Abstract

The Karangsambung Geological Nature Reserve Area is an area established by Regional Regulation Number 23 of 2012 concerning the Regional Spatial Plan of Kebumen Regency as a geological protected area that needs to maintain physical and rocky existence and the ecosystem above it for the purposes of education, tourism, and environmental conservation. The problems studied are (1) How is the protection of the Geological Protected Area in the Karangsambung Geological Nature Reserve Area? (2) How is the control of space utilization in the Geological Protected Area in the Karangsambung Geological Nature Reserve Area? This research uses qualitative research methods with an empirical juridical approach. Data sources are primary data and secondary data. Primary data were obtained from the Public Works and Spatial Planning Office of Kebumen Regency, Kebumen Regency Environmental Office, BRIN Karangsambung Geodiversity, and Karangsambung Geopark with interview techniques. Secondary data is obtained from library sources. The results and discussion of this research are (1) Protection of geological protected areas in the Karangsambung Geological Reserve Area through maintaining the integrity of existing geological sites with security from exploitation activities, as well as supporting efforts so that existing rock sites remain sustainable by maintaining drainage, making terracing, reforesting and also carried out disaster mitigation to reduce the impact of disasters. (2) In geological protected areas in the Karangsambung Geological Nature Reserve Area controlling spatial use through several efforts, namely zoning, licensing, incentives and disincentives, and sanctions. The utilization of existing space is going well in terms of education and tourism, but the carrying capacity of the environment for education, tourism, and environmental conservation is not going well because there are still activities that change the geological form in the form of mining in the Karangsambung Geological Nature Reserve Area.

Abstract

ABSTRACTIn this study will examine the application of the Delimitation Contradictory Principle in the PTSL program and the factors that influence the application of the the Delimitation Contradictory Principle in the PTSL program. The research methods used empirical juridical research with a qualitative research approach. This research is located in Sampangan and Bendan Duwur Villages. The research results in the implementation of the Delimitation Contradictory Principle in the PTSL program in Sampangan and Bendan Duwur Villages, Semarang City have not been fully implemented in accordance with PP No. 24 of 1997, there are several obstacles that occur in its implementation such as the owner does not maintain the land and the absence of the owner or the bordering party at the time of measurement.Keywords: Implementation; Contradictoire Delimitatie; Land Registration. ABSTRAKPenelitian ini meneliti terkait  penerapan Asas Kontradiktur Delimitasi pada program PTSL dan  faktor yang mempengaruhi penerapan Asas Kontradiktur Delimitasi pada program PTSL. Metode penelitian yang digunakan yakni menggunakan penelitian yuridis empiris dengan pendekatan penelitian kualitatif. Penelitian ini berlokasi di Kelurahan Sampangan dan Bendan Duwur dimana menjadi tempat pelaksanaan Program PTSL di Kota Semarang. Hasil penelitian yakni penerapan Asas Kontradiktur Delimitasi pada program PTSL di Kelurahan Sampangan dan Bendan Duwur Kota Semarang belum sepenuhnya terlaksana sesuai dengan PP Nomor 24 Tahun 1997. Masih terdapat beberapa kendala dan hambatan yang terjadi pada pelaksanaannya seperti tidak diketahuinya  pemilik tanah atau pihak yang berbatasan (no name) ketika akan diukur, pemilik yang tidak memelihara dan memperhatikan tanah kepemilikannya serta tidak hadirnya pemilik atau pihak yang berbatasan pada saat pengukuran.Kata Kunci: Penerapan; Kontradiktur Delimitasi; Pendaftaran Tanah

