Abstract

Tindakan kekerasan adalah bentuk pelanggaran nilai-nilai kemanusiaan yang dilakukan secara sengaja oleh seseorang terhadap individu lain, yang mengakibatkan penderitaan baik fisik maupun spiritual. Tindakan ini dimotivasi oleh berbagai faktor, termasuk kondisi ekonomi pelaku, ketidakstabilan emosional pelaku, pengaruh eksternal dari lingkungan sekitar, serta berbagai faktor lain yang menyebabkan tindakan tersebut terjadi. Insiden kekerasan yang dilakukan oleh Mario Dandy Satrio telah menarik perhatian publik, di mana sikap arogannya sangat kejam dalam menyiksa dan bahkan merayakan setelah melakukan kekerasan terhadap Cristalino David Ozora, yang dipicu oleh perselisihan asmara semata. Penelitian ini menggunakan pendekatan normatif, yaitu jenis penelitian hukum yang berfokus pada studi norma hukum dan peraturan perundang-undangan melalui bahan pustaka. Analisis data dilakukan dengan menggunakan pendekatan kualitatif, dengan mendeskripsikan dan menafsirkan isu-isu hukum yang relevan secara sistematis dan komprehensif. Berdasarkan hasil analisis dan diskusi, menunjukkan bahwa dalam konteks perlindungan saksi dan korban dalam kasus kejahatan penyerangan terhadap Cristalino David Ozora, peran LPSK sangat penting. Hal ini sejalan dengan tugas dan fungsinya sebagaimana diatur dalam Undang-Undang Perlindungan Saksi dan Korban sebagaimana diubah menjadi Undang-Undang Nomor 31 Tahun 2014. Berdasarkan hal tersebut, dalam keputusannya, majelis hakim menjatuhkan hukuman 12 tahun penjara kepada Mario Dandy dan menetapkan kewajiban untuk membayar restitusi kepada korban sebesar Rp25.000.000.000,00.

Abstract

This study aims to conduct a juridical analysis of the application of criminal law in cases of aggravated theft as adjudicated in Decision Number 1150/PID.B/2024/PN MDN (Medan District Court). The primary focus is to identify and examine the conformity between the legal facts revealed during the trial and the elements of theft as stipulated in Article 363 of the Indonesian Criminal Code (KUHP), as well as the legal considerations of the judge in rendering the verdict. The research method employed is normative-empirical with a case study approach. The main data source is Decision Number 1150/PID.B/2024/PN MDN, supported by literature studies related to criminal law theory, aggravated theft, and court decisions. The analysis indicates that the panel of judges carefully considered the fulfillment of the elements of aggravated theft, particularly the existence of at least one aggravating factor (for instance, the act was committed at night or involved two or more individuals). The juridical considerations of the judges in this decision are deemed consistent with the provisions of Article 363 KUHP and the applicable principles of criminal law. This study concludes that the decision reflects a balanced law enforcement approach between legitimate proof and the imposition of fair sanctions. The implication of this research highlights the importance of careful verification of aggravating elements to ensure legal certainty and justice.

Abstract

Corruption is a form of crime that has a direct impact on the welfare of society. Corruption is an unlawful act carried out to enrich oneself, another person, or a corporation, which is detrimental to state finances or the country's economy. Corruption is also a crime that is included in the category of special crimes because it has different specifications from general crimes both in procedural law and material (substance), especially in the handling of evidence of special crimes whose origins must be examined so that the handling of the crime does not harm parties who are not involved. Corruption is also regulated in various regulations such as Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, Law Number 15 of 2002 concerning the Crime of Money Laundering, Law Number 30 of 2002 concerning the Corruption Eradication Commission, the latest Criminal Code (Law Number 1 of 2023), and so on. The law has regulated a number of provisions aimed at strengthening and perfecting the eradication of corruption in Indonesia as well as anticipating and eradicating various increasingly sophisticated corruption modes, as well as increasing the effectiveness of law enforcement related to corruption crimes. The method used is an empirical juridical approach with direct field research studies at the South Tapanuli District Attorney's Office. Mechanisms and Procedures for Securing Evidence in Corruption Crimes according to the provisions of the Criminal Procedure Code and the Corruption Crime Law. The provisions of evidence according to the Criminal Procedure Code are regulated in articles 39-46 of the Criminal Procedure Code starting from Confiscation, Storage of Confiscated Objects, Management of Confiscated Objects / evidence after having permanent legal force. Meanwhile, Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 concerning the Eradication of Corruption Crimes regulates more specifically the management of evidence, especially related to assets resulting from corruption by means of Asset Confiscation (Article 18 of the Corruption Law). Confiscation of Assets suspected of originating from criminal acts of corruption, Blocking and Custody, to Execution of Decisions. The Role of the Prosecutor's Office in Securing Evidence that has been In Kracht in corruption cases. The Prosecutor's Office through the Asset Recovery and Evidence Management division has a role in managing evidence as regulated in the Regulation of the Attorney General of the Republic of Indonesia Number: PER-027/A/JA/10/2014 Concerning Guidelines for Asset Recovery. In practice, the management of evidence carried out by the Prosecutor's Office through the Asset Recovery and Evidence Management Division consists of 5, namely: Direct Sales, Indirect Sales, Determination of Use Status, Grants, and Destruction. Implementation of Evidence Securing in the Practice of Corruption Law Enforcement at the South Tapanuli District Prosecutor's Office. Evidence Securing in criminal acts of corruption at the South Tapanuli District Prosecutor's Office often takes the form of documents, financial transactions, and letters.

