Abstract

Abstract: Elections means implementation of the sovereignty of the people held in directly, general, free, confidential, honest, and fair in the Republic of Indonesia under Pancasila and the Constitution of the Republic of Indonesia Year 1945. The implementation of the election has a lot of dynamics, among others political boat fees are expensive, expensive campaign funds to political imagery, the cost of consultations and surveys are expensive as well as winning money politics. Financial disclosure is very important political party in an election, because a lot of the flow of the corruption that is used in the election. As a result, people do not believe in political parties, or some communities in Indonesia began to no longer sympathetic to the political party. The idea of political party financial disclosure regulations should be initiated carefully in Indonesian election codification plan. Forward Indonesia must have arrangements campaign funds or political funds transparent, accountable, and has strict sanctions and binding on the parties involved, so that people come back believing again to political parties, and assured political parties place to channel their aspirations in granting the right in elections  Abtrak: Pemilu adalah sarana pelaksanaan kedaulatan rakyat yang diselenggarakan secara lansung, umum, bebas, rahasia, jujur, dan adil didalam Negara Kesatuan Republik Indonesia berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pelaksanaan pemilu memiliki banyak dinamika, antara lain biaya perahu politik yang mahal, dana kampanye yang mahal untuk politik pencitraan, ongkos konsultasi dan survei pemenangan yang mahal serta politik uang. Keterbukaan keuangan partai politik sangat penting didalam pelaksanaan pemilu, karena banyak aliran hasil korupsi yang dipakai dalam pemilu. Akibatnya masyarakat tidak percaya kepada partai politik, atau sebagaian masyarakat Indonesia mulai tidak lagi simpatik pada partai poltik. Gagasan regulasi keterbukaan keuangan partai politik harus digagas dengan seksama didalam rencana kodifikasi pemilu Indonesia. Kedepan Indonesia harus memiliki pengaturan dana kampanye atau dana politik yang transparan, akuntabel, serta memiliki sanksi yang tegas dan mengikat para pihak yang terlibat, sehingga masyarakat kembali percaya lagi kepada partai politik, dan yakin partai politik tempat menyalurkan aspirasi mereka dalam pemberian hak dalam pemilu. DOI: 10.15408/jch.v4i2.3433

Abstract

Tujuan penelitian ini adalah mengkaji kehadiran dari lembaga negara independen di Indonesia, serta ingin mengetahui kedudukan lembaga negara independen dalam mencapai tujuan negara hukum. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan menggunakan metode dogmatik hukum yang didasarkan pada dalil-dalil logika. Hasil penelitian menunjukkan bahwa kehadiran lembaga negara independen di Indonesia terjadi pasca perubahan UUD 1945 dan masyarakat memiliki krisis kepercayaan terhadap lembaga-lembaga negara yang ada. Sedangkan kedudukan lembaga negara independen dalam mencapai tujuan negara hukum dimulai dari pembentukannya selama ini dibentuk melalui Undang-undang, Peraturan Pemerintah Pengganti Undang-undang, Keputusan Presiden, Peraturan Presiden serta Peraturan Pemerintah dengan penamaan yang berbeda-beda. Tujuan pembentukan lembaga negara independen ini pun juga sesuai dengan tujuan negara Indonesia yang terdapat dalam pembukaan UUD 1945. The purpose of this study is to examine the presence of independent state institutions in Indonesia, and want to know the position of independent state institutions in achieving the objectives of the rule of law. This study uses normative juridical research methods, using legal dogmatic methods which are based on the postulates of logic. The results showed that the presence of independent state institutions in Indonesia occurred after the changes to the 1945 Constitution and the public had a crisis of confidence in existing state institutions. Whereas the position of an independent state institution in achieving the objectives of the rule of law starts from its formation as long as it is formed through Laws, Government Regulations Substituting Laws, Presidential Decrees, Presidential Regulations and Government Regulations with different names. The purpose of forming an independent state institution is also in accordance with the objectives of the Indonesian state contained in the opening of the 1945 Constitution.

Abstract

Perkawinan merupakan peristiwa hukum apabila perkawinan tersebut merupakan perkawinan yang sah. Perkembangan ilmu pengetahuan dan teknologi yang begitu pesat membawa pengaruh pada semakin mudahnya terjadi hubungan antar sesama manusia, antar suku bangsa, dan antar Negara dalam segala aspek kehidupan. Salah satu pengaruhnya adalah terjadinya perkawinan campiran antara pasangan berbeda kewarganegaraan, termasuk pada tenaga kerja Indonesia dengan tenaga kerja dari Negara lain. Perkawinan beda kewarganegaraan memang seringkali menimbulkan persoalan, terutama berkaitan dengan proses pencatatan perkawinan yang akan dilangsungkan, apakah di negara asal calon suami atau di negara asal calon istri. Prosedur perkawinan antar Negara menurut hukum perdata internasional menjelaskan bahwa aturan pernikahan terhadap pasangan beda warga negara, dikembalikan pada pasangan masing-masing akan memakai hukum Negara calon suami, atau memakai hukum Negara calon istri. Problem yang muncul dalam prosedur perkawinan campuran beda kewarganegaraan adalah pada tahap mempersiapkan surat keterangan dari pegawai pencatat perkawinan dan pada tahap mempersiapkan surat ataupun dokumen lainnya. Penyelesaian problem yang muncul dalam prosedur perkawinan campuran yang telah dipersiapkan pemerintah adalah memberikan informasi yang jelas dan menyediakan website kepada pasangan yang akan menikah. Kepada oknum-oknum yang nakal, harus diberikan sanksi yang tegas.

