Abstract

The high crime rate and overcapacity in correctional institutions underscore the necessity of examining the effectiveness of prison sentences and exploring fairer alternative sanctions. This research aims to analyze the effectiveness of prison sentences within the criminal justice system and identify ideal criminal sanctions to achieve justice. The study employs a normative juridical method with a descriptive approach. The findings reveal that prison sentences carry negative consequences, including stigmatization and challenges in social reintegration. To enhance the effectiveness of law enforcement and realize justice, the study recommends adopting restorative justice approaches, strengthening preventive measures, and integrating non-legal considerations into law enforcement. Thus, this research contributes to shaping criminal law policies that are not solely repressive but also preventive and rehabilitative. It advocates for the development of a legal system adaptable to the challenges of overcapacity in correctional institutions, promoting a balance between repression, prevention, and rehabilitation for a more equitable and sustainable justice framework.

Abstract

This research explores the legal protection of domestic doctors in Indonesia in response to the increasing utilization of foreign doctors (FDs) within the framework of knowledge transfer aimed at improving healthcare services. With the enactment of Law No. 17 of 2023 on Health, the Indonesian government provides space for foreign doctors to practice with simplified licensing procedures, raising legal concerns regarding legal certainty, professional equality, and the rights of patients to clear and honest communication. This study uses normative juridical methods with statutory and conceptual approaches to analyze the legal framework surrounding this issue. The findings show that the implementation of simplified requirements for foreign doctors potentially threatens the professional standing of local doctors and risks violating patient rights. Recommendations include strengthening legal instruments and monitoring mechanisms to ensure that knowledge transfer objectives are met without compromising legal protection and healthcare quality. The legal framework provided by Law No. 17 of 2023 allows foreign doctors to practice with more straightforward licensing processes, but it raises concerns regarding the adequacy of regulatory oversight. Local doctors fear that the simplified procedures for foreign doctors may not guarantee the same level of competency, accountability, and ethical standards. Furthermore, the presence of foreign doctors could lead to a disparity in professional treatment and recognition, undermining the integrity of the medical profession in Indonesia. This study explores how these legal issues intersect with the broader goals of patient protection, ensuring that all medical practitioners, regardless of nationality, adhere to the highest standards of care and ethical conduct. The role of patient rights in this context is critical, as patients must receive clear and honest communication about the qualifications of the doctors treating them, ensuring their right to informed consent is upheld.

Abstract

Abstracts: The criminal policy against the crime of adultery in the Positive Criminal Law is contained in Article 284 of the Criminal Code, which criminalizes anyone who has sexual intercourse if one of the perpetrators or both of them is married. Adultery in this article is not comprehensive and fulfills a sense of justice for some people who think that adultery is not limited to that because it is not following the values of the Indonesian people's customs and Islamic law, in which the majority of Indonesian people are Muslims. The Criminal Policy in the RKUHP includes an expansion of the meaning of adultery which criminalizes a person who commits adultery with the unconditional condition that one of the perpetrators or both of them is married, the RKUHP also includes cohabitation adultery and incestuous adultery (family ties). This writing does not only make a comparison between the criminal policies regulated in the Positive Criminal Law, namely Article 284 of the Criminal Code and the RKUHP, with Islamic Criminal Law. the problem of poverty which causes prostitution activities to still occur and religious marriage activities that are not registered by the state are carried out by some Indonesian people. Abstract

ABSTRACTChild sexual abuse is a serious threat that impacts the lives of children and the security of society. The Indonesian government has taken serious steps by imposing severe criminal sanctions, including chemical castration, to combat this crime. The research uses a normative juridical approach by analyzing legal materials and theories related to chemical castration against perpetrators of child sexual abuse, with the aim of understanding the application of this sanction in the best interests of children. The research shows that child sexual abuse requires a firm legal response, including additional sanctions such as chemical castration. However, the effectiveness of this sanction is still debated in relation to preventing repeat sexual violence. The procedure for implementing chemical castration involves clinical evaluation and rehabilitation after the offender has completed the sentence. Although regulated as a legal response, the implementation of chemical castration requires careful medical, social and legal considerations. The ultimate goal is to prevent repeat sexual violence and provide a deterrent effect. Strong preventive measures and medical and psychological support are needed to protect children from sexual violence.

Abstract

This study aims to analyze the application of the doctrine of vicarious liability in the liability of hospitals for medical malpractice lawsuits in Indonesia. The increasing number of medical disputes raises questions regarding the extent to which hospitals can be held responsible for the negligence of medical personnel working under their authority. This research employs a normative juridical method with statutory, conceptual, and case approaches, by examining the Indonesian Civil Code, Law No. 44 of 2009 on Hospitals, Law No. 17 of 2023 on Health, and relevant court decisions. The findings reveal that, normatively, hospitals can be held accountable under Article 1367 of the Civil Code, which aligns with the doctrine of vicarious liability (Black, 2019). However, judicial practice in Indonesia remains inconsistent: in some cases judges place liability on hospitals, while in others they hold individual doctors fully responsible (Budiman, Absori & Rizka, 2023; Vitrianingsih, Miarsa & Yahya, 2025). This inconsistency demonstrates a gap between normative regulation and juridical implementation. The novelty of this study lies in emphasizing the importance of the principle of justice in applying vicarious liability. Legal protection should not be limited to written norms but must also be substantive by balancing patients’ rights to safe and quality healthcare with the rights of medical personnel and hospitals to legal certainty. This is in line with Rawls’ (1971) concept of justice as fairness and Radbruch’s (2006) idea of balancing justice, legal certainty, and expediency.

Abstract

The Public Prosecutor's Office's authority to investigate economic crimes in Indonesia remains limited, both normatively and institutionally. Yet the complexity and magnitude of losses resulting from economic offenses demand an institution with adequate juridical and technical capabilities. To address issues concerning the legal basis for these limitations, their impact on law enforcement, and an ideal legal‐policy model for the Public Prosecutor's Office, a normative legal approach was employed, incorporating statutory, case‐law, historical, comparative, and conceptual analyses. The discussion examines the grounds for such limitations under positive law, the prevailing legal‐policy direction, and the design of criminal institutions, according to which the Public Prosecutor's Office may exercise investigative functions only where governed by a lex specialis provision. Moreover, the normative and practical effects of these limitations on enforcement effectiveness are analyzed, particularly in relation to inter-agency coordination, legal certainty, and public confidence. In light of the Public Prosecutor's Office's success in handling major corruption cases, which are part of the broader category of economic crimes, there is a pressing need to formulate a legal‐policy model to expand and strengthen the institution's role. As a solution, a criminal‐law reform model is proposed that positions the Public Prosecutor's Office as the principal investigative body through centralized authority, accountable procedures, and integrated cross‐agency governance. This model is intended to establish a more centralized, efficient, and credible system for enforcing economic criminal law while reinforcing the direction of national criminal-law reform.
