Abstract

The purpose of this research is to determine and analyze the implementation of an environmentally friendly waste management system in Kupang City based on Kupang City Regional Regulation Number 3 of 2011 and to identify the obstacles faced in implementing the waste management system in Kupang City. Data collection techniques were carried out through document studies and in-depth interviews with related parties, especially the Kupang City Environment and Sanitation Service (DLHK). The results of the study indicate that the implementation of the waste management system in Kupang City has not been running optimally due to various obstacles that can be grouped into three aspects, namely: (1) legal aspects, in the form of the absence of implementing regulations and weak law enforcement; (2) sociological aspects, in the form of low public awareness, participation, and compliance; and (3) institutional and governmental aspects, in the form of limited facilities and infrastructure, weak institutional roles, and minimal coordination between Regional Apparatus Organizations (OPD) and waste management partners. To overcome these obstacles, efforts are needed in the form of strengthening the legal aspects through the preparation of technical regulations, increasing public awareness through education and community involvement, and strengthening institutions and governance.

Abstract

The objectives of this research are to understand and analyze the regulation of the duties and authority of the Department of Women's Empowerment and Child Protection in protecting children, and to identify and understand the inhibiting factors in carrying out these duties and authority. The research methodology used is normative juridical research, obtained through interviews and observations, and empirical juridical research, obtained through literature studies. The research results show: (1) The regulation of the duties and authority of the Department of Women's Empowerment and Child Protection in Rote Ndao Regency in protecting children includes the areas of child protection and fulfillment of children's rights and the special child protection program. (2) The inhibiting factors of the Department's duties and authority in protecting children include strategic issues and problems in regional development and strategic issues and problems in the sector of women's empowerment and child protection, population control, and family planning.

Abstract

Lotas Village, Rinhat District, Malaka Regency, often experiences problems in the management of natural resources, especially in the provision of clean water to the community. This type of research is empirical legal research, namely research that focuses on studying problems in detail and in detail. Abstract

In the context of the implementation of local government in accordance with the mandate of the Constitution of the Republic of Indonesia in 1945, Local governments follow the principles of autonomy and assistance duties while regulating and managing their own government issues. Furthermore, local governments are instructed to increase regional competitiveness by paying attention to the principles of democracy, equity, justice, privileges, and regional specificity within the framework of the Unitary State of the Republic of Indonesia. They are also instructed to expedite the realization of community welfare through improvement, service, empowerment, and community participation. As stated in Article 236 paragraph (1) of Law Number 32 of 2004 concerning Regional Government, Regional Regulations are established for the implementation of regional autonomy and assistance tasks. Therefore, in order to implement regional autonomy in Sabu Raijua Regency, it is necessary to have a Regional Regulation made by the local government of Sabu Raijua Regency. In addition to Regional Regulations, the Sabu Raijua community also has other regulations in the region such as regional head regulations, village regulations, customs and so on. The results of the study stated that in carrying out its function as a regulator on gambling control in Sabu Raijua Regency, the government has not carried out its duties properly. The government has not established a Regional Regulation on Gambling Control due to the low quality of human resources, the absence of participation from the community and the lack of availability of funds in Sabu Raijua Regency.

Abstract

The purpose of this research is to analyse the execution of the function of the Regional Revenue and Assets Agency of East Nusa Tenggara Province in overseeing Motor Vehicle Tax) revenue, as well as identifying inhibiting factors based on East Nusa Tenggara Governor Regulation Number 25 of 2022. The results showed that (1) Regional Revenue and Asset Management Agency East Nusa Tenggara Province has carried out the supervisory function through monitoring, evaluation, recommendations, and reporting, (2) but it has not been optimal due to low taxpayer awareness, the absence of standardised standard operating procedure, and limited facilities and infrastructure. Therefore, a strategy is needed to increase the effectiveness of the supervisory function and update technical policies as well as increase socialisation to the public in order to optimise revenue in the region.

Abstract

This study examines the efforts of the General Election Commission of Manggarai Regency to increase voter turnout for the 2024 Election through fact-based legal strategies. Data were gathered via interviews and document analysis at the KPU Manggarai office. The study identified six key steps: (1) technological voter data management (WhatsApp, Sidalih); (2) inclusive registration (e-KTP access, Voting Rights Guard Post); (3) diverse socialization channels (Goes to School/Campus, social media, billboards); (4) political education targeting new voters, women, and persons with disabilities; (5) creative programs (e.g., Colour Run) and inter-institutional collaboration; and (6) accessible polling stations (facilities for the elderly and disabled, Braille templates). Despite these efforts, four main obstacles emerged: (a) limited human resources (Pantarlih competence); (b) infrastructure issues (road access, polling station shortages, weak electricity/network); (c) unbalanced budget allocation (only 0.35% or IDR 161 million for socialization out of IDR 45.3 billion); and (d) suboptimal participation (average 75.36%, below the 80% national target). Gaps between electoral districts (lowest in District 3: 73.39%) and minimal DPK/DPTb usage highlight persistent challenges related to geography, administration, and resource limitations.

