Abstract

Emergency care is a fundamental health service that must be provided immediately without administrative or financial delays to protect the rights to health and life. However, within the implementation of Indonesia's National Health Insurance (Jaminan Kesehatan Nasional, JKN), the BPJS Kesehatan Memorandum of Agreement (Berita Acara Kesepakatan, BAK), which serves as a guideline for claims settlement, may influence the delivery of emergency care. This study aims to analyze the legal implications of the BAK for the provision of emergency care under Indonesian positive law and to examine it from the perspective of Islamic law. This study employed normative legal research using statutory and case approaches. Legal materials were collected through library research and analyzed using a prescriptive legal approach based on grammatical, systematic, and teleological interpretation, complemented by an analysis grounded in the principles of maqāṣid al-sharī'ah. The findings indicate that several provisions of the BAK, particularly those concerning Death on Arrival (DOA) claims and internal consultations, have the potential to shift the nature of the therapeutic obligation from inspanningverbintenis (obligation of best efforts) to resultaatsverbintenis (obligation of results), creating disharmony with the legal framework governing emergency care and undermining the principle of balance in the legal relationship between BPJS Kesehatan and hospitals. From the perspective of Islamic law, these restrictions are inconsistent with the principles of ḥifẓ al-nafs (protection of life), maṣlaḥah (public interest), and lā ḍarar wa lā ḍirār (no harm and no reciprocating harm), all of which recognize the protection of human life as a primary objective of Islamic law. Therefore, harmonization of BPJS Kesehatan's administrative policies with Indonesia's health law framework is necessary to ensure legal certainty, justice, and optimal protection of patient safety.

Abstract

Masalah sosial seperti pengemis, gelandangan, dan orang terlantar adalah suatu hal yang dapat menggambarkan masyarakat miskin yang ada didalam suatu wilayah. Para gelandangan tersebut secara tidak Langsung memberikan persepsi Kabupaten Boyolali sebagai kabupaten yang kumuh, kotor sehingga mempengaruhi keindahan Kabupaten Boyolali. Karena permasalahan tersebut Pemerintah Kabupaten Boyolali membentuk Peraturan Daerah No.8 Tahun 2025 tentang Penyelenggaraan Ketertiban Umum dan Ketentraman Masyarakat serta Perlindungan Masyarakat. Tujuan dalam penelitian ini adalah mengetahui implementasi Satpol PP Boyolali dalam menegakkan Perda Kab. Boyolali Nomor 8 Tahun 2025 tentang Penyelenggaraan Ketertiban Umum dan Ketentraman Masyarakat serta Pelindungan Masyarakat dalam menangani permasalahan PGOT secara efektif dan kendala yang dihadapi. Metode penelitian yang digunakan dalam penelitian ini adalah Pendekatan empiris yaitu mengkaji tentang peranan Satpol PP dalam menegakkan Perda Kab. Boyolali Nomor 8 Tahun 2025 tentang Penyelenggaraan Ketertiban Umum dan Ketentraman Masyarakat. Hasil penelitian ini adalah Satpol PP Kabupaten Boyolali telah memiliki pedoman hukum yang jelas untuk menjalankan perannya berdasarkan Perda Kabupaten Boyolali Nomor 8 Tahun 2025. Hal ini bisa dilihat dari data patroli yang telah dilaksanakan Satpol PP Kabupaten Boyolali dan data dari Dinas Sosial mengenai pemanfaatan yang ada di rumah singgah Kabupaten Boyolali yang terdapat sejumlah 34 orang. Pelaksanaan Perda ini oleh Satpol PP Kabupaten Boyolali juga masih mengalami beberapa hambatan yang ditinjau dari lima faktor penegakan hukum.

Abstract

Modernisasi peradilan di Indonesia ditandai dengan hadirnya persidangan elektronik atau e-litigation sebagai respons terhadap tuntutan pelayanan hukum yang sederhana, cepat, dan berbiaya ringan. Meski demikian, penggunaan teknologi dalam proses beracara memunculkan pertanyaan tersendiri tentang sejauh mana prinsip due process of law tetap terjaga. Artikel ini menelaah dua persoalan: bagaimana pengaturan hukum e-litigation dalam sistem peradilan perdata Indonesia, dan apakah pelaksanaannya telah selaras dengan prinsip due process of law. Kajian dilakukan melalui penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, menggunakan bahan hukum primer, sekunder, dan tersier yang dihimpun melalui studi kepustakaan lalu dianalisis secara kualitatif. Hasil kajian menunjukkan bahwa dasar hukum e-litigation di Indonesia sudah cukup memadai, terutama melalui Peraturan Mahkamah Agung Nomor 1 Tahun 2019 yang telah diperbarui dengan Peraturan Mahkamah Agung Nomor 7 Tahun 2022. Namun, praktik di lapangan masih diwarnai gangguan sistem e-court, kesenjangan akses teknologi, kelemahan pembuktian elektronik, serta pemeriksaan para pihak dan saksi secara virtual yang belum optimal. Kondisi-kondisi tersebut menunjukkan bahwa due process of law belum sepenuhnya terpenuhi karena berpotensi mengurangi kesempatan para pihak untuk memperoleh proses peradilan yang adil dan seimbang. Artikel ini merekomendasikan penguatan regulasi, perbaikan infrastruktur teknologi, dan penguatan perlindungan hak prosedural agar persidangan elektronik tetap sejalan dengan asas negara hukum dan keadilan prosedural.

Abstract

Legal Obligations, Health Services, BPJS Health services are the right of every person as stated in the 1945 Constitution, namely, article 28 H paragraph (1) which confirms: "every person has the right to live in physical and spiritual prosperity, to have a place to live, and to have a good and healthy living environment and to receive health services". BPJS or Social Security Administering Body is a legal entity whose aim is to organize social security programs to ensure that all people can fulfill the basic needs of a healthy life. BPJS is organized based on the principles of humanity, benefit and social justice for all Indonesian people. The high need for national health experiences problems when it is not accompanied by an increase in health services. Therefore, what are the government's obligations in ensuring health insurance for all levels of society? This research uses a juridical-normative approach. The approach method taken is a statutory approach and a sociological approach. Based on the research results, it was found that the government was negligent in its legal obligations in providing health services to BPJS patients in the form of health facilities, transparency or openness of service information and performance monitoring. The government has a legal obligation to ensure that every citizen without exception obtains their rights and provides legal protection to BPJS patients from acts of discrimination
