Abstract

This research is conducted to describe the impact of the issuance of Government Regulation Number 11 of 2010 on the Control and Utilization of Abandoned Land that serves as an important part of the agrarian reform agenda. It is relevant to the solution to counteract and eradicate the crisis of poverty by providing land and other facilities necessary for production so that people are able to work more productively and live a prosperous life. Essentially, it involves the whole process of restructuring the tenure, ownership, use, and utilization of land in order to achieve social welfare and justice. This research applies normative legal methods to conduct a literary review because of the characteristics and traditions of law. The approaches used in legal research are the statute approach, the case approach, and the conceptual approach. The results of the research show that agrarian reform needs to be included in the nation's agenda and the basic strategy of the country to build a just political, economic and social structure. This is the relevance of placing all references, understanding, scope, and usefulness of the management of "the abandoned land which later becomes the state property" in realizing the true agrarian reform.

Abstract

National land laws prohibit the ownership right of land by foreigners as reflected in the provisions of Article 9 UPPA, the Basic Agrarian Law, which confirm that only Indonesian citizens who can have ownership rights on the land. In addition, the provisions of Article 26 Paragraph (2) UUPA also prohibit the transfer of ownership of land from the citizen of Indonesian to foreign citizen, both directly and indirectly. Legal consequences of the deed of agreement of the land ownership rights of Indonesian citizen by foreign citizens made by a notary public is null and void because the objective conditions are not met, as postulated by Article 1320 of the Civil Code. Indeed ownership rights to land by foreign citizens, either directly or indirectly does not promise a legal protection to the party concerned.

Abstract

The efforts to reduce poverty through increasing the role of traditional villages are very appropriate to do especially in Bali. Based on the mandate of the Regional Regulation Province Bali Number 4 of 2019 Regarding Traditional Villages, the Poh Bergong Traditional Village through a perm formed Utsaha Padruwen Desa Adat (BUPDA) managed by the traditional village. This study aims to examine the implementation of BUPDA institutions in the management and utilization of customary village land assets in Bali. The research method used is normative legal research using a statutory approach and a conceptual approach. The results of the study indicate that the development of BUPDA management uses the objective of access reform with the concept of Tri Hita Karana, the implementation of BUPDA in the management of access reform which aims to prosper the indigenous peoples and relieve the person of the community in carrying out the custom.

Abstract

This study aims to analyze the urgency of land banks in maintaining the existence of land acquisition for development. This research method uses normative legal research methods with a statutory approach and a conceptual approach. The types and sources of legal materials used are primary, secondary and non-legal legal materials. The method of collecting legal materials uses the method of literature study. Analysis of legal materials using qualitative descriptive analysis. Based on the results of the study, it shows that the urgency of the Land Bank in land acquisition activities for development has the function of overcoming the problem of the form and value of compensation for land acquisition objects, preventing the growth of inventory of land needs for development activities for the public interest and reducing the implementation of land acquisition activities that require large costs and that take people's rights to their land.

Abstract

Penelitian ini di lakukan untuk menganalisa keteraturan hukum di masyarakat, Permasalahan Hak milik dalam Hal memiliki tempat tinggal serta lingkungan hidup yang baik dan sehat, adalah merupakan hak dasar setiap warga negara Indonesia. hakikatnyastrata title terdapat gabungan kepemilikan bersama dan kepemilikan individu. Hal ini tidak dikenal dalam kepemilikan tanah dan rumah pada kawasan horizontal seperti komplek perumahan (real estate) atau pemukiman lainnya baik di perkotaan maupun perkampungan. Penelitian ini menggunakan metode hukum yuridis Normatif untuk melakukan studi pustaka karena ciri khas dan tradisi ilmu hukumPendekatan yang digunakan didalam penelitian hukum adalah pendekatan peraturan perundang-undangan (statue opprach), pendekatan kasus (case opprach) dan pendekatan konseptual (conceptual opprach). Hasil penelitian menunjukan bahwa rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik sebagai tempat hunian dan jenis pembebanan hak atas satuan rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik dapat serta memperbaiki akses masyarakat kepada sumber-sumber ekonomi, terutama tanah atas penguasaan pemilikan, penggunaan dan pemanfaatan tanah dan sumber-sumber pertanahan untuk meminimalisir sengketa Pertanahan untuk meningkatkan kesejahteraan masyarakat. This research is done to analyze the legal regulation in the community. The issue of property rights in terms of having a good and healthy living place and environment is the basic right of every Indonesian citizen. the essence of the title is that of joint ownership and individual ownership. It is not known in the ownership of land and houses in the horizontal area such as housing complex (real estate) or other settlements in both urban and settlement areas. This research uses Normative juridical legal method to conduct literature study because of the characteristic and traditions of law. The approach used in legal research is the approach of legislation (statue opprach), case approach (case opprach) and conceptual approach (conceptual opprach). The result of the research shows that the flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik as the dwelling place and the type of imposition of the right to the unit of flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik can also improve the public access to the sources economic, especially land over ownership, use and utilization of land and land resources to minimize land disputes to improve people's welfare.

