Abstract

This research delves into the implementation of divorce case mediation at the Enrekang Religious Court, emphasizing the pre-mediation stages, mediation implementation, and final reporting to the case judge. Findings reveal a structured process involving problem identification, proposal of alternative solutions, and consultation. The mediator is mandated to report mediation outcomes and legal consequences, including a written agreement signed by parties. In cases of agreement, parties present the signed agreement to the judge, potentially leading to a peace decision. The Settlement Agreement, validated by a Deed of Settlement, adheres to court disclosure regulations.

Abstract

Suara yang lantang melawan ketidakadilan menjelaskan kondisi yang menuntut keadilan. Dalam mencapai kesejahteraan sosial, perlu ada teori-teori yang berbicara tentang keadilan. Teori-teori yang dapat menggambarkan seperti apa keadilan itu, dan bagaimana mengaplikasikannya dalam kehidupan dengan segala permasalahannya yang semakin kompleks. Artikel ini berusaha untuk membahas penggalan-penggalan teori tentang keadilan. Penelitian ini menggunakan pendekatan interdisipliner dalam ilmu hukum atau biasa disebut dengan penelitian sosio-legal. Prinsip keadilan utilitarianisme memberikan pemahaman bahwa keadilan dapat diukur, setidaknya mampu memberikan atau paling tidak secara teoritis memberikan metode konkret dalam pengambilan keputusan yang sulit. Kemudian, prinsip keadilan kelompok liberalisme egalitarian mengedepankan prinsip keadilan yang disebut dengan justice as fairness atau keadilan sebagai persamaan. Sementara itu, prinsip keadilan historis pada hakikatnya adalah tindakan mengambil sesuatu yang tidak boleh merugikan orang lain, harus dilakukan secara sukarela kepada orang lain yang didasarkan pada pengalihan kepemilikan atas suatu keadaan atau tindakan di masa lampau yang dapat menciptakan hak atas sesuatu.

Abstract

Investment is the allocation of capital or resources with the aim of gaining profits in the future. Foreign investment is often considered the primary driver of economic development as it can increase the amount of capital available for development, create jobs, and introduce new technologies and management skills. In Indonesia, investment activities are regulated under Law Number 25 of 2007 concerning Investment and Law Number 6 of 2023 concerning Job Creation, widely known as the Omnibus Law, which also regulates investment. Despite having various regulations, the protection mechanisms are often debated, especially when conflicts arise between foreign investors and the government or local parties. Therefore, it is important to study how legal protection and dispute resolution related to foreign investment in Indonesia are addressed. The research method used in this study is normative with a comparative, legislative, and analytical approach. The types of data used in this research are primary and secondary data, where primary data consist of legislation, while secondary data consist of published documents that are not in official form, including legal textbooks, legal journals, legal papers, and so forth. The data analysis technique is qualitative and presented descriptively by explaining, describing, and illustrating issues closely related to the topic, then drawing conclusions based on analysis using deductive logic in line with prescriptive discipline. The results of the study show that both Law Number 6 of 2023 and Law Number 25 of 2007 provide legal protection to foreign investors, although the focus and approach used to provide such protection differ.

Abstract

This research was conducted with the aim of knowing the legal force of the deed of binding sale and purchase agreement on land rights (PPJB) made before a notary/PPAT and to find out the legal protection for the parties in the binding agreement on sale and purchase of land rights (PPJB). The type of research used in this study is normative research, which is a process of finding legal rules, legal principles, and legal doctrines to answer the legal issues at hand. Legal research that examines rules or norms is referred to as normative research, so the research method used is the Normative legal research method which will analyze the Deed of Sale Agreement (PPJB) of Land Rights. Based on the analysis of data and facts, in chapter four above, the following conclusions can be drawn: The legal force of the Sale and Purchase Agreement (PPJB) of Land Rights made before a Notary/PPAT, depending on where the sale and purchase agreement is made, if not before a public official (notary) then it becomes a private deed whereas if it is made by or before public officials, the deed becomes an authentic deed. This is in accordance with Article 1868 of the Indonesian Civil Code that a deed can become an authentic deed if it is made before the authorized public official at the place where the deed was made. And As for the legal protection for the parties, especially the buyer in a sale and purchase agreement that is carried out privately, the legal protection provided in the binding sale and purchase agreement is very strong because of the nature of proof of the binding sale and purchase agreement made before a public official in this case a Notary. Namely by signing the deed in front of a Notary or official appointed for signature validation (such as Consular Officers, Embassies, or Regional Heads starting from the Regent level and above) by explaining the contents first to the parties and then signing in front of a Notary or an authorized public official has very strong evidence in accordance with the evidence from the authentic deed.

Abstract

This study aims to determine the legal basis that can bind unwritten debt agreements and to determine the strength of unwritten debt agreements as evidence. This study uses a type of normative legal research with a statutory approach and an analytical approach by examining and analyzing the legal issues being faced. The results of the research show that the legal basis that binds an unwritten debt agreement is contained in article 1313 of the Civil Code which states that an agreement is an act by which one or more parties bind themselves to another or more people. So the unwritten debt agreement must comply with the legal requirements of an agreement by Article 1320 of the Civil Code. And legally valid agreements apply as laws for those who make them, this is by Article 1338 Paragraph (1). For evidence that can be used in the event of a default on one of the parties, that is, you can use evidence of testimony (by bringing in more than one witness) and can be strengthened by electronic mail evidence.

