Abstract

State finance is only interpreted narrowly, which is limited to the State Revenue and Expenditure Budget. Article 23 E of the 1945 Constitution states that in order to examine the management and responsibility of state finance, a free and independent Supreme Audit Agency (BPKP) is held. Based on the provisions of Article 6 of Law 17/2003, the President as the Head of Government holds the power of managing state finances as part of the next governmental power: authorized by the Minister of Finance, as fiscal manager and Government Representative in the ownership of separated state assets; authorized to the minister / head of the institution as the Budget User / Property User the state ministry / institution he leads; submitted to the governor / regent / mayor as head of regional government to manage regional finance and represent the regional government in the ownership of separated regional assets; and not including the authority in the monetary sector, which includes among other things issuing and circulating money, which is regulated by law. As the holder of the power of state financial management, the government has a supervisory agency / agency / unit within the government that has the duty and function of conducting supervision which is often known as the Government Internal Supervisory Apparatus consisting of the Financial and Development Supervisory Agency and Inspectorate General.

Abstract

The legal aspect of civil registration is to obtain as much legal certainty as possible about personal events. Civil registration institutions are government institutions, the state administrative agency in charge, serves to record all family events and has the right, the authority to issue provisions in the field of population and citizenship. As a result of recording and publishing the provision, it has a legal connection with one's civil status or individual law. With the enactment of Law 1 of 1974 concerning Marriage and PP 9 of 1975 as implementing regulations, the public needs for Civil Registry Institutions are increasingly important. Research on this scientific work was a type of normative legal research. Civil records had carried out the tasks carried out by the state well, namely by serving each party who will report the mixed marriages carried out by the parties as well as possible, which is a problem is the lack of public awareness of the importance of the reporting. The implementation of mixed marriages can be carried out if the parties have fulfilled all the requirements determined by the law as contained in Article 60 Paragraph (1) of Law 1 Year 1974. Whereas the Record Institution was only tasked to record the mixed marriage events. Every legal act carried out by any particular person has an impact or effect both for himself and for the other party. No exception in mixed marriages is the legal consequences that arise, both for mixed marriages and for children born from the mixed marriages.

Abstract

State civil service (ASN) resource management is an important part of state governance that aims to assist and support all human resources of state civil apparatus to realize their full potential as civil servants and citizens. One is the openness of public information described in the UU ASN and the Law on Public Information Disclosure (UU KIP). The implications of the application of the KIP Law to the public or the public are the opening of access for the public to obtain information related to the public interest. First, Information that must be provided and announced and Required Information Announced necessarily (easy to reach and easy to understand). Establishing characterized and proportional ASNs are various ways, namely: 1) State Civil Service Committee (KASN); 2) Utilizing information communication technology (ICT), which provides public information disclosure data to the public through the website; 3) Implementation of UU KIP; 4) need to be socialized both to public bodies and communities; 5) Public bodies are given space to establish, build, and develop institutional PPIDs in accordance with the characteristics of institutions of their respective public bodies; 6) The government should be able to optimize socialization and encourage public participation to be able to carry out information disclosure, as mandated by UU KIP. With these means are expected to realize the character of ASN and proportional that also amandat of UU KIP.

Abstract

Beragam bentuk pelanggaran HAM yang terjadi di sekolah telah memunculkan keprihatinan nasional yang harus direspon dengan cepat, tepat, dan benar. Respon tersebut sangat diperlukan agar kasus-kasus serupa tidak lagi muncul di masa depan. Beberapa cara dan upaya telah ditempuh kementerian / lembaga untuk menghapus kasus-kasus pelanggaran HAM di sekolah. Tapi, upaya tersebut belum mampu menunjukkan hasil yang optimal. Persoalannya karena upaya tersebut dijalankan secara sektoral, tematik, tidak terintegratif, tidak partisipatif, dan tidak berkelanjutan. Artikel ini menggunakan metodologi penelitian hukum normatif. Hasil penelitian menunjukan bahwa Sekolah Ramah HAM / Human Rights Friendly School (SRH) merupakan pendekatan baru dan berbeda untuk menyelesaikan beragam pelanggaran HAM di sekolah. SRH adalah sebuah sekolah yang mengintegrasikan nilai-nilai HAM sebagai prinsip- prinsip inti dalam organisasi dan pengelolaan sekolah. NilaiĀ  atau prinsip hak asasi manusia merupakan inti atau ruh dari proses dan pengalaman pembelajaran, dan tercermin dalam segala aspek. Sendi kehidupan sekolah. Pendekatan konsep SRH yang dipadukan dengan konsep pendidikan, diharapkan mampu memberikan jawaban riil untuk menyelesaikan beragam persoalan HAM yang ada di sekolah. Implementasi Konsep SRH akan berjalan optimal bila dilakukan secara sungguh-sungguh oleh Kementerian Pendidikan dan Kebudayaan dengan dukungan Komisi Nasional Hak Aasai Manusia (Komnas HAM), kementerian/lembaga terkait, masyarakat, para tokoh agama, tokoh masyarakat, lembaga-lembaga internasional, dan partisipasi aktif dari seluruh stake holder yang terkait dengan sekolah.