Abstract

This study addresses the urgent question: How can legal protections for Geographical Indications (GIs) as a form of Intellectual Property (IP) enhance the welfare of coffee farmers in Temanggung, Indonesia? Coffee is a vital agricultural product in this region, yet farmers face challenges in maximizing its economic potential. The research positions itself within the framework of empirical legal studies, analyzing the interplay between legal protections and agricultural sustainability. The paper discusses the issue by first examining the current state of GI protection in Temanggung, identifying both obstacles faced by farmers and the government. Through qualitative analysis, the study evaluates effective strategies for implementing GI protections and their implications for farmer welfare. The main findings indicate that while there are significant challenges in enforcing GI protections, targeted strategies—such as regular training and outreach for farmers, improved marketing initiatives, and the establishment of local regulations—can substantially enhance their livelihoods. Moreover, the research highlights the importance of increasing awareness and knowledge among farmers to leverage GI protections effectively. Overall, this study contributes to the understanding of agricultural law's role in rural development, providing actionable insights for policymakers and stakeholders aiming to support Indonesia’s coffee farmers.

Abstract

This article aims to examine the dynamics of community participation in the land registration process in the digital era, as well as the challenges faced in optimizing citizen involvement. In the midst of developments in digital technology, land registration has great potential to become more transparent and efficient. However, although information technology can facilitate access to information and speed up the registration process, there are a number of challenges that need to be overcome. These challenges include the digital divide, low technological literacy among the community, and a lack of understanding of land rights. This research uses qualitative methods to find out people's experiences in participating in the land registration process and find ways to make people more active.  It is hoped that the results of this research can provide advice to the government and related parties so that people can participate more easily and everyone feels involved.

Abstract

Abortion remains one of the most controversial legal and ethical issues, balancing between reproductive rights, religious doctrines, and state regulations. In Indonesia, abortion laws are primarily governed by the Health Law No. 36 of 2009 and the Criminal Code, which generally prohibit abortion except under specific circumstances, such as medical emergencies or rape-induced pregnancies. These legal restrictions reflect Indonesia’s socio-religious landscape, where Islamic principles significantly influence legislative frameworks. From an Islamic legal perspective, abortion is largely prohibited but with nuanced interpretations depending on the gestational stage and underlying reasons. Classical Islamic jurisprudence generally forbids abortion after ensoulment (believed to occur at 120 days of pregnancy), though some scholars permit it under limited circumstances, such as to preserve the mother’s life or in cases of severe fetal abnormalities. However, differences exist among Islamic schools of thought regarding permissibility before ensoulment, leading to diverse legal applications across Muslim-majority countries, including Indonesia. This study critically examines the intersection of Indonesian state law and Islamic law on abortion, highlighting their points of convergence and divergence. It explores how legal, religious, and ethical considerations shape abortion policies and the implications for women's reproductive rights. The paper also addresses ongoing debates over potential legal reforms, considering global human rights perspectives and the influence of Islamic jurisprudence in shaping reproductive health policies. By comparing these legal frameworks, this study aims to provide a comprehensive understanding of abortion law in Indonesia within both secular and religious contexts.

Abstract

Sistem pencatatan kepemilikan lahan di Indonesia memainkan peran vital dalam menjamin aspek legalitas kepemilikan properti. Hal ini menjadi esensial mengingat lahan merupakan aset fundamental dalam kehidupan sosial, serta kerap memicu perselisihan terkait hak kepemilikan dan penggunaannya. Studi ini mengeksplorasi kerangka legal terkait sistem pencatatan kepemilikan lahan di Indonesia dan mengevaluasi pentingnya proses registrasi awal untuk memberikan perlindungan hukum kepada pemilik properti. Melalui kajian yuridis normatif, studi ini menelaah berbagai instrumen hukum terkait pencatatan lahan, mencakup UUPA, PP 24/1997, serta PP 18/2021 yang mengatur tentang Pengelolaan, Hak Properti, Unit Apartemen, dan Sistem Registrasi Lahan. Pencatatan lahan secara sistematis dipandang krusial untuk meminimalisir konflik, memperkokoh status kepemilikan, dan menyediakan payung hukum bagi pemegang hak. Temuan riset mengindikasikan bahwa meski telah tersedia berbagai regulasi, akselerasi dan optimalisasi efisiensi dalam implementasi pencatatan lahan melalui program PTSL dan pemanfaatan sistem elektronik masih menjadi fokus pengembangan untuk mencapai jaminan legal yang lebih komprehensif bagi masyarakat.

