Abstract

Digitalization of investment can boost the development of the tourism sector. However, regulations in Indonesia related to digital investment still need to be improved, thus triggering risks for investors. This research aims to analyze the impact of digitalization of investment on the development of the tourism sector. This research uses normative legal study with a conceptual, legislative, and comparative approach. The research results show that, first, investment digitalization impacts the development of the tourism sector. However, various problems still need to be solved, including suboptimal regulations, overlapping authorities, digital gaps between regions, and a need for more privacy data protection. Second, investment digitalization in Japan and Thailand has several advantages compared to Indonesia, mainly due to more advanced technological infrastructure, strategic government policies, and a more mature digital economy. Third, Indonesia must implement the principle of legal certainty and protection by strengthening investment digitalization regulations and collaborating with various parties to prepare special regulations regarding investment digitalization and increase data privacy protection to realize sustainable tourism and development.

Abstract

One of the sales of objects that can be carried out through the auction mechanism is property assets that become collateral for mortgages which later in the auction will be referred to as mortgage execution auctions. During the Covid-19 pandemic, there was a decline in the sale of auction property assets. The purpose of this study is to find an effort to optimize the sale of property assets in the auction of mortgage executions as an effort to improve the investment climate in Indonesia and provide income for the country. This research is a normative juridical research using an approach based on secondary legal materials. This study uses the approaches: statute approach, and conceptual approach. The technique of tracing legal materials uses a document study technique (library research), and the analysis of the study uses qualitative analysis. The results of this study indicate that the efforts and strategies taken to optimize the sale of auction property assets are by educating the public and socializing through brochures in both mass media and social media as well as joint marketing with banks.

Abstract

Background: Kecelakaan dan Keselamatan Kerja (K3) di lingkungan kerja seringkali menjadi hal yang diabaikan oleh pemilik usaha dalam memberikan perlindungan kerja bagi pekerjanya. Masih banyak pekerja yang melakukan pekerjaan yang mengandung resiko yang tidak dilindungi dengan alat pelindung diri yang optimal. Tujuan kegiatan ini adalah untuk meningkatkan kemampuan dan keterampilan pekerja dalam penggunaan APD untuk menjamin terlaksananya K3 di lingkungan kerja CV Gotama Jaya Sejahtera Lestari sehingga mampu memebrikan perlindungan yang maksimal bagi pekerja. Metode: Dilakukan Sosialisasi, Edukasi dan Pelatihan serta Pendampingan melalui Program SEOS dalam penerapan K3 CV Gotama Jaya Sejahtera Lestari. Hasil: Melalui Sosialisasi, pelatihan dan pendampingan, mitra berhasil dalam meningkatkan pengetahuan terkait dengan K3 dan peningkatan kemampuan serta kesadaran dalam penggunaan APD dalam melaksanakan pekerjaan. Kesimpulan: Kegiatan pengabdian ini berhasil dalam mencapai target capaian kegiatan yang diharapkan, dengan kesesuaian antara masalah yang dihadapi mitra dengan solusi dan metode yang diterapkan.

Abstract

Indonesia has an important role in improving the global environment. One of the efforts made is to create new economic instruments that aim to reduce risks and provide opportunities for capital flow growth in various sectors. However, to date, it cannot be denied that Indonesia still depends on environmentally unfriendly investments. Monetary policies that rely on extractive investments have become the main choice in Indonesia's financial and development approaches. One way to address challenges in the tourism industry is to make green investments to overcome the negative impacts on environmental damage. The use of energy transition is one solution that can be offered in the development of green investment in the tourism service sector. The research method used in this study is the Socio Legal Research method, where legal materials are collected by systematically compiling and identifying primary, secondary, and tertiary legal materials using the snowball technique. The analysis of legal materials is carried out using descriptive, comparative, evaluative, and argumentative techniques. The results of the study show that the implementation of energy transition policies to realize green investment in Indonesia still faces various obstacles, namely legal inconsistencies related to the use of renewable energy and policies on green investment, as well as economic obstacles related to limited budgets and technology in implementing this energy transition.

Abstract

Penelitian ini bertujuan menganalisis pengaturan perjanjian di bawah tangan dalam perspektif hukum positif Indonesia serta proses pembuktian terkait keabsahan perjanjian tersebut. Metode yang digunakan adalah penelitian hukum normatif dengan mengkaji peraturan perundang-undangan dan literatur terkait. Hasil penelitian menunjukkan bahwa meskipun ketentuan hukum tentang perjanjian di bawah tangan cukup mendukung keberlakuan dan kekuatan mengikatnya, terdapat kendala dalam aspek pembuktian. Keabsahan perjanjian ini sangat bergantung pada pengakuan pihak-pihak yang terlibat. Jika terjadi penyangkalan, beban pembuktian beralih kepada pihak yang mengklaim keabsahan perjanjian, yang harus menghadirkan bukti tambahan, seperti saksi atau dokumen lain. Penelitian ini juga mendapati bahwa penggunaan tanda tangan elektronik dalam perjanjian di bawah tangan dapat menjadi alternatif, meskipun masih menghadapi tantangan terkait keabsahannya dalam praktik hukum. Oleh karena itu, diperlukan klarifikasi lebih lanjut dalam ketentuan hukum mengenai prosedur pembuktian untuk menciptakan kepastian hukum yang lebih baik.