Abstract

The protection of labor rights is a state obligation; however, the practice of unilateral termination of employment (PHK) by companies often violates legal norms, including criminal law. This study aims to examine the regulations and forms of criminal legal protection for workers experiencing termination under Law No. 11 of 2020 concerning Job Creation using a normative juridical method. The results indicate that although the Job Creation Law does not explicitly detail criminal sanctions specific to termination, the criminal legal basis remains applicable by referring to Articles 153 and 185 of the Manpower Law and Article 28 of the Labor Union Law to address discriminatory terminations or violations of normative rights. Furthermore, administrative manipulation and document forgery during the termination process can be prosecuted under the Penal Code (KUHP) or other special laws. The primary obstacle to law enforcement lies in weak supervision and the prevalence of administrative settlements. The study recommends strengthening labor inspection and fostering synergy among law enforcement agencies to ensure effective and fair labor protection.

Abstract

This research aims to identify the factors that cause domestic violence against children and to analyze the role of the Unit for the Protection of Women and Children (PPA) of the Medan Police in providing legal protection for child victims. The study uses an empirical legal research method with a juridical approach. Data were obtained through interviews with officers from the Unit for the Protection of Women and Children (PPA) of the Medan Police and literature studies on relevant laws, books, and journals. The results show that domestic violence against children is caused by various interrelated factors, including economic hardship, low educational levels, patriarchal culture, psychological pressure, substance abuse, and disharmonious family relationships. The Unit for the Protection of Women and Children (PPA) of the Medan Police plays three main roles: preventive efforts through public legal education, repressive efforts through law enforcement against perpetrators, and rehabilitative efforts through psychological and social recovery for victims. However, the implementation of legal protection for child victims is not yet optimal due to limited human resources, insufficient facilities, and weak inter-agency coordination. Strengthening institutional cooperation and public legal awareness is essential to achieve effective and sustainable protection for children who are victims of domestic violence.

Abstract

Severance pay is a workers' right arising from termination of employment and must be fulfilled by employers in accordance with the provisions of labor law. In practice, there are still entrepreneurs who do not pay severance pay even though the obligation has been determined through agreements, court decisions, or the provisions of laws and regulations. This study aims to analyze the procedures for the implementation of criminal proceedings against employers who do not fulfill the obligation to pay severance pay and examine the position of criminal law as a last resort or ultimum remedium in resolving labor disputes. The research uses a combination of normative and empirical methods. The normative approach is carried out through the study of labor regulations, criminal law, legal doctrine, and court decisions. The empirical approach is carried out by examining the implementation of law enforcement in cases of non-payment of severance pay. The results of the study show that criminal proceedings can be applied if the employer deliberately does not carry out the obligation to pay severance pay that already has a clear legal basis. The process begins with dispute resolution through bipartite negotiations, mediation or conciliation, and mechanisms at the Industrial Relations Court. If the obligation is still not carried out and the act meets the elements of an employment crime, the worker can make a report to the labor supervisor or law enforcement officials. However, the application of criminal law should be placed as the ultimum remedium after administrative, civil, and industrial relations settlement efforts have yielded no results. The application of these principles is necessary to maintain a balance between the protection of workers' rights, legal certainty, and the proportionality of law enforcement.

Abstract

This study aims to evaluate the application of additional punishment in the form of chemical castration to perpetrators of sexual violence against children as stipulated in Government Regulation (PP) Number 70 of 2020 concerning Procedures for the Implementation of Chemical Caster. The birth of the PP is the government's effort to provide maximum protection for children as victims of sexual crimes, as well as a form of deterrent effect for perpetrators. The research method used is normative juridical research with a statutory approach and a conceptual approach. Data was obtained through literature studies by examining laws and regulations, legal doctrines, and related literature. The results of the study show that the application of chemical castration punishment still faces a number of challenges, both from the judicial, medical, and human rights aspects. From a juridical perspective, Government Regulation No. 70 of 2020 has provided technical guidelines related to the implementation mechanism, but there are still gaps in synchronization with other regulations, including the Criminal Code and health-related laws. From a medical perspective, chemical castration procedures require professional medical personnel and adequate health facilities, while from a human rights perspective, there is a debate about the relevance of this punishment to the principle of respect for human dignity. Thus, an evaluation of the application of chemical castration needs to be carried out comprehensively in order to ensure the protection of children's rights without ignoring the principles of justice and humanity.

