Abstract

BUMDes merupakan salah satu usaha desa dalam bentuk lembaga yang pengelolaanya dijalankan oleh pemerintah desa dan masyarakat desa guna mendorong peningkatan perekonomian masyarakat desa atau termasuk usaha dari desa, oleh desa dan untuk desa, namun dalam pelaksanaanya tetap mengacu pada kebutuhan masyarakat dan potensi desa yang ada. (1) Bagaimanakah fungsi badan pengurus dalam pengelolaan BUMDes di Desa Hadakewa dan Desa Dikesare , Kecamatan Lebatukan, Kabupaten Lembata? (2) Sejauh manakah peran pemerintah Desa Hadakewa dan Desa Dikesare ,Kecamatan Lebatukan , Kabupaten Lembata dalam mendukung kinerja BUMDes di Deas Hadakewa dan di Desa Dikesare. Jenis data yang dikumpulkan adalah data primer dan data sekunder. Metode pengumpulan data adalah metode observasi, metode interview, dan metode kepustakaan Hasil penelitian ini menunjukan bahwa : 1. Kehadiran unit bisnis pariwisata ini tentunya berdampak baik buat masyarakat karena mampu menyerap tenaga kerja kurang lebih 25 orang dengan penghasilan rata-rata 1 juta rupiah per bulan. Pantai Hadakewa dilengkapi restoran, juga terdapat fasilitas café kapal, banana boat, camping ground, kayak dan SUP (Stand Up Paddleboard-papan dayung berdiri), sedangkan pantai dikesare dilengkapi café lamadike, warung yang tersedia ketupat dan ikan bakar, rumah apung yang terdapat di tenga luat dan berbagai spot untk berpose. 2. Peran pemerintah desa dalam mendukung kinerja BUMDes dari kedua desa adalah melindungi masyarakat dalam pertumbuhan ekonmi, dan mengawasi dan mendukung kinerja bumdes di desa.

Abstract

Peraturan Wali Kota Kupang Nomor 2a Tahun 2017 tentang Tata Cara Perizinan Reklame pada pasal 1 angka 6 menjelaskan bahwa penyelenggaraan Reklame Adalah Rangkaian kegiatan dan pengaturan yang meliputi perencanaan, jenis, perijinan, penyelenggaraan, pengendalian, pengawasan dan penertiban reklame dalam rangka mewujudkan pemanfaatan ruang kota yang serasi. Satpol PP memegang peranan penting dalam penegakan pemasangan reklame sebagaimana yang telah diatur dalam Peraturan Walikota Kupang Nomor 2a Tahun 2017 Tentang Tata Cara Perizinan Reklame. Penelitian ini termasuk jenis penelitian yuridis empiris, yakni mengkaji hukum dalam implementasinya (law in books and law in action) yaitu penelitian yang datanya diperoleh melalui penelusuran langsung di lokasi penelitian. Berdasarkan Hasil Penelitian maka dapat disimpulkan bahwa: Pelaksanaan Fungsi Polisi Pamong Praja Dalam Penegakan Hukum Terhadap Pemasangan Reklame Tanpa Ijin di Kota Kupang menujukkan bahwa kurang efektif. Hal tersebut dapat dilihat bahwa kinerja Satuan Polisi Pamong Praja belum mampu menjalankan tugas dan fungsinya dalam menertibkan papan reklame liar yang tersebar di berbagai titik. Berdasarkan Kesimpulan diatas maka dapat disarankan bahwa Satuan Polisi Pamong Praja dalam penertiban papan reklame agar dapat bekerjasama lebih efektif lagi untuk meminimalisir permasalahan yang terjadi sehingga dalam penertiban dapat berjalan secara efektif dan efisien supaya dapat dirasakan oleh berbagai elemen masyarakat.

Abstract

Efektivitas Penegakan Hukum Badan Pengawasan Pemilu Kabupaten Ende seringkali mengalamikendala dan tantangan mewarnai dinamika dalam proses penyelenggaraan Pemilu 2019. Pada sisi yang lain, sebagai salah satu lembaga penyelenggara pemilu, Bawaslu juga telah berupaya seoptimal mungkin dalam menjalankan tugas, fungsi dan wewenangnya dalam menyelesaikan setiap persoalan dalam proses penyelenggaraan Pemilu 2019. Sebagai ikhtiar untuk menarik pembelajaran dari pengalaman pertama menyelenggarakan pemilu secara serentak dan sebagai bagian dari pertanggungjawaban kepada publik, Bawaslu merasa perlu untuk melakukan evaluasi. Masalah pokok dalam penelitian ini yaitu:(1) Seberapa jauh penegak hukum oleh Bawaslu Kabupaten Ende terhadap pemilihan Umum Serentak Tahun 2019? (2) Faktor-Faktor apa saja yang berpengaruh terhadap penegakan Hukum Pemilu Serentak 2019 di Kabupaten Ende? Jenis penelitian ini yaitu Penelitian hukum yuridis empiris dengan menggunakan tipe kajian sosiologi hukum (Socio-legal research)yang menekankan pada pentingnya langkah-langkah observasi, pengamatan dan analitis yang bersifat empiris. Hasil penelitian ini menunjukan bahwa: (1) Penegakan hukum Bawaslu Kabupaten Ende dalam pemilihan umum tahun 2019 berdasarkan Undang-Undang No.7 Tahun 2017 sudah sangat maksimal karena dilihat dari laporan dan temuan yang disampaikan semuanya dapat diselesaikan dengan prosedur dan mekanisme yang diatur dalam peraruran perundang-undangan. (2) Faktor-faktor yang mempengaruhi penegakan hukum pada saat pemilihan umum tahun 2019 di Kabupaten Ende yaitu minimnya kesadaran masyarakat dalam mengawasan pelanggaran pemilu kurangnya pemahaman masyarakat dalam mencegahan pelanggaran Pemilu dipengaruhi oleh keterbatasan sumberdaya manusia dan biaya dalam menegakan pelanggaran Pemilu serta lemahnya kontrol partai politik terhadap kader partai yang melakukan kecurangan masi sangat enggan melaporkan pelanggaran-pelanggaran yang terjadi.

