Abstract

The employment absorption by the Sukarasa Keripik Kaca home industry in Tenjolaya Hamlet, Kertayasa Village, Cijulang District, Pangandaran Regency needs to be further examined from the perspective of positive law. The aim is to understand the existence of the Sukarasa Keripik Kaca home industry in absorbing local labor and to review the positive legal perspective on the employment absorption system in enhancing community income in Kertayasa Village, Cijulang District, Pangandaran Regency. This research is classified as qualitative research, and the data collection techniques used were interviews, observation, and documentation. The research results show that the Sukarasa Keripik Kaca home industry continues to operate to this day. A total of 8 workers have been absorbed. Based on the review of Law Number 13 of 2003 concerning Manpower, the employment absorption system is appropriate as there is no discriminatory treatment. The application of the Regional Minimum Wage applies to companies with a minimum of 20 workers. Since the Sukarasa Keripik Kaca home industry only has 8 workers, the wages provided are appropriate.Keywords: Family Economy, Home Industry, Sukarasa Keripik Kaca, Positive Law.

Abstract

This research aims to identify the impact of the change in legal policy on the protection of human rights and gender equality. This research analyzes the relationship between the aspects influencing legal changes regarding the legal age of marriage in Indonesia from a gender perspective and the SDGs. This study employed a qualitative approach that is based on library research to identify the impact of changes in legal policy. This study also used a juridical approach to capture an overview of Indonesian family law policies as stipulated in the Law Number 16 of 2019 with maslahah theory and Philipus M. Hadjon’s theory of legal protection as the analytical framework. The research results: First, it was found that the issue of the minimum legal age of marriage is part of the legal discovery area, which resulted in the emergence of Law Number 16 of 2019. Second, the gender movement in Indonesia has played a significant role in changing the paradigm of family law towards a more progressive view and a more protective to women’s rights. The integration of Hadjon’s theory of legal protection strengthens the analysis of the impact of changing legal policies on individual rights and gender equality.

Abstract

This study aims to determine the process of slaughtering broilers in the village of Kertawinangun and the process of slaughtering according to the the Indonesian Ulema Council standard. This research is descriptive-analytical using qualitative methods. This research resulted in three things, first, the method of slaughtering and processing stages of broilers grouped into three stages, namely the stages in the preparation of chickens, slaughtering, and processing of chickens. And secondly, several factors influence consumer behavior related to halal slaughter, namely; 1) Cultural Factors, namely human behavior is largely determined by the culture that surrounds it, and its influence will always change every time by the times. 2) Social factors include family groups and role models. 3) Personal factors consisting of age and stages of the life cycle, economic conditions, lifestyle, and personality.

Abstract

Abstract: This article captures the implementation of cooperative legal entities that are still conventional toward digital transformation, considering significant changes in the world. This study aims to describe how to strengthen the role of cooperatives as a pillar of the Indonesian economy, the legal basis for digital transformation, and the digital transformation of legal entity cooperatives in Indonesia. The findings show that transforming the cooperative business model into a digital basis is necessary. Cooperatives can obtain a vast market share by using tools such as website companies, social media, marketplace, and paid online advertising. The legal basis for business transformation from conventional to electronic-based models already exists. Cooperative legal entities can conduct business activities by utilizing digital technology for various activities such as administration, marketing via internet media, advertising using third parties such as Facebook Ads or Google Ads, selling products through online stores, analyzing business trends in the community, building relationships with more parties through social media, member meetings using video call applications, and many more that can be utilized. With the G20 forum, opportunities to expand business to various countries need to be used optimally by cooperatives in Indonesia. Keywords: Digital, Legal Entities, and Cooperatives.

Abstract

The rise of non-cash transactions today has made people tend to switch from manual transactions that use cash to electronic transactions. LinkAja Syariah service is an application-based electronic money service designed to facilitate user transactions. LinkAja Syariah Services prioritizes three main categories of sharia service products, namely the ZISWAF, mosque-based economic empowerment and digitization of Islamic boarding schools, micro small and Medium Enterprises. Thus, this study seeks to reveal the contribution of LinkAja Sharia Services in the city of Cirebon, where the majority of the population is Muslim and there are many religious institutions. This study aims to determine the practice of using LinkAja Syariah Services in Cirebon City from an Islamic law perspective. The method used in this research is qualitative by inductive means, that is, from data to a higher level of abstraction, including synthesis and theory development (if necessary and the data supporting). This means that data analysis in qualitative research is more open-ended and must be adjusted to data in the field, such as the results of interviews, observations, and documentation. In addition, the data analysis technique used in this study was qualitative analysis as stated by Miles and Hubberman, namely data collection, data education, data presentation and conclusion drawing. The results of this study are: LinkAja Sharia services that prioritize three main products, namely the ZISWAF ecosystem, mosque-based economic empowerment, and digitization of Islamic boarding schools and UKM. In Cirebon City LinkAja Syariah services can be used for zakat, infaq and shodaqoh payments at LAZISMU Cirebon Regency, donations at At-Taqwa Mosque, and shopping at traditional markets such as Gunung Sari Market, PGC Morning Market, and Kanoman Market

