Abstract

Driving discipline is an important attitude that must be possessed by all drivers or drivers in order to arrive safely at their destination. Traffic violations still occur frequently, one of which is smoking and calling while driving. The Transportation Service is an implementing element of the Regional Government in the field of Transportation which has the main task, namely Organizing Government affairs in the field of land, sea and air transportation, in accordance with the Laws and Regulations. This type of research shows empirical juridical research, with data collection techniques through interviews, observations, and literature/document studies. The data collected is analyzed descriptively, the data that has been processed will be analyzed using the descriptive analysis method. The results of this study show: (1) The implementation of the duties and functions of the Kupang City Transportation Office for motorcyclists who smoke and call while driving is not / or has not been effective in accordance with the provisions of applicable laws and regulations. (2) There are several factors that hinder the implementation of the duties and functions of the Kupang City Transportation Office for motorcyclists who smoke and call while driving, including the legal factors themselves and the factors of facilities and infrastructure, namely the main obstacle is the unavailability of the budget. These two factors certainly have an interest that always hinders or affects the implementation of the rules regarding the prohibition of smoking and calling while driving, making the rules ineffective. Based on the results of the research, the author has several suggestions, namely improving the implementation of duties and functions for motorcyclists who smoke and call while driving, in accordance with the provisions of applicable laws and regulations and add educational programs and campaigns in the community related to the dangers of smoking and calling while driving, in addition to law enforcement must be carried out consistently by providing clear sanctions so that it has a deterrent effect, and local governments need to allocate budgets to improve facilities and infrastructure that support control.

Abstract

The function of the sub-district in coordinating community empowerment activities in the sub-district area, the position of the sub-district is explained in article 221 of Law Number 23 of 2014, namely the district/city area forms a sub-district in order to improve the coordination of government administration, public services, and empowerment of the village/sub-district community. This research is a Normative-Empirical Law research, where this research is carried out in Ngada Regency. The data obtained in this study is qualitative data, using the guidelines of the law with interviews and respondents then processed into qualitative descriptive. The results of this study are an illustration that; (1) The West Golewa Sub-district according to the regulation of its function has not been maximized in coordinating community empowerment activities, as explained in article 221 of Law Number 23 of 2014 (2) the inhibiting factor in carrying out the function of regulating the sub-district in coordinating community empowerment activities periodically and optimally, it is necessary to play a role in coaching and supervising the sub-district so that it is more active in carrying it out, the function of the sub-district, so that it plays an active role.

Abstract

Conservation is one of the ways taken by the government to protect, conserve, and maintain biodiversity and its ecosystems from extinction. So that the provisions of Article 21 paragraph 2 of Law no.5 of 1990 concerning the Conservation of Natural Resources and Their Ecosystems are expressly regulated regarding the prohibition of trading and utilizing protected animals, including eggs and other parts. Poaching, turtle egg theft, and coastal pollution are some of the factors that cause the drastic decline in the population of these rare animals. One of the turtle conservation places in Lembata Regency is the Loang Turtle Conservation. This research is an empirical juridical research, namely reviewing and analyzing the turtle conservation process by the people of Riabao Village and Duawutun Village, and knowing the participation of the people of Riabao Village and Duawutun Village in turtle conservation efforts. By using a special approach and approach to legislation that examines the conformity between the applicable legal provisions and the facts that occur in the field. The results of this study show that: (1) Apart from the declining population and government policy attachment related to the prohibition of turtle hunting, another major factor in the establishment of this captivity geographically is because the Loang coastline is the destination area for the migration of turtles. (2) Community participation in conservation efforts of turtles as protected animals on the coast of Loang, Riabao Village and Duawutun Village, Nagawutung District, Lembata Regency, which was initially a group of conservation youth who felt very concerned about the survival of the ancient animal.

Abstract

The implementation of Government Regulation Number 94 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office has not been fully effective where there are still violations of civil servant discipline including violations of time discipline and work discipline such as arriving late, leaving early, leaving the office and work for personal interests. The problems in this thesis are (1) How is the Effectiveness of the Implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office? (2) What are the Factors that hinder the Effectiveness of the implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Belu Regency Education and Culture Office? This research is a normative legal research supported by empirical legal research where the data is obtained directly from the research location by observation and interviews. to compare the applicable regulations with the reality that occurs in society and use qualitative descriptive juridical analysis. The results of this study indicate that (1) the local government of Belu Regency has provided TPP (Income Improvement Allowance) as an appreciation from the government, especially from the leader of the region related to work discipline. where employees who are absent are not in accordance with the provisions of working hours, the TPP of these employees is automatically deducted by the electronic attendance system, namely vinzer print, provisions like this, the local government has tried to maintain discipline within the scope of the State Civil Apparatus in carrying out its duties and obligations, but the system that has been implemented by this local government does not rule out the possibility of violations of discipline. These violations make the application of a provision or regulation in an agency not run effectively. (2) Factors inhibiting the implementation of Government Regulation Number 94 of 2021 concerning Civil Servant Discipline at the Education and Culture Office of Belu Regency, namely: civil servant awareness factors, and cultural factors.

