Abstract

Human trafficking is a form of abuse that violates human dignity. Human trafficking in the form of organised crime networks is increasing both domestically and internationally. This organised crime makes it difficult for governments to deal with it and protect its victims. Bloomsbury University refers to human trafficking as "human trafficking", which is "the illegal process of finding and mistreating people for unpaid and often unpleasant labour in settings with no rights defined as the act. How is the legal regulation of human trafficking crimes nationally and internationally and how is the legal protection for victims of these crimes? The method used in writing this research is an analytical approach with legal concepts or statutory approach. The results of the research show that although the regulation on human trafficking is contained in international instruments such as the Palermo Protocol, the domestic regulation in Law Number 21 Year 2007 on Crime Eradication does not allow the trade of human organs by Indonesians. However, if the organ can be used to save the life of another person, for example by transplantation, there will be additional legal requirements for human organ transplantation. For the regulation of human organ trafficking in Indonesia, Law No. 21 Year 2007 on the Eradication of the Criminal Offence of Trafficking in Persons. Currently, the form of protection for victims of human trafficking and human trafficking offences is to punish the perpetrators legally and fulfil the needs of the victims.

Abstract

The concept of restorative justice as a form of out-of-court settlement is needed to overcome various problems beyond the capacity of prisoners in prisons. Because the overcapacity of prisoners can cause many kinds of problems that exist in correctional institutions. Overcapacity in correctional institutions is influenced by several factors, one of which is the high rate of imprisonment used in existing regulations. The application of the concept of restorative justice can reduce the use of imprisonment to overcome overcapacity in correctional institutions. The research method of legal writing is normative legal research. Restorative justice policies are regulated by international legal instruments and national laws. The results of the study show that the policy of building restorative justice in combating prisoner overcrowding has been contained in the 2000 Vienna Declaration, the Minimum Standard Rules for the Treatment of Prisoners, Law No. December 1995 on Corrections, Perkapolri No. 6 of 2019, Perjak No. 15 of 2020, MARI Badilum Decree No. 1691/DJU/SK/PS.00/12/2020). The implementation of the concept of restorative justice aims to overcome overcapacity in correctional institutions.

Abstract

The purpose of this study is to evaluate the violence that often befalls women who are victims of verbal sexual harassment. Law Number 12 Year 2022 provides legal protection for victims of sexual violence (TPKS Law). The method used in this case study is the normative method. This is based on the fact that bullying is a form of verbal violence that expresses non-physical actions involving the body, sexual desire and inappropriate attractiveness to lower a person's mood. This can degrade human dignity based on their decency. As stipulated in the TPKS Law, victims of verbal sexual harassment have the right to be protected from actions that can degrade dignity. The form of protection is the implementation of duties and instilling a sense of security for victims, provided that it is carried out by LPSK and other institutions authorized by law. Verbal harassment or acts of violence should not be taken lightly, there must be firm action to provide a deterrent effect for the perpetrators. Because it is not only detrimental to the victim, but also a problem from the point of view of the norms that exist in society. In essence, humans are social creatures who live side by side to build community life and create synergy. Most catcalling occurs in community settings directed at women.

Abstract

Cases of narcotics and drug abuse in Indonesia are increasingly worrying, this can be seen from the increasing number of narcotics use among the next generation of the nation, especially "teenagers". The rise of drug abuse cases among teenagers is certainly caused by several supporting factors, including high curiosity or trends and a friendship environment where someone considers new and challenging things to do, making children in adolescence easily fall into drug use. Drugs are dangerous substances that affect a person's psychiatric condition or psychology and cause addiction, which has the potential to become an obstacle to national development that threatens the security and sovereignty of the state. The problems faced are How is Law Enforcement Against Narcotics Crimes in Indonesia According to Law Number 35 of 2009 concerning Narcotics, and How is the Protection of Drug Abusing Children Viewed from the Aspects of Victimology. This writing examines secondary data in the form of secondary legal materials by understanding the law as a set of positive rules or norms in the legislative system that regulates human life (library research). Based on the results of the research, it is known that law enforcement against narcotics crimes according to the Narcotics Law is subject to imprisonment, fines, life imprisonment and other sanctions, protection for children who abuse drugs in terms of victimology aspects, namely rehabilitation because the child is on the one hand the perpetrator and the other side is the victim

Abstract

Narcotics and illegal drugs have become a real threat that can destroy the Indonesian Nation. The problems of drugs has become one of the problems that has long required serious handling. The implementation of the program to prevent and eradicate drug abuse and illicit trafficking among students is one of the important efforts in realizing substantive justice. This research uses an empirical research method with a qualitative approach. Data were collected through interviews and observations with National Narcotics Board of Purbalingga Regency, Pratama Clinic National Narcotics Board of Purbalingga Regency, Nurul Ichsan AL-Islami Rehabilitation Center, teacher, and students, as well as analysis of related documents. The results showed that National Narcotics Board of Purbalingga Regency has made various efforts to implement the program among students, by conducting socialization in schools. There are several challenges in implementing this program, such as lack of human resources, budget, and geographical location. The implementation of the prevention and eradication of drug abuse and illicit trafficking among students by National Narcotics Board of Purbalingga Regency has contributed to increasing students’ awareness and knowledge about the dangers of drugs.