Abstract

Rumah Penyimpanan Benda Sitaan Negara (RUPBASAN) merupakan lembaga yang berperan penting dalam menjaga keamanan, keutuhan, dan nilai ekonomis benda sitaan negara (BASAN) serta barang rampasan negara (BARAN) sebagai bagian dari sistem peradilan pidana terpadu. Namun, dalam praktiknya, kewenangan Kepala RUPBASAN masih terbatas pada fungsi administratif, sementara tanggung jawabnya mencakup aspek teknis dan hukum yang luas. Kondisi ini menimbulkan ketimpangan antara tanggung jawab dan kewenangan, sehingga pengelolaan BASAN dan BARAN sering kali tidak efektif, menimbulkan kerugian negara, dan menurunkan nilai aset akibat proses hukum yang berkepanjangan. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode pendekatan perundang-undangan dan konseptual, yang difokuskan pada analisis terhadap KUHAP, PP Nomor 27 Tahun 1983 jo. PP Nomor 92 Tahun 2015, serta Permenkumham Nomor 16 Tahun 2014. Sumber data diperoleh dari bahan hukum primer, sekunder, dan tersier, yang dianalisis secara kualitatif-preskriptif. Hasil penelitian menunjukkan bahwa terdapat disharmoni regulasi dalam pengaturan kewenangan Kepala RUPBASAN. Hal ini berdampak pada lemahnya efektivitas fungsi RUPBASAN dalam menjaga nilai aset negara. Diperlukan langkah harmonisasi hukum melalui reformulasi regulasi lintas sektor, pemberian diskresi administratif terbatas kepada Kepala RUPBASAN, dan pembentukan mekanisme koordinasi antar lembaga penegak hukum. Kesimpulannya, penguatan kewenangan Kepala RUPBASAN merupakan kebutuhan mendesak untuk mewujudkan tata kelola pemerintahan yang berprinsip pada legalitas, efisiensi, akuntabilitas, dan good governance, sehingga pengelolaan BASAN dan BARAN dapat berjalan efektif, transparan, dan berkeadilan.

Abstract

The issue of the Constitutional Court's authority in assessing a decision related to open legal policy has become a very interesting discussion and has received a lot of attention from the public. As explained above, when rejecting a case, the Constitutional Court always argues that the case is an open legal policy, which is the authority of the DPR as the legislator. In several recent decisions, the Constitutional Court has been inconsistent in viewing and adjudicating cases that have an open legal policy nuance. One example of the court being inconsistent in the decisions it makes is regarding the election law regarding age limits, which has recently become a legal debate. The Constitutional Court as the guardian and interpreter of the constitution or “the guardian and the sole and the highest interpreter of the constitution” in several of its decisions regarding age in elections, it provides its interpretation contained in various decisions related to open legal policies made by legislators. Therefore, the formulation of the problem contained in this research is how to regulate the authority of the Constitutional Court in reviewing laws related to open legal policy and what are the legal implications of the authority of the Constitutional Court in deciding cases related to open legal policy. The research used in this writing uses normative legal research. This research uses a statutory approach, a conceptual approach. The research results show that the authority of the constitutional court in deciding open legal policy cases is contrary to the authority possessed by the constitutional court and has implications for the concept of the division of power. The Constitutional Court must have a clear legal basis in looking at cases related to open legal policy so that in the future the constitutional court will have a clear perspective. the same so that there are no more inconsistencies in the Constitutional Court's decisions regarding cases that have an open legal policy nuance. Regulations regarding open legal policy must be regulated in detail so that the norm testing process carried out has clear standards and mechanisms so as to provide legal certainty for the community

Abstract

The purpose of this study is to analyze the legal position of the Minister of Ttriumvirat in the Constitutional system of the Republic of Indonesia. This research method is normative law (library research), this research examines legal materials, books, and laws and regulations that are closely related to the legal issues studied. The results showed that the legal position of the triumvirate minister as the executor of the Presidential duties in the constitutional system of the Republic of Indonesia is specifically regulated in the constitution of the Republic of Indonesia, namely contained in article 8 paragraph 3 and also in the hierarchy of laws and regulations in MPR Decree Number VII / MPR / 1973, precisely article 5 as the basis for legitimacy and recommendations in terms of filling the vacancy of the office of president and vice president. The basis for considering the Triumvirate Minister as the executor of Presidential duties if the president and / or vice president quits in the middle of his term of office is because they are considered to understand the course of government and have responsibility for foreign policy, domestic government, and national defense.

Abstract

Law No. 6/2014 provides a legal basis for the allocation of village funds in Indonesia with the aim of improving the welfare of rural communities through infrastructure development, local economic empowerment, and improved quality of life. However, the use of village funds is often in the spotlight due to potential misuse, lack of transparency, and low accountability. This research aims to find out how far the village government functions and the obstacles in the use of village funds based on Law No. 6 of 2014 in Mandungo Village and Denduka Village, South Wewewa District, Southwest Sumba Regency. This research method uses a qualitative approach with data collection techniques through interviews, observation, and document analysis. The results showed that although both villages have relatively complete government structures in accordance with the Village Law, the functions of village government have not been fully optimized. Some village government functions, such as the preparation of village regulations, financial management, and public services still face significant challenges. In addition, barriers to the use of village funds were also found, including a lack of transparency, a lack of administrative capacity, and a lack of community understanding of village fund allocations. This study concludes that despite the existence of regulations governing village governance functions and the management of village funds, their implementation still faces significant challenges.
