Abstract

This study analyzes the inheritance rights of children from interfaith marriages under Balinese customary law. It was found that children who followed the mother's religion only inherited from the mother's side, not from the father's side. This is supported by the decision of the Denpasar District Court Number 483/Pdt.G/2020/PN Dps, which states that non-Hindu children cannot inherit from their Hindu father's family. This study concludes that religious changes during marriage affect children's inheritance rights in Balinese customary law.

Abstract

This study examines the effectiveness of Government Regulation Number 24 of 2016 which expands the work area of PPAT from districts/cities to one province. The method uses empirical legal research by elaborating the theory of legal certainty, legal effectiveness, and legal authority. Data was obtained through observation and interviews in Badung and Bangli Regencies. The results show that the implementation has not been effective due to the absence of implementing regulations, thus causing legal uncertainty and potential conflicts of authority. This study recommends accelerating the preparation of technical regulations to support the effectiveness of land administration.

Abstract

Bank guarantee is a guarantee in a work outsourcing agreement that protects the bouwheer from the contractor's default. However, in practice, the disbursement of bank guarantees often faces obstacles, especially when the contractor goes bankrupt. Banks often refuse disbursements for administrative reasons that do not have a clear legal basis, thus creating legal uncertainty for bouwheer. This research uses normative legal methods with legislative, conceptual and case approaches. This approach is used because there are vague norms in the arrangement of bank guarantees, especially regarding legal protection for bouwheer. Although there are regulations on bank guarantees, the existing rules focus more on the responsibility of banks without explicitly regulating bouwheer's rights in the disbursement of collateral. The results of the study show that legal protection for bouwheer is divided into preventive and repressive protection. Preventive protection includes strict contractual clauses, the selection of credible banks, and supervision of the execution of guarantees. Repressive protection is carried out through non-litigation and litigation channels in the event of disbursement denial without a valid reason. Decision No. 159/Pdt.G/2023/PN Ptk emphasizes that banks are still obliged to disburse guarantees even if the contractor is bankrupt, and rejection without legal basis can be categorized as default by banks.

Abstract

Non-performing loans pose a serious challenge in the banking sector, especially for Rural Credit Banks (BPR). One of the solutions is through the takeover of collateral or AYDA. This study aims to examine the authority of notaries in the creation of deeds concerning credit guarantees as part of the non-performing loan resolution process. The research method used is empirical with a qualitative approach, through interviews with three notaries/PPAT in the Denpasar area and one notary/PPAT in the Badung area. The data collection techniques used are Purposive Sampling, Interview Technique, Observation Technique, and Documentation Technique. The research results show that notaries are authorized to draft the AYDA deed based on non-performing loan collateral still burdened by a mortgage, based on an agreement between the creditor and the debtor. The debtor must first create a statement letter of collateral surrender to the creditor, which is subsequently followed up by the Notary with the drafting of several deeds for the benefit of both parties, namely the power of attorney, debt settlement agreement deed, sale and purchase deed, sale and purchase binding agreement, and eviction agreement.

Abstract

Tanah merupakan salah satu kekayaan negara Indonesia yang menjadi modal dasar agar kehidupan masyarakat dapat adil dan makmur, sehingga pemanfaatannya harus berdasarkan prinsip-prinsip yang tumbuh dan berkembang dalam kehidupan masyarakat Indonesia. Penelitian tesis ini menggunakan Penelitian Hukum Normatif yang menganalisis tentang pembatalan Perjanjian Sewa-Sewa Tanah yang dialihkan kepada pihak ketiga. Rumusan masalah dalam penelitian skripsi ini adalah apa akibat hukum yang timbul jika pembatalan dialihkan kepada pihak ketiga? dan bagaimana pembatalan Perjanjian Sewa-Sewa Tanah dialihkan kepada pihak ketiga berdasarkan Putusan Mahkamah Agung Nomor: 1616 K/PDT/2018? Sebagai alat analisis untuk membahas hal tersebut digunakan Teori Perjanjian dan Teori Kepastian Hukum, serta menggunakan Pendekatan Statuta, Pendekatan Analitik dan Konseptual, Pendekatan Kasus dan Pendekatan Komparatif. Kesimpulan dari penelitian ini adalah akibat hukum yang timbul dari pembatalan yang dialihkan kepada pihak ketiga yaitu Perjanjian yang menggunakan warga negara Indonesia sebagai Nominee adalah penyelundupan yang sah karena substansinya bertentangan dengan Undang-Undang Pokok Agraria (UUPA), dimana secara substansi ketentuan dalam Pasal 9, Pasal 21, dan Pasal 26 ayat (2) UUPA tidak dapat menyimpang. Pada hakekatnya perjanjian nominee bertujuan untuk mengalihkan hak milik atas tanah kepada pihak asing, sehingga keberadaan akta otentik perjanjian nominee sebagai alat bukti menjadi batal demi hukum

Abstract

Because there is a shift in the meaning of belis from a cultural tradition to something that is considered a burden and burdensome for men as the party who gives belis, this also causes the giving of belis to not be carried out in full before the marriage takes place. So from this it is very good to examine if the belis is not fully implemented whether the heirs' rights for the heirs will be obtained. Rather than this, this study uses an empirical legal research method by using a conceptual approach. Where the source of data for this research is obtained through primary data obtained through the results of interviews, observations and documentation. Secondary data is obtained through applicable laws and regulations. The data source is then analyzed with description techniques and legal discovery techniques in the field. The result of this study is that if the marriage status of the belis that has not been paid in full in Hambraping village, then the man will be obliged to prepare land and land for the woman who is in the village which is usually called Laku Longgamai which means that the woman is not allowed to visit the man's house and is only allowed once a month if the woman returns to her biological parents' house,  It is also not allowed to stay overnight and stay overnight.

