Abstract

This study aims to find and examine the implementation of land management in the Kerobokan Traditional Village for tourism industry activities. The issues raised in this study are about mechanisms and procedures for land management and the implementation of land management in traditional villages for the tourism industry. This research is an empirical research with an emphasis on field data as primary data. This study found that the implementation of land management in the Kerobokan Traditional Village for tourism industry activities was carried out by leasing a contract based on an agreement through the relevant Paruman Desa Adat/Banjar Adat. The Kerobokan Traditional Village also has a Perarem Pangele which regulates administrative provisions that must be met by krama tamiu (in this case including investors). The authority to manage this land is strengthened by the Regional Regulation of the Province of Bali Number 4 of 2019 concerning Traditional Villages in Article 1 number 8 which provides autonomy for Traditional Villages to manage their own households. Penelitian ini bertujuan untuk menemukan dan mengkaji terkait implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata. Permasalahan yang diangkat dalam penelitian ini adalah tentang mekanisme dan prosedur pengelolaan tanah serta implementasi pengelolaan tanah di Desa Adat untuk industri pariwisata. Penelitian ini merupakan penelitian empirik dengan menekankan pada data lapangan sebagai data primer. Penelitian ini menemukan bahwa implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata dilakukan dengan sewa kontrak berdasarkan kesepakatan melalui Paruman Desa Adat/Banjar Adat yang bersangkutan. Desa Adat Kerobokan juga memiliki Perarem Pangele yang mengatur tentang ketentuan administrasi yang harus dipenuhi oleh para krama tamiu (dalam hal ini termasuk investor). Kewenangan pengelolaan tanah tersebut diperkuat dengan Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 tentang Desa Adat pada Pasal 1 angka 8 yang memberikan otonomi bagi Desa Adat untuk mengurus rumah tangganya sendiri.

Abstract

This study aimed at analyzing regulations concerning legal protection for employees who are under self-isolation caused by Covid-19 infection. Moreover, there is the latest regulation concerning Protection and Business Continuity of Workers/Manpower related to prevention and control of Covid-19 Pandemic. This is a juridical-normative study with a statutory approach. The finding of this study showed that the legal protection scheme on the employees under self-isolation in a company affected by Covid-19 has been regulated in some Government Regulations. Therefore, principally the business owner should give wages fully to the employees as well as providing sick leave base on the established regulations.

Abstract

Digital ethics involve moral principles and values that govern behavior individuals and groups in digital environments. Digital ethics involves deep responsibility disseminate accurate information, maintain the quality of online communication and interaction, and awareness of the social and environmental impact of the use of digital technology. This study uses a literature study method with a descriptive qualitative approach to study ethics and challenges of citizenship in cyberspace from a moral and legal perspective. Through data analysis, found several important digital ethical concepts in dealing with challenges in cyberspace, such as responsibility in disseminating information, privacy protection and data security, digital awareness, respect for freedom of expression, verification information, and respect intellectual property rights. From a moral and legal perspective, comprehensive regulation is needed to regulate the use of digital technology, enforcement effective law against digital ethics violations, legal education and awareness, and development of online communication ethics. Challenges of citizenship faced in the world cyber through a moral and legal perspective including the spread of harmful content, respect to privacy and data, cyberbullying behavior, and use of inappropriate language. Legal regulation, protection against cyber crime, and a balance between freedoms speaking and legal boundaries are also challenges that need to be overcome.

Abstract

Pentingnya perlindungan data pribadi adalah untuk memastikan bahwa data pribadi seseorang yang terkumpul digunakan sesuai dengan tujuan pengumpulan, sehingga tidak terjadi penyalahgunaan data. Tujuan Umum penelitian ini adalah Terbangunnya model pengaturan perlindungan terhadap data diri pribadi dalam sistem hukum Indonesia di era ekonomi digital sesuai dengan prinsip-prinsip hukum yang mampu memberikan kepastian hukum dan perlindungan yang aman terhadap data diri pribadinya, sedangkan tujuan khusus adalah: 1) Menganalisis pengaturan hukum yang digunakan untuk dalam perlindungan data diri pribadi di Indonesia dan juga di Malaysia untuk memformulasi model perlindungan data pribadi di Indonesia yang nyaman dan memberikan kepastian hukum, 2) Mengimplementasikan model perlindungan terhadap data diri pribadi dalam sistem hukum Indonesia di era ekonomi digital melalui studi perbandingan dengan pengaturan perundang-undangan perlindungan data diri pribadi yang ada di Malaysia. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum Socio Legal Research, pengumpulan bahan hukum dilakukan dengan cara menyusun dan mengidentifikasi secara sistematis bahan hukum primer, sekunder dan tersier dengan menggunakan teknik bola salju, teknik analisa bahan hukum dilakukan dengan menggunakan teknik deskriptif, komparatif, evaluatif dan argumentative.