Abstract

The development of information and communication technology has significantly transformed government administration systems, particularly through the implementation of electronic systems such as e-procurement, e-budgeting, and various other digital services. However, alongside these advancements, new forms of corruption have emerged that utilize cyber means as both the primary and supporting tools in committing unlawful acts. This study aims to analyze the legal framework, criminal liability, and effectiveness of law enforcement concerning cyber-enabled corruption crimes in Indonesia. The research method employed is normative legal research using statutory, conceptual, and case approaches. The findings indicate that Indonesian law has not explicitly regulated cyber-based corruption as a distinct offense; therefore, law enforcement is still conducted through a cumulative application of the Anti-Corruption Law, the Electronic Information and Transactions Law, and other related regulations. Criminal liability is not limited to public officials but also extends to other parties involved in the use of electronic systems to facilitate corruption. The effectiveness of law enforcement still faces obstacles such as regulatory limitations, inadequate human resources, and the complexity of digital evidence. Therefore, regulatory harmonization and strengthening the capacity of law enforcement agencies are necessary to address corruption crimes in the digital era effectively.

Abstract

Perkembangan kejahatan korupsi yang melibatkan korporasi menempatkan korporasi sebagai subjek hukum pidana yang dapat dimintai pertanggungjawaban pidana. Regulasi mengenai prosedur penanganan kasus pidana oleh korporasi di Indonesia diatur melalui PERMA Nomor 13 Tahun 2016. Namun, regulasi tersebut belum memberikan parameter yang jelas dan terukur mengenai bentuk kesalahan korporasi dalam kejahatan korupsi, sehingga mengakibatkan inkonsistensi dalam penerapannya di praktik peradilan. Penelitian ini bertujuan untuk menganalisis regulasi parameter kesalahan korporasi dalam tanggung jawab pidana kejahatan korupsi berdasarkan PERMA Nomor 13 Tahun 2016 dan menganalisis penerapan parameter kesalahan korporasi dalam praktik peradilan untuk kejahatan korupsi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan hukum, pendekatan konseptual, dan pendekatan kasus. Bahan hukum yang digunakan terdiri dari bahan hukum primer berupa undang-undang dan putusan pengadilan, serta bahan hukum sekunder berupa buku, jurnal ilmiah, dan doktrin ahli hukum. Hasil penelitian menunjukkan bahwa PERMA Nomor 13 Tahun 2016 telah memberikan dasar hukum untuk tanggung jawab pidana korporasi, tetapi belum mengatur secara rinci indikator kesalahan korporasi sebagai dasar hukuman. Dalam praktik peradilan, hakim menggunakan berbagai interpretasi dalam menentukan kesalahan korporasi, khususnya terkait keuntungan korporasi, membiarkan tindakan kriminal, dan kegagalan korporasi untuk mencegah korupsi. Situasi ini menciptakan ketidakpastian hukum dan perbedaan dalam penerapan tanggung jawab pidana korporasi. Oleh karena itu, diperlukan parameter kesalahan korporasi yang lebih jelas dan terukur untuk memastikan kepastian hukum dan penegakan hukum yang efektif terhadap korupsi yang melibatkan korporasi.

Abstract

Pesatnya perkembangan konektivitas digital di Indonesia telah diikuti dengan munculnya berbagai bentuk kejahatan yang memanfaatkan teknologi informasi, salah satunya adalah cyberstalking. Penelitian ini bertujuan untuk menganalisis pengaturan hukum cyberstalking dalam Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua atas Undang-Undang Informasi dan Transaksi Elektronik, serta mengkaji pertanggungjawaban pidana terhadap pelaku cyberstalking dalam kerangka peraturan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Bahan hukum yang digunakan terdiri atas bahan hukum primer berupa peraturan perundang-undangan dan putusan pengadilan, serta bahan hukum sekunder yang diperoleh dari berbagai literatur ilmiah. Hasil penelitian menunjukkan bahwa hukum positif Indonesia belum mengatur cyberstalking sebagai tindak pidana yang berdiri sendiri, sehingga penegakan hukumnya masih didasarkan pada kombinasi beberapa ketentuan, terutama Pasal 27A, Pasal 27B, Pasal 29, dan Pasal 26 Undang-Undang ITE, serta ketentuan yang relevan dalam Kitab Undang-Undang Hukum Pidana yang baru. Pertanggungjawaban pidana ditentukan berdasarkan adanya kesengajaan, kemampuan bertanggung jawab pelaku, serta pembuktian yang didukung oleh alat bukti elektronik sebagai instrumen utama. Penelitian ini menyimpulkan bahwa meskipun pengaturan yang berlaku telah memberikan perlindungan yang lebih baik bagi korban dibandingkan pengaturan sebelumnya, masih terdapat kekosongan norma karena karakter cyberstalking yang bersifat berulang dan sistematis belum diatur secara eksplisit. Oleh karena itu, diperlukan penyempurnaan regulasi untuk memberikan kepastian hukum dan perlindungan yang lebih efektif bagi korban.