Abstract

Pemerintah Daerah memiliki peran yang sangat vital didalam perlindungan anak. Hal ini tertuang didalam pasal-pasal Undang-Undang Perlindungan Anak. Didalam mewujudkan tata kelola pemenuhan hak anak oleh Pemerintah Daerah haruslah benar-benar direalisasikan dan dijalankan dengan semestinya. Kota Layak Anak merupakan impian dari setiap anak, karena anak akandibesarkan secara layak dan semestinya. Pemerintah Daerah sebagai pemerintah yang bersentuhan lansung dengan kehidupan anak, harusnya lebih aktif dan lebih kritis, untuk menyuarakan hak-hak anak. Menata kelola pemenuhan hak anak oleh Pemerintah Daerah harus diawasi sebuah lembaga sendiri yang fokus untuk melindungi, menjaga, memantau dan mengawasi hak anak. Penanaman pemahaman perlindungan anak berkelanjutan sangatlah perlu diajarkan sejak dini kepada masyarakat, karena apabila sejak dini masyarakat diajarkan memahami perlindungan anak secara berkelanjutan, maka perlindungan anak di Indonesia tidak akan berhenti.

Abstract

Child protection in Indonesia is closely linked to Indonesian legal politics that gave birth to Indonesia's legal system. The legal political struggle in establishing child protection arrangements in Indonesia, is the impact of providing legal certainty to child protection. In today's protection is very sad. This paper will discuss about: 1) how the development of legal politics at this time? 2) how does legal political analysis affect changes to child protection legislation? 3) how is the formation of the second amendment of child protection law number 17 of 2016? The approach method used is normative legal research. Political law is always evolving in accordance with the interests of the legislature and the interests of society. The legal politics of child protection in Indonesia as a positive legal system or ius contituendum and the intended law or ius contitium applicable and which will prevail in the present and future. Therefore, the legal system of child protection is formed as a consequence of the application of Indonesian legal politics. The Child Protection Act was established as a result of the Political Law of Government, which in this case explains that the legal politics is part of the jurisprudence studying the change of ius constitutum into ius constituendum to fulfill the life of society change.

Abstract

The business development of the economy not only in the field of conventional, Shari'ah economic business now has started mushrooming everywhere. With a population of Indonesia is predominantly Muslim, the more it will attract market share to take part in business economics Shari'ah. Instead of that, the presence of a notary Shari'ah is urgently needed in Indonesia, because the focus of work in the field of economics Shari'ah, so it can ensure law and society in transacting Shari'ah. The research used normative juridical approach, using the theory of legal certainty. So we get Analisia, that the reality is that the people do not feel comfortable in transacting Shari'ah, because of the absence of provisions on rules of shari'a law notary. So the conclusion is obtained, the need for Shari'ah notary very important.

Abstract

The main problems in this research were, first, how is the participation of local governments in realizing children-friendly city/district (KLA) in Indonesia. Second, what are the factors that affect the local governments in realizing children-friendly city/district in Indonesia. This was a normative legal research; legal materials were analyzed using descriptive qualitative approach. The results of the research showed that: first, the forms of participation of the local governments in fulfilling children’s rights so that they deserve to be declared as KLA are: 1) Civil Rights and Freedom; 2) Family and Alternative Nursery; 3) Disability, Basic Health and Welfare; 4) Education, Utilization of Leisure Time and Cultural Activities; and 5) Special Protection. Second, there are several factors that affect how a region becomes KLA: 1) Legislation and policies on the fulfillment of children's rights; 2) Budget for the fulfillment of children's rights; 3) The number of legislations, policies, programs and activities that get input from children forum and other children groups; 4) Availability of KLA-trained human resources who are able to integrate children’s rights into policies, programs and activities; 5) Availability of children’s data by sex, age, and sub-districts; 6) Involvement of community institutions in the fulfillment of children's rights; and 7) Involvement of business in the fulfillment of children’s rights.

