Abstract

Kecanggihan teknologi informasi membuat judi online semakin berkembang. Hal ini juga menimbulkan maraknya promosi dan iklan judi online, salah satunya seperti yang dilakukan username @abdiiyyy pada tanggal 28 Juni 2022 yang mempromosikan judi online di laman instagramnya. Jenis penelitian ini adalah yuridis normatif. Spesifikasi penelitian dalam penulisan ini adalah deskriptif analitis yang menyangkut tindak pidana terhadap judi online menurut Undang-undang nomor 11 tahun 2008 dengan pendekatan perundang-undangan, konseptual, sosial dan teoritis. Data penelitian yang digunakan dari bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil pembahasan mengenai penelitian ini berkesimpulan bahwa, pertama seorang influencer dapat menerima tawaran judi online karena tekanan finansial dan menjadikan jasa promosi sumber pendapatan utama. Seorang influencer juga menginginkan audiensnya semakin meningkat, sehingga berani untuk mengiklankan judi online, kedua salah satu cara supaya influencer tidak melakukan promosi judi online yaiu dengan membuat kebijakan larangan promosi judi online di berbagai platform dan memberikan edukasi kepada influencer mengenai dampak negatif jika promosi terhadap judi online tetap dilakukan Kata Kunci: Judi Online, Influencer, Iklan judi online The advancement of electronic information has led to the growing popularity of online gambling. This has also resulted in the proliferation of promotions and advertisements for online gambling, such as the one conducted by the username @abdiiyyy on June 28, 2022, who promoted online gambling on their Instagram page. This research is a normative juridical study with descriptive-analytical specification, involving criminal acts related to online gambling according to Law No. 11 of 2008, with a statutory, conceptual, social, and theoritical approach. An influencer can engage in this crime in relation to sociogenesis theory. It can occur due to financial pressure and a luxurious lifestyle, which forces them to seek additional sources of income. Prevention efforts can be made by implementing policies that prohibit or restrict online gambling advertisements. The government can set strict standards regarding the types of ads that influencers can promote, including a ban on online gambling ads. Based on the results of the discussion regarding this research, it is concluded that, firstly, an influencer can accept online gambling offers due to financial pressure and make promotional services the main source of income. An influencer also wants his audience to increase, so that he dares to advertise online gambling, secondly, one way for influencers not to carry out online gambling promotions is by making policies prohibiting online gambling promotions on various platforms and educating influencers about the negative impacts of promoting online gambling. still doing. Abstract

This research discusses the concursus contained in the Decision of the Mataram District Court Number: 194/Pid.B/2021/PN.Mtr. The author's interest in this research is based on the concursus that is more often found in the form of crimes that are not similar. However, it is different in the object of this research which is a concursus with similar criminal offenses, namely in the form of theft with theft. With the concursus doctrine, of course the type of indictment imposed on the defendant will affect the verdict. Departing from this, in this study the author aims to analyze the effect of the concursus teaching on the type of indictment in the crime of theft with the object of research in the Mataram District Court Decision Number: 194/Pid.B/2021/PN.Mtr. This research uses normative juridical research, which is research conducted using the library method to explore legal rules related to the object of research. Because this research is a decision analysis, the approaches used in this research are statutory approaches and conceptual approaches. The results of this study indicate that the object of research is included in the qualification of concursus realis and is included in the type of single indictment. The inclusion of a single indictment is certainly due to the influence of concursus realis which in a regulation must contain several elements of a criminal offense that can provide clarity to the Public Prosecutor to impose a type of indictment on the Defendant. Ketertarikan penulis dalam penelitian ini didasari pada keidentikan concursus yang lebih sering dijumpai yaitu berupa tindak pidana yang tidak sejenis. Namun, berbeda pada objek penelitian ini yang merupakan concursus dengan tindak pidana sejenis, yaitu berupa kasus pencurian dengan pencurian Dengan adanya concursus tentu sebuah dakwaan yang dijatuhkan kepada terdakwa akan berpengaruh terhadap putusannya. Berangkat dari hal tersebut, maka dalam penelitian ini penulis bertujuan untuk menganalisis pengaruh ajaran concursus terhadap jenis dakwaan dalam tindak pidana pencurian dengan objek penelitian Putusan Pengadilan Negeri Mataram Nomor: 194/Pid.B/2021/PN.Mtr. Penelitian ini menggunakan tipe penelitian yuridis normatif, yaitu penelitian yang dilakukan dengan metode pustaka untuk menggali aturan-aturan hukum yang berkaitan dengan objek penelitian. Oleh karena penelitian ini merupakan analisis putusan maka pendekatan yang dipergunakan dalam penelitian ini yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukan bahwa dalam objek penelitian termasuk dalam kualifikasi concursus realis dan termasuk dalam jenis dakwaan tunggal. Dikenainya dakwaan tunggal tersebut tentu tidak lain disebabkan pengaruh concursus realis yang di dalam sebuah pengaturannya harus memuat beberapa unsur tindak pidana yang bisa memberikan kejelasan kepada Jaksa Penuntut Umum untuk menjatuhkan sebuah jenis dakwaan kepada Terdakwa. Abstract

