Abstract

The poor condition of Indonesian women nationally, where the education of Indonesian women in general is still low, as well as low physical quality and inadequate non-physical, plus the social and cultural environment conditions of most Indonesian people who are less supportive of women, then the enforcement of human rights is not implemented. The May 1998 tragedy prompted the President to issue Presidential Decree No. 181 of 1998 as the legal basis for the National Commission on Violence Against Women, which was updated by Presidential Regulation No. 65 of 2005. This commission is an independent human rights commission institution established by the state to respond to the issue of women's rights as part of human rights. To realize the enforcement of women's human rights, the commission has the following tasks: a) dissemination of understanding, b) studies and research, c) monitoring, d) recommendations and regional and international cooperation.

Abstract

Tindak pidana pembunuhan merupakan salah satu bentuk kejahatan yang memiliki ancaman pidana paling serius dalam hukum positif Indonesia. Pasal 338 Kitab Undang-Undang Hukum Pidana (KUHP) mengatur bahwa setiap orang yang dengan sengaja merampas nyawa orang lain diancam dengan pidana penjara paling lama lima belas tahun. Kompleksitas tindak pidana pembunuhan tidak hanya terletak pada akibat yang ditimbulkan, tetapi juga pada motif, cara melakukan perbuatan, serta kondisi sosial dan psikologis pelaku. Oleh karena itu, hakim dituntut untuk melakukan pertimbangan hukum secara cermat dengan berlandaskan pada fakta persidangan, alat bukti yang sah, serta keyakinan hakim sebagaimana diatur dalam Pasal 183 Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Penelitian ini bertujuan untuk menganalisis pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana pembunuhan dalam Putusan Nomor 64/Pid.B/2024/PN Pbr dan Putusan Nomor 90/Pid.B/2024/PN Pbr, serta mengkaji penerapan pidana oleh hakim dalam kedua putusan tersebut, khususnya terkait pengaruh motif pelaku dan fakta-fakta persidangan terhadap berat atau ringannya sanksi pidana. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-analitis. Bahan hukum primer meliputi KUHP, KUHAP, Undang-Undang tentang Kekuasaan Kehakiman, serta kedua putusan pengadilan yang dianalisis, sedangkan bahan hukum sekunder berupa literatur ilmiah, jurnal hukum, dan pendapat para ahli hukum pidana. Seluruh bahan hukum dianalisis secara sistematis dan logis menggunakan metode deduktif. Hasil penelitian menunjukkan bahwa penjatuhan pidana oleh hakim tidak hanya didasarkan pada terpenuhinya unsur formil tindak pidana pembunuhan, tetapi juga mempertimbangkan aspek kemanusiaan, keadilan, serta tujuan pemidanaan. Pertimbangan hakim dalam kedua putusan tersebut mencakup pertimbangan yuridis yang bersumber pada fakta-fakta persidangan dan pembuktian unsur Pasal 338 KUHP, serta pertimbangan sosiologis yang memperhatikan nilai-nilai hidup dalam masyarakat dan kondisi subjektif terdakwa. Meskipun kedua perkara menggunakan dasar hukum yang sama, terdapat perbedaan dalam penerapan pidana, yang mencerminkan penerapan asas individualisasi pemidanaan, yaitu bahwa pidana harus disesuaikan dengan kondisi konkret pelaku dan peristiwa pidana yang dilakukan.

Abstract

Abstract: This study examines Restorative Justice as a manifestation of human rights within the framework of ultimum remedium in the Indonesian criminal justice system. The restorative approach is understood as a paradigm that places victim recovery, offender accountability, and community participation at the core of criminal case resolution. This orientation differs from the retributive model, which primarily emphasizes punishment and retaliation. The human rights framework provides a normative foundation that every individual is entitled to dignified and proportional treatment, as well as access to substantive justice. The principle of ultimum remedium reinforces the idea that criminal law, particularly imprisonment, must be used as a last resort after other alternative mechanisms have been considered. Legal reform through the new Criminal Code reflects a more humane and responsive policy direction toward societal needs. The integration of Restorative Justice into the criminal justice system is expected to achieve a balanced protection of public interests, victim restoration, and the fair social reintegration of offenders.  Keywords: Restorative Justice, Human Rights, Ultimum Remedium.