Abstract

This paper aims to discuss to what extent the management of village-owned enterprises (BUMDes) in Menia Village, west Sabu District, Sabu Raijua Regency in realizing community welfare and to examine the inhibiting factors for managing village-owned enterprises (BUMDes) in Menia Village, west Sabu District, Sabu Raijua Regency. The research is Empiris juridical research, namely: to approach the problem under study with a real legal nature or by the reality experienced by the community. The research emphasizes the implementation and obstacles faced in carrying out the roles and functions of Village Owned Enterprises (BUMDes) in Menia Village, West Sabu District, Sabu Raijua. The results of this research show that the management of village-owned enterprises (BUMDes) in Menia Village is not running well and is not in accordance with the established rules. This is because the initial funds or capital for micro small businesses (kiosan) are smaller than the capital for social and other development in Menia villages. So the management of kiosk businesses experiences bottlenecks due to goods that have been purchased and resold by BUMDes members setting prices higher than market prices. The impact of this stalled kiosk business is making it difficult for people to meet their needs amidst activity restrictions (Covid-19) andd also losses in funds that have been provided by the the villagee for initial capital in running BUMDes. Inhibiting factors that occur in the management of BUMDes are divided into two parts, namely: human resources. Minimal budget, leadership, and governance, while the external factor was an unexpected disaster (COVID-19). This shows that in managing BUMDes there must be careful management and preparation so that the expected results can be achieved for the welfare of the Menia village community

Abstract

This study aims to analyze the implementation of Regent's authority delegating to Subdistrict Head in the context of regional autonomy and the impediment factors of the implementation of the Subdistrict Head authority at Kambera and Kota Waingapu Subdistrict of East Sumba Regency. This was an empirical judicial research with qualitative and conceptual approach. The data processing technique used were editing, clarification, tabulating, and verification, and analyzed by qualitative descriptive accord with the law theories, principles and norms. The results revealed that the Head of Kambera and Kota Waingapu Subdistrict have implemented the authority delegated by the Regent of East Sumba eventhough not optimal yet, which were (1) licensing services of commercial sector of issuing Micro and Small Enterprises (MSEs/UMK) Business License, by publishing code of conduct terms in running the MSEs business while the issuing and signing up the license by OSS RBA (Online Single Submission Risk-Based Approach) at the Capital Investment and Integrated One-Stop Services Agency (CIIO-SSA) of East Sumba Regency Government, (2) non licensing services of village and society/community empowerment sector by budget allocation for family welfare empowerment (PKK) activities and the homelesses; listing the village inhabitants deserved for and distribution the social aids; developing the young millenial generations through engagement in farming, breeding, running a business, and trading; (3) evaluation of the program by capacity developing of the Chiefs and all human resources apparatus set of the villages in drafting the Village General Revenue and Expenditure Budget (APBDes); accompanying in the planning, establishing, and implementing the APBDes, APBDes draft and village budget evaluation, and APBDes concerned village regulations evaluation quarterly and every year. The impediment factors of the implementation of the Subdistrict Head authority were (1) the minimity of MSEs Business Licensing socialization, (2) the utilities and infrastructures lacking which were the availability of services hall, office appliances such as computer, printer, operational motor vehicle, and budget, (3) the lack of coordination between the subdistrict with the villages government, neighborhood asociation (RT/RW) of the MSEs Business licensing services, listing the MSEs businessmen, acceptor listing and distribution of the social empowerment aids, and had not ever coordinated with the regency government and the CIIO-SSA, and (4) the poor quality of the subdistrict government human resources. Researcher suggests that the concerned stake holders which are the chief and the all human resources apparatus set of the subdistricts and regency governments, and CIIO-SSA should more enhancing the synergy in solution finding efforts of the impediment factors of the implementation of the Regent’s authority delegating to the Subdistrict Head such as by routine and continuously coordination in order to maintain and enhancing the services performance and regional welfare development

