Abstract

This study is motivated by the lack of adherence among local government officials in executing decisions issued by the Administrative Court (PTUN). Furthermore, there is a legal inconsistency between Law Number 51 of 2009, which amends Law Number 5 of 1986 on Administrative Courts, and Law Number 30 of 2014 on Government Administration. This discrepancy concerns the sanction mechanisms for government officials who disregard PTUN rulings, potentially leading to ineffective enforcement. The research aims to examine the existing administrative sanction regulations and develop an optimal sanction framework for local government officials who fail to comply with PTUN decisions. Utilizing a normative approach, the findings reveal two distinct methods for enforcing administrative sanctions. Consequently, the author advocates for regulatory reform by redefining Administrative Court authority, enabling it to impose administrative sanctions on non-compliant officials. This adjustment is intended to reinforce the principle of separation of powers and ensure legal certainty.

Abstract

Public participation in forming laws shows variations in their application in Indonesia, the United States and the Netherlands. To find out about the urgency and implementation of public participation in the formation of laws and regulations, normative legal research is carried out based on the legal materials that have been collected. The legal material used is primary legal material related to statutory regulations governing the mechanism for forming statutory regulations. While the secondary legal materials used mainly come from scientific articles published in journals, which discuss popular sovereignty, democracy, community participation, and the mechanisms for forming legislation in various countries. The study results show that the urgency of public participation in the formation of laws and regulations is needed to carry out the teachings of people's sovereignty and democracy in a state, where the highest power lies with the people. Therefore, the people must be involved in forming laws as the legitimacy of government policies. The form of public participation in the formation of laws and regulations in Indonesia is carried out at the stages of preparing academic papers and discussing draft laws and regulations, either through direct participation or representatives.

Abstract

This study examines the evolving role of Indonesia's Constitutional Court, specifically the tension between its constitutional mandate as a negative legislator and instances of judicial activism approaching positive legislation. Using normative legal research methodology, the research analyzes two landmark decisions, No. 90/PUU-XXI/2023 and No. 62/PUU-XXII/2024, to distinguish between legitimate constitutional review and potential judicial overreach. The findings reveal that while judicial activism can strengthen constitutional checks and balances when properly constrained, it risks undermining democratic legitimacy when extending to the creation of new legal norms. The study proposes a five-parameter framework emphasizing constitutional supremacy, compelling justification, substantive justice conditions, procedural integrity, and institutional restraint to guide judicial interpretation within constitutional boundaries. This framework contributes to resolving the fundamental challenge of balancing judicial independence with democratic accountability in Indonesia's evolving constitutional landscape, ensuring the Court can effectively safeguard constitutional rights without compromising democratic processes.

Abstract

This study discusses the authority of judicial orders issued by the Constitutional Court in the context of legal construction and the principle of separation of powers in Indonesia. Judicial orders, as a concrete form of the expansion of the role of the judiciary, play an important role in filling legal gaps and ensuring the implementation of the Constitution, especially when the executive and legislative branches fail to fulfill their obligations. This study employs a normative legal approach with three analytical methods: a statutory approach, a case study of Constitutional Court decisions, and a conceptual approach to relevant legal theories. The findings indicate that judicial orders in Indonesia are not supported by a strong implementation framework, unlike practices in other countries such as India, Colombia, South Africa, Austria, and Germany, which are more progressive in regulating and supervising the implementation of judicial orders. The Indonesian Constitutional Court tends to issue declaratory or conditional rulings, but effective follow-up mechanisms do not accompany these. Therefore, this study recommends reformulating rulings to be more operational, establishing an implementation oversight unit, and adopting a continuing mandamus model for strategic issues as part of efforts to strengthen the role of the Constitutional Court in upholding constitutional supremacy and substantive justice in a constitutional democracy.

Abstract

This research aims to criticize the appointment of Acting Regional Heads as part of legal conflicts that are contrary to the constitution. The appointment of Acting Regional Heads who do not involve the people directly, causes a perception that people's sovereignty is sidelined for the sake of administrative efficiency. Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia is above the Election Law and the regulations under it, so that the interpretation of this regulation is not harmonious can trigger a polemic. This study uses doctrinal/normative research with a statute approach, conceptual approach, and case approach. The results of this study describe the concept of the appointment of Acting Regional Heads as an irrational part and has the potential to weaken the sovereignty of the people as enshrined in the staatfundamental norm (1945 Constitution) or grundnorm (Pancasila), the content element in the provisions for the appointment of Acting Regional Heads is full of non-democratic conditions so that these provisions need to be reviewed by prioritizing the aspect of people's participation. Therefore, it is necessary to strengthen the representation, participation of the people, and democratic mechanisms to maintain the sustainability of an inclusive and equitable political system.