Abstract

Village community empowerment is the duty and authority of the Village Head as contained in article 26 of Law Number 6 of 2014 concerning Villages, it is stated that the Village Head is in charge of organizing Village Government, implementing Village Development, Village Community Development and Village Community Empowerment. Village government organizational structure The village head is the leader of the village helpers/officials. This research was conducted in Oabikase Village, West Insana District, and Kiusili Village, South Bikomi District, TTU Regency. This research basically uses empirical juridical research methods, namely: research carried out directly to related parties in order to obtain information on the problem under study. Respondents are methods that take the pointer process based on the purpose for which information is to be obtained, then 44 people are used. According to the author's observations, the community in Oabikase Village and Kiusili Village are still not independent and prosperous in knowledge, ability and skills, so there are indications that the Village Head has not carried out his duties and authorities to optimally improve community empowerment. Although BUMDes have been established in the two villages, because the abilities, skills and knowledge of the community are still limited so they have not been able to use them optimally. The implementation of the duties of the village head in community empowerment and the use of Oabikase Village and Kiusili Village in Kefamenanu District, North Central Timor Regency has not run optimally, this is evident from the uneven infrastructure development. Oabikase Village and Kiusili Village still have factors that hinder government administration activities, including human resources.

Abstract

The purpose of this study is to analyze the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment as an Effort to Prevent Smoking in Students at Atambua Christian High School, Belu Regency. This type of research shows empirical juridical research. The results of this study indicate that the implementation of the Regulation of the Minister of Education and Culture Number 64 of 2015 concerning Smokefree Areas in the School Environment is not / or has not been effective. There are several factors that influence the successful implementation of this regulation including legal structure, legal substance, and legal culture. These three factors certainly have an interest that always hinders or influences the implementation of rules regarding Smokefree Areas so as to make these rules ineffective. Based on the results of the study, the authors have several suggestions, namely increasing supervision of the implementation of the no smoking area policy in the school environment, ensuring law enforcement against violations of regulations consistently and firmly to create discipline in the school environment and conducting regular counseling and education programs to all students, teachers, and staff including school guards about smoking and the importance of a smoke-free environment.

Abstract

Election or General Election is a facility of freedom or right owned by the people to elect members of the House of Representatives, DPRD, DPD, President and Vice President which is carried out directly, publicly, freely, secretly, honestly and fairly or commonly abbreviated as LUBER JURDIL based on Pancasila of the Constitution of the Republic of Indonesia in 1945. There are various ways to win the hearts of the public in the implementation of elections, including through democratic strategies such as using the vision, mission, program and work of the candidate pair to the community. There are also other ways that are often done, even as if it is mandatory to be able to win elections, then for most voters it becomes a common and inevitable thing, namely money politics. The practice of using money in politics in Indonesia is not a new money. The reason is that from the reform period, the practice of money politics was rampant. Many candidate pairs use money as a way to bring victory in elections. This research is an empirical research supported by a qualitative descriptive approach that uses primary data and secondary data collected using interview and observation methods and data is processed using data examination methods (editing), data marking (coding), data validation, and data vertification and analyzed using judicial analysis techniques. The results of this study show that (1) The management of village funds by the Oelnaineno village government in meeting the community's needs for clean water has been carried out in accordance with procedures and gradually, this is marked by the creation of mini reservoirs and reservoirs in each hamlet. (2) Factors that affect the Oelnaineno village government in allocating village funds to fulfill the rights of the Oelnaineno village community to clean water, namely legal factors, law enforcement factors, facilities or facilities factors and community factors that are less active in taking part in helping the village government.

