Abstract

Legal protection related to personal data has been legalized but raises norms of vagueness. So the formulation of the problem, 1) How is the security arrangement of population administration data according to law number 27 of 2022 concerning personal data protection? and 2) How is the form of legal protection for the theft of population administration data in Indonesia. Using normative research methods. The results showed that the Personal Data Protection Law is still not maximized in its application, so it is still multi-interpretive in article 67 paragraph (2). The lack of clarity of the phrase "against the law" does not provide definite limits and understanding of each element in detail. The article will have a multi-interpretive impact in its application, which is vulnerable to abuse, for the purpose of criminalizing others. Factors that encourage the occurrence of criminal acts of data theft cases, ranging from factors of law enforcement officials, security, and official laws to the lack of knowledge of the law from the public in Indonesia, which is the strongest cause of criminal acts of personal data theft.

Abstract

Senganan Village is a village in Penebel District, Tabanan Regency with a population of 6,431 people, consisting of 3,186 males and 3,245 females, distributed across 12 Banjar Dinas. Senganan Village is one of the villages with great economic potential, and with this potential, the existence of the Village-Owned Enterprise (Bum Desa) becomes important to manage and utilize local resources. Senganan Village has the Semedi Karya Bum Desa, which has been established since 2014, but in recent times has faced several significant challenges that have disrupted business activities. The inactivity has resulted in incomplete business legality, especially regarding the registration of the Business Identification Number (NIB) that Bum Desa must have starting from 2023. Given the problems faced, the implementation of this community service activity is carried out using methods of socialization, training, technology application, mentoring, and program evaluation and sustainability. The result of this activity is that Bum Desa Semedi Karya is facing several issues, including legal cases involving previous management, a lack of understanding regarding the registration process for NIB based on OSS RBA, and unawareness of the benefits of business legality through NIB. To address this, socialization, training, mentoring, and post-training evaluation were conducted. Having an NIB also opens access to various facilities and government support, such as capital and training. However, the implementation of this system in Bum Desa Semedi Karya has not been fully realized due to inactivity in business over the past few years and the existence of legal cases that need to be resolved first. Once the legal issues are resolved, the NIB registration can be continued promptly

Abstract

Tanah merupakan salah satu kekayaan negara Indonesia yang menjadi modal dasar agar kehidupan masyarakat dapat adil dan makmur, sehingga pemanfaatannya harus berdasarkan prinsip-prinsip yang tumbuh dan berkembang dalam kehidupan masyarakat Indonesia. Penelitian tesis ini menggunakan Penelitian Hukum Normatif yang menganalisis tentang pembatalan Perjanjian Sewa-Sewa Tanah yang dialihkan kepada pihak ketiga. Rumusan masalah dalam penelitian skripsi ini adalah apa akibat hukum yang timbul jika pembatalan dialihkan kepada pihak ketiga? dan bagaimana pembatalan Perjanjian Sewa-Sewa Tanah dialihkan kepada pihak ketiga berdasarkan Putusan Mahkamah Agung Nomor: 1616 K/PDT/2018? Sebagai alat analisis untuk membahas hal tersebut digunakan Teori Perjanjian dan Teori Kepastian Hukum, serta menggunakan Pendekatan Statuta, Pendekatan Analitik dan Konseptual, Pendekatan Kasus dan Pendekatan Komparatif. Kesimpulan dari penelitian ini adalah akibat hukum yang timbul dari pembatalan yang dialihkan kepada pihak ketiga yaitu Perjanjian yang menggunakan warga negara Indonesia sebagai Nominee adalah penyelundupan yang sah karena substansinya bertentangan dengan Undang-Undang Pokok Agraria (UUPA), dimana secara substansi ketentuan dalam Pasal 9, Pasal 21, dan Pasal 26 ayat (2) UUPA tidak dapat menyimpang. Pada hakekatnya perjanjian nominee bertujuan untuk mengalihkan hak milik atas tanah kepada pihak asing, sehingga keberadaan akta otentik perjanjian nominee sebagai alat bukti menjadi batal demi hukum

Abstract

This community service activity aims to empower kris craft enterprises in Gianyar Regency by integrating cultural preservation and economic development. The focus is on Sanggar Nami Pusaka, a workshop that produces krises and is dedicated to cultural preservation. The main challenges faced by kris craftsmen include limited managerial and marketing knowledge, restricted market access, and artisan regeneration issues. This craft is often viewed as a traditional activity rather than a sustainable business. Using a Community-Based Empowerment (CBE) approach, the program provides direct assistance in technology implementation and strategic planning, with an evaluation stage to assess the impact and develop a sustainability plan for Nami Pusaka. The program aims to transform Nami Pusaka from a workshop into a more organized business. Through training, the workshop can now access broader markets via digital platforms and improve financial management. The program has led to increased income and strengthened cultural identity, demonstrating that traditional crafts can thrive as a sustainable economic sector. Future recommendations include expanding the program, collaborating with more partners, and focusing on the regeneration of young artisans, with the ultimate goal of global recognition for Gianyar's kris as both a cultural heritage and high-value product.

