Abstract

Tulisan ini membahas mengenai perlindungan anak sebagai pelaku tindak pidana di dalam proses penyidikan di Polisi Resort Kota Padang. Teori penelitian yang dipakai dalam tulisan ini adalah teori perlindungan hukum dan teori perlindungan anak. Metode penelitian yang dipaka adalah yuridis sosiologis. Pembahasan dalam tulisan ini fokus kepada: penyidikan tindak pidana dalam pelaksanaan hak anak; kendala yang ditemui dalam pelaksanaan hak anak dalam tahap proses penyidikan. Kesimpulan yang didapatkan adalah penyidikan di Polisi Resort Kota Padang sudah berjalan dengan baik, namun harus ditingkatkan lagi, agar menjamin perlindungan anak

Abstract

Indonesia is a country based on Pancasila, wherein the first principle states, "The One Godhead." So therefore all laws made by the state or government in the broadest sense, may not conflict with God's law, even more than that, every legal order that is made must be based on and intended to realize God's law. Freedom of speech, expression and freedom of the press are human rights, in a democratic country that is now Indonesia's choice, this right must be guaranteed. Besides the guarantee contained in the 1945 Constitution, the government also regulates it in the Criminal Code article 156, 156a and article 157. Indeed, in the Criminal Code there is no special chapter that regulates religious offense offenses or better known as religious offenses. However, the existence of these articles has proven that the government has regulated this religious offense. As well as Law Number 11 of 2008 concerning Information and Electronic Transactions.

Abstract

All of the principles of Good Corporate Governance can support the realization of Good Corporate Governance in order to prevent the misuse of shareholder power considering that the Piercing the Corporate Veil principle can be used to prevent illegal acts committed by shareholders, commissioners or directors. Shareholders, commissioners or directors are possible to commit acts against the law and utilize existing facilities for their personal interests by manipulating their actions or the misuse of company assets. The research method used in this article is the normative juridical research method. The final goal of applying the Piercing the Corporate Veil principle above is the existence of Good Corporate Governance, namely good corporate governance. Therefore, the follow-up to the adoption of the Piercing the Corporate Veil principle is its implementation in Good Corporate Governance, which is a good and correct management system.

Abstract

Abstract: The purpose of this study was to determine the effect of individual characteristics on the quality of services in Komnas Perempuan, protection of women's rights to service quality in Komnas Perempuan, individual characteristics of human resource competencies in Komnas Perempuan, human resource competencies on service quality in Komnas Perempuan, protection of women's rights to human resource competencies in Komnas Perempuan, human resource competencies in mediating the relationship between characteristics and quality of services in Komnas Perempuan, and human resource competencies mediating the relationship between protecting women's rights and the quality of services protecting women rights in Komnas Perempuan. Based on the formulation, objectives and research hypotheses, the method used in this study is quantitative research with a descriptive approach. Descriptive approach can be interpreted as a research method that seeks. The results found that the individual characteristics variable had a significant effect on the human resource variables of the National Commission on Violence Against Women employees. The variable on the protection of women's rights has a significant effect on the human resource variable of the National Commission's female employees. Individual Characteristics Variable has a significant effect on service quality variables in the National Commission on Violence Against Women. The variable of human resources has a significant effect on the variable service quality of employees. The variable on the protection of women's rights has a significant effect on the variable service quality of employees. 6) Characteristic variable does not significantly influence Service Quality through human resource construct variables. 7) The variable for the protection of women's rights does not significantly influence the Quality of Service through the human resource construct variable. Abstract

ABSTRACT In the country of law, the law is one form of legal norms formulation in the life of the state. The existence of laws in a country has a strategic and important position, regardless of the conception of the law, hierarchy of legal norms, as well as from the function of law in general. People’s welfare is one of the goals of the state. In the realization of the necessary mechanisms are reflected in the public policy that is made. This study aims to examine and examine the public participation in the formation of legislation to create the welfare state of Indonesia. The research of this scientific work, the type of normative legal research. The understanding of the welfare state can be applied in the formulation of legislation. Welfare is the dream of every society, and laws and regulations function as regulators and means of achievement. To realize the formation of responsive legislation in Indonesia, the formation of legislation in Indonesia must be subject to Article 5 and Article 6 of Law Number 12 Year 2011 on the Establishment of Legislation, And this is related to the formation of Legislation and adheres to the principles of the establishment of good legislation. Abstract

Protection of children's rights are elements of the Human Rights. Efforts to protect the rights and future of the children were violated by the state, the adults, the environment itself, and parents are still not so noticed. Though children are soulmates, picture and mirror the future, asset family, religion and nation. Child Protection Act has given sanction to any parents who fail to provide protection to children. Cases against parents who fail to protect the rights of his son, then according to the authors it has violated the children's rights are part of human rights. There are two forms of compliance required by children, namely in terms of the act and the other terms of the rules that are responsive and nature gives happiness. Continuing to child protection, it requires continuous legal justice for children, ongoing legal certainty for the child and the benefit of ongoing legal for children.

