Abstract

Public information disclosure is a principle underlying public access to information produced or owned by public bodies. In practical reality, although there are regulations and provisions governing public information disclosure, there are still many public bodies in East Nusa Tenggara that have not fulfilled their obligations to provide adequate information to the public. Therefore, the formulation of the problem in this study is how urgent is the public information disclosure in East Nusa Tenggara Province and how is the application of the principle of good governance in constitutional law to the urgency of public information disclosure in East Nusa Tenggara Province. This research is a Juridical-Normative research using Juridical-Normative analysis techniques. The results of the study show that the urgency of public information disclosure in East Nusa Tenggara Province is increasingly apparent, although the Public Information Openness Index score increased in 2023, the impact has not been significant on socio-economic improvements such as poverty rates and the Human Development Index (HDI). The principles of good governance, including transparency, accountability, and professionalism, are key to optimizing public information management. Challenges such as low professionalism in Regional Apparatus Organizations and lack of accountability need to be addressed through training, improving the monitoring system, adopting technology, and aligning local regulations with national standards. These efforts will support the creation of an effective, responsive, and participatory government in inclusive and sustainable development.

Abstract

Since 2020 until now, the world, including the City of Kupang, has been hit by the spread of corona virus disease 2019 which does not yet appear to be over and requires enormous attention and budget to carry out efforts to overcome it. The research in this thesis discusses the productivity of the supervisory performance of the Kupang City Regional People's Representative Assembly in dealing with corona virus disease 2019 in Kupang City.The method used by the author is a normative juridical research method using a case methodology. The findings of this research suggest that the Kupang City Regional Representative Council in carrying out its supervisory function, including in handling corona virus disease 2019 in Kupang City, continues to use its authority and function normatively, by tightening oversight so that all corona virus disease 2019 countermeasures policies in Kupang City can run as they should and can more effective in controlling the spread of corona virus disease 2019 in Kupang City.

Abstract

Land registration depends not only on the existence of legal regulations but also on how communities understand, evaluate, and practice the law. This issue is important because land control in East Manggarai Regency involves an interaction between customary recognition and formal land administration. This study compares the legal consciousness of residents in Melo Village and Mandosawu Urban Village regarding the registration of land ownership rights and examines the conditions associated with differences between the two locations. The study employed empirical legal research with a socio legal approach and a descriptive comparative design. Data were collected from 64 respondents, consisting of 32 residents from Melo Village and 32 residents from Mandosawu Urban Village, through questionnaires, interviews, and document analysis. The findings show that all respondents in Melo reported no knowledge or understanding of the relevant land regulations and reported no compliant behavior across the measured indicators. Positive attitudes nevertheless appeared in several indicators, especially those concerning community rights and obligations. Respondents in Mandosawu demonstrated more varied and higher levels of legal knowledge, understanding, attitude, and reported compliance. Administrative records cited in the study reported no certified land in Melo, while 47.13 percent of land parcels in Mandosawu had reportedly been certified. The study concludes that legal consciousness does not develop in a linear sequence and is associated with customary tenure systems, access to services, legal information, and the practical value of land certificates.

Abstract

Batas maritim antara Indonesia (Wini) dan Timor-Leste (Oecusse) hingga saat ini masih belum terselesaikan, sehingga menimbulkan ketidakpastian hukum dalam tata kelola kelautan, pemanfaatan sumber daya, dan kerja sama bilateral. Penelitian ini mengkaji kerangka hukum pengelolaan batas maritim berdasarkan perspektif Teori Negara Kesejahteraan dan United Nations Convention on the Law of the Sea (UNCLOS) 1982. Dengan menggunakan penelitian hukum normatif, studi ini menerapkan pendekatan perundang-undangan, konseptual, perjanjian internasional, dan perbandingan untuk menganalisis instrumen hukum internasional, peraturan nasional, serta doktrin hukum yang relevan terkait pengelolaan batas maritim. Hasil penelitian menunjukkan bahwa UNCLOS 1982 menyediakan dasar hukum yang komprehensif bagi delimitasi maritim sekaligus mendorong pengaturan kerja sama sementara sambil menunggu tercapainya kesepakatan batas akhir. Penelitian ini berpendapat bahwa penerapan Joint Development Agreement (JDA) merupakan model hukum yang paling tepat bagi batas maritim Indonesia–Timor-Leste, karena memungkinkan pengelolaan sumber daya laut secara bersama tanpa mengurangi posisi hukum masing-masing negara dalam delimitasi maritim final. Model tersebut memperkuat kepastian hukum, mendorong tata kelola sumber daya yang berkelanjutan, mendukung perlindungan lingkungan, serta meningkatkan kesejahteraan masyarakat perbatasan melalui mekanisme pembagian manfaat yang adil. Konstruksi hukum yang diusulkan mengintegrasikan prinsip penyelesaian yang adil, itikad baik, dan kewajiban untuk bekerja sama dalam UNCLOS 1982 dengan kewajiban konstitusional negara untuk memajukan kesejahteraan umum. Dengan demikian, penelitian ini memberikan kontribusi teoritis dan praktis melalui tawaran kerangka hukum kolaboratif yang mampu menyeimbangkan kedaulatan negara, tata kelola maritim berkelanjutan, dan pembangunan sosial-ekonomi di wilayah perbatasan Indonesia–Timor-Leste.

