Abstract

The debt and receivable agreement entered into by business actors and consumers at UD Bhuana Rahayu is a money lending and borrowing agreement. The contents of the agreement must be implemented by the parties, especially consumers, by returning the debt in accordance with Article 1754 of the Civil Code. Apart from that, this is done to fulfill consumer obligations and the rights of business actors. However, in reality there are consumers who do not pay their debts (default) which results in losses for business actors. So the procedures and mechanisms for resolving defaults are being questioned, as well as how legal protection can be provided to business actors. Through empirical legal research methodology, the answer was obtained that business actors use verbal/unwritten agreements in debt and receivable agreements. The solution can only be resolved through mediation. Therefore, the legal protection that can be provided is repressive legal protection through statutory regulations that have been regulated to prevent, and preventive legal protection through resolving litigation, namely district court lawsuits.

Abstract

This article critically analyzes the implications of licensing simplification which has the impact of making business licensing easier. This raises the crucial question of whether the licensing simplification model has an impact on the industrialization of business licensing and the effect on the degradation of environmental wisdom? This research uses the methodQualitative research with data collected and analysis is more qualitative in nature. Qualitative analysis is used by adopting an investment model as a form of implementing business permits in environmental protection in France and Japan with the composition of France being a country without environmental wisdom and Japan having very strong environmental wisdom values. As a result, these two countries implemented a green investment model which emphasizes that economic growth must also pay attention to environmental protection. The environment is also positioned as a legal subject with the same rights as other legal subjects. The government has an important role in forming regulations that lead to a green economy so that every business activity places green investment as the foundation for implementing business activities.

Abstract

Perkembangan iteknologi yang pesat memberikan kemudahan bagi masyarakat, khususnya yang membutuhkan dana, melalui hadirnya layanan ipinjaman ionline. Sebagai bagian dari financial technology (fintech), pinjaman ini menawarkan syarat yang lebih mudah dan ifleksibel dibandingkan lembaga keuangan konvensional seperti ibank. Dalam transaksi, baik konvensional maupun digital, data pribadi sering disalahgunakan oleh pelaku usaha tanpa persetujuan pemiliknya. Pada layanan pinjaman online, penyalahgunaan ini dilakukan melalui skimming ATM, pencurian rekening, hingga peretasan ponsel konsumen untuk mengintimidasi keluarga mereka melalui media sosial. iTujuan ipenelitian ini adalah untuk mengetahui perlindungan hukum dan faktor-faktor mempengaruhi terjadinya terhadap penyalahgunaan idata ipribadi milik pengguna pinjaman online. Jenis ipenelitian ihukum empiris dan Jenis pendekatan yang digunakan pada karya tulis ini adalah jenis Pendekatan Sosiologi Hukum dan iPendekatan iFakta (fact approach). iHasil dari penelitian ini adalah Penelitian ini menyimpulkan bahwa meskipun perlindungan data pribadi telah diatur melalui berbagai regulasi seperti UU PDP, UU ITE, dan POJK, implementasinya di Kota Denpasar masih belum efektif, terutama dalam konteks pinjaman online. Pelanggaran data pribadi terjadi karena faktor internal, seperti rendahnya literasi digital dan kurangnya kesadaran masyarakat, serta faktor eksternal berupa lemahnya pengawasan, maraknya pinjaman online ilegal, dan belum optimalnya penerapan regulasi

Abstract

This study focused on the role of Sad Kertih, a policy concept based on Balinese local wisdom, from the perspective of environmental control. Bali, with its rich culture and traditions, has developed various environmental management practices rooted in local values, one of which is through the Sad Kertih system. This system combines social, cultural, and ecological aspects to maintain environmental sustainability and the sustainability of Balinese people's lives. The purpose of this study is to explore how Sad Kertih can contribute to environmental control and preservation, both locally and globally. With a local wisdom approach, this system not only prioritizes respect for nature but also empowers communities to play an active role in sustainable natural resource management. This study uses a normative legal research method, that is a research examining legal norms prescriptively. The finding of the study indicated that Sad Kertih has a potential to increase environmental awareness among Balinese people and can provide more adaptive solutions to climate change and increasing environmental damage. In conclusion, the application of Balinese local wisdom values ​​through Sad Kertih is very relevant in strengthening environmental control in the modern era, by paying attention to aspects of sustainability and ecosystem balance. Abstract

This study was carried out at Asri Jewellery engaged in a craft of bone carving, located at Br. Mantring, Tampaksiring Village, Bali. The training, mentoring, and evaluation methods for the sustainability of service activities. The results were the installation of wifi and neon boxes, website creation, product catalogs and brochures, business cards and business stamps, and online promotion assistance and through social media and marketplaces. The activities that have been carried out have provided the benefit of increasing a wider market share which resulted in the income maintained during the COVID-19 pandemic.

