Abstract

The Good Faith Principle is one of the fundamental principles in Contract Law according to Civil Law scholarship, as stipulated in the Civil Code (Kitab Undang-undang Hukum Perdata) that every agreement (contract) must be executed in good faith. This principle itself has been extensively studied with various interpretations regarding the meaning of the good faith principle. This paper aims to examine the conception of the Good Faith Principle in Contract Law from an Islamic perspective, which subsequently reveals that first, in various verses of the Quran and in the Hadith, there are prohibitions against acts containing bad faith, which means violating the principle of good faith; second, that good faith is a reflection of one's piety. A person who acknowledges themselves as a Muslim and believes in the matters prescribed in the Quran and Hadith is on a path to attaining happiness, which is the ultimate goal of a Muslim

Abstract

This study explained that as time goes by (the era of globalization), problems in the field of employment are increasing, one of which is the clarity of legal protection for workers based on certain term work agreements. This research uses normative methodology through library research. Fixed-term work agreements and non-permanent workers in Indonesia still require legal protection regarding job status and security. Inappropriate conditions in an employment relationship between workers/laborers and employers are mainly related to the issue of fulfilling workers' rights within the scope of their work. The government has an important role in regulating labor regulations, especially as these regulations or norms serve as the basis for worker safety. Now, workers can know the laws that regulate the obligations between recipients and employers to prevent exploitation of workers and that there is a negotiation stage first before an agreement is made. It also regulates permits for termination of employment rights (PHK) which result in the end of the rights and obligations between the worker/employee and the employer. Therefore, it is natural for the government to regulate regulations, not only protecting workers' rights but also paying attention to the company's financial capacity by providing maximum regulations evenly.

Abstract

Program pengabdian masyarakat dengan tema "HOPE BOX untuk DUAFA" merupakan kolaborasi dalam community service antara Institut Ilmu Sosial dan Bisnis Andi Sapada dengan The Faculty of Business Management and Professional Studies, Management and Science University, Malaysia. Pengadian kepada Masyarakat dibiayai oleh kedua Institusi yang kemudian dikonversi dalam bentuk box yang berisi berbagai macam barang seperti pakaian, obat-obatan, dan lain-lain. Hasil dari kegiatan ini mencakup peningkatan kesejahteraan Masyarakat khususnya kaum duafa yang hidup dibawah garis kemiskinan yang dalam kehidupan sehari-hari kebutuhan mereka belum cukup terpenuhi. Selain itu, Masyarakat pada umumnya dapat lebih terbuka untuk melaksanakan kegiatan-kegiatan serupa.

Abstract

Desa Kamiri berasal dari pemekaran Kelurahan Takkalasi Kecamatan Soppeng Riaja Kabupaten Barru Provinsi Sulawesi Selatan. Desa ini memiliki beberapa potensi wisata salah satunya wisata air terjun To Magelli, yang terletak di Dusun Rumpiah. Dalam usaha meningkatkan potensi serta menarik wisatawan Institut Andi Sapada bekerjasama dengan pemerintah Desa Kamiri, mengadakan bakti sosial di sekitar lokasi Air terjun, seperti membersihkan jalanan menuju Lokasi Air Terjun, serta memberikan bantuan berupa Tali tambang pada akses jalan menuju air terjun yang medannya cukup curam dan berbatu.

Abstract

Undang-Undang Nomor 31 Tahun 1999 jo Undang-Undang Nomor 20 Tahun 2001 tentang “Pemberantasan Tindak Pidana Korupsi” (UU Tipikor) telah menjadi dasar hukum utama untuk menangani tindak pidana korupsi. Namun, setalah disahkannya Kitab Undang-Undang Hukum Pidana (KUHP) Nasional pada tahun 2023 justru berdampak pada penegakan hukum tindak pidana korupsi karena perbedaan sanksi yang mencolok. Penelitian bertujuan untuk memperbandingkan sanksi dan potensi implikasi dari penerapan KUHP Nasiona terhadap penegakan hukum di Indonesia. Penelitian ini menggunakan metode penelitian normatif dengan dua pendekatan yakni pendekatan perundang-undangan dan pendekatan perbandingan. Temuan menujukkan bahwa sanksi yang terdapat dalam KUHP Nasional ringan dibandingkan sanksi yang diatur dalam UU Tipikor dan hal ini berpotensi untuk menjadi celah dalam mekanisme penegakan hukum. Kata Kunci: Hukum, Korupsi, Pidana, Sanksi, KUHP Nasional.

Abstract

This study examines the evolution of the legislative power relationship between the House of Representatives (DPR) and the President within Indonesia's constitutional framework, particularly before and after the amendments to the 1945 Constitution. It aims to identify how constitutional reforms have reshaped the distribution of legislative authority and whether they have succeeded in achieving a substantive balance of power. Using a qualitative, normative juridical approach with historical and comparative analysis, the study explores relevant constitutional documents, laws, and Constitutional Court decisions. The findings reveal that although the constitutional amendments shifted the Indonesian system from presidential dominance to a formal balance of power, lawmaking practices remain heavily influenced by executive control. The president retains significant authority in legislative initiation and formulation, while the role of the DPR is often constrained by political and institutional constraints. Consequently, the principle of checks and balances in Indonesia's presidential system tends to be cooperative rather than competitive, with procedural balance lacking substantive equality. The study concludes that constitutional reforms must be complemented by institutional strengthening of the DPR through increased research capacity, professional legislative drafting, and increased public participation. This study contributes to the theoretical discourse on constitutionalism by proposing a cooperative checks and balances model suitable for presidential systems characterized by asymmetric power relations

Abstract

This assimilation program is a right obtained by all prisoners and children who meet the requirements. The purpose of this study is to answer 2 (two) main problems, namely the extent to which the implementation of the rules of assimilation and the right of integration at home for prisoners in Class II A Prison in Parepare City, and can the implementation of the rules of assimilation and the right of integration at home for prisoners have an effect in suppressing the spread of Covid-19 at Class II A Prison in Parepare City. This research is an experimental research that uses empirical or non-doctrinal legal research with a quantitative approach to prisoners and their warden staff Rules; Assimilation; Covid-19 at Class II A Prison in Parepare City. This assimilation aims to measure the level of citizen protection as an influencing variable (X1), equal rights for prisoners as a variable (X2), and the provision of health insurance for all citizens (X3) in suppressing the spread of the covid outbreak as the dependent variable (Y). in the Class IIA Prison in Parepare.

Abstract

This study aims to find civil law arrangements regarding the juridical analysis of breaking a promise to marry or what is commonly referred to as Broken Marriage Promises as an unlawful act. What are the legal consequences of breaking a marriage promise as unlawful? This study uses a normative legal research type with a statutory approach. The types and sources of legal materials use primary, secondary, and tertiary legal materials. Analysis of legal materials uses deductive logical reasoning, which is studied from a qualitative perspective. The results of the study show that breaking a promise to marry or commonly called promises of marriage as an unlawful act, is regulated in Article 58 of the Civil Code and several judges' decisions such as Supreme Court Decision Number 3191 K/Pdt/1984, Supreme Court Decision Number 3277 K/Pdt/2000, Decision of the Supreme Court Number 1644 K/Pdt/2020. The legal consequences of breaking a marriage promise as an unlawful act, namely if a person suffers a loss due to breaking of the marriage promise, both material and immaterial losses, then he can be sued for compensation following the loss suffered if the element of the unlawful act is fulfilled according to Article 1365 of the Civil Code.
