Abstract

The population living without documents in Indonesia continues to grow from year to year. Law No. 12 of 2006 concerning Citizenship and Immigration Law. Number has not provided a solution regarding their residence permit status and citizenship.Problems that arise the number of people who are settlers without documents increases, especially if they have mixed marriages with Indonesians. The handling so far that has been carried out by the government is only unclear and tends to ignore the problem of how the state's discretion and responsibility towards foreign citizens are without documents. By using normative research methods, research is carried out. The results of the study a. the immigration office's discretion regarding the status of foreigners without documents is unclear. b. The state is not responsible for the status and existence of foreign citizens without documents by neglecting their civil rights status c. Abstract

The right to life is the absolute right of every person and is included in the category of rights that cannot be reduced. Indonesia is one of the countries that still maintains and recognizes the legality of the death penalty as a way to punish the perpetrators of certain criminal acts such as narcotics, terrorism, and murder crimes despite the pros and cons. This study aims to investigate the regulation of the right to life against the death penalty in Indonesia, the construction of the death penalty law from human rights viewpoint, and the judge's consideration in imposing the death penalty associated with the principles of human rights. This study used a qualitative normative juridical approach by referring to the legal norms in statutory regulations and norms of the society. The findings highlight that the early existence of the death penalty in Indonesia is legally regulated in the Criminal Code, most of which are from the Netherlands, namely WvS (Wetboek van Strafrecht).

Abstract

The phenomenon of gender change in Indonesia shows that many people want to change their gender. This study aims to examine and analyze legal arrangements in the field of human rights regarding gender change, the implementation of court decisions in Indonesia regarding gender change and the effect of the formation of laws and regulations that specifically regulate gender change on court decisions in Indonesia. Normative research carried out by means of law, conceptual and case approaches. The results showed international agreements and national legislation have not specifically regulated gender change. The court ruling is based on consideration of the results of the medical examination and legal considerations. The establishment of legislation in particular can strengthen court ruling.

Abstract

The purpose of this research is to conduct an analysis and study related to how the existence of the Nedosa offense as a Sangihe customary crime and how this offense is included in the renewal of the national criminal law. The prohibition of Nedosa is still existed nowadays and is obeyed by the community and traditional leaders, the settlement is still using customary law methods even though the judicial system has been implemented by the general court. By using a normative juridical research method that focuses on the study of documents and legal materials, both laws and customary decisions are found to be (1) Judiciary, using Law No. 1 Drt/1951 concerning Provisional Measures to Organize Unitary Powers and Procedures for Civil Courts. (2) The case of Donor or “Blood Pollution” (Delik Nedosa) is a unique crime that only exists in the Sangihe Talaud Customary Rules. Both 1917 and 1932 customary rules as well as the 1951 declaration stated that marriage is forbidden between people whose families are in a straight line up and down, cousins, and siblings. The maximum penalty is 5 years in prison. Therefore, the role of the Nedosa offense is very important in the customary law which is still respected and obeyed by the Sangihe Talaud community today. Nedosa's offense is wider than Zinah in the Criminal Code because this offense is related to religion and the perpetrator will be thrown into the sea.

Abstract

The increasingly humanistic development of Human Resource Management (HRM) requires the integration of social and cultural values into organizational practices. However, local culture is often perceived as limiting women’s participation and gender equality. This study aims to analyze cohesion within the Mapalus Rumah culture and explore its potential as a local wisdom–based model for women’s empowerment in HRM. The novelty of this study lies in positioning Mapalus Rumah culture as a culturally grounded HRM model that integrates women’s participation, social cohesion, and collective empowerment into modern organizational management. This research employed a qualitative approach with an exploratory descriptive design. Sixteen informants were selected through purposive sampling, consisting of 12 women actively involved in Mapalus Rumah activities and 4 supporting informants. Data were collected through in-depth interviews, participatory observation, and documentation, then analyzed using the interactive model of Miles and Huberman with triangulation to ensure validity. The findings show that cohesion in Mapalus Rumah culture is built through continuous social interaction, mutual trust, open communication, and collective commitment. Women play strategic roles as initiators, decision-makers, and social agents within the community. Strong patterns of emotional support, solidarity, and resource exchange among women also contribute to strengthening individual capacity and collective social resilience. These findings indicate that local culture can function as an inclusive space that supports contextual gender equality, understood as gender relations that adapt to local social and cultural contexts while still promoting equal participation and opportunities for women. This study concludes that Mapalus Rumah culture has strong potential as a culturally based management model relevant to modern organizations. The integration of cohesion, participation, solidarity, and community-based support into HRM practices can serve as an effective and sustainable strategy for women’s empowerment, employee engagement, and socially adaptive organizational development in the modernization era.

