. Law Number 28 of 2014 concerning Copyright provides a clear legal framework to ensure such protection. However, in reality, copyright infringement remains widespread in Indonesia, taking forms such as piracy, unauthorized use, and illegal distribution through digital platforms. This condition highlights a gap between the ideal legal norms and their implementation in practice. This study aims to analyze the sanctions and legal processes applicable to copyright infringement in Indonesia and evaluate the effectiveness of their implementation based on the existing laws and regulations. The methodology used in this research is a normative juridical approach, with primary data sources consisting of statutory regulations, academic literature, and relevant court decisions. The findings indicate that although Indonesia has relatively comprehensive regulations on copyright, the implementation of sanctions and legal procedures still faces obstacles, such as weak law enforcement, low public awareness, and the challenges of digitalization that facilitate the rapid spread of infringement. Therefore, a synergistic effort among policymakers, law enforcement authorities, and society is needed to build an effective and adaptive copyright protection system in response to contemporary developments.
