Abstract

Kupang City is the capital of East Nusa Tenggara province which is inseparable from the case of rape of a father against a biological child. There are several cases including a minor being a victim of sexual violence. Tragically, a student of a junior high school in Kupang became a victim of rape committed by her biological father. The case of adultery committed by the father to his biological child was handled by the PPA Unit of the Kupang City Police Satreskrim in 2019. The results of this study show that (1) the causative factor for children as victims of rape by biological fathers in Kupang City is the influence of lack of religious understanding in the family environment that causes the perpetrator to commit crimes. The actions carried out by the perpetrator were carried out repeatedly without thinking about the mental and physical influence of the victim. For this reason, it is hoped that religious understanding can be applied in the family environment so that it becomes a moral benchmark for one's life as well as the cases researched by the author. (2)) The impact on children as victims of rape by biological fathers in Kupang City is the physical and social impact experienced by the victim after the incident that befell the victim. (3) Legal Protection Efforts for Children as Victims of Rape by Biological Fathers in Kupang City In particular, Indonesia has its own law regarding the protection of children, namely Law Number 23 of 2004 concerning Child Protection. In Articles 81 and 82 of the Law on Child Protection, it is stipulated that the perpetrator of sexual abuse of children is sentenced to a maximum of 15 years in prison.

Abstract

The development of digital technology based on Artificial Intelligence (AI) has had a significant impact on society, including the emergence of new crimes such as deepfake pornography. Deepfake pornography is a form of AI misuse that creates fake pornographic content by manipulating a person's face into a video or image without consent. This phenomenon raises complex legal issues within the Indonesian criminal law system. This study aims to examine how Indonesian criminal law regulates AI deviations in the form of deepfake pornography and to assess the effectiveness of these regulations in providing legal protection. This research uses a normative approach with qualitative analysis methods and the theory of legal effectiveness as the analytical tool. The research findings indicate that AI deviations in the form of deepfake pornography are not specifically regulated in Indonesia's positive criminal law. The applicable regulations are still general in nature, scattered across several laws such as the Electronic Information and Transactions Law (ITE Law), Personal Data Protection Law, Pornography Law, Sexual Violence Criminal Act Law, Copyright Law, and the Criminal Code (KUHP), which do not comprehensively address the technological aspects and psychosocial impacts of this crime. Based on Soerjono Soekanto's theory of legal effectiveness, the existing regulations are not yet effective, as seen from the legal substance, law enforcement, legal facilities and infrastructure, community factors, and legal culture. Therefore, a responsive legal reform is needed to keep pace with digital technological developments, along with strengthening the capacity of law enforcement institutions.

Abstract

llegal fuel misuse (without a license) is the activity of processing, buying, moving and/or storing fuel oil by buying fuel oil when the fuel oil is still in normal condition. The fuel oil is traded back at an increased price from the normal price.The formulation of this research problem is: (1) What are the factors that cause hoarding of subsidized diesel fuel and pertalite in Belu Regency? (2) What is the modus operandi of hoarding subsidized diesel fuel and pertalite that occurs in Belu Regency? (3) What are the efforts to overcome cases of hoarding of subsidized diesel fuel and pertalite that occur in Belu Regency? This research is empirical juridical research, namely research conducted in the field to find data and information related to the problem: (1) To determine and analyze the factors that cause hoarding of subsidized diesel fuel and pertalite in Belu district. (2) To determine and analyze the modus operandi of hoarding subsidized diesel fuel and pertalite that occurs in Belu Regency. (3) To determine and analyze efforts to overcome cases of hoarding of subsidized diesel fuel and pertalite that occurred in Belu Regency. The results of the analysis obtained in this study are: (1) There are two main factors that cause the hoarding of subsidized fuel oil in Belu Regency, namely internal factors and external factors. Internal factors are the intention of the perpetrator, economic factors and moral and educational factors. External factors such as the ease of obtaining subsidized fuel oil and lack of supervision of illegal fuel.

Abstract

Criminals with various backgrounds and levels of violent crime are in the same place, which causes the coaching process to not run as expected. Prison sentences have not been able to deter perpetrators of violent crimes. This can be proven by the increasing number of violent crimes that occur in prison environments. Activities in correctional institutions are not just to punish or guard prisoners but include a coaching process so that inmates realize their mistakes and improve themselves and do not repeat the crimes they have committed. The main problems of this research are (1) What are the factors causing violence between inmates in Class II A Kupang Penitentiary? (2) What is the role of the Penitentiary in overcoming violence between inmates in Class II A Kupang Penitentiary?. This type of research is Empirical legal research. The approach in this study is a qualitative descriptive approach. The location of the research that the author took was the Class II A Kupang Correctional Institution. The sources and types of data used are primary data and secondary data. Data collection techniques use interview techniques and literature studies. Data management and analysis in this study use qualitative descriptive analysis.

