Abstract

A will is a legal instrument in the inheritance system in Indonesia, thus its position is very important because it contains both legal and religious aspects. As an authentic deed, a notarial will has great evidentiary power because it provides legal certainty in the eyes of positive law. However, its substance is often inconsistent with or contradicts the principles of Islamic law. Thus, there is a challenge, namely the still-unharmonious relationship, especially between positive law and Islamic law in practice in Indonesia. This study aims to analyze and examine the extent of the legal force of a notarial will in the Compilation of Islamic Law applicable in Indonesia. This study uses a normative legal research method. The results show that the legal force of a notarial will is relative for Muslims, because it depends on the conformity of the substance of the notarial will with Islamic law.

Abstract

This study investigates the legal guarantees for curators in the administration of collateral assets belonging to debtors declared bankrupt and subject to auction, as stipulated in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (PKPU). Specifically, this study refers to Decision Number 557 K/Pdt.Sus-Pailit/2024. The discussion includes the regulatory framework regarding legal protection for curators and an examination of the curator's authority to manage collateral assets included in the bankruptcy estate to be auctioned. Using a normative juridical approach along with case studies, the evaluation is based on the application of the law and the protection of the rights of curators and creditors. The study findings indicate that the reviewed decisions confirm the curator's authority to manage and auction collateral assets as part of the bankruptcy estate resolution process. Legal clarity regarding the curator's function is crucial to ensuring that the auction process is carried out effectively, fairly, and in compliance with regulations, while protecting the rights of secured creditors.

Abstract

The nominee scheme is a common practice in foreign investment in Indonesia, whereby an Indonesian citizen lends their name to formally hold shares on behalf of a foreign party in order to circumvent legal ownership restrictions. This practice raises legal concerns as it contradicts principles of transparency and legality enshrined in the national legal system. This article aims to examine the legal implications of nominee arrangements in foreign ownership of limited liability companies (Perseroan Terbatas) through a normative juridical approach. The discussion focuses on the validity of nominee agreements under Indonesian positive law and the legal consequences for both the foreign investors and the Indonesian nationals acting as nominees. The study finds that nominee schemes contravene the Investment Law, the Company Law, and the principle of beneficial ownership, rendering such agreements null and void by law, and denying legal protection to the parties involved.

Abstract

Acquittals in corruption cases often generate controversy and undermine public trust, necessitating their reconstruction to strengthen justice and law enforcement in Indonesia and mitigate errors in the application of law (error in recht) in acquittal decisions. The problem at hand is how to reconstruct acquittals in corruption cases under the Corruption Eradication Law and the implications of acquittals for law enforcement in Indonesia. The research method used is normative juridical legal research. The results indicate that the reconstruction of acquittals in corruption cases is necessary to affirm justice and legal certainty. This effort requires limiting judicial interpretation, strengthening evidence, and tightening oversight to maintain judicial integrity and increase public trust. The reconstruction of acquittals strengthens accountability, transparency, and consistency in the judiciary, while ensuring substantive justice. This reform also increases public trust and strengthens commitment to corruption eradication and the rule of law.

Abstract

Perkembangan teknologi digital yang semakin masif menjadikan data pribadi pengguna sebagai aset penting sekaligus rentan terhadap berbagai bentuk pelanggaran. Kondisi ini menuntut adanya mekanisme perlindungan hukum yang efektif untuk memastikan hak privasi pengguna tetap terjamin dalam penggunaan platform digital di Indonesia Permasalahan yang dihadapi adalah bagaimana bentuk perlindungan hukum terhadap data pribadi pengguna pada platform digital di Indonesia. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap data pribadi pada platform digital di Indonesia berlandaskan Pasal 28G ayat (1) UUD 1945 dan diperkuat melalui UU No. 27 Tahun 2022 tentang Pelindungan Data Pribadi yang menegaskan data pribadi sebagai hak fundamental. UU PDP mengatur prinsip pemrosesan data serta kewajiban platform digital untuk memperoleh persetujuan, menjaga keamanan data, dan memenuhi hak-hak subjek data. Namun, efektivitasnya masih terkendala oleh rendahnya kepatuhan, lemahnya pengawasan, dan belum optimalnya penegakan sanksi terhadap pelanggaran data pribadi. Dengan demikian, bentuk perlindungan hukum terhadap data pribadi pada platform digital di Indonesia secara normatif sudah memadai, tetapi secara praktis masih memerlukan penguatan pada aspek penegakan hukum, literasi digital masyarakat, dan konsistensi kepatuhan oleh platform digital agar tujuan perlindungan hak privasi dapat terwujud secara efektif.