Abstract

Repetisi larangan nepotisme dan ketentuan sanksi yang berbeda-beda bagi PNS pelaku nepotisme dalam UU No. 28 Tahun 1999, UU AP, PP No. 42 Tahun 2002, PP Manajemen PNS, PP No. 94 Tahun 2021, dan Permenpan RB No. 9 Tahun 2017 menyebabkan tumpang tindih hukum. Dalam UU No. 28 Tahun 1999, sanksi yang diatur adalah sanksi pidana/perdata, sedangkan UU AP, PP Manajemen PNS dan PP No. 94 Tahun 2021, sanksi yang diatur adalah sanksi administratif dan disiplin. Kemudian dalam PP No. 42 Tahun 2004 dan Permenpan RB No. 9 Tahun 2017, sanksi yang diatur adalah sanksi moral dan tindakan administratif. Melalui penelitian yuridis normatif dengan pendekatan perundang-undangan, asas dan konseptual, penelitian ini menunjukkan akibat adanya tumpang tindih larangan dan sanksi nepotisme adalah terjadinya hiper regulasi dan ketidakpastian hukum terkait jenis sanksi yang akan digunakan, siapakah yang menegakkan sanksi, serta tidak terlaksananya kepastian hukum, sehingga dibutuhkan harmonisasi hukum. Melalui interpretasi menyelaraskan dan gramatikal, ditemukan sanksi perdata tidak memenuhi asas lex certa sehingga patut dihapuskan. Adapun sanksi yang didahulukan adalah sanksi administratif ringan, sanksi moral dan tindakan administratif, namun jika perbuatan nepotisme menyebabkan kerugian keuangan negara, kerusakan lingkungan, dan pelaku PNS mendapatkan keuntungan, dapat dijatuhi sanksi pidana sebagai diikuti sanksi administratif berat. Kata kunci: Nepotisme; Pegawai Negeri Sipil (PNS); Sanksi

Abstract

Character building is the foundation for realizing the vision of national development, which is to create a noble, moral, ethical, cultured, and civilized society based on the philosophy of Pancasila. Based on this background, the legal issues in this research are: 1) What is the object of character building  that become the focus of national development planning? and 2) How is character building regulated in legislation? This research uses a statutory approach and a conceptual approach. The objects of character building  that becomes the focus of national development planning are the character building of children, youth and the State Civil Apparatus. Character building is regulated in several regulations, namely: Law No. 5 of 2014 on State Civil Apparatus, Amendment to Child Protection Law, Amendment to the Marriage Law, Law No. 18 of 2019 on the Islamic Boarding Schools, Law No. 11 of 2022 concerning Sport, Law No. 12 of 2022 on the Sexual Violence Crimes and Law No. 23 of 2022 on the Psychology Education and Services.

Abstract

The rise of Artificial Intelligence (AI) in Indonesia's 2024 presidential campaign reveals a significant legal gap in Law No. 7 of 2017 on Elections. Using a normative juridical approach, this study examines the 1945 Constitution, Election Law, and Constitutional Court Decision No. 166/PUU-XXI/2023. Findings show that while the Court prohibits "excessive” AI manipulation under the notion of citra diri (self-image), no binding technical rules exist to govern its use. The study employs the theories of Radbruch's Legal Purpose, Satjipto Rahardjo’s Progressive Law, and Nonet–Selznick's Responsive Law to analyse justice, certainty, and social benefit in regulating AI campaigns. It concludes that AI-driven campaigning through avatars, deepfakes, and microtargeting poses constitutional risks unless addressed by adaptive, participatory, and justice-oriented regulation. Thus, responsive and progressive legal reform is crucial to preserving electoral integrity and democratic legitimacy in the digital era.

Abstract

Structure-oriented or system-oriented movements will be more advanced than ordinary movements without relying on a system (normative). Structural legal aid is included in the movement of non-governmental organizations whose work system leads to structural or systemic changes, rather than changes at the individual or case-by-case level. The legal aid movement aims to ensure access to justice for people in need, especially women. With normative legal research, it is hoped that this can provide important findings about community colaboration, aid service providers, NGOs, and CSOs in societal change and equality. Thus, structural legal aid is a legal aid strategy based on the movement by eliminating power relations and gender inequality. In addition, village women paralegals can act as a movement to realize structural gender legal assistance for women, children, and other marginalized groups, and not just for the poor. The old perspective on traditional legal aid is not effective, makes structural legal aid an alternative from legal aid, that can be encouraged by movement that can eliminate gender inequality and change existing structures in society. Women’s participation as paralegals in a social movement can be optimized with support from NGOs and CSOs such as legal aid organizations. So that women’s social movements produce gender equality, fulfill women’s rights, and overcome discrimination. Apart from that, the legal aid movement needs to be focused and structured so that women’s rights are fulfilled. The challenge for paralegals is to be able to go beyond the duits stated in the UUBH.

Abstract

The interim president anticipates the vacancy of the office of president and vice president; Indonesia calls it ‘pelaksana tugas kepresidenan’, which is filled by the minister of home affairs, foreign affairs, and minister of defense. This article explores the two actors (bureaucrats and legitimacy) who become interim presidents in the constitutions of the world's countries. Next, the Indonesian arrangement and accompanying problems in the 1945 Constitution will be reviewed. This article is aided by a doctrinal research method with historical, legislative, and comparative constitutional approaches. Indonesia has its peculiarities compared to the constitutions of world countries because it applies a compound position as interim President adopted from the New Order legal products (Tap MPR VII/1973) without going through a decontextualisation process, so it still applies the old features (bureaucratic actors) with compound/collegial executive positions in the new constitutional structure that seeks to purify the presidential system. In addition, there are conditions that the 1945 Constitution still cannot resolve and that cause paralysis of governance. This article offers one solution—which could alleviate two specific problems simultaneously—and that is to make the Speaker of the House of Representatives (DPR) the acting President of the future.