Abstract

This article explores the integration of Tri Hita Karana, a Balinese philosophical framework emphasizing harmony among humans, nature, and the divine, as a paradigm of community empowerment in addressing environmental crimes. Environmental crimes, such as illegal logging, pollution, and land degradation, not only threaten ecological sustainability but also undermine social justice and cultural values. Conventional law enforcement often encounters limitations in ensuring compliance and fostering ecological justice, especially when community participation is weak. This study argues that Tri Hita Karana can function as a cultural-legal tool to strengthen collective awareness, enhance preventive measures, and support restorative approaches in environmental law enforcement. By adopting normative legal research and conceptual analysis, the article highlights how the principles of Tri Hita Karana can be integrated into legal frameworks and community-based practices, thereby reinforcing environmental governance. Ultimately, the integration of Tri Hita Karana promotes ecological justice by balancing punitive measures with values of harmony, sustainability, and community empowerment. The findings indicate that incorporating Tri Hita Karana values into environmental law enforcement enhances community participation, encourages environmentally responsible behavior, and provides a restorative dimension to legal practices. This integration not only contributes to more effective prevention and mitigation of environmental crimes but also reinforces the pursuit of ecological justice

Abstract

The reformulation of criminal liability in the New Criminal Code through Articles 38 and 39 demonstrates the commitment of the Indonesian criminal law system to accommodate the principle of inclusive justice for persons with mental and/or intellectual disabilities. This article discusses the elimination and reduction of punishment for perpetrators with disabilities from a normative perspective, as well as the challenges of its implementation at the practical level. In the old Criminal Code, Article 44 only provides general criminal exemptions without procedural clarity and alternative measures. The 2023 Criminal Code, which will enter into force in 2026, changes this approach by distinguishing between offenders who are still able to understand the consequences of their actions (subject to punishment with reduction or alternative measures) and offenders who are in an acute state and unable to understand (subject to measures without punishment). This article uses a normative juridical approach and is supported by limited empirical juridical analysis to examine the effectiveness and challenges of this new provision. The results of the study show that Articles 38 and 39 have shifted the paradigm of punishment from retributive to humanistic, but their implementation still faces obstacles, especially regarding technical guidelines for assessing mental capacity, expert involvement, and potential treatment disparities. Therefore, a lex specialis is needed to support the general provisions so that they can be operationalized effectively, fairly, and non-discriminatively against persons with disabilities in the criminal law process.

Abstract

This study analyzes mediation in administrative dispute resolution in Indonesian Administrative Courts. The settlement of administrative disputes through mediation is not recognized in the Administrative Court procedural law. Mediation in the dispute resolution process in Administrative Courts is still a matter of debate. One of the parties to the dispute is a public body or official who is included in the realm of public law, so that mediation is not possible. The execution of Administrative Court decisions that have permanent legal force does not guarantee justice and legal certainty. This research aims to analyze the development and implementation of mediation in settlement of public disputes in Administrative Courts. The research method used is doctrinal research or library research with secondary data sources in the form of legislation on Administrative Courts, Supreme Court regulations on mediation, and scientific journals of research results. The results showed that mediation in public dispute resolution is used as an alternative to dispute resolution and has long been applied in several countries. Mediation in administrative dispute resolution can be carried out in two ways. First, mediation can be carried out outside the Administrative Court, and then the lawsuit is revoked. Second, mediation can be carried out through Court-connected mediation in the Administrative Court. There is a need to develop and strengthen the application of Court-connected mediation for administrative dispute resolution from the aspects of procedural law and Administrative Court resources that support the mediation process.