Abstract

General Background: The rapid growth of Indonesia’s skincare industry has increased consumer dependence on cosmetic products, while the circulation of hazardous and non-compliant items continues to rise. Specific Background: Despite regulatory controls under Law Number 8 of 1999 on Consumer Protection, many producers still disregard safety standards, leading to health risks and information asymmetry. Knowledge Gap: Existing studies seldom integrate legal doctrine, regulatory mechanisms, and practical enforcement challenges in analyzing producers’ liability for unsafe skincare products. Aim: This study examines the scope of legal liability borne by skincare producers for product safety violations under the Consumer Protection Law. Results: Findings show that the law imposes strict obligations on producers to ensure product safety, provide accurate information, and comply with BPOM standards; violations may trigger civil compensation, administrative sanctions, or criminal penalties. Novelty: This research systematically synthesizes strict liability, product liability, and preventive legal duties within the context of Indonesia’s contemporary skincare market, highlighting gaps between normative mandates and real-market practices. Implications: Strengthening regulatory enforcement, transparency, and consumer awareness is crucial for achieving a fair, ethical, and accountable skincare industry. Abstract

The Job Creation Law, the Online Single Submission–Risk Based Approach, and the Basic Agrarian Law collectively reshape Indonesia’s land licensing system while simultaneously creating substantial regulatory and institutional challenges. This study evaluates the effectiveness of the OSS-RBA policy in accelerating land transaction compliance while preserving legal certainty and administrative efficiency. The research adopts a doctrinal legal method by examining statutory instruments, implementing regulations, and administrative procedures governing land licensing and spatial conformity. To strengthen the analysis, the study integrates a comparative legal approach to assess patterns of institutional coordination and digital governance. The analysis concentrates on three central dimensions: regulatory consistency in land rights verification and spatial suitability, institutional coordination among competent authorities, and the integration of spatial and land information systems. The results show that regulatory overlaps and normative inconsistencies continue to generate legal uncertainty in land licensing. Fragmented institutional authority further weakens coordination and delays administrative decision-making. In addition, limited interoperability between spatial and land databases reduces the effectiveness of digital licensing services. This study concludes that the OSS-RBA policy will effectively accelerate land transaction compliance only through regulatory harmonization, strengthened inter-agency coordination, and the establishment of an integrated spatial–land information system to ensure legal certainty, good governance, and sustainable land administration.

Abstract

The development of digital technology has facilitated the distribution of pornographic content through social media, creating new challenges for criminal law enforcement. This phenomenon demands adaptive and proportional criminal policies based on contemporary criminal law principles and the provisions of Law Number 44 of 2008 concerning Pornography. The problem faced is how to regulate criminal policies for perpetrators of the distribution of digital pornographic content through social media in Indonesia and how to construct criminal policies for the distribution of digital pornographic content through social media in Indonesia. The research method used in this study is normative juridical legal research. The results of the study indicate that the regulation of criminal policies for perpetrators of the distribution of digital pornographic content through social media in Indonesia is regulated in Law Number 44 of 2008 concerning Pornography and supported by the Information and Electronic Transactions (ITE) Law, but its implementation still requires harmonization to be more effective and adaptive to developments in digital technology. Meanwhile, the construction of criminal policies for the distribution of digital pornographic content needs to be directed towards a more comprehensive approach, by balancing aspects of law enforcement, protection of public morals, and the right to freedom of expression within the framework of contemporary criminal law.
