Abstract

Abstract

Abstract

The law of guarantees recognizes two types of guarantees, namely general guarantees and special guarantees, while special guarantees can still be distinguished into material guarantees and guarantees of people who guarantee debts. General guarantees and debt guarantees do not fully provide certainty regarding debt repayment, because the creditor does not have priority rights so the creditor's position remains as a concurrent creditor against other creditors. Fiduciary guarantees are conventional products that are determined to protect creditors, especially if the debtor defaults. Fiduciary guarantees that have not been able to be applied comprehensively to all financial institution systems in Indonesia, need to be conducted several studies, especially from the perspective of Islam and Law No. 42 of 1999 which uses the Sharia financial system. The focus of the study that is used to formulate the problem is how is the law of fiduciary guarantees from the perspective of Islamic law and Law No. 42 of 1999 concerning fiduciary guarantees in Indonesia. In this study, normative law is used, or it can be called library research. The results of the study show that the practice of implementing fiduciary in Indonesia has a very important positionand must be fulfilled by financing service providers. Meanwhile, according to Islamic views, there is no fiduciary guarantee in the aspect of Islamic law, but matters concerning guarantees can be equated with Rahn. Thus, in Islamic Financial Institutions, Rahn is guided as a guarantee system in lending activities by Islamic law, this is based on the word of Allah QS. Al-Baqarah verse 283 and Law Number 21 of 2008 concerning Islamic Banking.

Abstract

The increasing use of private vehicles in urban areas has led to the growth of parking services, but often gives rise to legal conflicts when vehicles are lost or damaged. This study aims to review the form of legal responsibility of parking service providers towards consumers, especially when exoneration clauses are used as a basis for exemption from responsibility. With a normative juridical approach and a literature study of Law Number 8 of 1999 concerning Consumer Protection, this study demonstrates that the responsibility of service providers is absolute (strict liability), whereby they are still obliged to provide compensation even if they are not proven to be directly negligent. The results of the study also reveal that exoneration clauses included unilaterally in parking tickets are contrary to the principle of contractual justice and are declared invalid under law. Therefore, it is important to strengthen regulations and educate consumers about their rights to obtain protection against losses. These findings are expected to contribute to the formulation of a  fairer policy in the parking service sector.

Abstract

Agrarian reform is a crucial instrument in Indonesian agrarian law, aimed at reducing inequality in land ownership and achieving social justice as mandated by the constitution. Although the normative framework for agrarian reform has long been established through the Basic Agrarian Law and its various derivative policies, the realization of these objectives still faces fundamental challenges both at the regulatory and implementation levels. This study aims to systematically examine the development of scientific studies on agrarian reform and its relationship to the concept of social justice from the perspective of Indonesian agrarian law. The method used is a systematic literature review by analyzing journal articles, scientific books, laws and regulations, and relevant court decisions published within a specific period. The results of the study indicate that the agrarian law literature highlights a discrepancy between the normative objectives of agrarian reform and its implementation practices, particularly regarding the protection of land rights for smallholders and indigenous communities. Furthermore, the dominance of administrative and sectoral approaches in land management is considered not to fully reflect the principle of substantive social justice. This study concludes that achieving social justice through agrarian reform requires strengthening regulatory consistency, a legal approach oriented toward substantive justice, and an active role for the state in ensuring legal certainty and protection of land rights. This study is expected to provide a conceptual contribution to the development of agrarian law and serve as an academic and policy reference for implementing equitable agrarian reform.
