Abstract

Penelitian ini bertujuan untuk memahami dan menganalisis bagaimana penegakan hukum bagi pelaku penyalahgunaan tindak pidana jual beli narkotika golongan 1 bukan tanaman dan menganalisis pertimbangan hakim terhadap pelaku penyalahgunaan tindak pidana jual beli Narkotika golongan I bukan tumbuhan (Dalam Putusan Nomor:199/Pid.Sus/2022/PN.Tjk). Penelitian ini merupakan jenis penelitian yuridis normatif dengan pendekatan perundang-undangan. Tindak Pidana Narkotika diatur dalam Undang-Undang Nomor 35 Tahun 2009, pada hakikatnya undang-undang mengatur masyarakat secara baik dan bermanfaat dengan menentukan apa yang diwajibkan atau diperbolehkan dan sebaliknya. Hukum dapat mengkualifikasikan suatu tindakan sesuai dengan hukum atau mendiskusikannya sebagai melawan hukum.Kata kunci: Jual Beli; Narkotika; Penegakan Hukum; Tindak Pidana

Abstract

Kebijakan deregulasi melalui omnibus law membawa perubahan signifikan terhadap sistem perizinan usaha di daerah, termasuk bagi UMKM di Provinsi Lampung. Pemberlakuan Undang-Undang Nomor 6 Tahun 2023 memperkuat legalitas usaha melalui penerapan perizinan berusaha berbasis risiko (Risk Based Approach) dan penggunaan Nomor Induk Berusaha (NIB) sebagai identitas tunggal pelaku usaha. Regulasi ini juga menjadi dasar bagi pemerintah daerah dalam meningkatkan perlindungan hukum, kemudahan layanan, dan transparansi perizinan. Penelitian ini bertujuan menganalisis dampak regulasi tersebut terhadap penguatan UMKM di Lampung serta mengevaluasi efektivitas peran DPMPTSP dalam implementasinya. Metode yang digunakan adalah pendekatan yuridis empiris dengan data primer melalui wawancara dan data sekunder melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa regulasi ini meningkatkan kepastian hukum dan kemudahan berusaha bagi UMKM, namun implementasinya masih menghadapi kendala literasi digital, keterbatasan sumber daya manusia, serta hambatan teknis sistem OSS berbasis RBA. Oleh karena itu, diperlukan penguatan pengawasan, peningkatan kapasitas aparatur, serta sosialisasi dan pendampingan berkelanjutan bagi pelaku UMKM guna mendukung pertumbuhan ekonomi daerah yang berkelanjutan.