Abstract

This program aims to empower students, specifically Generation Z, to become pioneers in applying zero waste principles. Through the production of eco-friendly soap, participants not only contribute to waste reduction but also experience various other benefits. By reducing the use of harmful chemicals in soap and its packaging, students can protect and improve their health. Moreover, the program offers a more economical solution, enabling students to manage resources more wisely. In the long term, this initiative contributes to environmental sustainability, fostering collective awareness of the importance of preserving the earth for future generations. Thus, the students of SMA Negeri 4 Parepare are not merely participants but also warriors who inspire positive change within their community.

Abstract

Home Ownership Loans (KPR) offered by PT Bank Tabungan Negara (persero) Tbk. (Bank BTN) are superior products in housing financing. However, the risk of bad loans remains a significant challenge for banks. To overcome this problem, Bank BTN has developed a series of bad loan settlement mechanisms regulated in the Standard Operating Procedures (SOP). These mechanisms include repayment with relief, gradual repayment, transfer of debtors, redemption of collateral, subrogation, cessie, and sale of collateral. Through a transparent and collaborative approach, the bank strives to provide fair solutions for customers and maintain financial stability. The study also identifies factors that affect the success of the non-performing loan settlement process, including policy innovations that accommodate provisions outside the SOP. One such innovation is the transfer of debtors under the hands, which allows risk mitigation and legal protection for potential buyers. Thus, Bank BTN can continue to maintain credit quality and provide the best service to its customers.

Abstract

The practice of kawin tangkap is a traditional custom in Sumba in which a man or his family unilaterally abducts a woman to be married without her prior consent. This practice has sparked controversy due to its perceived violation of women's rights, while on the other hand, it is regarded by some as a part of customary law. This study aims to analyze the legal standing of the kawin tangkap practice from the perspective of Law No. 1 of 1974 on Marriage and Islamic law. The research employs a normative legal method with a statutory approach, analytical approach, and Islamic legal approach. The findings indicate that the practice of kawin tangkap is in conflict with Article 6 paragraph (1) of the Marriage Law, which explicitly requires the consent of both prospective spouses as a condition for a valid marriage. Consequently, a marriage conducted through kawin tangkap may be annulled pursuant to Article 22 of the Marriage Law. Furthermore, kawin tangkap contradicts Islamic law as it involves ikrah (coercion) in marriage, which is prohibited by Islamic principles and Article 16 paragraph (1) of the Compilation of Islamic Law. Although kawin tangkap is rooted in customary law, its enforcement cannot be legitimized as it violates Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia (which requires customary law to align with the principles of the Republic) and the theory of receptie a contrario (which mandates that customary law must conform to Islamic law).

Abstract

Digitalisasi menghadirkan fenomena cancel culture yang berpotensi berimplikasi sebagai tindak pidana di media sosial. Oleh karena itu, penelitian ini bertujuan mengakaji cancel culture dalam perspektif hukum pidana untuk mengetahui relevansi hukum pidana dalam mengakomodasi perkembangan masyarakat dalam bermedia sosial, dengan menggunakan penelitian normatif melalui pendekatan perundang-undangan dan konseptual. Sehingga hasil penelitian ini menunjukkan bahwa informasi yang melatarbelakangi cancel culture dapat berimplikasi sebagai tindak pidana jika memuat unsur pencemaran nama baik seperti yang dialami Gofar Hilman. Hukum pidana dapat mengakomodasi pelaku penyebar utama informasi elektronik melalui Pasal 27A jo. Pasal 45 ayat (4) Undang-Undang No. 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-Undang No. 11 Tahun 2008 Tentang Infromasi dan Transaksi Elektronik. Dalam penegakan hukum cancel culture, memiliki tantangan tersendiri dikarenakan bersifat kompleks sehingga dalam penerapan pasal dan pembuktiannya peran ahli dibidang ilmu hukum, sosial, atau komunikasi sangat dipertimbangkan guna memberikan batasan pemahaman pada aparat penegak hukum untuk menghindari overcriminalization guna mewujudkan keadilan, kepastian, dan kemanfaatan hukum.

Abstract

Papua merupakan wilayah dengan kompleksitas konflik sosial yang tinggi, dimana dinamika keamanan menurut strategi pengamanan yang adaptif. Penelitian ini bertujuan untuk menganalisis strategi pengamanan yang diterapkan oleh Brimob dalam merespons konflik sosial dan menjaga stabilitas keamanan di Papua, khususnya melalui Operasi Damai Cartenz 2023 di Kabupaten Pegunungan Bintang. Penelitian ini menggunakan jenis penelitian hukum empiris dan pendekatan konflik. Hasil penelitian menunjukkan bahwa strategi Brimob menggabungkan pendekatan taktis, preventif dan humanis, serta pendekatan sosial terhadap masyarakat. Strategi ini dinilai efektif dalam menekan eskalasi konflik bersenjata dan meningkatkan partisipasi masyarakat dalam menjaga keamanan. Kesimpulan dari penelitian ini menunjukkan bahwa keberhasilan Brimob dalam pengamanan di Papua tidak hanya ditentukan oleh kekuatan senjata, tetapi juga dengan pendekatan sosial adaptasi terhadap dinamika lokal.