Abstract

Notary joins an organization called Indonesian Notaries Association. Indonesian Notary Association membership consists of ordinary members, active and werda notary; Extraordinary Members, any person who has passed the master degree of notary or special notary education programs and registered as members of the association; and Honorary Member. werda active role in the indonesian notaries association, namely: 1) role views of the rights and obligations as a regular member Indonesian notaries association; 2) their role in the Congress; 3) their role in the Regional Conference; 4) role in Regional Conference. werda Notary from the point of legal logic, who no longer holds a notary protocol, if called upon by law enforcement for the purposes of the examination with regard to the deeds made Notary Law. If summoned by law enforcement for the purpose of examination relating to the deeds he / she has ever made in a criminal case, the provisions of Article 66 of the Notary Office Law shall apply.

Abstract

Settlement of human rights violations in Indonesia is regulated in Law Number 26 Year 2000 on Human Rights Court. Any person or group who has reason to believe that their fundamental rights have been violated can file reports and oral or written complaint to the national commission for human rights. This law contains provisions on the establishment of a special human rights court (ad-hoc) to prosecute human rights violations in the past that happened before the law goes into effect, while the permanent human rights court handles only crimes committed after ratification enactment these laws. However, the ad-hoc court as it was only set up to adjudicate pecific cases and formed through a special procedure anyway. The President can only establish ad-hoc courts like this if there is an explicit recommendation of the House of Representatives. Weaknesses in the settlement of human rights violations in Indonesia based on Law Court of human rights within the general judicial system, making it highly dependent on bureaucracy and administration of the public courts occupy, no article that mischaracterized that would allow actors to be free, and also the presence of an age limit whether it is to be investigators, prosecutors, and judges ad-hoc, thus inhibiting the influx of people who are competent.

Abstract

Children as part of a citizen, they have the same rights as other citizens, which shall be protected and respected by every citizen of the State. Child legal protection is defined as an effort to protect the law against freedom and child rights related to their welfare. Mass media coverage is adorned by the many acts of violence that occur in children. Today the phenomenon that occurs in the world of the press, the press media only focus more on democracy and politics and even the owners of the press media more focused plunge into the world of politics, even some owners of the press openly declare himself as a future presidential candidate or vice presidential candidate. The mass media should be required to broadcast appropriate information, for the development and protection of the rights of the child. Negative information will have a negative impact on the development of the child reaching his adult. The press in guarding the protection of children's rights, must carry out the role of social control and guarding every thing directly with children. This is because children are part of citizens, they have the same rights as other citizens, which must be protected and respected by every citizen and country.

Abstract

Keluarga merupakan lembaga pertama dan utama yang berperan penting dalam menamkan pendidikan nilai dan pembentukan karakter dari setiap anggota keluarga. Keluarga sebagai unit pergaulan hidup terkecil dalam masyarakat, dan berperan sebagai pelindung bagi pribadi-pribadi yang menjadi anggota.Kondisi nilai dalam keluarga pada masa ini sangat minim, hal tersebut terbukti dari banyaknya kasus yang terjadi di dalam keluarga seperti kekerasa, asusila, korupsi, dan sebagainya. Solusi pendidikan dalam menyelesaikan permasalahan sosial tidak hanya melalui lembaga formal, informal, non formal. Terutama lembaga keluarga, yaitu dengan melalui pendidikan nilai di lingkungan keluarga. Dalam pandangan sosiologi, penanaman nilai moral dalam keluarga, tidak hanya dilakukan dengan cara indoktrinasi, tetapi dengan cara memberikan semua penjelasan kepada anak mengapa aturan-aturan tersebut dipatuhi. Tahapan proses pendidikan nilai meliputi: Identification Process, Internalization Process, Proses Pemodelan, Direct Reproduction. Saran Agar degradasi moral dapat dimilimalisir, sebagiknya didakan suatu program yang mampu menginternalisasikan pentingnya pendidikan nilai di dalam keluarga kepada seluruh keluarga di Indonesia, serta dibentuknya aturan pidana yang lebih ketat kepada pelaku tindakan penyimpangan berat dalam lingkungan keluarga

Abstract

The function of education is the transformation of culture and values to students, in order to be able to understand, internalize and convey to the next generation. One of them is character education. Of course character education will be very good if it is supported by other sciences. This article is supported by psychology. The research method used in this article is a literature review research method or literature study, which contains relevant theoretical theories. The conclusion of this article states that character education shapes a person's personality through character education, the results of which can be seen in one's real actions, namely good behavior, honest responsibility, respect for others, hard work, and so on. Character education is supported by educational psychology. Educational psychology is more of a science that can be applied in everyday life, especially on how our society manages learning. Educational Psychology develops into a science that focuses on the discovery and application of psychological principles and techniques into education, so the scope of educational psychology includes topics that are closely related to character education. Character education goals are very good to use and develop. Contents, methods in the form of implementation, methods in the form of guarding, educational tools in the form of action, environment for character education, and students, both to be used and developed which are supported by other sciences apart from psychology.

Abstract

The issue of religious intolerance is a problem that is always warm in the life of society, nation and state. Until now, there are still many community groups that carry out intolerance. Just look at the case of rejection of the construction of the church in the majority area of its people is Muslim, and vice versa against the refusal of the construction of mosques in areas where the majority are non-Muslims. On this matter, this paper wants to examine the strengthening of local wisdom to counteract religious intolerance in Indonesia, using normative legal research methods. To carry out local wisdom, there are many social institutions that live in the midst of society, one of which is traditional leaders or traditional elders in the local area. The role of traditional leaders or traditional elders is very important in solving problems that arise in people's lives. One of them is intolerance of religious people.