Abstract

Catcalling adalah bentuk pelecehan verbal yang masih marak dan dinormalisasi di Indonesia. Catcalling dapat terjadi kapan saja dan dimana saja. Oleh karena itu penelitian ini menggunakan pendekatan Yuridis Normatif dan sumber hukum yang digunakan yaitu bahan pustakaan. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan. Berdasarkan hasil penelitian menunjukkan: pertama, pelecehan seksual secara verbal dalam Undang-Undang Tindak Pidana Kekerasan Seksual diatur dalam Pasal 4 huruf a Undang-Undang Republik Indonesia Nomor 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual ; kedua, korban kekerasan seksual secara verbal dapat melakukan upaya perlindungan hukum yang diatur pada Pasal 5 Undang-Undang Republik Indonesia Nomor 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual, Pasal 67 ayat 2 Undang-Undang Republik Indonesia Tentang Tindak Pidana Kekerasan Seksual. Korban seringkali mendapat stigma jika mereka memprovokasi catcalling dengan pakaian atau perilakunya. TIndakan ini berdampak pada pskikis korban yang merasa malu dan enggan melaporkan kejadian tersebut. Harapannya, dengan adanya dasar hukum ini, catcalling dapat dicegah dan korban tidak perlu merasa takut. Apabila terjadi catcalling, korban dapat melaporkannya kepada pihak yang berwajib Kata Kunci:  Pelecehan seksual, tindak pidana catcalling, dasar hukum pelecehan verbal. Catcalling is a prevalent form of verbal harassment that is still rampant and normalized in Indonesia. Catcalling can happen anytime and anywhere. Therefore, this research employs a Normative Juridical approach, and the legal sources used are library materials. The approach used in this study is a legislative approach. Based on the research findings: firstly, verbal sexual harassment is regulated in Article 4 letter a of the Indonesian Law Number 12 of 2022 concerning Sexual Violence; secondly, victims of verbal sexual violence can seek legal protection as stipulated in Article 5 of the Indonesian Law Number 12 of 2022 concerning Sexual Violence, and Article 67 paragraph 2 of the Indonesian Law on Sexual Violence. Victims often face stigma if they are perceived to provoke catcalling through their clothing or behavior. Such actions impact the psychological well-being of the victims, leading to feelings of shame and reluctance to report the incidents. With the existence of this legal basis, it is hoped that catcalling can be prevented, and victims need not live in fear. In the event of catcalling, victims can report it to the relevant authorities. Abstract

Putusan hakim merupakan puncak penyelesaian perkara yang diadili oleh hakim. Hakim dalam menjatuhkan putusan terhadap terdakwa harus mempertimbangkan faktor yuridis dan non yuridis  yang terungkap di persidangan. Hakim dalam membuat rumusan putusan juga harus memperhatikan aspek kehati- hatian. Hal ini dilakukan demi terciptanya kepastian hukum dalam putusan. Namun, seringkali dalam praktiknya masih ditemukan putusan hakim yang kurang  tepat, terutama dalam tindak pidana pencucian  uang. Hal ini terjadi pada saat Hakim menafsirkan unsur-unsur yang terdapat dalam Pasal 3 UU TPPU.Penelitian ini membahas mengenai 2 rumusan masalah yaitu : pertama, bagaimana pertimbangan hakim dalam menafsirkan unsur "menerima" pada Pasal 3  UU TPPU dalam Putusan  Nomor 248/Pid.B/2022/PN.Jkt.Brt dan Kedua, apakah unsur "menerima" dalam Pasal 3 UU TPPU tepat untuk diterapkan kepada terdakwa dalam Putusan Nomor 248/Pid.B/2022/PN.Jkt.Brt. Adapun tujuan dari penelitian ini adalah untuk mendeskripsikan dan menganalisa kedudukan kata “menerima” dalam Pasal 3 UU TPPU pada Putusan Nomor 248/Pid.B/2022/PN.Jkt.Brt dan untuk mengetahui secara tepat penerapan unsur “menerima” dalam Pasal 3 UU TPPU terhadap terdakwa dalam Putusan Nomor 248/Pid.B/2022/PN.Jkt.Brt. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan secara undang-undang (statute approach),  pendekatan  kasus  (case approach) dan pendekatan secara konseptual (conseptual approach). Dalam penelitian ini .sumber bahan hukum yang digunakan adalah data sekunder dan analisis data dilakukan secara deskrtiptif kualitatif. Hasil pembahasan menyatakan bahwa : pertama, terdapat penafsiran hakim yang kurang tepat mengenai unsur “menerima” pada Pasal 3 UU TPPU dalam Putusan Nomor 248/Pid.B/2022/PN.Jkt.Brt, karena penafsiran yang dilakukan oleh Majelis Hakim terkait unsur menerima uang hanya mempertimbangkan keterangan saksi ahli saja, tidak mempertimbangkan keterangan dari saksi dan keterangan para terdakwa bahwa uang tersebut bukan hasil dari tindak pidana melainkan dari modal dari hasil pinjaman kepada Mochamad Max Alatan (broker) untuk membayar pajak 2 sertifikat.  Penerapan  unsur menerima tidak tepat, hal ini para terdakwa termasuk pelaku pasif, hakim seharusnya mempertimbangkan Pasal 5 UU TPPU.