Abstract

The symptoms seen by the author one of the main factors that make the community complain about the duties and functions of the village government is the uneven development carried out by the village government because the village government focuses more on carrying out development for families than equitable distribution of development for local village communities. The problem formulation in this research is: (1) What is the function of the Village Government in village development in Weain Village and Webetun Village, Rinhat District, Malaka Regency? (2) What are the inhibiting factors in implementing village development functions in Weain Village and Webetun Village, Rinhat District, Malaka Regency? The objectives of this research are: (1) to find out and describe the duties and functions of the Village development in Weain Village and Webetun Village, Rinhat District, Malaka Regency, (2) to find out and describe the inhibiting aspects in implementing development in Weain Village and Webetun Village, Rinhat District, Malaka Regency.This research uses empirical legal research methods and normative juridical legal research methods. The results of this research show: (1) The function of the village government in village development in Weain Village and Webetun Village, Rinhat District, Malaka Regency, namely: (a) Village development planning stage, (b) Implementation of village development, (c) Accountability stage, (2) Factors that become obstacles in the implementation of village development in Weain Village and Webetun Village, namely: (a) Low human resources, low understanding and level of education so that many opportunities are not touched.

Abstract

This research has been carried out in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency in September 2023. The purpose of this study is to identify the role that village heads play in the management of village funds in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency, as well as the factors that inhibit this management. Both normative and empirical juridical legal methodologies were employed in this investigation. Primary and secondary data are the two categories and sources of data. Literature reviews, interviews, and observation are used as data collection methods. Tabulation, coding, and editing are the three steps in data processing. The results showed that the management of Village Funds in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency from the planning stage, the implementation stage to the accountability stage has not run optimally in compliance with village financial management regulation Number of 2018 issued by the minister of home affairs. Inhibiting factors in the management of Village Funds in Nobi-Nobi Village are, lack of human resources, incomplete facilities and infrastructure, lack of awareness from the community and tend not to understand and sources of income that only come from one source, namely transfer funds.

Abstract

This research aims to find out to what extent the implementation of Kupang City Regional Regulation Number 7 of 2015 concerning Buildings, in Kelapa Lima District, Kupang City and what factors are obstacles to its implementation. The research method used in this research is Empirical Juridical, namely legal facts relating to matters relating to community members in implementing statutory regulations including Kupang City Regional Regulations which are the object of study in this research or certain situations, which give rise to gaps between das solen and das sein or between practice theory, ineffective application of law, deviant behavior or behavior, situations in people's lives that are starting to experience rapid transformational changes. The approach method used is a sociological juridical approach as well as a conceptual approach and the types of data used in this research are primary data (interviews), secondary (laws) and tertiary (dictionaries). The results of the research show that the implementation of concerning Buildings in Lasiana Village and Oesapa Village as a whole reached 60%. This indicates that the implementation of these regulations is quite good, although there are still 40% who do not use building permits. And the inhibiting factor is the low level of human resources and public legal awareness.

Abstract

In the current era, cases are increasing due to consuming alcoholic drinks, both in the community and among teenagers, one of which is in the city of Kupang. So the Kupang city government must handle cases of free distribution of alcoholic drinks among the public, one of which is by giving the Kupang city government duties and responsibilities to the Department of Industry and Trade. This research aims to determine the duties and responsibilities of the industry and trade department in supervising alcoholic beverages, and the obstacles that exist in supervising alcoholic beverages. The type or types of research used in this research proposal is empirical juridical research, namely research carried out by going directly into the research field to collect information as a required legal fact, using an interview approach from the required sources. The research results found that before the supervision was carried out, the Department of Industry and Trade formed a supervision team, place and time for supervision, checked the completeness of business permits, carried out an assessment, and ultimately imposed sanctions on those who violated them. and Obstacles: lack of community cooperation in government efforts and lack of strict sanctions given to sellers, which only take the form of warnings. The proposed lack of outreach by the Department of Industry and Trade in conducting outreach to sub-districts in Kupang City regarding the sale of alcoholic drinks to the public, business actors should comply with existing regulations.

Abstract

Licensing plays a crucial role in regulating societal activities, aiming to foster order, fairness, and prosperity. Despite its significance, challenges persist within the Investment and Integrated One-Stop Service Office (DPMPTSP), particularly in Kupang City, where residents face hurdles in adapting to digitalization. This lack of understanding exacerbates issues such as low awareness of Building Construction Approval (PBG), leading to a disconnect between the community and the government. This thesis addresses: (1) The effectiveness of DPMPTSP in facilitating PBG in Kupang City; and (2) Factors hindering its implementation. Conducted as an empirical legal study at DPMPTSP, it involved primary and secondary data analysis. Findings reveal: (a) Monitoring is hindered by server maintenance and public unfamiliarity with PBG procedures. (b) Despite regulatory efforts, PBG processes have evolved with the introduction of a web-based system called the Building Management Information System (SIMBG). (c) Recommendations from DPMPTSP remain partially implemented, reflecting a gap in public-government understanding. Recommendations include staffing, infrastructure upgrades, and public education to bridge this divide.