Abstract

Land management integrated with ecotourism is crucial for sustainable village development in rural Bali, where natural and cultural potential is often hampered by irregular land management, a lack of legal certainty over customary land, and the risk of agricultural land conversion. This community service program aims to address these issues in Sidan Village, Gianyar District, through an ecotourism-based land management approach to optimize tourism potential such as Kissidan Eco Hill while preserving the environment and cultural values. The methods used included land law socialization, the application of digital mapping technology for land inventory and zoning, and sustainability strategies through strengthening village and customary village institutions. Results showed increased community understanding of regulations such as the Basic Agrarian Law (UUPA), the Integrated Land Management System (PTSL), and the LP2B Protection Law, which differentiates between productive agricultural and tourism areas, as well as strengthened synergy between institutions to mitigate the risk of land disputes. Overall, this program successfully established Sidan Village as a model for sustainable ecotourism, balancing economic development, environmental conservation, and local wisdom through orderly and law-based land management.

Abstract

The Land Deed Official (PPAT) who has been appointed in Badung Regency but continues to work as staff at a notary office in Kalimantan is the background of this research. This study aims to analyze the role and effectiveness of the Advisory and Supervisory Board of PPAT in Badung Regency in carrying out the duties, authorities, guidance, and supervision conducted by the Head of the Land Office of Badung Regency. Using an empirical legal research method, this study explains the gap between norms and practice (das sollen and das sein). The results of the study show that the implementation of the board's duties has been in accordance with the scope of its authority; however, the effectiveness of guidance and supervision still requires additional technical regulations so that the mechanism can function optimally as expected by the government.

Abstract

The transfer of Building Use Rights to Ownership Rights is an important aspect in the regulation of agrarian law in Indonesia, especially after the issuance of Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration. In this study, the normative legal research method is used. Regulations related to the transfer of Building Use Rights to Ownership Rights are regulated in Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units and Land Registration. Provisions regarding whether or not a Building Use Right can be transferred are stated in Article 45 paragraph (2) of the Article as the basis or basis for someone to change their Rights from Building Use Rights to Ownership Rights. The change of Building Use Rights to Ownership Rights has been clarified in Article 94 of Government Regulation Number 18 of 2021. The form of implementation of Article 48 of Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units and Land Registration and also as an effort to realize the government regulation. Determining priority rights over land in the form of Building Use Rights (HGB) that have expired depends on three factors: the subject of the rights, in terms of who submits the application for the rights, usually the subject of the rights whose name is recorded on the certificate (the former rights holder); the subject of the rights who submits the application must be able to prove that they are truly entitled to the land; and the land use is in accordance with the intent of the granting of the rights in question.

Abstract

This study discusses the regulation of notary fees in Article 36 of the Notary Law (UUJN) in relation to the principles of legal certainty and justice. The problem arises because this provision regulates the maximum fee, but does not provide clear parameters regarding economic and sociological values, nor does it regulate the minimum fee. This study uses a normative legal research method with a regulatory approach and a conceptual approach using primary, secondary, and tertiary legal materials. The results of the study show that the regulation of notary fees provides legal legitimacy for notaries to receive compensation for the legal services they provide and aims to provide legal protection for notaries and the public. However, the ambiguity of the norms in this provision has the potential to cause differences in interpretation and tariff competition between notaries. Therefore, the determination of notary fees needs to be done proportionally by taking into account legal provisions, professional codes of ethics, and social conditions.

Abstract

This community service program aims to provide training and assistance in making the Articles of Association Document of the Bylaws and Organizational Administration Tools for the youth management of ST Yowana Mekar, which is assisted by lecturer service. Through this activity, it is hoped that the youth management of ST Yowana Mekar can organize their organization in a healthy, orderly, and orderly manner so that the Vision can be realized. The method used to achieve the goal is technical and participatory guidance. The form of participatory empowerment activities is in the form of active participation of participants in activities carried out by the team in workshops, mentoring, and monitoring-evaluation. The steps of its activities are as follows: 1) Workshop on the Articles of Association document of the Bylaws for an organization, to provide an understanding of the importance of the Articles of Association document of the Bylaws for an organization, 2) Training on making documents of the Articles of Association of the Bylaws, 3) Assistance in finalizing the preparation of the Articles of Association document of the Bylaws. The result of the activity is: that the Youth organization ST Yowana Mekar can create and have a Balinese-language Bylaws document of the Bylaws.
