Perkembangan teknologi membawa perubahan pada dunia perdagangan, saat ini E-Commerce tumbuh dengan begitu pesat. pertumbuhan tersebut membawa dampak pada menjamurnya industri kosmetik di online shop, namun hal tersebut menyebabkan maraknya kosmetik illegal yang beredaran dipasar salah satunya merek Zayora. Tujuan dari penelitian ini adalah untuk memberikan kontribusi terhadap kesadaran konsumen mengenai penerapan perlindungan konsumen terhadap produk kosmetik ilegal dan memberikan rekomendasi perbaikan sistem.Metode penelitian yang digunakan dalam analisis kasus adalah penelitian hukum normatif yang sistematis. Dalam penelitian ini peneliti menggunakan data sekunder, dimana alat hukum primer yang digunakan adalah peraturan perundang-undangan. Teknik pengumpulan data yang digunakan dalam penelitian ini disebut penelitian kepustakaan (LR). Teknik analisis data yang akan digunakan dalam penelitian ini adalah hukum normatif, dimana analisis tersebut berkaitan dengan komponen-komponen substansi hukum yaitu teori, konsep, dan beberapa undang-undang yang berlaku Perlindungan hukum konsumen terhadap kosmetik illegal pada studi kasus Putusan No Nomor 687/Pid.Sus/2021/PN Ckr bahwa pelaku memperoleh sanksi pidana selama kurang lebih dua tahun dengan denda sebesar 10.000.000, hal ini menunjukkan bahwa terdapat upaya dalam melindungan konsumen. Penarikan serta penghentian produk yang beredar secara illegal tanpa adanya surat izin dari BPOM menunjukkan implementasi perlindungan hukum kepada konsumen, hal ini disebabkan karena sulitnya BPOM mengawasi perederan kosmetik yang dijual secara online untuk itu masyarakat dihimbau lebih teliti dalam membeli produk secara online.Berdasarkan temuan diatas dapat ditarik kesimpulan bahwa peran BPOM dalam pengawasan kosmetik illegal masih kurang, hal ini dapat dilihat dari ribuan kosmetik illegal tanpa izin yang beredar secara online.

The development of the aviation industry, particularly in the implementation of the Hajj pilgrimage, encourages airlines to implement various clauses in transportation agreements, one of which is the non-refundable clause. The problem faced is how to provide legal protection for those who suffer losses due to the implementation of non-refundable clauses in flight tickets. The type of research used is normative juridical legal research. The results of the study indicate that non-refundable clauses in air transportation agreements are problematic. Non-refundable clauses in flight tickets are standard clauses that have the potential to harm consumers because they eliminate the right to a refund. Decision Number: 310/Pdt.G/2023/PN Jkt.Brt emphasizes that legal protection for consumers can be realized in court through an assessment of the validity of the clause, in order to create a balance of rights between business actors and consumers.

The purpose of this study is to critically analyze the quality of Supreme Court decisions in achieving justice and legal certainty in Indonesia. The Supreme Court is an important part of the justice system in upholding justice and providing legal security to the public. Nonetheless, the success of achieving the goals largely depends on the quality of the decisions made. Relevant Supreme Court decisions and a review of supporting literature were used in this qualitative research. This method allows for a thorough analysis of the components that affect the quality of decisions, such as the protection of human rights, equality before the law, equality of treatment, consistency in the interpretation and application of the law, and the guarantee of fair and clear legal protection.

Consumer legal protection in Indonesia refers to legal efforts to protect consumers from various economic actions that harm them. This research uses normative legal research methods. The purpose of this study is to determine the law enforcement of legal protection of consumers for the purchase of rice products with fake brands. The results of this study indicate that riceoplosan is an effort to produce fake rice brands that endanger consumer health and is a criminal offense as stated in articles 254 to 259 of the Criminal Code. As an existence of legal protection by the state against this, business actors who counterfeit rice product brands can be subject to sanctions as in Article 62 of Law Number 8 of 1999 concerning Consumer Protection, namely a maximum penalty of 5 (five) years or a maximum fine of Rp.2,000,000,000.00 (two billion rupiah).