Abstract

Indonesia sudah dianggap negara yang darurat kasus kekerasan terhadap anak sebagai korban, terutama kasus kekerasan seksual pada anak, maka Presiden telah mengeluarkan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 tahun 2016 tentang Perubahan Kedua atas Undang-Undang Nomor 23 tahun 2002 tentang Perlindungan Anak. Karena Undang-Undang Nomor 35 tahun 2015 tentang Perubahan Atas Undang-Undang Nomor 23 tahun 2002 tentang Perlindungan Anak, dan diundang menjadikan Undang-Undang Nomor 17 Tahun 2016 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2016 Tentang Perubahan Kedua Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak Menjadi Undang-Undang, tidak memberikan jera kepada pelaku kejahatan seksual. Pro-kontra hukuman kebiri muncul setelah pemerintah berencana menerapkan hukuman kebiri kepada pelaku pedofilia. Pihak yang pro berargumen hukuman kebiri diperlukan karena kasus kekerasan seksual sudah dalam tahap darurat. Sementara pihak yang kontra menolak hukuman kebiri berdasarkan beberapa argumen. Ada yang menolak karena mempertanyakan efektivitasnya dalam menimbulkan efek jera dan itu merupakan pelanggaran hak asasi manusia. Perppu ini hadir atas keadaan gawat yang dikeluarkan oleh Presiden untuk menggantikan undang-undang yang ada, yang telah diatur Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Perundang-Undangan. Penulis tidak percaya aturan ini bisa menurunkan jumlah kekerasan seksual terhadap anak. Sampai saat ini belum ada kajian yang menunjukan hukuman kebiri berdampak signifikan menurunkan jumlah kekerasan seksual. Seharusnya yang dibina adalah mental, psikologis dan iman pelaku bukan menghukum pelaku.

Abstract

Abstract: This study aims to analyze the progress of human rights (HR) in national criminal law through the prohibition of using analogy in determining an act as a criminal offense, as reflected in Article 1 Paragraph 2 of the new Indonesian Criminal Code (KUHP Nasional). The research uses a normative legal method with statutory and conceptual approaches. In the context of modern criminal law, the prohibition of analogy is considered a manifestation of the principle of legality (nullum crimen sine lege), ensuring legal certainty and protecting the fundamental rights of individuals from arbitrary state actions. By disallowing analogy, no individual can be punished unless based on a previously established law. This represents significant progress in the protection of human rights, especially in ensuring that criminal law is not used as a tool of repressive power. The findings indicate that Article 1 Paragraph 2 of the KUHP affirms human rights principles aligned with international instruments such as the ICCPR. Therefore, the prohibition of analogy in national criminal law is not merely a formal legal step, but an ethical milestone in the enforcement of criminal justice.Keywords: Human Rights, Analogy, National Criminal Code, Principle of Legality.

Abstract

Abstract: The principle of legality is one of the fundamental principles in criminal law that functions as a limitation on state power as well as an instrument for the protection of human rights. This principle affirms that no act may be punished without a prior provision of criminal law that was in force at the time the act was committed. The existence of the principle of legality is crucial in ensuring legal certainty, preventing arbitrary actions by law enforcement authorities, and protecting individual rights from retroactive criminalization. This study aims to analyze the position, meaning, as well as the concept and function of the principle of legality within the Indonesian criminal law system as a guarantee of human rights protection, particularly following the enactment of Law Number 1 of 2023 concerning the Criminal Code. The research employs a normative legal research method with a historical legal approach, examining the development of the principle of legality from classical criminal law to its reformulation in the national Criminal Code. The findings indicate that the principle of legality is no longer understood merely in a formal sense through the principles of lex scripta, lex certa, and lex praevia, but has also undergone an expansion of meaning through the recognition of living law in society, insofar as it is consistent with the values of Pancasila, the 1945 Constitution of the Republic of Indonesia, and human rights. The reformulation of the principle of legality in Law Number 1 of 2023 reflects an effort to balance legal certainty and substantive justice without diminishing its primary function as a protector of human rights. Accordingly, the principle of legality continues to occupy a central position in the Indonesian criminal law system as a foundation of a state governed by law that upholds the protection of human rights.Keywords: Principle of Legality, Criminal Law, Human Rights.

