Abstract

Abstract: This article captures the implementation of cooperative legal entities that are still conventional toward digital transformation, considering significant changes in the world. This study aims to describe how to strengthen the role of cooperatives as a pillar of the Indonesian economy, the legal basis for digital transformation, and the digital transformation of legal entity cooperatives in Indonesia. The findings show that transforming the cooperative business model into a digital basis is necessary. Cooperatives can obtain a vast market share by using tools such as website companies, social media, marketplace, and paid online advertising. The legal basis for business transformation from conventional to electronic-based models already exists. Cooperative legal entities can conduct business activities by utilizing digital technology for various activities such as administration, marketing via internet media, advertising using third parties such as Facebook Ads or Google Ads, selling products through online stores, analyzing business trends in the community, building relationships with more parties through social media, member meetings using video call applications, and many more that can be utilized. With the G20 forum, opportunities to expand business to various countries need to be used optimally by cooperatives in Indonesia. Keywords: Digital, Legal Entities, and Cooperatives.

Abstract

Tujuan penelitian ini untuk mengetahui hubungan pengetahuan ibu tentang imunisasi terhadap kelengkapan imunisasi dasar pada bayi di wilayah kerja Puskesmas Babadan. Penelitian ini menggunakan metode deskriptif analitik dengan pendekatan cross sectional, populasi penelitian ini adalah ibu yang memiliki bayi 0 – 12 bulan, pengambilan sampel menggunakan random sampling sebanyak 81 responden. Instrumen penelitian menggunakan lembar kueioner dan analisis menggunakan uji chi square. Hasil pada penelitian ini menunjukan bahwa dari 81 responden yang imunisasi dasar sudah lengkap sebanyak 40 responden dengan pengetahuan cukup sebesar 30 responden. Sedangkan imunisasi dasar tidak lengkap sebanyak 31 responden dengan pengetahuan cukup sebanyak 19 responden. Sehingga kesimpulan dari penelitian ini adalah ada hubungan antara imunisasi dasar lengkap terhadap kelengkapan imunisasi pada bayi di Puskesmas Babadan tahun 2022. Diharapkan agar tenaga kesehatan dapat meningkatakan kembali pengetahuan dan kesadaran ibu untuk memberikan imunisasi bayinya dengan cara memberikan penyuluhan- penyuluhan.

Abstract

Drug abuse is increasingly prevalent in Indonesia. In connection with the problem of narcotics abuse, a criminal law policy is needed that positions narcotics addicts as victims, not perpetrators of crime. Implementation of rehabilitation is the realization of a rule, this is very important because with an implementation it can be known whether a rule has actually been implemented or not. The research method used is normative juridical, the results obtained state that the application of rehabilitation for Narcotics Abuse Victims is an effort to treat and recover Narcotics Addicts and Narcotics Abuse Victims carried out by the authorities in rehabilitation institutions. The rehabilitation stages for Narcotics Addicts and Victims of Narcotics Abuse are: 1) Initial Acceptance Stage, 2) Detoxification Stage, 3) Pre-Rehabilitation Stage, 4) Coaching and Guidance Stage, 5) Reintegration Stage, 6) Advanced Guidance Stage and 7) Stage Integration into Society.

Abstract

Introduction: This article examines the alleged corruption in tugboat service operations at Pangkalbalam Port between 2020 and 2022. The issue emerged from several vessels that were not charged tugboat service fees, raising suspicions of potential state losses. The case became a legal concern because service exemptions in state-owned port enterprises must comply strictly with national maritime regulations.Purposes of the Research: The purpose of this study is to conduct a juridical analysis of whether the absence of tugboat service charges constitutes a corruption offense under Indonesian anti-corruption law. This research further seeks to clarify the legal classification of vessels subject to mandatory tug services and evaluate the regulatory compliance of port operators in determining service obligations.Methods of the Research: This study applies a normative juridical method using statutory, case, and jurisprudential approaches. Data sources include case files, maritime transport laws, Ministerial Regulations on pilotage and towage services, internal tariff policies of PT Pelindo, and relevant court decisions. These legal materials are analyzed systematically to determine whether all elements of corruption and state financial loss are fulfilled based on applicable legislation.Findings of the Research: The findings prove that the vessels exempted from tugboat service charges were legally categorized as non-mandatory tug vessels under Law Number 17/2008, Ministerial Regulation PM 57/2015, and PT Pelindo’s tariff policies. No elements of abuse of authority, illicit enrichment, or state financial loss were found; therefore, the case could not proceed to prosecution. This research offers novelty by clarifying vessel-classification mechanisms and recommending improved regulatory understanding for port operators.