Abstract

One of the educational institutions that plays an important role in developing Human Resources is Higher Education. Higher education is organized using an open system. In Indonesia, the process of providing education, especially in universities, often deviate from established regulations. One of them is the abuse of power carried out by lecturers towards students (abuse of power). This happens because the lecturer has a higher position than the students, so if it is not used professionally, this power can be misused in certain ways. Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab tindak pidana pembuangan limbah bengkel motor tidak pada tempat seharusnya di Bengkel Maranu Kota Kupang dan upaya upaya penanggulangan mengatasi pembuangan limbah bengkel motor tidak pada tempat seharusnya di Bengkel Maranu Kota Kupang. Metode pendekatan ini adalah deskriptif kualitatif. Hasil penelitian menunjukan Faktor Penyebab Pembuangan Limbah Motor Tidak Pada Tempatnya ada dua yaitu: faktor internal dan faktor external. 1) Faktor Internal yang mempengruhi terjadinya pembuangan limbah bengkel motor tidak pada tempatnya: a). Ketersediaan kapasitas bak sampah umum yang kecil, b).Penumpukan sampah di setiap bak sampah umum, c).Meningkatnya sampah/limbah dalam waktu yang singkat, d). Ketersediaan tempat penampungan sampah yang relatif sempit/kecil, e). Luas ruangan/lahan relatif sempit/kecil, f). Minimnya ide untuk mendaur ulang sampah/limbah menjadi lebih berguna atau bernilai ekonomis. 2) Faktor External yang mempengaruhi terjadinya pembuangan limbah bengkel motor tidak pada tempatnya: a). Menurunnya kesadaran masyarakat akan hukum, b). Masyarakat tidak mendapatkan arahan atau penyuluhan secara berkala dari Badan Lingkungan Hidup Kota Kupang, c). Pemerintah tidak tegas dalam menuntut penegakan hukum, d). Kurangnya kinerja truk pengangkut sampah sehingga sampah terus-menerus menumpuk, e). Kesadaran hukum pelaku pembuangan limbah bengkel motor tidak pada tempat seharusnya.

Abstract

Theft is a criminal offense that frequently occurs and continues to develop within society, including in academic environments. The case of theft of inventory assets at Nusa Cendana University, carried out continuously, indicates the presence of underlying criminological factors. This study aims to analyze the causal factors and the efforts to address such criminal acts. This research employs an empirical method with a qualitative approach. Data were obtained through interviews and literature review, and were analyzed using descriptive qualitative methods. The results of the study indicate that the factors causing theft consist of internal factors, namely intention and consumptive behavior, and external factors, namely opportunity and peer influence. Efforts to address the crime are carried out through repressive measures in the form of law enforcement and rehabilitative measures in the form of offender development. Thus, the occurrence of theft is influenced by the interaction between internal and external factors, so that countermeasures must be carried out comprehensively through both legal enforcement and rehabilitative approaches. It is recommended that young people engage in positive social interactions and enhance legal awareness, supported by social concern and community control, while Nusa Cendana University should strengthen its security system to prevent theft and protect campus assets. On the other hand, law enforcement officers must carry out firm, professional, and consistent law enforcement, while also improving rehabilitative efforts through structured correctional programs so that offenders develop legal awareness and do not reoffend.

Abstract

This study examines the implementation and effectiveness of the security system at Class IIA Kupang Correctional Institution in preventing inmate escape cases. Using an empirical juridical approach with a qualitative descriptive method, the research analyzes the application of security regulations in practice and identifies factors influencing their effectiveness. The findings reveal that the security system has been implemented through three primary mechanisms: static security, dynamic security, and procedural security. These measures have been carried out in accordance with Law Number 22 of 2022 concerning Corrections and Regulation of the Minister of Law and Human Rights Number 33 of 2015 concerning Security in Correctional Institutions and Detention Centers. Physical security arrangements, dynamic supervision by officers, and the implementation of standard operating procedures (SOPs) have formally functioned as required by applicable regulations. However, despite the availability of a structured regulatory framework and established security mechanisms, the effectiveness of the system in practice remains constrained. The study indicates that operational challenges limit the optimal prevention of inmate escapes. The effectiveness of the security system is significantly influenced by several interconnected factors, including limited human resources, inadequate security facilities and infrastructure, and the high density of inmates. These factors collectively affect the overall security environment and hinder the full realization of preventive objectives. In conclusion, although the security system at Class IIA Kupang Correctional Institution is normatively well-designed, its practical implementation has not yet achieved optimal effectiveness in preventing inmate escapes.

Abstract

The problem of illegal logging is actually a very complex matter, because it is not only related to the law enforcement or juridical aspects, but also related to economic, sociological and cultural aspects. This illegal logging practice is generally carried out by individuals who actually have official permits from the Indonesian government to carry out logging on land, such as holders of Forest Concession Rights (HPH) concession permits. The type of research in this study is empirical legal research. The types and sources of data used are primary data and secondary data. The role of the Forestry Service in overcoming illegal logging practices in the Umanen area, West Atambua District, Belu Regency is carried out with two handling approaches, namely the preventive approach, namely the approach to the community, empowering the community, and reforestation (replanting bare forests). The repressive approach, namely conducting operations, and imposing severe sanctions on those who violate. Obstacles in overcoming Illegal Logging include legal obstacles, geographical factors, lack of law enforcement facilities and infrastructure, weak coordination between law enforcers, and community human resource factors.