Abstract

Penelitian ini bertujuan untuk Untuk mengkaji dan menganalisis pengaturan hukum hak guna ruang atas tanah (HGRAT) bangunan gedung hotel di Kota Manado, dan Untuk mengkaji dan menganalisis upaya pencegahan terhadap kerugian dalam kegiatan bisnis pembangunan hotel di Kota Manado. Metode Penelitian ini dilakukan terhadap asas hukum dan aturan hukum yang berlaku dan menganalisis kelebihan dan kelemahannya serta menganalisis harmonisasi antara aturan tersebut dengan aturan lain baik secara vertikal maupun horizontal sehingga tipe penelitian ini adalah tipe penelitian normatif yuridis. Hasil Penelitian Menunjukkan  dalam Pengaturan hukum hak guna ruang atas tanah (HGRAT) bangunan hotel di Kota Manado terdiri dari aturan umum, seperti Kitab Undang-Undang Hukum Perdata (KUH Perdata), pasal 681 dikaitkan dengan penelitian ini maka berdasarkan hak dasar bangunan Hotel Manadodapat mencegah pembangunan yang peninggiannya menghalangi pemandangan laut yang merupakan keunggulan dari hotel Lagoon. Selanjutnya, pengaturan yang terkait lainnya terdiri dari aturan yang lebih khusus tentang bangunan gedung dan kebijakan peremerintah Kota Manado yang hanya sebatas mengatur tentang persyaratan administrasi penerbitan Izin Mendirikan Bangunan sebagai salah satu alas hak jika harus menempuh upaya hukum akibat kerugian dalam kegiatan bisnis.

Abstract

Tesis ini berjudul “Perlindungan Hukum terhadap Korban yang Dijadikan Tersangka oleh Aparat Penegak Hukum” Penelitian ini dilatarbelakangi oleh adanya praktik penyalahgunaan kewenangan oleh aparat penegak hukum yang menyebabkan korban kejahatan justru ditetapkan sebagai tersangka, sehingga menimbulkan pelanggaran terhadap hak asasi manusia dan keadilan hukum. Tujuan penelitian ini adalah untuk menganalisis bentuk perlindungan hukum bagi korban yang dijadikan tersangka, menelaah tanggung jawab aparat penegak hukum atas penyalahgunaan kewenangan tersebut, serta mengkaji upaya pemulihan keadilan bagi korban dalam sistem peradilan pidana Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, menggunakan data sekunder dari peraturan perundang-undangan, literatur hukum, serta hasil penelitian terdahulu. Analisis dilakukan secara deskriptif kualitatif guna menemukan norma dan prinsip hukum yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi korban yang dijadikan tersangka belum terlaksana secara optimal karena lemahnya implementasi asas due process of law, minimnya pengawasan terhadap aparat penegak hukum, serta belum adanya regulasi yang tegas mengenai pemulihan hak korban. Diperlukan penguatan sistem perlindungan hukum dan penerapan prinsip restorative justice agar hak-hak korban dapat terlindungi secara adil. Tesis ini diharapkan dapat menjadi kontribusi akademik dalam pengembangan ilmu hukum, khususnya di bidang hukum pidana dan hak asasi manusia, serta menjadi referensi bagi upaya pembaruan sistem peradilan pidana di Indonesia. Abstract

This research analyzes how the Prosecutor's Office conducts the eradication of collusion and creates a clean state apparatus to prevent corruption. To examine the rosecutor's office function, a normative research method was used with a sample of the rules and policies issued by the prosecutor's office of the Republic of Indonesia. The findings show that the function of the Prosecutor's Office in eradicating corruption and enforcing the law must be continually carried out through various efforts so that the government projects are right on cost, on time, and of good quality by supervising and securing the planning, implementation, and utilization of development results. Keywords:  Clean State Apparatus, Collusion, Crime Eradication, Functions of the Prosecutor's Office, Normative Legal Research