Abstract

This study aims to analyze: (1) the legal framework governing the protection of human rights for child suspects during the investigation process; (2) the potential forms of human rights violations that may occur against child suspects during investigations; and (3) efforts to optimize the protection of human rights for child suspects at the investigation stage. This research employs a qualitative descriptive method using normative juridical and empirical juridical approaches. The data were obtained through library research utilizing primary and secondary legal materials, which were analyzed based on legal principles and the classification of statutory provisions within the prevailing legal system. The results of the study indicate that: first, the legal framework concerning the protection of child suspects’ rights refers to the Convention on the Rights of the Child, Law No. 23 of 2002 on Child Protection, and the Law on the Juvenile Criminal Justice System (UU SPPA). Second, the forms of human rights violations still found in practice include physical and psychological violence, limited access to legal assistance, detention of children without considering age requirements or the principle of ultimum remedium, and the lack of implementation of diversion. Third, efforts to optimize the protection of child suspects’ rights during investigations include enhancing the capacity of law enforcement officers, providing child-friendly facilities, strengthening legal and psychosocial assistance, improving inter-institutional coordination, and promoting public awareness and participation. In conclusion, the protection of human rights for child suspects requires a collective commitment from all stakeholders to realize a humanistic and just legal system. Abstract

Introduction: This article examines the legal and practical framework of inmate development within Indonesia’s correctional system following the enactment of Law Number 22 of 2022 on Corrections. It highlights ongoing challenges in ensuring that correctional institutions effectively fulfill their rehabilitative mandate, with Cirebon Class IIA Correctional Facility serving as the primary locus of analysis.Purposes of the Research: The purpose of this study is to analyze the legal regulation of inmate development under Law Number 22 of 2022, evaluate its implementation in Cirebon Class IIA Correctional Facility, and identify inhibiting factors as well as the institutional efforts undertaken to optimize inmate development in accordance with national correctional standards.Methods of the Research: This research employs a descriptive qualitative design combining normative and empirical juridical approaches. Secondary legal materials from primary and secondary sources underpin the analysis. Data interpretation uses a deductive reasoning model through syllogistic analysis to assess the alignment of legal norms with on-ground practices in the implementation of inmate development programs.Findings of the Research: This study confirms that the Cirebon Class IIA Correctional Institution has made great efforts to fulfill the rights of inmates in accordance with the mandate of the Law on Corrections, which is manifested in the implementation of spiritual, social, health, and vocational development programs. These institutional efforts include the provision of routine religious guidance, psychological and social counseling, health seminars, and vocational skills training such as carpentry, agriculture, and handicrafts. However, the optimal implementation of these programs is severely hampered by significant structural challenges, namely severe overcapacity of inmates, limited number of correctional personnel and professional experts (psychologists, social workers, vocational instructors), and inadequate facilities and infrastructure to accommodate and support development activities effectively. The study highlights the gap between the ideal legal framework (das sollen) and the operational reality on the ground (das sein), while also demonstrating collaborative initiatives with external parties and proposals to increase resource allocation as mitigation measures.

Abstract

Restorative justice (RJ) is an alternative approach to resolving criminal cases that focuses on victim recovery, perpetrator rehabilitation, and community reintegration. In the context of domestic and child violence, this approach offers the potential for a more inclusive and sustainable resolution compared to traditional retributive approaches. However, there is debate about the effectiveness of RJ in cases of violence that have profound psychological and physical impacts on victims. The issue at hand is whether RJ can provide adequate justice without reducing legal protection for victims. This study offers novelty by examining the application of RJ in cases of domestic and child violence in Indonesia, where RJ laws and policies are still developing. The purpose of the study is to identify the challenges and opportunities for implementing RJ in these cases and to evaluate the extent to which this approach is able to create restorative justice for victims and perpetrators. This study uses a qualitative method with case studies on several cases of domestic and child violence resolved through RJ in various regions. The findings indicate that RJ can be effective in facilitating victim recovery, but its implementation requires a strong support structure, including professional counselors and clear legal protection. The conclusion of this study confirms that RJ has great potential in resolving domestic violence cases, but its implementation must be carried out carefully to ensure justice and protection for victims. The implication is that this study encourages policy makers to design a more comprehensive and inclusive RJ framework in handling domestic violence.