Abstract

Tindak pidana penganiayaan merupakan salah satu bentuk pelanggaran hukum yang berdampak pada fisik dan psikologis korban serta mengganggu ketertiban umum. Kamus Besar Indonesia mengartikan penganiayaan  sebagai "perlakuan sewenang-wenang (penyiksaan, penindasan, dan sebagainya)." Perlakuan sewenang-wenang dalam kasus ini dijelaskan meliputi bentuk penyiksaan dan penindasan, yang secara jelas menunjukkan bahwa perlakuan terhadap orang tersebut sudah pasti melanggar norma yang berlaku dan melanggar hak asasi manusia. Yurisprudensi menyatakan bahwa  penganiayaan adalah tindakan yang disengaja untuk menimbulkan perasaan tidak menyenangkan, penderitaan, atau rasa sakit. Dalam kasus ini, terdakwa terbukti melakukan penganiayaan berat dengan menggunakan senjata tajam, dan dijatuhi pidana penjara selama 1 tahun 8 bulan.Permasalahan penelitian mengenai apakah faktor penyebab seseorang melakukan tindak pidana penganiayaan menggunakan senjata tajam berdasarkan Putusan Nomor 316/Pid.B/2024/PN.Tjk dan bagaimanakah pertimbangan hakim dalam menjatuhkan putusan pidana terhadap pelaku dalam tindak pidana penganiayaan menggunakan senjata tajam berdasarkan Putusan Nomor 316/Pid.B/2024/PN.Tjk.Penelitian menggunakan metode yuridis normatif dengan pendekatan kualitatif dan deduktif. Data diperoleh melalui studi kepustakaan, wawancara, dan observasi. Hasil penelitian dapat disimpulkan bahwa faktor penyebab terjadinya tindak pidana penganiayaan yang terdapat dalam putusan nomor 316/Pid.B/2024/Pn.Tjk yaitu dikarenakan adanya faktor emosional dimana terdakwa merasakan perasaan marah terhadap korban dan terdakwa tidak dapat mengendalikan rasa amarahnya maka dari itu terdakwa melakukan tindakan kekerasan terhadap korban dan Majelis Hakim memutuskan terdakwa dinyatakan bersalah secara sah dan meyakinkan bersalah melakukan tindak pidana "Penganiayaan", seperti yang didakwa oleh Tunggal Penuntut Umum. Hakim menjatuhkan pidana terhadap terdakwa selama satu tahun delapan bulan, dengan masa penahanan dan penahanan terdakwa dikurangkan dari pidana yang dijatuhkan, hakim juga menetapkan agar Terdakwa tetap ditahan dan hakim menetapkan barang bukti berupa 1 unit sepeda motor honda beat warna hitam biru tanpa plat dirampas untuk negara dan menetapkan agar terdakwa dibebani membayar biaya perkara sejumlah Rp2,000.00 (dua ribu rupiah). Pertimbangan hakim didasarkan pada alat bukti yang sah, keterangan saksi, barang bukti, serta keadaan yang memberatkan dan meringankan terdakwa. Hakim tidak menemukan alasan pembenar maupun pemaaf yang dapat menghapus pertanggungjawaban pidana terdakwa. Keputusan yang dijatuhkan bertujuan untuk menegakkan keadilan dan memberikan efek jera, sesuai dengan prinsip keadilan, kepastian hukum, dan kemanfaatan hukum dalam sistem peradilan pidana.

Abstract

Purpose: This study examines judicial considerations in cases of theft committed jointly (medeplegen) as a continued act (voortgezette handeling) based on Indonesian criminal law, focusing on Decision No. 104/Pid.B/2025/PN.Tjk. Research Methodology: This research uses a normative-empirical juridical approach, combining statutory analysis with field research including interviews with judges, prosecutors, and investigators related on the problem in this research. Results: The court correctly applied Article 363 paragraph (1) sub-4 in conjunction with Article 64 paragraph (1) of the Kitab Undang-Undang Hukum Pidana (KUHP). The elements of joint participation and continuing acts were established through evidence of functional cooperation and unity of intent (één wilsbesluit). Although physical evidence was unavailable at trial, the conviction was lawfully established through consistent witness testimonies and the defendant’s confession in accordance with the negative statutory proof system (negatief wettelijk). Conclusions: The decision reflects proper legal reasoning by balancing juridical, philosophical, and sociological considerations. The sentence imposed fulfills the objectives of legal certainty, justice, and utility. Limitations: This study focuses on a single district court decision, limiting broader generalization in Indonesian jurisprudence. Contributions: This study contributes to the doctrinal understanding of collective criminal liability and continuing offenses in Indonesian criminal law, particularly regarding evidentiary construction in the absence of physical evidence.

Abstract

Immoral crime is an act that deviates from the norms of decency which describes the actions and views of the harasser to the person being harassed where the views are humiliating,demeaning or worthless. Research problems regarding the criminal causes of theperpetrators of spreading immoral photos/videos through social media and the criminalresponsibility of the perpetrators of spreading immoral photos/videos through social media.The research method uses: 1. a normative juridical approach carried out by studying normsor rules, 2. an empirical approach carried out by interviewing informants. The causativefactor was that it was true that the perpetrator did not accept it because the witness-victim wanted to end his romantic relationship with the perpetrator, so without the permission andknowledge of the witness-victim, the perpetrator spread the immoral pictures/photos/videosof the witness-victim. Criminal responsibility for the perpetrator has fulfilled all the elementsin accordance with the indictment by the public prosecutor with an alternative form ofindictment to Article 27 paragraph (1) of the ITE Law, so the Judge imposes a sentence onthe perpetrator with imprisonment for 3 (three) years and a fine of IDR 1 ,000,000,000.00(one billion rupiah) if the fine is not paid then it is replaced by imprisonment for 4 (four)months. The judge's decision is appropriate and ensnares the perpetrator so that he does notrepeat his actions in the future, and creates a deterrent effect on the perpetrator.