Abstract

Gelgel Village is one of the villages in Bali known for producing Balinese woven fabrics, namely songket and endek fabrics. Songket/endek fabric is one of the characteristics of Balinese cultural products. In order to preserve songket weaving, legal protection is necessary. Moving on from this matter, there are several problems experienced by participants in this program, namely: 1) Lack of interest of the younger generation in working as weavers, 2) Lack of compatibility of work results required by employers with weavers, and 3) Legal protection for workers and employers of songket/short cloth weaving in Gelgel Village, Klungkung. The activities carried out in this program were to provide counseling on the importance of preserving songket weaving as a cultural characteristic. These activities increased the younger generation's interest in weavers by counseling them on preserving songket weaving as a cultural characteristic. In addition, a good working relationship is needed in the songket/short woven fabric production process so that the weaving results are by the expectations of employers and consumers. Legal protection for weaving workers is to provide their rights as workers by applicable laws and regulations. Entrepreneurs are also encouraged to get legal protection by making Intellectual Property Rights (IPR) in the form of Copyright.

Abstract

The Land Bank Agency faces various challenges, these challenges include limited accurate spatial data, frequent agrarian conflicts between indigenous peoples, farmers, and large companies, and weak coordination between government institutions. In addition, policy implementation is often hampered by bureaucratic issues, overlapping regulations, and low community participation in the decision-making process. Therefore, an innovative approach and learning from best practices in other countries that have previously implemented similar policies are needed. One country that has long experience in implementing agrarian reform is Malaysia. Through the establishment of The Federal Land Development Authority (FELDA) in 1956. The type of research that researchers use in this study is a qualitative descriptive research method. The approach used in this study is normative juridical descriptive. The research was conducted by literature study to obtain legal materials and using document study techniques. The Malaysian land bank, FELDA, has been established for a long time, namely in 1956, compared to the Indonesian Land Bank Agency, which only had definite regulations in 2021 and FELDA has a different implementation mechanism compared to Indonesia, namely FELDA focuses more on implementing land banks in the agricultural sector, while the implementation of land banks in Indonesia tends to be relatively new.

Abstract

The problem of manpower or labors is an typicals problems that we headr for develop country, included Indonesia. One of those problems is terminations of employment by the company. Based on the descriptions of the text above, author can formulates two problems that will be discuss in this paper. The problems formulations at this research are: How the Wage System in Law Number 11 of 2020 concerned occupation Creations? And how determination of the workers' wages based on Article 88 C of Law Number 11 of 2020 concerning Job Creation? The types of researches used is normative legal research, that are legal research conducted by researching library materials. The conclusion in this study is that the Government changed the wage provisions in Law No. 11 of 2020 concerning Job Creation. These changes include the abolition of the district/city minimums wage (UMK) and the sector-based minimum wage in the province or district/city. The Employment Creation Act changes the policy regarding the wages of workers which was previously regulated by the Manpower Act.

Abstract

Notaris dapat diketahui merupakan pejabat publik yang memiliki suatu wewenang dalam pengurusan suatu tanah yang melakukan tugasnya berpacu pada suatu aturan yaitu UUJN serta UUJN-P. Dalam melakukan tugasnya untuk menggantikan notaris karena notaris mengalami halangan maka akan digantikan oleh notaris pengganti. Sama dengan notaris, notaris pengganti juga melakukan tugasnya berdasarkan peraturan dalam UUJN dan UUJN-P. Setiap notaris memiliki perlindungan hukum sebagaimana dalam Pasal 66 ayat (1) dari UUJN-P tetapi perlindungan hukum yang diatur dalam pengaturan itu hanya untuk notaris saja, sehingga perlindungan hukum untuk notaris pengganti mengalami kekosongan norma. Dalam melakukan penelitian, peneliti merumuskan dua rumusan masalah yaitu, Bagaimana kewenangan dan tanggung jawab Notaris Pengganti dalam pembuatan akta otentik? serta Bagaimana bentuk perlindungan hukum bagi Notaris Pengganti dalam hal pemanggilan berkaitan dengan kepentingan proses peradilan pidana terkait dengan akta yang dibuat dihadapannya? Menggunakan tipe penelitian hukum normatif, melihat hasil penelitian bahwa jabatan notaris pengganti memiliki suatu kewenangan yang memang sama dengan notaris yang mengakibatkan dokumen-dokumen yang dibuat dan dikerjakan olehnya mempunyai kekuatan hukum yang memang sama. UUJN maupun UUJN-P belum memberikan perlindungan hukum secara preventif kepada notaris pengganti sehingga mengalami kekosongan norma. Notaris pengganti seharusnya memiliki dua bentuk perlindungan hukum yaitu, represif serta perlindungan preventif.