Abstract

This study aims to find out and analyze the legal basis for considering the regulation of fine sanctions of Kupang Mayor Regulation Number 7 of 2013 concerning the health of mothers, infants and children under five and to find out and assess the effectiveness of the enforcement of Kupang Mayor Regulation Number 7 of 2013 concerning the Health of Mother, Infants and Children under five through the regulation of fine sanctions. This type of research is empirical normative research using interviews and data analysis methods that are carried out qualitatively. In this study, the author uses a type of empirical normative research or legal research that examines written law from the aspects of theory, history, philosophy, comparison, structure and composition, scope and material, general explanation of article by article, formality and binding force of a law but not binding aspects of its application or implementation. The results of the study show the legal basis for considering the regulation of fine sanctions in Kupang Mayor Regulation Number 7 of 2013 concerning the health of mothers, infants and children under five, because there are still incidents of childbirth outside health facilities in the working area of the Bakunase Health Center which can be at risk of maternal and infant mortality rates. This happens because there are still pregnant women who give birth at home because of impromptu childbirth so that childbirth does not occur in health facilities but outside health facilities or at home and childbirth is still helped by birth attendants. The risk of maternal and infant mortality can still occur. The effectiveness of the enforcement of Kupang Mayor Regulation Number 7 of 2013 concerning the Health of Mothers, Infants and Children Under Five through the regulation of fine sanctions in the working area of the Bakunase Health Center has been effective for health workers. For the public, there are still many who do not know about the Regulation of the Mayor of Kupang Number 7 of 2013 concerning the Health of Mothers, Babies and Children under five so that there are still incidents of childbirth outside health facilities and childbirth assisted by shamans. Knowledge about childbirth, attitudes and family support in this study also has an important role in determining mothers to have a safe delivery. It is suggested that new regional regulations need to be socialized to the community so that existing regulations can run effectively. An obedient society is also a basic thing so that regulations can run effectively.

Abstract

Pengelolaan tambang di Kabupaten Alor harus diatur sesuai dengan ketentuan peraturan perundang-undangan agar tidak mencemari lingkungan dan menimbulkan akibat hukum. Penelitian ini menggunakan metode penelitian hukum normatif. Dalam penelitian ditemukan, pertama; pemberian izin pertambangan di Kabupaten Alor pada umumnya belum berjalan sesuai dengan peraturan perundang –undangan yang berlaku sehingga mengakibatkan adanya pelanggaran terhadap izin lingkungan khususnya pada izin eksplorasi, kedua; pelaksanaan pembinaan dan pengawasan sebagai bentuk penegakan hukum dari Pemerintah Daerah dalam hal ini instansi teknis terkait kepada pengusaha tambang belum dilakukan secara efektif sehingga belum mampu membanguan kesadaran hukum secara utuh. Saran yang diberikan, pertama; pemberian izin pengelolaan tambang dalam menunjang pembangunan berkelanjutan di kabupaten alor harus melibatkan dinas terkait untuk melakukan sosialisasi tentang hak dan kewajiban dan sanksi yang akan diberikan kepada perusahaan yang akan melakukan usaha tambang, kedua; harus dibuat Peraturan daerah khusus tentang pemberian Lingkungan Hidup.

Abstract

The development and progress of villages as the smallest units in the governance structure are crucial for sustainable national development. In this context, the role of village facilitators has a significant impact on assisting villages in realizing their full potential. Village facilitators play a crucial role in assisting village governments in effectively and efficiently managing village funds to achieve sustainable community development and empowerment. The research problems in this study can be formulated as follows: (1) To what extent is the implementation of facilitation functions by village facilitators in the management of village funds in the fiscal year 2020 in Tebole Village and Lenguselu Village, South Rote District, Rote Ndao Regency, based on the Minister of Village, Development of Disadvantaged Regions, and Transmigration Regulation Number 3 of 2015 Regarding Village Facilitation? And (2) What are the factors inhibiting the implementation of Village Facilitator functions in the management of Village Funds in South Rote District, Rote Ndao Regency? The purpose of this study is to describe the implementation of Village Facilitator functions in the management of Village funds in Tebole Village and Lenguselu Village. This study is a Juridical Empirical study where data is obtained directly from relevant parties or institutions. After collecting the necessary data, the researcher processes and categorizes the data according to its type and source. The population in this study is the Village Head, Village Facilitators, and the Community, totaling 13 people. The Village Head consists of 2 people, Village Facilitators consist of 1 person, and the Community consists of 10 people. The results of this study indicate that: (1) This study explores the implementation of village facilitator functions in the three main stages of village fund management: planning, implementation, and supervision of village development in Tebole Village and Lenguselu Village, South Rote District, Rote Ndao Regency. The results show that village facilitators have not effectively carried out their functions in these three stages. (2) Inhibiting factors in the implementation of village facilitator functions in the management of village funds in Tebole Village and Lenguselu Village. These factors include the low level of education of village facilitators, which reduces their effectiveness in assisting in the planning, implementation, and supervision processes, insufficient budget availability perceived by the village government and village facilitators, and a lack of support in infrastructure and facilities, which poses a serious obstacle for village facilitators. The author's recommendations for this study are that the government needs to improve the education and training of village facilitators, enhance budget transparency, strengthen partnerships with village governments, and provide adequate infrastructure and facilities to support the tasks of village facilitators. By implementing these recommendations, significant improvements in village fund management and local community progress are expected.
