Abstract

In using e-payments such as e-money, it is highly recommended to pay attention to technology that has weaknesses in its technical use. This causes problems regarding the payment system that uses electronic money, especially QRIS, which is becoming increasingly complex so that it demands legal protection with regulations for QRIS users, then also causes the vulnerability of criminal acts of fraud committed in using QRIS. The legal protection that can be given to QRIS user consumers is through preventive legal protection related to digital transactions through the QRIS system carried out with an understanding and awareness for the public regarding the procedures for using the QRIS system in transactions including potential criminal acts. Repressive legal protection is carried out with certain developments by law enforcement officials so that they are ready and alert in the face of criminal acts of digital transactions that utilise the QRIS system. In addition, if the QRIS system is internally problematic, it is necessary to regulate the liability of the QRIS system maker or publisher for the losses incurred. Apply the ITE Law to perpetrators who commit fraud against consumers in transactions using QRIS.

Abstract

Due to the fast-paced population increase, land, a valuable natural resource, is becoming more and more scarce. A societal crisis could be sparked by land, which is equally susceptible. Consequently, it is critical that the State equitably regulates land ownership. The right to utilize and profit from land is granted to the possessor. Land might have primary or secondary rights, depends on the terms of the agreement between the landowner and the potential secondary right holder. Land rights are transferred through buy and sale agreements. The acquisition of land rights is governed by national land law, which places limitations on foreign nationals. Their ownership rights are not granted; only the right to use the land is. Nominee agreements with Indonesian citizens are used by some foreign nationals to own. To stop foreigners from gaining control, the Indonesian government gives priority to land owned by Indonesian nationals. Criminals also conceal assets through the employment of nominees. Therefore, Indonesian law forbids foreign nationals from owning land. Under the guise of Indonesian citizens, foreign nationals can lawfully smuggle land into Indonesia through nominee arrangements. An agreement between a foreign national and an Indonesian national is involved in this.

Abstract

MSMEs as the backbone of Indonesia's economy are driving the government to actively provide assistance, ranging from administrative, financial or capital equipment to legal aspects. Legal protection for MSMEs comes from existing regulations. Legal protections for MSMEs are clear and create legal certainty. Legal protection for MSMEs can be found in states that grant MSMEs patents on their products. This legal protection cannot be seen only through regulations on unfair competition between companies. MSMEs gain the right to compete in a larger market and to compete with large companies to develop their business. These regulations are expected to protect MSME actors and promote business UKM sebagai tulang punggung perekonomian Indonesia membuat pemerintah gencar menawarkan bantuan mulai dari pengaturan administrasi, keuangan atau permodalan hingga aspek hukum. Perlindungan hukum UKM dapat dilihat berdasarkan peraturan yang ada. Batas atas hukum untuk UKM jelas dan menawarkan kepastian hukum. Perlindungan hukum terhadap UKM tercermin dalam kenyataan bahwa negara memberikan hak kepada UKM untuk mematenkan produknya, namun tidak hanya perlindungan hukum juga tercermin dalam ketentuan tentang persaingan tidak sehat. UKM diberikan hak untuk bersaing di pasar yang lebih luas dan juga bersaing dengan pengusaha besar untuk mengembangkan usahanya. Peraturan tersebut diharapkan dapat melindungi pelaku UMKM dan mengembangkan usahanya.

Abstract

Notaries, entrusted with upholding legal certainty by producing authentic legal documents, now face notable difficulties in adapting to digital transformation. Even though electronic transactions and forms of digital authentication have become more widely embraced, Indonesia still lacks a clear legal framework for electronic notarial deeds (e-notary), resulting in legal uncertainty regarding their authenticity, validity, and evidentiary strength within the national legal system. Accordingly, this study raises two central problems: (1) how relevant are the elements “before a public official” and “made at the place where the deed is made” under Article 1868 of the Indonesian Civil Code within the context of electronic notarial deeds, and (2) what are the opportunities and challenges in regulating electronic notarial deeds to ensure authenticity and legal certainty. This study analyzes two central problems as previously mentioned. The research employs a normative legal method with statutory and conceptual approaches. The findings reveal that the elements of authenticity in deeds as stipulated in Article 1868 of the Indonesian Civil Code and the Notary Office Law still emphasize physical presence; however, in the digital era, they must be reinterpreted functionally through electronic communication systems that ensure security, integrity, and the free will of the parties. The digitalization of notarial systems presents opportunities for efficiency, transparency, and institutional integration, but it also faces normative, technical, and ethical challenges that require regulatory reconstruction and strengthening of digital legal infrastructure. Legal reform through the amendment of the Notary Office Law, establishment of implementing regulations, and adoption of blockchain technology are essential to ensure legal certainty in the implementation of electronic notarial deeds in Indonesia.

