Abstract

Indonesia is a state of law that guarantees protection for all its citizens, including within the institution of marriage. Domestic violence (KDRT) has become a phenomenon that disrupts family harmony and is often the basis for divorce lawsuits, particularly from wives. However, public understanding of domestic violence as a legitimate legal reason for divorce remains low. This study uses a normative and empirical juridical approach, through literature studies and interviews at the Boyolali Religious Court. The findings indicate that domestic violence can legally be used as the basis for divorce, as stated in Article 19 (d) and (f) of Government Regulation No. 9 of 1975 and Article 116 of the Compilation of Islamic Law. Evidence in divorce cases involving domestic violence can include witness testimonies, medical reports (visum et repertum), and reports to law enforcement. In conclusion, legal awareness and protection for victims of domestic violence must continue to be strengthened through education and a justice system that sides with victims.

Abstract

Presidential Regulation Number 12 of 2021 is an amendment to Presidential Regulation Number 16 of 2018 regarding the procurement of government goods and services. One of the key changes is the reinforcement of the e-purchasing system through electronic catalogs and online stores. This study aims to examine the implementation and effectiveness of this regulation in the context of e-purchasing carried out by suppliers, using PT. Global Gemilang Nusa Pertiwi as a case study. The research method used is empirical juridical, combining normative analysis of laws and regulations with empirical field data obtained through interviews and observation. The findings indicate that although the regulation normatively aims to achieve more transparent, efficient, and accountable procurement, its implementation still encounters several technical and administrative obstacles. These include lengthy product curation processes, technical issues within the e-catalog system, and limited digital literacy among regional suppliers. Thus, there is a need for strengthening technical capacities, improving digital infrastructure, and simplifying the curation process to ensure that e-purchasing implementation aligns with the spirit of bureaucratic reform and good governance.

Abstract

The transformation of sexual harassment from physical public spaces to cyberspace has given rise to a new form of crime known as digital catcalling. This phenomenon demonstrates the complexity of the law, which has not fully responded to the characteristics of gender-based crimes in the virtual world. This study aims to analyze the forms of legal protection for victims of catcalling on social media and examine the obstacles and government efforts in its implementation. The research method used a normative-descriptive approach with qualitative analysis. The results indicate that although regulations such as the TPKS Law, the Pornography Law, and the ITE Law exist that can be used to prosecute perpetrators, legal protection for victims remains ineffective due to the lack of specific norms explicitly governing digital catcalling. Systemic integration between regulations and a gender- and technology-based approach is needed to strengthen victim protection

Abstract

This study aims to examine the juridical aspects of the annulment of a birth certificate issued due to verification errors in the digital-based population administration system, focusing on the Decision of the Administrative Court (PTUN) of Yogyakarta Number 19/G/2020/PTUN/YK. In this case, the birth certificate under the name of Setyowati was issued by the Civil Registration and Population Service (Dukcapil) of Bantul Regency by listing her grandmother as her biological mother. This error not only raised administrative issues but also potentially affected the civil inheritance rights of legitimate heirs. This research employs a normative juridical method with a descriptive-analytical approach, supported by a literature review, analysis of statutory regulations, the principles of good governance (AUPB), the doctrine of material truth, and an in-depth review of the court’s decision. The findings reveal that the Defendant (Dukcapil), who only conducted administrative verification through the Population Administration Information System (SIAK) without factual examination, violated the principles of accuracy, legal certainty, and justice. The panel of judges emphasized that a birth certificate as a state legal product must reflect material truth, not merely the formal completeness of documents. This decision not only annulled a legally flawed birth certificate but also highlighted the urgency of reforming verification systems in digital-based population administration services. The existing system must be supported by competent and ethical human resources, field verification mechanisms, and effective internal supervision to prevent data manipulation that may harm other parties. This study is expected to provide an academic contribution to the development of administrative law, as well as a practical reference for public service institutions to strengthen accuracy, accountability, and fairness in issuing population documents.

Abstract

Penelitian ini bertujuan untuk mengkaji peran guru abad 21 dalam membentuk siswa Kristen yang cerdas secara intelektual dan tangguh secara spiritual. Melalui pendekatan studi pustaka, penelitian ini mengumpulkan dan menganalisis literatur terkait kompetensi guru, pendidikan Kristen, pembentukan karakter, serta tantangan era digital. Hasil kajian menunjukkan bahwa guru Kristen abad 21 dituntut untuk memiliki kompetensi pedagogis, literasi digital, integritas moral, serta kedewasaan rohani. Peran guru tidak hanya sebagai pengajar, tetapi juga sebagai teladan, pembina karakter, dan pemimpin spiritual. Strategi pendidikan yang relevan mencakup pembelajaran kontekstual, reflektif, kolaboratif, dan berbasis nilai-nilai Kristiani. Selain itu, keterlibatan Roh Kudus dan keteladanan guru menjadi faktor penting dalam membentuk ketangguhan iman siswa. Penelitian ini menegaskan bahwa pendidikan Kristen harus bersifat holistik dan transformatif agar mampu mempersiapkan generasi yang siap menghadapi tantangan dunia modern tanpa kehilangan arah iman.