Abstract

Asri art bone waste carving is one of the carving cow and buffalo bone waste which is an icon of Tampaksiring Village. Some problems faced by Asri are not having a place to store raw materials, the quantity of production is still relatively low, and product quality control is still lacking. To overcome these problems, the solutions provided are making raw material storage, providing production equipment, as well as making and assisting in the implementation of Standard Operating Procedures for production. The results of this activity are the quality of Asri's raw materials to be better maintained, the quantity of Asri's production has increased, and the quality of the products produced can be controlled.

Abstract

This study aims to determine strategies for increasing Asri Jewelry production capacity by continuing to apply health protocols during the Covid-19 pandemic. They are socialization, procurement of hand sanitizers, simple handwashing stations, masks, hand gloves, building materials, assistance in repairs, and expansion as well as arrangement of production sites. The study finds that increased workers' awareness of using masks, and hand gloves, a more comfortable workplace, and more structured flow of production activities. This implies that workers' health and safety are fully guaranteed. The improvements of the production site provide workers the comfortability bringing an increase of the total production capacity of Asri Jewelry.

Abstract

Corruption crimes which requires an active role of the Public Prosecutor’s Office not only as a public prosecutor but also as an investigator in law enforcement. The research problems addressed in this study are how the mechanism and procedures of corruption investigation are implemented at the Denpasar District Prosecutor’s Office and how the role of the Prosecutor’s Office is carried out in such investigations. This research uses empirical legal research with data collection techniques through direct interviews with prosecutors of the Special Crimes Division at the Denpasar District Prosecutor’s Office and supported by literature studies on relevant laws and legal references. The results of the research indicate that the mechanism and procedures for investigating corruption crimes at the Denpasar District Prosecutor’s Office have been implemented in accordance with criminal procedural law and internal guidelines of the Prosecutor’s Office, starting from the investigation stage, escalation of cases to formal investigation, examination of witnesses and suspects, until the case files are declared complete. Furthermore, the role of the Prosecutor’s Office in corruption investigation is strategic since it functions as the controller of the case from the early stage of investigation to prosecution, although in practice there are still technical constraints and inter-agency coordination issues that affect the effectiveness of the investigation process.

Abstract

Changes to Indonesia's licensing system through Law Number 11 of 2020 and Government Regulation Number 28 of 2025 have improved government efficiency and digitalization. However, these changes have not adequately addressed inclusion and the rights of indigenous peoples. This study aims to explore innovations in licensing regulations to protect indigenous rights through three main approaches: procedural, substantive, and institutional innovation.  Procedural innovation involves indigenous communities in public consultations, in line with the principle of Free, Prior, and Informed Consent (FPIC). Substance innovation calls for integrating customary law and local wisdom into regulations, aligning state law with local practices. Institutional innovation seeks to strengthen cooperation between the government and indigenous institutions to address licensing issues. The findings suggest that inclusive licensing promotes social legitimacy, ecological justice, and culturally based sustainable development. Thus, recognizing customary law is crucial for developing fair governance that reflects local wisdom.

Abstract

The essence of labor law is to protect workers from arbitrary employer actions. This employment relationship is interdependent, where business entities require workers for operations, while workers depend on wages. Therefore, the rights and responsibilities of both parties, the company and the workers, need to be kept in balance. One fundamental worker right is protection consistent with religious principles, humanity, Pancasila, and the State's goals, as enshrined in the 1945 Constitution of the Republic of Indonesia (UUD1945). This protection aims to guarantee workers' basic rights, equal opportunity, and the prevention of discrimination, in order to realize the welfare of workers and their families. However, business development and the interests of business actors must not be ignored. Legal instruments for upholding workers' rights include specific regulations, such as Law Number 13 of 2003 of the Republic of Indonesia concerning Manpower. This research employs a normative juridical method to examine the role of law in safeguarding human rights in the workplace.