Abstract

This research analyzes the legal consequences of not removing Fiduciary guarantees registered in the online system in the province of Bali. The implementation of the elimination of Fiduciary guarantees registered in the online system is the obligation of Fiduciary recipients as creditors, this provision is regulated in Article 16 paragraph (2) of Government Regulation Number 21 of 2015 concerning Procedures for Registration of Fiduciary Guarantees And the cost of making a Fiduciary Guarantee Deed. However, in practice there are still fiduciary recipients, namely creditors who do not fulfill their obligations to abolish the fiduciary guarantee after the fiduciary giver, namely the debtor, has fulfilled all his achievements. There is no sanction that regulates related if the Fiduciary recipient does not eliminate the Fiduciary guarantee which results in this obligation being disobeyed. The study of this research is related to the implementation of the elimination of Fiduciary guarantees registered in the online system and the legal consequences of the negligence of the Fiduciary recipients for not notifying the Fiduciary guarantee deletion to the Minister registered in the online system. The method used is an empirical legal research method. The analytical knife of legal issues in this thesis is the theory of legal effectiveness, the theory of legal certainty and the theory of legal protection. The results that can be concluded in this study are if the Fiduciary recipient, his proxy or his representative does not notify the removal of the Fiduciary guarantee, then the Fiduciary guarantee concerned cannot be re-registered.

Abstract

Tourism development in Bali increasingly confronts structural challenges generated by the persistent tension between economic growth imperatives, environmental sustainability, and the preservation of local cultural identity. However Bali’s Spatial Planning Regulation (RTRW) 2023–2043 integrates the Tri Hita Karana philosophy and the principle of “one island, one plan, one management,” its implementation remains constrained by fragmented inter-agency coordination, limited law enforcement capacity, and a development orientation that privileges economic interests over socio-ecological balance. In response, this study examines how an integrated spatial governance framework can harmonize national legal instruments with local wisdom to support sustainable tourism development in Bali. Using a normative juridical research method, the study employs conceptual analysis, statutory review, and comparative legal approaches. The findings demonstrate, first, that local regulatory instruments, particularly awig-awig and community-based zoning mechanisms, contribute significantly to maintaining spatial equilibrium and protect cultural identity and environmental values at the community level. Second, the study finds that the effectiveness of these local instruments remains limited by inadequate formal regulatory recognition and weak alignment with central government mechanisms, including risk-based business licensing systems and spatial conformity approval processes. Third, comparative analysis of Thailand’s sustainable tourism governance, especially the Designated Areas for Sustainable Tourism Administration (DASTA) model, reveals that effective spatial governance depends on robust multi-actor collaboration and institutional coherence that formally integrates local governance structures within designated tourism areas.

Abstract

This study aimed to identify and formulate the model of integrated tourism policy based on local wisdom for economic recovery from post covid-19 pandemic. The method of this research was empirical legal research by using primary data sources in form of an interview which was analyzed qualitatively and displayed descriptively. The finding of this research showed that the design of the integrated policy in tourism was conducted by designing a policy formulation in which the policy formulation design was taken from strategic issues related to tourism including internal and external conditions in implementing tourism policy, and the analysis of the previous policies was conducted including analysis of policy and analysis for policy.

Abstract

Drug abuse is a serious problem faced by many countries, including Indonesia. To overcome this problem, the Indonesian government provides rehabilitation sanctions for drug users, including foreign citizens living in Indonesia. This research aims to analyze the regulation of drug rehabilitation for foreign nationals in criminal acts of drug abuse in Denpasar City and this research also highlights the importance of the Self Management and Recovery Training (SMART) method as an effective solution in the rehabilitation of foreign nationals caught in drug abuse in Indonesia. The research method used is empirical legal research with a critical qualitative approach. The data collection technique was carried out by interviews where informants were selected purposively. Data processing analysis techniques are carried out in a qualitative descriptive manner. The research results show that foreign citizens involved in drug abuse crimes in Denpasar City can undergo the same rehabilitation program as Indonesian citizens. This process begins with applying to local authorities, such as the police or authorized agencies. However, rehabilitation policies for foreign nationals depend on various factors, including the severity of the offense and whether they are willing to cooperate with authorities, and drug rehabilitation for foreign nationals is important. The SMART method is an effective rehabilitation method for foreign nationals because this program can be adapted to different individual needs, languages, and cultures. This program also emphasizes individual responsibility in the recovery process, so that it can help individuals to build a better sense of self-confidence and self-control.