Abstract

President is the supreme leader in the Republic of Indonesia, it is also clearly stated in the Constitution of the Republic of Indonesia Year 1945. After the outgoing president, and became ordinary Indonesian citizens, the president is also still get one of their rights, namely the right to earn a living, it is a form of tribute to the former President or Vice President who has been leading this country during the period of his leadership. Towards the end of his term, Susilo Bambang Yudhoyono to change the rules providing a home for former president and vice president. The change was then poured in Presidential Regulation No. 52 Year 2004 on the Amendment of Presidential Decree No. 88 Year 2007 concerning Procurement and Standard Home for Former President and Vice President. The policy made by President, invited strong reactions from the public. Therefore, the facilities will be reserved for the former president and vice president in the form of procurement of the house is considered very exaggerated and does not reflect a sense of justice for the people, especially people from the lower middle class who until now have not had a home. In this paper will discuss the procurement and the right to a standard home to the former president and / or the former vice president of the republic of Indonesia, and controversy procurement and standards for the former president's home and / or former vice president of the republic of Indonesia.

Abstract

Election Campaigns are part of the political education of the community and carried out responsibly in carrying out democratic parties. Campaign activities contain material that includes the delivery of the vision, mission and programs that will be carried out by both political parties and individual participants. Reflecting on the implementation of the campaign in the 2018 Regional Head General Election there were many violations against child exploitation. KPAI as an independent state commission responsible for overseeing child protection under the Child Protection Act records 15 violations against children in the implementation of the campaign. This paper explains that the Election Oversight Body plays a role in filling out legal evidence for child exploitation in the implementation of the campaign, because many children who have not been 17 years in the election have been identified as having been 17 years, this includes criminal acts. Its roles include giving sanctions to those who invite children to campaign and report the matter as a form of crime as regulated in Article 280 Paragraph (2) letter K of the Election Law and in Article 15 and Article 76 H of the Child Protection Act.

Abstract

The Assessment Process is an initial stage where narcotics addicts and victims of narcotics abuse report to the National Narcotics Agency requesting rehabilitation. This process can be used as a benchmark for drug addicts and victims of narcotics abuse itself to determine the length of the rehabilitation period for narcotics addicts and victims of narcotics abuse who request to be rehabilitated. From the results of the assessment it was also used as material for consideration of the Integrated Assessment Team in making decisions on the application. Today, based on data from the National Narcotics Agency (BNNP) of West Sumatra Province, the problem of abuse of current drug abuse in the Mentawai is very alarming. This research is a descriptive analytical study. The approach used in this study is a normative juridical approach supported by an empirical juridical approach. The process of implementing rehabilitation for addicts and victims of narcotics abuse by the Mentawai Islands Police Satnarkoba has been running in accordance with Law No. 35 of 2009. However, there is a possibility that there are always shortcomings in carrying out these rules. The obstacle of police investigators in determining rehabilitation for drug users is the lack of awareness or willingness of narcotics abusers who are old enough to report themselves to the police to be directed to IPWL or reported by families if narcotics users are not old enough, fearing that parents or families of narcotics users will be damaged their image if it is known that the child or family member is a drug user so that they are reluctant to report themselves, there are still many people who do not know that rehabilitation for drug users is all costs borne by the government / free.

Abstract

A presidential system government is a government in which the executive position is not accountable to the representative body of the people, in other words the executive power is outside (direct) parliamentary oversight. Not only is presidentialism and a multiparty system a "difficult combination", it also opens up opportunities for deadlocks in executive and legislative relations which then impact on the instability of presidential democracy. The government system in the constitutional trajectory that applies is as much as 5 times, it is divided into: three times using a presidential system, one time Quasi Parliamentary (Quasi Parliamentary), and one time using a presidential system. In a coalition government, political parties are not responsible for raising the president in the election so political parties tend to leave the president who is no longer popular. Presidential elections are always there before the eyes so that political parties try as much as possible to keep distance from various presidential policies, which may be good, but not populist. The reason for the incompatibility, is likely to bring down the government unconstitutionally. The magnitude of the opportunity for unconstitutional change of government is very relative because in a presidential system it is very difficult to reduce an elected president. We can feel the multi-party effects in Indonesia, namely the difficulty of the President to make decisions relating to the problems of national life and strategic state. Actually the position of the President is very strong because the president is directly elected by the people not elected by the DPR. But in the case of the issuance and ratification of the presidential legislation the DPR needs support.