Abstract

Abstract: The principle of legality in Indonesian criminal law has undergone significant development following the enactment of Law Number 1 of 2023 on the Criminal Code, particularly through the recognition of law living within society as regulated in Article 2. This regulation marks a paradigm shift from a purely formal understanding of the principle of legality toward a more material and contextual approach, while still maintaining legal certainty as a fundamental principle. This research aims to analyze the juridical construction of the recognition of living law as a basis for criminal punishment and its position within the Indonesian criminal law system. The research method employed is normative legal research using a historical legal approach, which examines the development of the principle of legality and its integration with social and constitutional values. The findings indicate that living law is recognized in a limited and conditional manner, insofar as it is consistent with Pancasila, the 1945 Constitution of the Republic of Indonesia, human rights, and general principles of law recognized by civilized nations. Its position is complementary to written criminal law, functioning to fill legal gaps and to realize substantive justice. Accordingly, this regulation reflects the state’s effort to balance legal certainty, social justice, and the protection of human rights in the reform of the national criminal law system.Keywords: Punishment, Pancasila, Human Rights.

Abstract

Flight delays, cancellations, and unilateral flight rescheduling are persistent issues, obstructing the protection of consumer rights in Indonesia’s aviation services sector. The legal issues examined in this study are: (1) the form of legal protection for passengers affected by flight delays from a human rights perspective, and (2) the responsibility of the state and airlines in ensuring the fulfilment of passengers’ rights. Previous studies by Fahrizal et al. (2022) examined business actors’ liability for flight delays, Thoriq & Ilham (2023) focused on unilateral flight cancellations, and Budi & Siddiq (2025) analysed unilateral flight rescheduling. Although these studies share a common focus on consumer protection, they have not comprehensively integrated a human rights perspective. This study aims to analyse legal protection for airline passengers from a human rights perspective and to examine the responsibilities of airlines and the state. The research employs a normative legal research method using statutory and comparative approaches. The analytical framework is based on human rights theory, legal liability theory, and legal protection theory. The findings indicate that flight delays without fair and transparent handling constitute violations of human rights and the right to information as guaranteed by the International Covenant on Civil and Political Rights, Law No. 39 of 1999 on Human Rights, Law No. 8 of 1999 on Consumer Protection, and Law No. 1 of 2009 on Aviation, as partially amended by Law No. 6 of 2023. Airlines must be held liable in providing compensation, accommodation, or alternative flights, while the government, through the Ministry of Transportation, is authorised to impose sanctions on negligent airlines. It is recommended that the government strengthen effective complaint mechanisms to ensure the protection of passengers’ rights.

Abstract

Abstract: Legal aid is an important aspect of the legal system which aims to provide access to justice for all individuals, especially those who are less fortunate. This concept is applied in various forms in different countries, with approaches ranging from government legal aid programs to services provided by non-governmental organizations and pro bono lawyers. Even though it still faces many challenges in its implementation, efforts to expand access to legal aid must continue to be made in order to create a fairer and more inclusive legal system.Keywords: Assistance, Law.

Anthropology of science education that was born in the mid-20th century. The question that arose at that time was the extent to which education could change society, the frame of mind at that time how to develop development in developing countries and indeed at that time developed countries like Europe were thinking of doing it. changes in society develop through its programs, so that educational anthropology tries to find patterns of community learning culture that can create a change.