Abstract

The increase in land buying and selling activities occurs as a result of an increase in the community's need for land. This buying and selling activity is a form of the process oftransferring ownership rights to land. However, in practice there is still a lot of buying and selling done under the hands. This sale and purchase is not carried out before the PPAT, but is carried out on the basis of mutual trust between the buyer and seller. The sale and purchase of landrights under this hand will be very detrimental to the buyer, because legal certainty for the buyer has not been fulfilled. Normative legal research methods from secondary data sources. The transfer of rights through underhand buying and selling begins with deliberation. After an agreement ismade, the price is determined and the handover is carried out, which is attended by the Village Head, RT Chair, Customary Leaders, witnesses. As evidence that the sale and purchase of land had taken place, then a sale and purchase statement was made signed by the Village Head,seller and buyer, and two witnesses, stamped by the village, there was proof of payment in the form of a receipt and stamped. The legal consequences of buying and selling under the hands are still valid because the legal conditions for buying and selling according to the UUPA have beenfulfilled, namely cash, clear, real. Meningkatnya kegiatan jual beli tanah terjadi akibat dari adanya peningkatan kebutuhan masyarakat akan tanah. Kegiatan jual beli ini adalah sebagai salah satu bentuk proses peralihan hak milik atas tanah. Akan tetapi dalam prakteknya masih banyak jual beli dilakukan di bawah tangan. Jual beli ini tidak dilakukan dihadapan PPAT, akan tetapi dilakukan atas dasar saling percaya antara pihak pembeli dan penjual. Jual beli hak atas tanah dibawah tangan ini akan sangat merugikan bagi pihak pembeli, karena kepastian hukum untuk pembeli belum dapat terpenuhi. Metode penelitian hukum normatif dari sumber data sekunder. Peralihan hak melalui jual beli di bawah tangan dimulai dengan musyawarah. Setelah adanya kesepakatan kemudian menentukan harga dan dilakukan serah terima, yang dihadiri oleh Kepala Desa, Ketua RT, Ketua Adat, saksi-saksi. Sebagai alat bukti telah terjadi jual beli tanah, kemudian dibuat pernyataan jual beli ditanda tangani Kepala Desa, penjual dan pembeli, dan dua orang saksi, di stempel oleh desa, ada bukti pembayaran berupa selembar kuitansi dan bermaterai. Abstract

Land registration is carried out to provide legal guarantees to holders of land rights. However, there are still many disputes that are the work of the government. This is because certificates as strong evidence have not been able to guarantee legal certainty for holders of property rights to the land, so that parties who feel entitled can block land rights at the Land Office. The implementation of the block is regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 13 of 2017. This study aims to determine the process and procedure for blocking certificates at the Boyolali Regency Land Office and to find out the obstacles in the implementation of the blocking at the Boyolali Regency Land Office. Empirical juridical research method, by reviewing and explaining the study of research law in order to obtain objective research. Data was collected by interviewing the officers in the dispute section and officers in the land law relations section. Block registration is divided into two, namely blocks with cases attached and blocks without cases being attached. The fee that must be paid is Rp. 50,000.00 (fifty thousand rupiahs) in accordance with Government Regulation Number 128 of 2015, although later after the review process, the application for registration of blocking certificates is rejected. Not all requests for block registration were accepted even though they had paid the PNBP fee, this was because the reason for submitting the block was not in accordance with the provisions. The obstacle faced by the Boyolali Regency Land Office is that there are still many requirements that have not been fulfilled by the applicant in submitting a request for registration of blocking certificates, thus hampering the smooth implementation of recording blocking of certificates. In addition, the KKP Web application cannot be automatically deleted after 30 days of blocking registration without having to apply for the revocation of the certificate block. Pendaftaran tanah dilakukan untuk memberikan jaminan hukum kepada pemegang hak atas tanah. Akan tetapi masih banyak terjadi sengketa yang menjadi pekerjaan bagi pemerintah. Hal ini disebabkan sertipikat sebagai alat bukti yang kuat belum bisa menjamin kepastian hukum bagi pemegang hak milik atas tanah tersebut, sehingga pihak yang merasa berhak dapat melakukan blokir terhadap hak atas tanah pada Kantor Pertanahan. Pelaksanaan blokir diatur dalam Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 13 Tahun 2017. Penelitian ini bertujuan mengetahui proses serta prosedur pemblokiran sertipikat di Kantor Pertanahan Kabupaten Boyolali dan mengetahui hambatan dalam pelaksanaan pemblokiran di Kantor Pertanahan Kabupaten Boyolali. Metode penelitian yuridis empiris, dengan mengkaji dan menjelaskan kajian hukum penelitian agar mendapatkan penelitian yang objektif. Pengumpulan data dilakukan dengan wawancara kepada petugas seksi sengketa dan petugas di seksi hubungan hukum pertanahan. Pencatatan blokir dibagi dua, yaitu blokir dilampiri perkara dan blokir tanpa dilampiri perkara. Biaya yang wajib dibayar sebesar Rp. 50.000,00 (lima puluh ribu rupiah) sesuai Peraturan Pemerintah Nomor 128 Tahun 2015, walaupun nanti setelah proses pengkajian, permohonan pencatatan pemblokiran sertipikat ditolak. Permohonan pencatatan blokir tidak semua diterima meskipun sudah membayar biaya PNBP, hal tersebut dikarenakan alasan diajukannya blokir tidak sesuai dengan ketentuan. Hambatan yang dihadapi oleh Kantor Pertanahan Kabupaten Boyolali adalah masih banyak persyaratan yang belum terpenuhi oleh pemohon dalam mengajukan permohonan pencatatan pemblokiran sertipikat sehingga menghambat kelancaran dalam pelaksanaan pencatatan pemblokiran sertipikat.Selain itu, aplikasi KKP Web belum bisa secara otomatis terhapus dengan sendirinya setelah 30 hari pencatatan blokir tanpa harus mengajukan permohonan pencabutan blokir sertipikat