Abstract

The recognition and protection of indigenous peoples’ rights constitute a constitutional mandate as stipulated in Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia. However, in practice, the implementation of these rights continues to face significant challenges, particularly in conservation areas. One such area is the Mount Mutis Nature Reserve in North Central Timor Regency, East Nusa Tenggara Province, which has been traditionally controlled and utilized by the Mollo indigenous community. This study aims to analyze the implementation of indigenous peoples’ rights in the control of the Mount Mutis Nature Reserve and to examine the role of local government and community support in managing the area. The research employs a normative legal research method supported by an empirical approach. Data were collected through literature review of relevant laws and regulations, as well as interviews with government officials, conservation area managers, customary leaders, and local community members in Tasinifu Village, Mutis District. The findings reveal that the Mollo indigenous community maintains strong historical, spiritual, and social ties to the Mount Mutis area, as reflected in the existence of customary sites such as sacred stones (faot kanaf) and sacred water sources (oe fam). Although the rights of indigenous peoples over the area are normatively recognized, their implementation remains suboptimal due to limited administrative recognition, boundary disputes, and conservation management approaches that tend to be top-down. Government support is still partial and has not fully positioned indigenous communities as key actors in conservation area management. This study emphasizes the necessity of strengthening legal recognition of indigenous peoples and developing participatory conservation management models that prioritize indigenous involvement to ensure justice, protection of traditional rights, and environmental sustainability.

Abstract

This study aims to analyze the implementation of Presidential Instruction Number 1 of 2025 concerning expenditure efficiency in the implementation of the State Budget (APBN) and Regional Budget (APBD) at the Department of Education and Culture of East Nusa Tenggara Province, as well as its impact on priority educational programs. The research employs an empirical legal method with a socio-juridical approach through interviews, observations, and document analysis. The findings indicate that the efficiency policy has been implemented through the establishment of an Expenditure Efficiency Team, administrative service digitalization, procurement consolidation, and the refinement of priority programs. Although the policy has been administratively effective and has generated significant budget savings, its implementation continues to face challenges, including limited digital infrastructure, archipelagic geographical conditions, and human resource capacity constraints. The efficiency measures have also affected several priority programs, particularly school infrastructure rehabilitation, teacher competency development, character education, and local cultural preservation. Therefore, more adaptive and affirmative policies are required to ensure that budget efficiency measures do not undermine the constitutional right of citizens to access quality education.

Abstract

The development of information technology and social media has accelerated the dissemination of information, but it has also increased the circulation of false information or hoaxes, which may create public unrest and misinformation. This study analyzes the role of the Kupang City Department of Communication and Informatics in combating false information on social media and identifies factors hindering the implementation of its functions. Using empirical legal research with a socio-legal approach, data were collected through interviews, observations, and documentation at the Department and analyzed descriptively and qualitatively. The findings show that the Department has carried out its role through the Kota Kabas Hoax program, information verification and clarification, public digital literacy promotion, and collaboration with the police, academics, media organizations, and related institutions. These efforts reflect the implementation of local government authority in maintaining public information quality and preventing hoax dissemination in the digital sphere. However, several obstacles remain, including limited competent human resources, inadequate facilities and infrastructure, and low public legal awareness and digital literacy. Therefore, strengthening human resources, improving facilities, and optimizing digital literacy programs are necessary to enhance the effectiveness of combating false information on social media.