Abstract

This study examines the gap between the existence of data protection regulations and their ineffective implementation in Nigerian higher education institutions. Despite the enactment of the Nigeria Data Protection Regulation (NDPR) 2019 and the Nigeria Data Protection Act (NDPA) 2023, universities continue to face challenges in ensuring data security and compliance. This research explores why implementation remains ineffective and how legal, technological, and organizational factors contribute to this condition. Using a socio-legal approach, the study combines normative legal analysis with empirical data from semi-structured interviews. The findings show that weak enforcement, limited institutional capacity, inadequate ICT infrastructure, low legal awareness, and unsupportive organizational culture hinder effective implementation. These factors interact to create systemic barriers to compliance. The study emphasizes the need for stronger enforcement, institutional reform, capacity-building, and technological investment to achieve effective data protection.

Abstract

ABSTRAKAnak usia dini merupakan kelompok yang paling rentan terhadap berbagai bentuk kekerasan, baik fisik, psikis, maupun seksual. Di Indonesia, persoalan restitusi bagi anak korban kekerasan masih menghadapi berbagai kendala serius dalam implementasinya meskipun regulasi yang mengatur hak tersebut telah cukup komprehensif. Penelitian ini bertujuan untuk menganalisis pengaturan hukum restitusi bagi anak korban kekerasan di Indonesia, mengkaji efektivitas implementasinya dalam praktik penegakan hukum, mengidentifikasi hambatan yang dihadapi, serta merumuskan solusi dan rekomendasi kebijakan. Penelitian menggunakan metode hukum normatif dengan pendekatan konseptual dan komparatif. Bahan hukum primer meliputi Undang-Undang Perlindungan Anak, Undang-Undang Perlindungan Saksi dan Korban, Undang-Undang Tindak Pidana Kekerasan Seksual, Peraturan Pemerintah Nomor 43 Tahun 2017, serta peraturan terkait lainnya. Hasil penelitian menunjukkan bahwa meskipun kerangka normatif restitusi telah tersedia, implementasinya masih sangat rendah akibat hambatan pada tiga dimensi: substansi hukum yang bersifat fakultatif, struktur penegakan hukum yang lemah, dan budaya hukum masyarakat yang belum mendukung. Perbandingan dengan sistem hukum Belanda dan Australia menunjukkan perlunya transformasi paradigma dari sistem berbasis hukuman menuju keadilan restoratif yang berpihak kepada korban. Penelitian ini merekomendasikan pembaruan regulasi agar restitusi bersifat mandatory, penguatan peran Lembaga Perlindungan Saksi dan Korban (LPSK), dan integrasi pendekatan keadilan restoratif dalam sistem peradilan pidana anak di Indonesia.Kata kunci: Restitusi, Anak korban, Kekerasan, Perlindungan hukum, Keadilan restoratif

Abstract

In the digital era, social media has revolutionized the way we communicate and interact, having a significant impact on intellectual property (IP) law. Social media platforms such as Facebook, Twitter, Instagram, and TikTok have blurred the lines between private and public spaces, creating new challenges in implementing and enforcing IP laws. This research aims to explore various legal strategies the importance of legal awareness education among social media users, and the role of technology in supporting intellectual property law enforcement. The research method used is a normative research method to investigate the impact of social media on intellectual property law. The results of the analysis show that social media influences the perception and application of IP law, including issues of privacy and the management of personal and social boundaries. A deep understanding of the dynamics of social media and IP law is critical to ensuring copyright and intellectual property protection in an increasingly connected world. The importance of intellectual property law in the digital era lies not only in the protection of copyrights and patents but also in the adaptation and evolution of the law to address new challenges arising from technological developments. Intellectual property law in today's digital era cannot be ignored.