Abstract

The background of this research is that interfaith marriages are not explicitly regulated in Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage, so there is a legal vacuum to strictly regulate interfaith marriages in Indonesia. This is because more and more people in Indonesia are doing interfaith marriages. With the Law no. 23 of 2006 concerning Population Administration (UU Adminduk) can accommodate interfaith marriages being disabled, but in practice it is best not to do so. Article 35 letter a of the Adminduk Law relating to interfaith marriages is a special rule that overrides more general regulations and does not erase old provisions, so that Law no. 16 of 2019 concerning Amendments to Law no. 1 of 1974 concerning Marriage is still valid in the national regulatory system in the field of marriage. With the existence of rules that prohibit interfaith marriages as a solution to overcome the legal vacuum by not giving rights to interfaith marriage actors to register their marriages through a court order. As for the legality of marriage materially, it still returns to the laws of their respective religions, while with regard to formal, civil law relations arising from marriage, if the marriage has received legal recognition, then everything is protected by law. The rejection of interfaith marriages in Indonesia is basically a discriminatory act that is not in accordance with the principles of Human Rights (HAM) itself. However, humans are obliged to prioritize their basic human obligation to comply with their religious laws and the state as law enforcer needs to regulate prohibitions on interfaith marriages so that violations do not occur in society.

Abstract

Globalization is a traditional process of exchanging world paradigms for the work, understanding and aspects of local wisdom of a nation which encourages the emergence of a situation of mutual dependence (interdependence) for technological, economic, health, social and cultural activities. Health globalization is closely related to economic and social globalization as a phenomenon to describe something that is complex or consists of various interrelated elements, such as for example in psychology which describes individual traits or characteristics that cannot be simplified. These changes have an impact on citizens in general and individuals, causing a complex influence on the incidence and causes of mental disorders in population development. In addition, the ways in which mental disorders are understood and shaped by ongoing global shifts. This problem is also possible with increasing industrialization and urbanization, access to western traditions to medical systems will become more common and sophisticated as a shift that can lead to changes in health technology. Internet access is a form of technological progress that cannot be avoided and will influence philosophical, ideological and political views of the world. The prevalence of mental disorders is closely related to social, economic and cultural conditions. If we consider all the previously mentioned changes in information technology, we can easily predict that the form and content of mental disorders, psychological treatments and psychotherapy as well as pharmacotherapy will undergo serious changes. Considering developments in the current era of globalization of modern technology and increasingly fierce competition in society, it is possible that people are not strong enough to live their lives so they can experience mental disorders and it needs to be underlined that mental illnesses can attack anyone.

Abstract

The lack of support for women remains one of the obstacles to achieving the 30% quota for female representation in legislative institutions. This lack of support significantly affects the performance of female legislators in parliament. In the Boyolali Regency DPRD for the 2024–2029 period, out of 50 legislative members, only 13 are women—around 26%—falling short of the ideal representation target. This condition reflects the continued underrepresentation of women in parliament, despite the fact that electoral and political party laws in Indonesia have provided opportunities for women to engage in politics and legislative membership. This study aims to examine how female legislators carry out their legislative functions in the Boyolali Regency DPRD, while also identifying the challenges they face and the strategies they adopt. The research is grounded in Hanna Pitkin’s theory of Women Representation, which distinguishes between descriptive and substantive representation. A qualitative descriptive approach was employed, with data collected through interviews, observation, and documentation. The results indicate that although the quantitative representation of women remains low, female members of the Boyolali DPRD have actively participated in all stages of the legislative process—from drafting and deliberation to ratification of local regulations. Challenges encountered include the burden of proving competence in a male-dominated political culture, balancing domestic and public roles, aspirational pressures from constituents, and moral responsibility in promoting gender-related issues. Strategies undertaken include strengthening formal legitimacy through legal frameworks, initiating pro-women regulations, improving communication in legislative forums, reinforcing constituent connections, and demonstrating tangible performance outcomes. These findings suggest that the involvement of women in legislative functions goes beyond fulfilling numerical representation; it also contributes to more inclusive and gender-sensitive policymaking. Therefore, enhancing the capacity and expanding the political space for women is essential for building a representative and just parliament.