Abstract

This article examines the implementation of marriage dispensation law in Religious Courts from the perspective of marriage law and the Sustainable Development Goals (SDGs), which often appear to be in conflict. Using a normative and sociological approach with qualitative analysis, this article finds that marriage dispensation, from the perspective of marriage law, is solely intended to serve the best interests of the child. It is a measure that must be carefully considered to ensure the child's protection, care, well-being, survival, and development. However, from the SDGs perspective, marriage dispensation may pose a threat or obstacle to achieving sustainable development goals, which aim to cultivate a reliable, resilient, and high-quality generation. The differing perspectives on marriage dispensation create an apparent contradiction between legal norms and sustainable development objectives. Nevertheless, these perspectives can be harmonized by recognizing that the goals of the SDGs and legal principles ultimately align. Thus, marriage dispensation should not always be viewed as a conflict between legal norms and societal realities. This divergence can be reconciled through court decisions that position marriage dispensation cases as das sein (facts/reality) and the SDGs' objectives as das sollen (ideals and aspirations). Artikel ini mengkaji penerapan hukum dispensasi kawin di Pengadilan Agama dari perspektif hukum perkawinan dan tujuan SDGs yang sering kali tampak saling bertentangan. Menggunakan pendekatan normatif dan sosiologis dengan analisis kualitatif, artikel ini menemukan bahwa dispensasi kawin dalam sudut pandang hukum perkawinan semata-mata untuk kepentingan terbaik anak, yaitu tindakan yang harus dipertimbangkan untuk memastikan perlindungan, pengasuhan, kesejahteraan, kelangsungan hidup dan tumbuh kembang anak. Sementara dalam perspektif SDGs, dispensasi kawin bisa menjadi salah satu ancaman atau penghambat bagi terwujudnya tujuan pembangunan yang berkelanjutan, yang hendak mempersiapkan generasi yang handal, kuat dan berkualitas. Sudut pandang yang berbeda dalam melihat dispensasi kawin tersebut menjadikan keduanya seolah saling bertentangan. Namun demikian, keduanya sebenarnya bisa diharmonisasikan dengan menyatukan persepsi bahwa antara tujuan SDGs dan tujuan hukum adalah satu kesatuan. Dengan demikian, dispensasi kawin tidak selalu harus dipertentangkan antara norma hukum dan realitas yang ada dalam masyarakat. Kenyataan tersebut bisa dijembatani melalui keputusan pengadilan, yang mendudukan kasus dispensasi kawin sebagai das sein (fakta/realita), dan tujuan SDGs sebagai das sollen (cita-cita dan harapan).

Abstract

Introduction: Professional zakat is an Islamic financial instrument contributing to economic redistribution and poverty alleviation. In Indonesia, professional zakat has been accommodated in various regulations, including in PT PLN, which applies automatic deduction through the payroll system based on Board of Directors Regulation Number 120.P/DIR/2017. Objective: This study aims to analyze the implementation of professional zakat through the payroll system at PT PLN, from a maqashid sharia perspective, and its impact on achieving the Sustainable Development Goals. Method: This research used a qualitative approach with a case study method, involving interviews, observation, and document analysis. Result: This study found that professional zakat in PT PLN is automatically deducted by the payroll system by the Human Capital Management Division from the salaries of Muslim employees according to the nishab and managed by the PLN Baitul Maal Foundation. This implementation facilitates the obligation of zakat and follows the principles of maqashid sharia, and contributes to poverty reduction, education, and economic empowerment in achieving Sustainable Development Goals. Implication: This research shows that the payroll system in professional zakat ensures sharia compliance, contributes to social welfare, and accelerates the sustainable achievement of the Sustainable Development Goals.