Abstract

Tujuan peneliian ini bertujuan ingin mengkaji dan menganalisis perlindungan hukum terhadap penumpang SJ-182 yang menderita kerugian Akibat jatuhnya pesawat Sriwijaya Air sesuai UU No 1 tentang Penerbangan tahun 2009. Jenis penelitian dari penelitian hukum ini adalah penelitian hukum normatif atau doktrinal. Studi doktrinal adalah studi yang secara sistematis menafsirkan aturan yang mengatur kategori hukum tertentu, menganalisis hubungan antara aturan, menjelaskan area yang sulit, dan dapat memprediksi perkembangan masa depan. Oleh karena itu, dapat dikatakan bahwa hanya perjanjian antara penumpang dan pengangkut yang menimbulkan hak dan kewajiban antara keduanya. Namun dalam praktiknya, perjanjian tersebut harus dibuat secara tertulis, seperti halnya di industri penerbangan kita, tiket adalah bukti perjanjian transportasi udara. Risiko terbesar bagi maskapai penerbangan adalah kecelakaan pesawat terbang. Kecuali menimbulkan kerugian materiil, yaitu hancurnya pesawat terbang, juga menimbulkan kerugian pada diri penumpang, bagasi atau barang yang diangkut. Walaupun perjanjian pengangkutan pada umumnya dilakukan dengan lisan, akan tetapi segala akibat yang timbul karenanya sepanjang menurut sifatnya merupakan inti perjanjian maka akan mempunyai kekuatan seperti undang-undang bagi yang bersangkutan.

Abstract

Acquittals in corruption cases often generate controversy and undermine public trust, necessitating their reconstruction to strengthen justice and law enforcement in Indonesia and mitigate errors in the application of law (error in recht) in acquittal decisions. The problem at hand is how to reconstruct acquittals in corruption cases under the Corruption Eradication Law and the implications of acquittals for law enforcement in Indonesia. The research method used is normative juridical legal research. The results indicate that the reconstruction of acquittals in corruption cases is necessary to affirm justice and legal certainty. This effort requires limiting judicial interpretation, strengthening evidence, and tightening oversight to maintain judicial integrity and increase public trust. The reconstruction of acquittals strengthens accountability, transparency, and consistency in the judiciary, while ensuring substantive justice. This reform also increases public trust and strengthens commitment to corruption eradication and the rule of law.

Abstract

Background (General): Traffic accidents in Indonesia continue to rise annually, creating serious social and economic impacts. Background (Specific): A significant number of fatal accidents are caused by drivers operating vehicles under the influence of alcohol, as illustrated in the Pekanbaru case involving multiple deaths. Knowledge Gap: However, comprehensive legal analysis on the classification of negligence and the extent of criminal liability for alcohol-related fatal accidents remains limited. Aim: This study aims to examine the legal categorization of negligence (culpa) and determine the scope of driver criminal responsibility when drunk driving results in loss of life. Results: Findings show that such cases fall under culpa lata or gross negligence, as the drivers consciously continue driving despite clear foreseeable risks, thereby meeting the legal elements of criminal negligence under Indonesian criminal and traffic law. Novelty: The study provides an integrated doctrinal and empirical analysis linking legal theory, statutory frameworks, and real case application, particularly emphasizing the application of dolus eventualis in traffic negligence. Implications: The research underscores the importance of stricter enforcement and legal awareness to enhance road safety and strengthen public protection through more effective criminal accountability mechanisms. Abstract

Perkembangan teknologi digital yang semakin masif menjadikan data pribadi pengguna sebagai aset penting sekaligus rentan terhadap berbagai bentuk pelanggaran. Kondisi ini menuntut adanya mekanisme perlindungan hukum yang efektif untuk memastikan hak privasi pengguna tetap terjamin dalam penggunaan platform digital di Indonesia Permasalahan yang dihadapi adalah bagaimana bentuk perlindungan hukum terhadap data pribadi pengguna pada platform digital di Indonesia. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap data pribadi pada platform digital di Indonesia berlandaskan Pasal 28G ayat (1) UUD 1945 dan diperkuat melalui UU No. 27 Tahun 2022 tentang Pelindungan Data Pribadi yang menegaskan data pribadi sebagai hak fundamental. UU PDP mengatur prinsip pemrosesan data serta kewajiban platform digital untuk memperoleh persetujuan, menjaga keamanan data, dan memenuhi hak-hak subjek data. Namun, efektivitasnya masih terkendala oleh rendahnya kepatuhan, lemahnya pengawasan, dan belum optimalnya penegakan sanksi terhadap pelanggaran data pribadi. Dengan demikian, bentuk perlindungan hukum terhadap data pribadi pada platform digital di Indonesia secara normatif sudah memadai, tetapi secara praktis masih memerlukan penguatan pada aspek penegakan hukum, literasi digital masyarakat, dan konsistensi kepatuhan oleh platform digital agar tujuan perlindungan hak privasi dapat terwujud secara efektif.

Abstract

General Background: The rapid growth of Indonesia’s skincare industry has increased consumer dependence on cosmetic products, while the circulation of hazardous and non-compliant items continues to rise. Specific Background: Despite regulatory controls under Law Number 8 of 1999 on Consumer Protection, many producers still disregard safety standards, leading to health risks and information asymmetry. Knowledge Gap: Existing studies seldom integrate legal doctrine, regulatory mechanisms, and practical enforcement challenges in analyzing producers’ liability for unsafe skincare products. Aim: This study examines the scope of legal liability borne by skincare producers for product safety violations under the Consumer Protection Law. Results: Findings show that the law imposes strict obligations on producers to ensure product safety, provide accurate information, and comply with BPOM standards; violations may trigger civil compensation, administrative sanctions, or criminal penalties. Novelty: This research systematically synthesizes strict liability, product liability, and preventive legal duties within the context of Indonesia’s contemporary skincare market, highlighting gaps between normative mandates and real-market practices. Implications: Strengthening regulatory enforcement, transparency, and consumer awareness is crucial for achieving a fair, ethical, and accountable skincare industry.