Abstract

This research analyzes the stages of settlement of international civil law disputes in the case of Chin Hsiang Electricity & Machinery Co. Pte. Ltd. vs. P.T. Loka Rahayu Plywood Industries. The objective is to evaluate the settlement stages and their legal implications based on the theory of International Private Law (IPL). The research method used is qualitative with a conceptual, case, and comparative approach. Data was collected through literature and documentation studies. The results of the study show that the application of Indonesian Civil Law by the Jambi District Court judge was appropriate, but not transparent regarding the application of IPL. This raises doubts about the application of IPL principles and rules. The conclusion is that transparency in the application of IPL and the role of IPL decisions in the development of national and international law are very important.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) serve as the economic backbone of communities, with their sustainability influenced by various factors, including adherence to business legality. Among the crucial legal aspects, obtaining halal certification stands out as a pivotal requirement. This certification plays a vital role for business entities, aiming to bolster consumer confidence in the products they offer. The research conducted adopts a mixed-methods approach, combining qualitative and quantitative data collection and analysis. Surveys and direct interviews with service partners reveal significant challenges faced by these partners. These challenges encompass a spectrum from comprehending the importance of halal food products and the processes involved in their production to understanding the intricacies of halal certification and the necessary steps to obtain it. In accordance with the Halal Product Assurance regulations, the implementation of halal certification in Indonesia is mandated to expedite. Notably, by no later than October 17, 2024, all products entering, circulating, and trading in Indonesia must be duly halal-certified. This stringent timeline underscores the urgency for businesses to prioritize obtaining halal certification, positioning it as a critical component of their legal obligations. The significance of halal certificates extends beyond mere compliance, serving as a testament to a business's commitment to meeting the ethical and religious considerations of its diverse consumer base. This study also advocates for the important role of halal certification in sustaining MSMEs as the economic backbone of communities. The findings underscore the need for robust policy-making, emphasizing the urgency of halal certification in accordance with Halal Product Assurance regulations in Indonesia. The research aligns with the advocacy for policies that prioritize the timely implementation of halal certification, recognizing it as a critical component for MSMEs to meet legal obligations and enhance consumer trust.

Abstract

The provision of antibiotics without doctor's prescription is serious problem in the Indonesian health system, which has impact on increasing antimicrobial resistance (AMR). Although regulations related to antibiotic use have been implemented, there are still gaps between the rules and implementation in the field. This study uses empirical legal method to analyze the effectiveness of controlling the use of antibiotics without doctor's prescription, challenges in its supervision, and strategies that can be applied to limit this practice. The results of the study show that although various regulations have strictly regulated the distribution of antibiotics, the level of pharmacy compliance with these rules is still low. A study conducted by the Indonesian Pharmacists Association (IAI) in 2023 showed that 79.5% of pharmacies still serve the purchase of antibiotics without a prescription, with a dominance in urban areas (82.3%) compared to rural areas (71.8%). The main factors causing this violation are weak supervision, legal sanctions that are not sufficiently deterrent, and high demand from the community. In addition, the lack of health education contributes to misuse of antibiotics, which risks increasing bacterial resistance and economic burden on the health system. Strengthening supervision and law enforcement of antibiotic distribution, implementing an electronic system for recording prescriptions, and educational campaigns for community and pharmacists are needed. With a stricter and more synergistic control strategy, practice of prescribing antibiotics without prescription can be minimized, so that the risk of antimicrobial resistance can be suppressed and effectiveness of treatment can be maintained.

SOCIAL JUSTICE issues can occur in relation to practically any aspect of society where inequality can arise as a result of unjust prejudices or policies.
