Abstract

Some people of Jatimulya Village, Cilodong, Depok, West Java, still could not understand clearly and faced difficulty in accessing law or legal instrument. Regarding to that, university through its faculty of law could take a part to overcome such condition. The faculty of law is able to conduct a kind of community service activity, namely socialization and public legal consultation. This study is based on information collected during the socialization and public legal consultation was held by Faculty of Law Pancasila University in Jatimulya Village. This study concludes that through the socialization and public legal consultation, the synergy between society, local government, and higher education institution could be tightened and also it would help the realization of better access to justice for all. Keywords: access to justice; public legal consultation; socialization Abstrak:Sebagian warga masyarakat Kelurahan Jatimulya, Cilodong, Depok, Jawa Barat, masih kesulitan dalam memahami hukum dan mengakses hukum. Untuk mengatasi masalah tersebut, perguruan tinggi, terutama melalui fakultas hukumnya, bisa melakukan kegiatan penyuluhan dan konsultasi hukum massal bagi warga masyarakat. Hal seperti inilah yang telah dilakukan oleh Fakultas Hukum Universitas Pancasila. Kajian ini menyimpulkan bahwa kegiatan penyuluhan dan konsultasi hukum massal ternyata bisa membawa dampak yang positif bagi pihak masyarakat yang masih belum begitu paham terhadap hukum, pihak pemerintah daerah sebagai otoritas penyedia layanan publik, dan juga bagi pihak institusi perguruan tinggi, khususnya fakultas hukum. Sinergi ketiga pihak tersebut dalam mewujudkan akses hukum yang baik pun dapat dibantu melalui kegiatan penyuluhan dan konsultasi hukum massal. Kata kunci: akses terhadap hukum; konsultasi hukum massal; penyuluhan hukum

Abstract

Given the importance of the role of notaries in ensuring legal certainty and order through the preparation of authentic Actes, the author considers it necessary to examine in depth the aspects of legal responsibility attached to the position of notary. In particular, the author's attention is focused on the issue of notary responsibility in the issuance of Actes that later become the subject of legal disputes, such as in cases of default on the transfer of shares. This research falls under the category of normative legal research, also often known as doctrinal legal research. This approach views law as a set of norms that apply in society within the framework of the national legal system, and focuses on the study of legislation and other legal materials as the main sources of analysis. Due to its nature, which is not directly related to empirical objects, this research is also referred to as library research or document study, given that the data sources used come from studies of legal documents and scientific literature, and are secondary data. Supreme Court Decision Number 4812 K/Pdt/2024 shows that an authentic Acte, which should have full probative force, can be annulled by the court if there was negligence on the part of the notary in the process of its creation, particularly in ensuring that the formal requirements for holding a GMS were met. In this case, the Acte of GMS Decision was declared invalid because it was drawn up without the presence or power of attorney of the majority shareholders, which should have been the basis for the validity of a GMS decision. The notary's negligence in verifying the validity of the meeting caused the Acte to lose its authenticity and harmed the legitimate shareholders.

Abstract

This study aims to describe the complete systematic land registration program, including its legal basis, procedures, and obstacles and solutions in its implementation. This study used an empirical legal study method that refers to secondary and primary data. The results of the study indicate that the complete systematic land registration program is based on Law Number 5 of 1960 concerning Basic Agrarian Principles and Regulation of the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency Number 6 of 2018. The implementation of the complete systematic land registration program includes location and budget preparation, collection of physical and legal data, bookkeeping and certificate issuance, and certificate delivery. Obstacles in the implementation of complete systematic land registration in Cibinong District include a lack of public understanding, differences in land area, limited land history data, and the existence of absentee land. Solutions to overcome obstacles in the implementation of complete systematic land registration include strengthening governance through outreach and cross-agency coordination, structuring transparent financing mechanisms, and updating land data through re-measurement and integration of digital land plot maps.