Abstract

Film merupakan suatu karya cipta yang dihasilkan oleh buah fikir seseoraang. Sehingga perlu dilindungi agar suatu kaya cipta tersebut tidak disalahgunakan untuk kepentingan pribadi. Dalam Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta telah mengatur mengenai hak-hak pencipta siapapun itu dan juga karya karyanya. Seiring pekembangan zaman dan kemajuan teknologi berbagai macam hal menjadi mudah dilakukan termasuk juga tindakan yang melanggar hukum salah satunya pembajakan. Pembajakan merupakan suatu perbuatan yang telah ada dari dulu tetapi kini semakin marak akibat dari kemajuan teknologi tersebut. contoh Kasus pembajakan yang terjadi seperti pembajakan terhadap karya animator berupa film yang disebarluaskan kedalam situs streaming ilegal atau situs nonton film yang tidak resmi, sehingga perlu upaya untuk melindungi suatu karya cipta film tersebut sekaligus juga sebagai pencegahan terhadap tindakan pembajakan karya film yang disebarluaskan kedalam situs streaming ilegal tesebut. Maka dari itu dalam penulisan ini digunakan penelitian empiris, untuk mengetahui bagaimana bentuk perlindungan hukum dan pencegahan terhadap perbuatan tersebut serta faktor apa saja yang mempengaruhinya.

Abstract

Electronic traffic law enforcement (ETLE) is law enforcement in the traffic sector based on information technology using electronic devices in the form of cameras that can detect various types of traffic violations and provide motor vehicle data automatically based on Automatic Number Plate Recognition (ANPR). This research aims to implement and impact the implementation of Electronic Traffic Law Enforcement (ETLE) as a system for controlling traffic violations in Denpasar City. The research method that researchers use is empirical juridical research. The research results show that the implementation of ETLE has not been effective in handling traffic violations in Denpasar City. This is because there are still obstacles in implementing ETLE in terms of law enforcement factors, facilities and infrastructure factors, as well as community legal culture factors. The use of ETLE is also a form of Polri's contribution in realizing Denpasar City as a smart city and is in line with bureaucratic reform. The impact of implementing ETLE in Denpasar City is that more and more people are being recorded committing violations and have not been able to reduce of violations because the public's legal awareness is still low.

Abstract

Guna mengefektifkan pelaksanaan rehabilitasi narkoba bagi pecandu, Badan Narkotika Nasional bekerjasama dengan Yayasan Rehabilitasi Narkoba. Salah satu Yayasan yang membuka jasa layanan untuk pusat informasi narkotika, psikotropika, dan bahan adiktif lainnya, konseling, adiksi dan rehabilitasi di Bali adalah Yayasan Kasih Karunia Bali. Yayasan ini berdiri sejak tahun 2022 dan berlokasi di Desa Sanur Kaja, Kecamatan Denpasar Selatan. Terdapat beberapa permasalahan prioritas yang dialami oleh Yayasan Kasih Karunia Bali khususnya dalam penanganan program rehabilitasi untuk klien yang berstatus Warga Negara Asing (WNA) salah satunya adalah bidang pendampingan hukum, dimana Yayasan Kasih Karunia Bali selaku mitra Pengabdian kepada Masyarakat (PkM) kesulitan dalam menyusun dokumen hukum seperti kontrak dan legal advice penanganan rehabilitasi klien narkoba yang berstatus WNA serta minimnya pengetahuan mitra perihal keimigrasian WNA yang terjerat kasus narkoba, sehingga hal tersebut membuat mitra kurang maksimal memberikan pelayanan di bidang hukum bagi WNA yang menjalani program rehabilitasi ditempatnya. Berangkat dari permasalahan tersebut, maka kegiatan PkM yang dilaksanakan bekerjasama dengan mitra bertujuan agar mitra mampu meningkatkan kinerja layanan konsultasi dan pelayanan optimal bagi WNA yang akan menjalani rehabilitasi narkoba baik melalui melalui metode pelatihan, sosialisasi, dan pendampingan hukum sekaligus membantu Pemerintah untuk mewujudkan generasi bersih bebas narkoba

Abstract

Digital nomads are developing rapidly in Bali, this rapid development has not been able to be monitored optimally and effectively. The large number of Digital nomad tourists who enter using only visit visas is considered to be very detrimental in terms of foreign exchange income for the country. Research into the arrangements for Digital nomad visas and residence permits in Bali must be carried out with the aim of discussing the lack of clarity in the regulations governing this matter. This research discusses the regulation of visas and residence permits for foreign citizens in Indonesia and the legal consequences of the lack of regulations related to their regulation. The results of this research are that many foreigner take advantage of this regulatory vacuum which causes misuse of visas and residence permits for foreigner in Indonesia.