Domestic Violence (DV) as a form of crime that violates the rights of victims cannot be underestimated, the Police as law enforcement officers must be able to enforce the law fairly and beneficially for the integrity and peace of the household. Domestic violence crimes have a serious impact on family continuity and can even threaten the integrity of a family. This crime can occur at any time and happen to anyone, both men and women, but the majority of domestic violence victims are women. Women and children, as the majority of victims of domestic violence, have attracted international attention. The Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) regulates the scope of human rights and the state's obligation to ensure their fulfillment. This normative juridical method research aims to answer why the Police in law enforcement of domestic violence in Indonesia must be based on human rights, through several approaches such as the statutory approach and theoretical approach so that it can be concluded that domestic violence is a criminal offense between the perpetrator and the victim has a close relationship within the scope of the household. Indonesia as a state of law must uphold human rights. Pancasila as the spirit in resolving criminal acts of domestic violence has values that complement each other and qualify between one precept and another and each precept has human rights values. The fundamental values of Pancasila have created a harmonious life in a divine, humane, united, populist, and just manner, this of course has upheld the values of human rights in domestic violence law enforcement by the Police in Indonesia. Keywords: domestic violence, police, law enforcement, human rights

Abstract

The results of the medical examination are proof of the doctor-patient relationship, which is documented in a record containing an explanation of the patient's health condition based on the results of the examination that has been carried out. Although the recording process is an obligation, there are several cases where medical records are not filled in correctly and some are not even filled in by officers. Therefore, this research is designed to find out the urgency of electronic medical records as evidence of therapeutic transactions. The problems studied in this article are: First, the juridical consequences of health workers and hospitals in making and keeping RM or RME confidential; Second, the position and strength of RM or RME as evidence according to the law of evidence. The results show that health workers or hospitals are obliged to make Medical Records or Electronic Medical Records correctly and responsibly. Regulation of the Minister of Health Number 749a/MENKES/Per/XII/1989 concerning Medical Records is the basis for the obligation to procure Medical Records, therefore it must be adhered to for every health service.Keywords: Medical Records, Electronic Medical Records, Evidence

Abstract

The enactment of Indonesia’s Criminal Procedure Code 2025 (KUHAP 2025) marks the strengthening of the integrated criminal justice system, positioning the principle of functional differentiation as a primary tenet in the administration of criminal proceedings. Under its provisions, KUHAP 2025 clearly defines the authority of law enforcement institutions, ensuring that their respective functions are not encroached upon. However, the principle of dominus litis still places the prosecutor as the controller of the case, raising questions regarding the boundaries of authority between the fact-finding process conducted by investigators and the assessment of the appropriateness of prosecution. This study focuses on how the limits of investigative and prosecutorial authority within the KUHAP 2025 should be understood proportionally to ensure that the application of dominus litis does not obscure the neutrality of investigations. Clarifying these functional boundaries is essential to prevent the integrated criminal justice system from collapsing into one that conflates authorities, but functions as a cooperative framework that preserves objectivity in uncovering the truth. The study relies on the perspective of the KUHAP 2025, which promotes integration in the criminal justice system by differentiating – not unifying – authorities, allowing functions to complement and supervise one another. By distinguishing investigation as the discovery of factual guilt and prosecution as the evaluation of legal guilt, this research shows that functional differentiation and dominus litis are not opposing principles. Rather, they constitute complementary concepts necessary to avoid overlapping authorities in law enforcement practice.