Abstract

This study aims to analyze the spiritual motives of pilgrims as a driver of innovation in hajj guidance, the transformation of the meaning of hajj through the internalization of Sharia socio-economic values, and the integration of a holistic community-based hajj guidance model in the Wadi Fatimah Cirebon Hajj Guidance Group. This study uses an interpretive qualitative approach to understand the social and spiritual experiences of pilgrims in the Wadi Fatimah Cirebon Hajj Guidance Group. Data were collected through observation, interviews, and documentation, then analyzed using the Miles and Huberman model to capture the meaning, patterns, and relationships between social, spiritual, and legal aspects in hajj practice. The study finds that: (1) the spiritual motives of pilgrims in Wadi Fatimah are driven by personal awareness rather than social pressure or status seeking, with the group playing a key role in integrating maqāṣid al-syarī‘ah and Islamic economics, supported by ethical governance and community empowerment; (2) The meaning of hajj has evolved from being a ritual to a social practice, with the group fostering both spiritual piety and socio-economic awareness through Sharia values and collaboration with state law; (3) The effectiveness of hajj guidance lies in its ability to build a holistic institutional model responsive to social dynamics. Wadi Fatimah successfully integrates spirituality, education, economic literacy, and social networks to bridge maqāṣid al-syarī‘ah with state regulations.Keywords: Socio-Spiritual Dimension; Hajj Worship; Hajj Guidance Group; Muamalah; Maqāṣid al-Syarī‘ah

Abstract

Pariwisata dalam pandangan islam dimaknai sebagai wisata religi, yaitu kunjungan ke tempat ibadah untuk berziarah. Pariwisata syariah disini tidak hanya berfokuskan kepada objek saja tetapi pada fasilitas dan sebagainya. Objek pariwisata syariah juga tidak hanya bernuansakan islam seperti masjid, makam, dan petilasan. Akan tetapi, pariwisata syariah bisa berupa wisata alam, wisata budaya maupun wisata buatan yang keseluruhannya terdapat nilai-nilai keislaman. Penelitian ini bertujuan untuk mengetahui strategi pengembangan pada Petilasan Sunan kalijaga Kota Cirebon perspektif Fatwa DSN MUI, dalam hal ini peneliti mengambil objek penelitiannya adalah pihak pengelola, pengunjung, pedagang, tukang parkir, ketua Rt sekitar objek wisata dan supir bus. Penelitian ini menggunakan metode kualitatif. Teknik pengumpulan data dengan cara observasi, wawancara dan dokumentasi. Berdasarkan hasil penelitian, strategi pengembangan yang dilakukan Petilasan Sunan Kalijaga adalah dengan mengembangkan atraksi (attraction), aksebilitas (accessibility), fasilitas (amenities), akomodasi (accomation) dan sapta pesona. Sumber daya manusia memiliki peran yang sangat penting dalam suatu pengembangan untuk menjaga dan mengelolanya. Hal ini beratikan manusia harus pandai dalam memanfaatkan peluang yang ada tersebut. Akan tetapi, sumber daya manusia disini justru menjadi faktor penghambat dalam menjalankan strategi pengembangan. Strategi pengembangan pada Petilasan Sunan Kalijaga sudah memenuhi kriteria yang terdapat dalam ketentuan-ketentua Fatwa DSN MUI.

Abstract

The aim of marriage is for procreation, but the validity of the marriage itself also participating to determine the validity of the birth of children nasab later. Along with the times that any Islamic family law in Indonesia has undergone many changes. Because of that provision nasab legitimate child, illegitimate child of reproductive technology and man-made law was not immune from the effects of changes there. To respond this issue, it should be used instead of a reference source is limited to conventional Fiqh books, it means that it is ontinues logic of the completed product of what is called as “Islamic law”. Therefore, the Indonesian regulation—such as Law of Marriage No.1 (1974) and the Islamic Law Compilation—are the major references in answering the roblems, it certainly lead to unrest in the community on legal certainty.[Salah satu tujuan perkawinan adalah untuk memperoleh keturunan, akan tetapi keabsahan perkawinan itu sendiri juga turut serta dalam menentukan keabsahan nasab anak yang dilahirkannya nanti. Seiring dengan perkembangan zaman yang terjadi, hukum Keluarga Islam di Indonesia telah banyak mengalami perubahan. Karena itu, ketentuan nasab anak sah, tidak sah, dan anak hasil teknologi reproduksi buatan manusia pun hukumnya tidak luput dari pengaruh perubahan yang ada. Untuk memberikan jawaban atas perkembangan masalah di atas, maka sudah seharusnya sumber rujukan yang dipergunakan bukan terbatas pada kitab-kitab Fikih Konvensional saja, yang notabene sebagaisuatu kelanjutan logis atau salah satu produk jadi dari apa yang sering disebut sebagai hukum Islam. Karena itu, peraturan hukum di Indonesia–seperti Undang-undang No. 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam (KHI)—juga harus menjadi rujukan utama dalam menjawab permasalahan yang bisa saja suatu saat menimbulkan keresahan di masyarakat mengenai kepastian hukumnya.]