Abstract

Law enforcement is related to the notion of "law enforcement" in the narrow word, and the notion of justice in the broad sense is substantive law, namely the upholding of justice. Abstract

The KBBI defines violence as the actions of a person or group of people that cause physical damage to someone else's property or belongings. Violence is a physical or psychological act committed by a person or group of people intentionally or unintentionally, directly or indirectly, personally or structurally, and often parents commit acts of violence against children with the result that many children experience trauma or could even die. Torture is a violent crime committed on the human body in various forms, resulting in injury or pain to a person's body and even death. In the Criminal Code, the general understanding is that abuse is a criminal act against the human body. This writing is aimed at finding out criminal liability and the factors that cause perpetrators to abuse their biological children which results in their death. The method used in this research is normative legal research and empirical law, namely research whose sources come from books, legislation, journals, interviews and other sources.

Abstract

Referring to national data in the Online Information System (SIMFONI PPA), cases of sexual violence against children have increased over the past few years, namely in 2019 the number of cases of violence against children was recorded at 11,057 cases and increased by 11,278 in 2020. Then, a significant increase occurred in 2021, which reached 14,517 cases, until 2022 the number of sexual violence reached 16,106 cases. In Lampung Province, data on sexual violence against children in 2021 reached 681 cases, in 2022 it decreased to 600 cases, but in 2023 it again increased, reaching 696 cases. This series of data suggests that Indonesia is known as a polite nation, but the rate of sexual violence in this country is quite high. This situation further strengthens the assumption that Indonesia, especially Lampung Province, is in a state of sexual violence emergency. Currently, cases of sexual violence against children are not only focused on girls, boys are often victims of sexual crimes by perpetrators who have disorders or deviations. sexual. Sexual violence committed against children can be seen from a victimology perspective. Victimology is a complement or refinement of existing theories of criminal etymology according to the actual proportions dimensionally. The aim of this research is to discuss how victimization results in children becoming victims of same-sex sexual violence. This research uses qualitative methods and case study research type, using the theory put forward by Stephen Schafer,  a  criminologist  and  sociologist,  where  the  focus  of  the theory that the author uses in this research is victim typology theory, this theory explains  how victims  are  consciously or unconsciously contributed to the victimization he suffered. From this problem, researchers see several aspects that can trigger victims. Apart from that, the role of the government, community institutions and parents is needed to combat child predators and provide countermeasures for child victims of sexual violence.

Abstract

Indonesia is a legal state, which contains all kinds of rules to improve the welfare of society. Indonesian citizens to fulfill their daily living needs by working. The fields of work in Indonesia are very diverse, ranging from farmers, fishermen, factory workers and so on. Recently there was a problem in Indonesia with the outbreak of the Covid-19 disease, which had many impacts on the citizens of the country, one of which was the economy. At that time, there were massive layoffs from entrepreneurs to their workers, giving rise to increased unemployment and poverty in Indonesia. During layoffs, many employees also file a lawsuit against their workplace to obtain justice in terms of severance pay, or work wages. This continues to happen to this day, there are still many entrepreneurs who behave abusively towards their employees so that many employees are fighting against the law.

Abstract

The authority to calculate the state losses in corruption, until now, is still a problem that must be addressed with government policy in conducting investigations Audit Board of the Republic of Indonesia (BPK) and Financial and Development Supervisory Agency (BPKP). Both of these bodies in issuing products for calculating state losses, apply different process of completing the product of the investigation conducted. Information from Indonesian Republic Police (Polri) investigators prefer the BPKP as a partner in determining state losses in a criminal act upon request of the investigators to BPKP to calculate the state losses. The method used in this study normative research and the approaches used are juridical and empirical approaches. The results of the study is BPK pursuant to Law No. 15 of 2006 has the authority to calculate State losses carried out by the Main Investigator Auditor (AUI) which has the authority to conduct Investigation Examinations, Although the Supreme Audit Agency Acts and has the authority to calculate State losses,. In addition to the BPK there are other bodies that have the authority to calculate State lossesy, that is Corruption Criminal Investigators that are more likely to use BPKP to calculate State losses compared to BPK.