The purpose of writing this article is to be able to understand and analyze the application of the precautionary principle as preventive protection in making authentic notarial deeds. This article uses a normative research type with a statutory and regulatory research approach and a conceptual approach, and uses qualitative descriptive data analysis with deductive thinking methods. The form of the precautionary principle referred to above is a principle that is not regulated and strengthened in the UUJN, which causes notaries in carrying out their duties as public officials who make authentic deeds to often encounter legal problems, such as forgery of identity letters of the parties, certificates and false statements from the parties. . In this way, the notary will be vulnerable to being caught in a crime, namely falsifying documents due to negligence or committing a criminal act due to negligence. Based on Article 50 of the Criminal Code, it confirms that "whoever commits an act to carry out statutory regulations, must not be punished." Article 50 of the Criminal Code provides legal protection for the actions of Notaries as stated in Article 48 paragraph (1) of Law no. 2 of 2014, which regulates that the contents of the Deed are prohibited from being changed, which has the implication of binding the Notary in the criminal act of Negligence

This research delves into the dynamics of resolving land disputes over customary rights among indigenous communities in Fakfak Regency, West Papua Province. The study addresses the historical context of customary rights in Fakfak, examining the growth and development of land disputes within this framework. Theoretical exploration encompasses the principles and concepts of customary rights within indigenous societies, accompanied by an analysis of relevant legal foundations and regulations in Papua Barat. Employing a multidisciplinary approach, the research scrutinizes common causes of land disputes and evaluates the role of social and political conflicts in these disputes. The study investigates various dispute resolution methods, assessing their advantages and shortcomings. Special attention is given to the active participation of indigenous communities in the resolution process, exploring factors influencing their involvement. Cultural and social dynamics affecting land dispute resolution are analyzed, identifying challenges and external factors complicating the process. The research concludes with recommendations for improvement, offering insights into effective dispute resolution strategies. Case studies from Fakfak Regency provide concrete examples, contributing to a comprehensive understanding of the subject. The findings have implications for policies and practices related to customary land dispute resolution.

The purpose of writing this article is to find out how the form of legal protection and legal certainty over the determination of abandoned land as a form of controlling abandoned land areas. This article uses normative legal research, with statute approach and conceptual approach and descriptive qualitative research analysis with deductive thinking method. The form of legal protection for the community against the determination of abandoned land is through the utilisation of abandoned land by the government which is a strategic stage and the mechanism must be able to ensure that efforts to curb abandoned land must be returned to the greatest prosperity of the people through the process of determining abandoned land that applies the values of the General Principles of Good Governance and in accordance with statutory regulations, starting from the Basic Agrarian Law, Government Regulation No. 18 of 2021 concerning Management Rights, Land Rights, Flat Housing Units, and Land Registration, Regulation of the Minister of Agrarian Affairs and Spatial Planning, Head of the National Land Agency No. 20 of 2021 concerning Procedures for the Ordering and Utilisation of Abandoned Areas and Land, as a form of guarantee in providing legal certainty in the issuance of the determination of abandoned land.

An agreement is a written or oral agreement made by two or more parties, each of whom agrees to obey what is contained in the agreement. This research uses a normative juridical approach and analysis. The research findings and discussion involve aspects such as the protection of good faith parties, the principle of good faith in the execution of agreements, and the legal implications of PPJB. The research conclusion emphasizes the importance of good faith in sale and purchase transactions, the need for legal protection for good faith parties, and the significant role of PPJB as a binding legal instrument. In the context of property sale and purchase, PPJB is perceived as an important means to protect the interests of the parties involved.

This research aims to evaluate the responsibilities of business actors, especially airlines, regarding consumer protection in the context of flight cancellations, with a focus on the legal perspective. Flight cancellations are often a complex issue, raising questions about the rights and obligations of business actors as well as the protection provided to consumers. This research will analyze the legal framework that regulates consumer rights and the responsibilities of business actors regarding flight cancellations. This legal approach will include a review of applicable aviation regulations, air carriage agreements, and consumer protection laws. In addition, this research will evaluate the extent to which the implementation of business actors' responsibilities is in accordance with applicable legal provisions and the impact on consumer protection.

This research discusses the nominee agreement in the context of land ownership by foreign nationals in Indonesia. Despite the Agrarian Basic Law explicitly prohibiting foreigners from owning land, the practice of nominee agreements or lending names is still prevalent. The study compares the validity of nominee agreements in Indonesia with other Asian countries such as Thailand, the Philippines, Malaysia, and Singapore. The research findings indicate that Indonesia lacks specific regulations regarding nominee agreements, while other countries have established clear guidelines. Specific legal cases are also examined, including the legal implications for notaries involved in drafting nominee agreements. The study recommends that the Indonesian government enact stricter regulations concerning nominee agreements to prevent illicit legal practices. It is hoped that more stringent sanctions will be imposed on notaries engaged in nominee agreements.