Abstract

This study examines the extent to which Islamic legal norms regard polygamy as a permissible marital practice, and how feminist legal perspectives assess such practice within the framework of gender equality and the protection of women’s rights. The research is directed by two principal legal questions: (1) What is the comparative analysis of polygamy under the Marriage Law when viewed from the standpoint of Islamic Law and Feminist Legal Theory? and (2) How is the concept of justice for women subjected to polygamous marriages assessed under Islamic Law and Feminist perspectives? This study employs a normative legal research design using a qualitative  descriptive analysis. Data were obtained through a literature-based method involving statutory materials, authoritative legal texts, scholarly works, and relevant academic articles. An analytical approach was adopted to interpret the meaning and scope of terms contained in legislative provisions, while data collection was conducted through comprehensive doctrinal and literature review to assemble all relevant legal information. The findings of this research demonstrate both differences and points of convergence between Islamic Law and Feminist perspectives regarding the legal and ethical status of polygamy. Under Islamic Law, polygamy is deemed permissible subject to strict substantive and procedural conditions, including the husband’s ability to uphold justice among his wives, both materially and emotionally. In practice, however, the failure to fulfil the principle of justice often results in discrimination and harm toward women. Conversely, from a Feminist perspective, polygamy is viewed as an inherently inequitable institution that reinforces patriarchal structures and places women in subordinate positions, socially, economically, and emotionally. Therefore, in order to achieve justice from both legal and gender-equality standpoints, a reinterpretation and reassessment of existing marital regulations is necessary to ensure greater responsiveness to gender justice and stronger protection of women’s rights.

Abstract

Data from the Directorate General of Corrections on the https://sdppublik.ditjenpas.go.id/ website as of August 2, 2025, recorded that the number of prisoners and detainees in Indonesia reached 281,790. Meanwhile, the total capacity of all correctional institutions (Lapas) in Indonesia can only accommodate 147,530 people. This condition indicates a 90% overcrowding. This overcrowding is a crucial issue because it has the potential to cause disturbances to security and order, such as attempted escapes, controlling drug trafficking from within prisons, the spread of radical ideology, and repeated violations of rules. These behaviors are indicators of an increase in the risk level of prisoners into the high-risk category. The emergence of high-risk prisoners is a serious challenge within the correctional system. In an effort to address this, the Ministry of Law and Human Rights issued Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 35 of 2018 concerning the Revitalization of Correctional Implementation. This policy regulates the development of prisoners based on their risk level. This paper aims to analyze the implementation of the correctional revitalization policy as a systematic solution in handling high-risk prisoners.

Abstract

This study examines criminal liability for the use of dark patterns in the registration process on digital platforms and applications, which often mislead users into providing consent for the processing of their personal data. Dark patterns are interface design strategies intentionally crafted to influence user behavior through visual and psychological manipulation, resulting in consent that is no longer freely given. The purpose of this research is to analyze the basis of criminal liability for the implementation of dark patterns under Indonesia’s national legal framework, particularly the Personal Data Protection Law (PDP Law), the Electronic Information and Transactions Law (ITE Law), and the 2023 Criminal Code (KUHP), as well as to identify obstacles to law enforcement against such practices in Indonesia. This study employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that dark patterns may fulfill the elements of a criminal offense due to the presence of intentionality, deception, and unlawful economic gain, thereby allowing liability to be imposed on both individuals and corporations. Nevertheless, significant barriers to effective enforcement remain, including the absence of an independent data protection authority, the lack of clear legal standards regarding manipulative interface design, and low levels of digital literacy among the public. This research underscores the urgency of strengthening regulatory frameworks and institutional capacity to ensure the protection of privacy rights and legal certainty within Indonesia’s digital ecosystem. Abstract

The development of information technology has led to a shift from conventional transactions to electronic commerce, including the widespread use of Cash on Delivery (COD) systems on marketplace platforms. Although COD provides a sense of security for consumers, it also creates legal risks for sellers, particularly when buyers abuse the product return mechanism. This study examines the legal protection available to online sellers against the misuse of COD returns, using a case example of a sports retail business in Banyumas, including Planet Shoes Banyumas. This research applies a normative legal method based on the Indonesian Civil Code (KUHPerdata), particularly the provisions governing sale and purchase agreements (Articles 1457–1540), the principle of good faith (Article 1338 paragraph 3), the principle of balance between contractual parties, and the concept of breach of contract (Article 1243). The act of returning goods that have been replaced with different items constitutes a breach of contract, which gives sellers the legal right to demand performance or compensation. The findings indicate that the enforcement of sellers’ rights is often constrained by limited evidence, incomplete consumer data, and the restricted role of third parties such as marketplace platforms and courier services, whose responsibilities are not comprehensively regulated in electronic contracts. This study recommends strengthening legal protection through clearer contractual clauses, proper documentation of product conditions, and technical verification mechanisms during the return process. The findings are expected to contribute to the development of civil law in the context of digital transactions and to provide practical guidance for business actors using COD systems in order to promote more balanced contractual relationships.