Abstract

This study examines the supervisory function of the Regional House of Representatives (DPRD) of Kupang City in overseeing the implementation of regional government policies from the perspective of constitutional and regional governance law. The research aims to analyze the implementation of the DPRD's supervisory function, identify factors that hinder its effectiveness, and formulate a revitalization model to strengthen legislative oversight. This study employed an empirical juridical approach using qualitative methods. Primary data were obtained through interviews and field observations, while secondary data were collected from legislation, books, and scientific literature. The findings reveal that the supervisory function of the Kupang City DPRD has been implemented through working meetings, public hearings, discussions of the Regional Head Accountability Report (LKPJ), field visits, and budget oversight. However, supervision remains predominantly administrative and procedural, limiting its contribution to substantive policy improvement. The principal obstacles include weaknesses in legal substance, institutional capacity, and legal culture, which collectively reduce the effectiveness of legislative oversight. To address these issues, this study proposes a revitalization model encompassing institutional capacity building, strengthening supervisory authority, improving human resources, enhancing legal frameworks, reinforcing institutional support, and promoting accountability-oriented legal culture. These efforts are expected to improve the effectiveness of legislative oversight and support transparent, accountable, and democratic regional governance.

Abstract

Waste management is an essential aspect of fulfilling the community’s right to a clean and healthy environment. This study aims to analyze the implementation of Regional Regulation of Timor Tengah Selatan Regency Number 4 of 2018 on Waste Management in Kota Soe District and to identify factors that hinder its implementation. The research employs an empirical juridical method with a socio-legal approach. Data were collected through interviews, field observations, and literature studies. The respondents consisted of 26 individuals, including officials of the Environmental Agency, the Technical Implementation Unit for Sanitation and Parks, village officials, sanitation workers, and community members. Data were analyzed qualitatively using a descriptive juridical method. The findings indicate that waste management implementation has been carried out through planning, implementation, supervision, and accountability stages by the Environmental Agency with the support of the Technical Implementation Unit; however, it has not been fully effective. Internal obstacles include limited human resources, budget constraints, and inadequate facilities and infrastructure. Meanwhile, external obstacles mainly arise from the low level of community participation and awareness in waste segregation and management at the source. This study concludes that the effectiveness of waste management policies depends not only on the existence of regulations but also on the availability of adequate resources, budgetary support, effective institutional coordination, and active community involvement.

Abstract

The development and progress of villages as the smallest units in the governance structure are crucial for sustainable national development. In this context, the role of village facilitators has a significant impact on assisting villages in realizing their full potential. Village facilitators play a crucial role in assisting village governments in effectively and efficiently managing village funds to achieve sustainable community development and empowerment. The research problems in this study can be formulated as follows: (1) To what extent is the implementation of facilitation functions by village facilitators in the management of village funds in the fiscal year 2020 in Tebole Village and Lenguselu Village, South Rote District, Rote Ndao Regency, based on the Minister of Village, Development of Disadvantaged Regions, and Transmigration Regulation Number 3 of 2015 Regarding Village Facilitation? And (2) What are the factors inhibiting the implementation of Village Facilitator functions in the management of Village Funds in South Rote District, Rote Ndao Regency? The purpose of this study is to describe the implementation of Village Facilitator functions in the management of Village funds in Tebole Village and Lenguselu Village. This study is a Juridical Empirical study where data is obtained directly from relevant parties or institutions. After collecting the necessary data, the researcher processes and categorizes the data according to its type and source. The population in this study is the Village Head, Village Facilitators, and the Community, totaling 13 people. The Village Head consists of 2 people, Village Facilitators consist of 1 person, and the Community consists of 10 people. The results of this study indicate that: (1) This study explores the implementation of village facilitator functions in the three main stages of village fund management: planning, implementation, and supervision of village development in Tebole Village and Lenguselu Village, South Rote District, Rote Ndao Regency. The results show that village facilitators have not effectively carried out their functions in these three stages. (2) Inhibiting factors in the implementation of village facilitator functions in the management of village funds in Tebole Village and Lenguselu Village. These factors include the low level of education of village facilitators, which reduces their effectiveness in assisting in the planning, implementation, and supervision processes, insufficient budget availability perceived by the village government and village facilitators, and a lack of support in infrastructure and facilities, which poses a serious obstacle for village facilitators. The author's recommendations for this study are that the government needs to improve the education and training of village facilitators, enhance budget transparency, strengthen partnerships with village governments, and provide adequate infrastructure and facilities to support the tasks of village facilitators. By implementing these recommendations, significant improvements in village fund management and local community progress are expected.