Abstract

Dalam dunia bisnis, suatu kerjasama tidak bisa lepas dari perjanjian yang dibuat.Di Dalam pelaksanaan perjanjian kerjasama antara UD.Citra dengan Restoran Nebula Kuta telah terjadi perselisihan mengenai ketidakseimbangan hak dan kewajiban antara para pihak. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan perjanjian kerjasama antara UD. Citra dengan restoran nebula kuta dalam bidang supplier buah dan sayur dan bagaimana penyelesaian perselisihan apabila terjadi wanprestasi dalam pelaksanaan perjanjian kerjasama antara UD. Citra dengan restoran nebula kuta dalam bidang supplier buah dan sayur. Metode dalam penelitian ini adalah jenis penelitian hukum empiris. Pendekatan masalah yang digunakan adalah pendekatan fakta. Berdasarkan hasil penelitian UD. Citra dengan Restoran Nebula Kuta membuat perjanjian berupa kontrak harga dan pembayaran yang harus dilakukan oleh Restoran Nebula Kuta selama 2 (dua) bulan sekali. Terjadinya perselisihan dikarenakan Restoran Nebula Kuta tidak memenuhi prestasi dalam hal ini yaitu tidak melakukan kewajibannya dalam melakukan pembayaran terhadap pihak UD. Citra. Penyelesaian sengketa dilakukan dengan pembuatan surat perjanjian utang piutang.

Abstract

Salah satu resiko tinggi dalam dunia pekerjaan adalah Pekerjaan Dalam Keadaan Bertegangan (PDKB) yang dilakukan oleh pekerja teknisi lapangan di PT. PLN (PERSERO). Penelitian ini bertujuan untuk menilai tanggung jawab PT. PLN (PERSERO) Rayon Mengwi dalam pelaksanaan keselamatan dan kesehatan pekerja teknisi lapangan. Penelitian ini menggunakan pendekatan hukum empiris dengan melakukan wawancara terhadap pihak terkait dan studi bahan hukum, serta menggabungkan pendekatan perundang-undangan dan pendekatan fakta. Hasil penelitian menunjukkan bahwa pelaksanaan keselamatan dan kesehatan kerja di PT. PLN (PERSERO) Rayon Mengwi, Badung, belum memenuhi standar peraturan perundang-undangan. Hal ini terutama disebabkan oleh kurangnya kedisiplinan pekerja dalam menggunakan Alat Pelindung Diri yang telah disediakan oleh perusahaan. Situasi ini dapat memiliki konsekuensi fatal dan mengancam nyawa pekerja. Keterbatasan jumlah pengawas juga menjadi faktor yang membuat perusahaan kesulitan dalam memantau tingkat kedisiplinan pekerja terhadap peraturan keselamatan dan kesehatan kerja di tempat kerja.

Abstract

Cooperatives which regulate the movement of business fields in the formation of capital from the savings of its members regularly and continuously and can also be lent to its members in a practical, easy and fast way are called Savings and Loans Cooperatives for welfare purposes. That way the aim of establishing it is to make it easier for the community to make financial transactions easier, with the existence of a savings and loan cooperative that provides small interest but opportunities in capital can be cheap. With normative law implemented in the method used in this study, allowances from sources such as principles, principles, and legal literature are used in resolving cases of default on borrowing money in cooperatives. The results of this study are the results of evidence in court proceedings, evidence can be submitted by the plaintiff and the truth of the lawsuit and the defendant does not deny it. The proof of the case made the judge declare that it was legal to have defaulted on borrowing money within the scope of the cooperative.

Abstract

The tourism business is the mainstay of the Small Island of Nusa Penida as an inseparable part of the Island of the Gods, Bali. The existence of the COVID-19 Pandemic has made Bali tourism and is no exception also an impact on the tourism business in Nusa Penida. The people's economy in Nusa Penida experienced very severe shocks and even eroded almost all economic sectors; including the impact on the financial services sector owned by a traditional village called the Village Credit Institution (LPD). Bali tourism, especially Nusa Penida as one of the world's tourist destinations during the COVID-19 Pandemic, has drained the energy of the management of Traditional Village LPDs throughout Bali, because many people from Traditional Villages have lost their purchasing power as a result of COVID-19, so that the principle of good faith in the world business is often neglected and even overtaken by the demands of the bowels. After the COVID-19 pandemic era, many LPD administrators were faced with a dilemma between saving LPD operations due to the large number of problem loans with a sense of empathy for indigenous village residents who were unable to pay credit installments as a result of loss of income as a result of COVID-19. Even though the COVID-19 pandemic has passed on the surface, the feeling of anxiety about the emergence of a new variant continues to create anxiety among LPD administrators. Related to this dilemma, this paper examines legal issues related to "rescuing problem loans" faced by LPDs after the COD-19 pandemic occurred in the tourist area of Nusa Penida Island. This legal issue will be studied using a normative legal approach supplemented by a sociological approach carried out by LPD administrators throughout the Nusa Penida District, Klungkung Regency -Bali.

Abstract

This Community Service is focused on socializing the legal legality of controlling coastal land by foreigners in Bali for tourism business purposes. The method used is empirical legal research with a statutory regulatory approach, conceptual approach, sociological approach and case approach. Based on authority theory, benefit theory and legal protection theory as analytical tools, it can be understood that the tourism business in Bali cannot be separated from the presence of foreigners. Likewise, the control of coastal land in Bali is not free from control by foreigners, either through legal or illegal investment, by taking advantage of mutually beneficial cooperation between local residents, as well as with Ada Village officials on the basis of sharing profits. The Balinese people, who have a unique culture with Hindu religious nuances, in their daily lives and in running business in the tourism sector are always based on the "Tri Hita Karana Philosophy" which is manifested in behavior that maintains a harmonious relationship between "Man and God", Man and Nature, and “Humans with other Humans”. In this philosophy, the principle of good faith in investing is reflected, so that control of coastal land by foreigners for tourism business purposes is obliged to respect this very noble principle; However, in empirical facts it turns out that the control of coastal lands in Bali by foreigners under the guise of mutually beneficial cooperation actually tends to be detrimental to the use of traditional villages in implementing the religious values attached to these coastal lands. In the concept of mutually beneficial cooperation, it actually contains the bad intentions of foreigners to control Balinese land just to gain personal benefits at the expense of Bali's nature which is wrapped in mutually beneficial cooperation.