Abstract

Freedom of expression is one part of human rights. In Indonesia as a country of law and democracy, the right of expression has been set in the constitution. Article 28 letter G of the Constitution of the Republic of Indonesia Year 1945 states that the State protects the freedom of the press and freedom of expression. But freedom of the press in conveying information to the public contrary to the legal interest in ensuring the protection of children's rights. Children's right to protection and guarantee of media coverage that guarantees the confidentiality of information of children when dealing with the law, the presentation of news about the child should be better and benefit, the information presented should protect children. When the children read the information in the electronic or print media, so your child can easily understand the information. Law No. 40 of 1999 concerning the Press indepeneden produce a state agency called the Press Council, the Press Council should control the news related to the rights of children, which is accessed by the whole society. The role of the Press Council in protecting the rights of children is to supervise and control the news about the child, the Press Council puts journalist organizations as partners in the enforcement of the code of conduct. Moreover, sanctions on journalists who violate the code of conduct can only be given by an organization of journalists and press companies. Journalist organizations can follow up the assessment and recommendation of the Press Council against unethical reporting.

Abstract

Pemberlakuan Undang-Undang Nomor 6 Tahun 2014 tentang Desa berimplikasi pada kucuran dana miliaran rupiah langsung ke desa yang bersumber dari alokasi dana desa. Kepala desa sebagai pemimpin desa harus dapat menerapkan fungsi manajemen sejak perencanaan, pengorganisasian, penggerakan, dan pengawasan untuk mengatur desanya supaya lebih maju. Berdasarkan peraturan per-UU-an yang ada, pemerintah desa dibantu oleh Badan Permusyawaratan Desa. Tulisan ini menyajikan peran vital BPD sebagai penerus aspirasi masyarakat di dalam pemerintahan desa. Artinya, BPD bukanlah lembaga yang dapat dengan begitu saja disepelekan, melainkan kepala desa harus senantiasa bekerja sama dengan BPD dalam pembangunan desa. Akhir penulisan ini menjelaskan tentang pengawasan keuangan yang dilakukan oleh BPD. Pelaksanaan pengawasan juga dapat mendeteksi, sejauh mana kebijakan kepala desa untuk menjalankan dan penyimpangan keuangan yang terjadi dalam pelaksanaan kerja tersebut. Tulisan ini juga menegaskan bahwa faktor yang dapat mendukung pengawasan BPD adalah masyarakat, karena masyarakat merupakan faktor penentu keberhasilan BPD dalam melaksanakan pengawasan keuangan desa.The Role of Village Consultative Board in Village Development and Village Finance SupervisionThe enactment of Law Number 6 Year 2014 on Village implies the disbursement of billions of rupiah funds directly to the villages sourced from the allocation of village funds. The village head as a village leader should be able to implement the management function from planning, organizing, mobilizing, and supervising to organize his village to be more advanced. Under the existing law, the village government is assisted by the Village Consultative Board (Badan Permusyawaratan Desa). This paper presents the vital role of BPD as the successor to the aspirations of the people in the village administration. BPD is not an institution that can be underestimated, but the village head should always work with BPD in rural development. The end of this paper describes the financial supervision made by BPD. The implementation of supervision can also detect to what extent the policy of the village head is to run and the financial irregularities that occur in the implementation of such work. This paper also confirms that the factors that can support BPD supervision is the community, because the community is a critical determinant of the success of BPD in implementing village financial oversight.DOI: https://doi.org/10.22304/pjih.v4n3.a10

Abstract

Partisipasi masyarakat dalam penegakan hukum perlindungan anak merupakan salah satu kunci dari kemajuan negara Indonesia. Hari ini, semakin marak terjadi pelanggaran terhadap perlindungan hak-hak anak di tengah masyarakat. Menjadi sebuah pertanyaan apakah kemudian yang dilakukan oleh masyarakat terkait hal tersebut, karena baik secara sadar maupun tidak sadar, perlindungan anak telah terabaikan. Tulisan ini menyajikan bagaimana pengaruh pemahaman kesadaran hukum oleh masyarakat terhadap perlindungan anak guna menciptakan perlindungan anak yang berkelanjutan. Kemudian dibahas pula bagaimana peran partisipasi masyarakat terhadap perlindungan anak. Jawabannya adalah partisipasi masyarakat memiliki peran utama dalam perlindungan anak, baik dalam bentuk partisipasi aktif maupun pasif. Pada akhir tulisan ini, penulis mencoba menggagas penanaman tentang perlindungan anak yang berkelanjutan di tengah kehidupan bermasyarakat. Sehingga dapat disimpulkan bahwa kesadaran masyarakat terhadap partisipasi masyarakat bagi perlindungan anak akan mempengaruhi perlindungan anak secara berkelanjutan. Public Participation in Sustainable Child Protection Law as a Form of Legal Awareness AbstractPublic participation in the enforcement of child protection laws is the key to the development of the Indonesian state. Today, a growing number of violations of the right of child continue to occur in society. A question then arises on what is done by the people related to the violations, which uncovers that child protection has been neglected either consciously or unconsciously. This paper discusses the legal awareness of the public regarding the protection of child to create a sustainable child protection. Furthermore, this paper also discusses the central role of public participation, whether in active or passive participation, in ensuring child protection. At the end of this paper, the author tries to initiate an ongoing understanding on child protection by the public.
